Environmental sector management approach at sea

(Summit No. 77 of the Government of the Shanghai City of 31 May 2010 to consider the publication, effective 1 July 2010, of Decree No. 46 of 1 June 2010, of the People's Government of Shanghai

Article 1

In order to regulate the management of the shore industry sector, to promote the construction and development of the shore industry sector, and to develop this approach in line with laws, regulations and national policies.

Article 2 (Regional scope)

Article 3 (Development orientation)

Article IV (Management responsibilities)

The city has established the Shanghai Portal Zone Management Committee (hereinafter referred to as the Committee). The Committee is responsible for the management of administrative affairs in the Port-au-Prince industrial area, as a public agency of the city's government, and exercises the following responsibilities:

(i) Develop, modify, implement specific provisions for the development planning, planning, industrial policies and administration of the port industry sector;

(ii) Approval of projects such as investment and development in the port industry area, commissioned by the administration sector;

(iii) Administration of infrastructure and construction works in the port industry area;

(iv) Determination of the first instance of a high-technical enterprise in the port industry and the identification of software enterprises, high-technical results-transfer projects;

(v) Harmonize the day-to-day administration of businesses in the transit industry sector, such as the Shanghai Customs, the Upper Sea Access Control Agency, the People's Bank's Shanghai, and the National Foreign Exchange Authority's sub-prime;

(vi) Provide guidance and services to enterprises in the port industry area;

(vii) Other matters to be taken up by the Government of the city.

The Government of the people of the Psychia New District, the Government of the people of the Upperi region, is responsible for the coordination and management of public affairs, such as finance, tax, business, public safety, culture, education, health, green city tolerance, civil administration, human security, population and family planning, and rural, community.

Article 5

The city has established dedicated development funds in the port industry area to support the development, construction and development of the port industry area. The use of earmarked development funds is managed by the Municipal Finance Bureau, together with the Municipal Development Reform Commission, the Urban Economic Informationization Commission and the Board.

Article 6

Tropical industrial planning should be in line with national and city economic development strategies and the overall planning of new ports, reflecting the requirements for integrated and coordinated regional coordination between the port industry and the surrounding areas such as the seamounts.

Tropical areas are planned by the Urban Planning Authority, organized by the Urban Land Resources Authority, which is approved by the Government of the People's Government of the Psychia New Region and by the Government of the people of the Upperi region and the relevant departments.

Article 7

The Commission shall plan the land reserve programme in accordance with the pre-port industry area and shall be reported in accordance with the relevant provisions of the State and the city. The Government of the people of the Psychia New East region, the Government of the people of the Upperi region, and the Commission, have jointly established land reserves for land reserves and have been established and managed by its mandated units. Article 8

The day-to-day work on construction, tendering and completion of the construction work in the port industry area is managed by the Committee.

In addition to large-scale construction works, the quality and safety of construction works are monitored by the Board.

Article 9 (Option of administrative approval)

The Board accepts the authorization of the municipal administration sector and implements the following administrative clearances in the area of the port industry:

(i) The establishment of approvals by the foreign investment enterprises commissioned by the business administration, as well as the approval of the business status and productive capacities for processing trade enterprises, the processing of trade operations approval certificates;

(ii) Approval of enterprise investment projects commissioned by management, such as development reform;

(iii) Planning management-mandated construction project selections, approval of planning design requirements, construction of ground planning licences, construction engineering design programmes, approval of construction engineering planning licences, and construction of completed engineering planning tests;

(iv) The transfer of State land-use rights entrusted by land management, the transfer of construction projects such as concessions, for prequalification purposes, except for the collective conversion of farmers to building land, farmland land, and the unused land for construction projects;

(v) Preliminary design review of construction projects commissioned by transport management, construction of construction permits approval, temporary use of urban roads, clearance of urban roads, exhumation of road roads, approval of vehicles or transportation of cargo to the urban roads or conditions of movement, and approval of various facilities in accordance with urban bridges, clearance of tunnel constellation lines, urban bridges, security of tunnel protection of operations in the region, and approval of various facilities occupied by urban road operators;

(vi) Approval of the provisional use of public greenfields and relocations, logging (other than Guang trees) commissioned by the Green City Correctional Administration;

(vii) The construction projects and approvals for drainage within the framework of the municipal administration;

(viii) Approval by the Civil Defence Administration in connection with the construction of airfields in connection with civilian buildings;

(ix) Administrative clearance matters entrusted by law by the relevant administration.

The specific elements entrusted by the former Administrative Approval shall be specified by the Board and the relevant authorities in the letter of commission. In the case of the commission of administrative approval, the Board shall be sent to the administrative management request entrusted, and the administrative management entrusted shall provide guidance and oversight for the implementation of administrative approval by the Board.

Article 10 (Coordination of administrative law enforcement)

In addition to taking over construction work and management clearance under Article 8, Article 9 of this approach, the Committee shall coordinate the implementation of administrative law enforcement functions in the port industry in accordance with the statutory procedures.

Article 11

The Board shall, at the request of the Government, communicate the basis, content, conditions, procedures, time periods and the model text of the application for all the submissions.

The applicant requests the Board to provide clarifications and explanations of the content, and the Board should clarify, explain and provide accurate and reliable information.

Article 12

The Committee shall establish, in conjunction with the Municipal Chamber of Commerce and Industry, the Municipal Quality Technician, the Municipal Finance Bureau, the levies, the Municipal Tax Administration, the Municipal Human Resources Security Service, and the Government of the People's Republic of the Puponga, the Government of the people of the Upperi Region, the establishment of appropriate institutions in the border industry area to concentrate on administrative matters and perform the related administrative responsibilities.

Article 13

Business management should complete the clearance process within three working days from the date of receipt.

The law, administrative regulations stipulate that matters to be approved should be taken before the approval process is centralized by the relevant authorities of the city and that the approval process has been completed within five working days from the date of admissibility.

Article 14.

The determination of the first instance of a high-technical enterprise in the port industry and the identification of software enterprises, high-technical results-transfer projects are coordinated by the Commission, such as the Municipal Council, the Committee on Economic Information and the City's High-Level New Technologies Business Determinants. In accordance with the principle of “consistency in determining criteria and efficiency, simplification of procedures and facilitation of business”, the Board will carry out its identification work and will identify the results to be presented to the relevant administrative departments, institutions.

The municipal administration authorities, institutions oversee the Commission's identification and issuance of documents, and the determinations that are incompatible with standards or requirements are entitled to be withdrawn.

Article 15 (Percentage)

Enterprises and projects in the gate industry area have been identified by the relevant administrations, institutions or committees that the following preferential policies are available in the State and in this city:

(i) To encourage preferential policies for industrial development and technological progress in modern equipment;

(ii) To encourage the transfer of scientific and technological results and industrialized preferential policies;

(iii) To encourage preferential policies in the software industry;

(iv) Relevant preferential policies for SME development;

(v) Encourage investment and other favourable policies to improve the investment environment.

Article 16

The Board should provide a wide range of brokering services for businesses, institutions in the pre-port industry area, such as talent, labour, finance, accounting, financial, insurance, patents, legal and public evidence.

Article 17

National and foreign professionals are encouraged to engage in engineering construction, business operation, research project development and results-based transformation in the port industry. The introduction of talents can take place in accordance with the relevant provisions of this city, either by a household or by the residence certificate of the Shanghai City.

Streamlining the procedures for the clearance of persons in the pre-prime industrial area for public departures. For those who require frequent departures, the State may apply the “one approval, multiple effectiveness” method of State approval or procedures for the return of Hong Kong and Macao to a certain period of time.

Article 18

Enterprises in the gate industry consider that the management of the administration sector is not in accordance with the provisions of this approach or that the preferential treatment that they should be enjoyed is not implemented and can be complained to the Committee. The Board shall be coordinated and addressed in accordance with the law.

Article 19

Rural villagers in the port industry should be subject to the State and the city's regulations relating to the management of rural villagers and to the requirements of the port industry sector planning.

Article 20

This approach has been implemented effective 1 July 2010. No. 16 of the Supreme People's Government Order No. 16 of 28 December 2003 was issued and, as amended by the Supreme People's Government Order No. 4 of 3 July 2008, the New Town Management Approach to the Shanghai City was rescinded.
