Labour-related weather management provisions in Northern Province

(The 76th ordinary meeting of the Government of the Northern Province, 14 December 2010, considered the publication, effective 1 February 2011, of People's Government Order No. 15 of the Northern Province of the River, adopted on 25 December 2010]

Chapter I General

Article 1, in order to strengthen the management of man-made weather-affected weather efforts, to defend and mitigate weather disasters and to guarantee the safety of the people's life and property, and to develop this provision in the light of the National Department's Code on Wildlife Management.

Article 2 refers to activities aimed at avoiding or mitigating meteoral disasters, rationalizing the use of climate resources, artificially affecting the physical, chemical processes of the atmosphere in the Department, in appropriate conditions, by means of science and technology, and achieving increased rains, habeas corpus, rains, fusidation, and countering.

Article 3 engages in and manages man-made weather activities within the territorial administration and should comply with this provision.

In accordance with Article 4 above, the meteorological authorities in the districts (communes, districts) are responsible for the implementation and guidance management of organizations that influence weather work.

Sectors such as development reform, finance, public safety, transport, flight control, communications and relevant military bodies should be manipulated to influence weather-related work in accordance with their respective responsibilities.

Article 5 Governments of more people at the district level should strengthen leadership in the work of man-made weather events, establish and improve command coordination, joint operational mechanisms, organize and plan to carry out man-made weather work and improve the effectiveness of man-made weather operations.

Article 6. Meteorological authorities at all levels should strengthen the development and application of manually influencing weather science and technology research and new technologies, increase the level of man-made weather science and technology, and expand the area of application of artificial weather-affected weather events.

Article 7 provides for the inclusion of the financial budget of the Government of the people at this level, in accordance with the manual impact of weather work approved by the Government.

Other artificial impacts on weather activities are borne by users.

Article 8. Units and individuals that make a prominent contribution to the work of man-made weather events should be recognized and rewarded by the Government of the people at the district level.

Chapter II Organizational implementation

Article 9. Provincial meteorological authorities prepare, with the approval of the Government of the Provincial People's Government, plans and plans for physical impact of weather events throughout the province, in line with the needs of disaster mitigation, ecological environmental construction, climate resource development.

The municipal, district and zonal meteorological authorities in the established area, in line with the top-level artificially impacted weather planning and plans, are being implemented after the approval of the Government of the present people, in conjunction with local practice.

Article 10. Meteorological authorities at all levels should establish artificially affected weather command systems, communications systems and weather monitoring early warning systems.

Article 11 units engaged in man-made weather operations should have the following conditions and apply to provincial meteorological authorities:

(i) A legal personality;

(ii) The infrastructure, equipment required to implement artificially affected weather operations in line with the relevant security requirements;

(iii) Persons eligible for compliance with the required number and for artificially affecting weather operations;

(iv) A well-developed security management and equipment maintenance, transport, storage and custody;

(v) There are communications tools that maintain links with the manually affected weather operations command centre and the flight control sector.

Provincial meteorological authorities shall be subject to review within 15 working days from the date of receipt of the application and to the granting of a certificate of eligibility for artificial weather operations. A written statement of reasons is not in accordance with conditions.

Article 12 Persons engaged in manually affecting weather operations should have the following conditions and apply to provincial meteorological authorities for the award of a certificate of eligibility for persons who have been affected by weather operations following the training of candidates:

(i) Be above 18 years of age and under 60 years of age, with full civil capability for conduct;

(ii) Physical health;

(iii) The degree of culture above;

(iv) No criminal punishment.

The list of persons using high-launch artillery, rocket-launching devices to carry out man-made weather-affected weather operations is reproduced by local meteorological authorities.

Article 13 After the expiry of the period of effectiveness, units requiring continuing to engage in man-made weather events should submit requests for continuation to provincial meteorological authorities by 30 years of effectiveness.

Article 14.

Article 15 City, district (communication, area) meteorological authorities in the establishment of artificial ground-based operations such as radio artillery, rockets, according to local climate characteristics, geographical conditions, the province's meteorological authorities will be reviewed with the flight control sector.

The established operating station (point) shall not be subject to arbitrary changes. There is a need for change and should be redefined in accordance with the preceding paragraph.

Article 16 implements manually affecting weather operations, with the following conditions:

(i) weather conditions with appropriate operations;

(ii) Operational spaces and operational timelines approved by the flight control sector;

(iii) The integrity of operating equipment and compliance with the requirements for use;

(iv) All operational personnel are in place;

(v) Communication with the command centre and the flight control sector.

Article 17, manually affecting weather operations units must operate within authorized airfields and time frames. In receiving instructions to stop operations during the course of the operation, the operation must cease immediately.

In the end of the operation, the manually affected weather operations unit should report on the operations to local meteorological authorities within the prescribed time frame, with meteorological authorities reporting to the people at the current level and to senior meteorological authorities.

Article 19, artificially affected weather operations units should establish operating archives in accordance with the relevant provisions of the State, such as actual records of operations, strengths, tools, types of ammunition and volumes, repayments and operational effects of operating airfields.

Article 20 jointly implements man-affected weather operations across the administrative region, organized by the parent-level meteorological authorities.

Article 21 Terrestrial meteorological stations should provide, in a timely manner, meteorological detection information, information and forecasts necessary for the implementation of man-made weather-affected weather operations and be equipped with the meteorological safeguards required for man-made weather operations.

Sectors such as agriculture, water, forestry, civil affairs, statistics should provide timely and unpaid information on the flood, hydrology, fires, etc. needed to implement artificial weather operations.

Chapter III Security management

Article 22 states that all levels of the people shall be protected by law against the environment and specialized facilities that affect weather operations.

Public safety, safe production monitoring authorities should be able, within their respective responsibilities, to manage the safety of manually affecting weather work.

Article 23. Meteorological authorities at all levels should strengthen the management of artificially affected weather operations, establish a security liability regime and develop safety accident emergencies.

Article 24

The use of high-launched artillery, rocket operations should be avoided.

Article 25

Article 26, where casualty, property losses and other security accidents occurred in the course of man-made weather operations, the meteorological authorities at the location should be disposed of in a timely manner and reported to the local people's governments and the top-level meteorological authorities to be organized by the Government of the people at the district level where the accident occurred.

No unit or individual shall commit the following acts:

(i) Expropriation of artificially affecting weather operations sites;

(ii) The crowding and disrupting the channels of communication that affect weather operations;

(iii) Disadvantaged, self-moval and mobile plant-specific facilities, equipment;

(iv) Disturbation of artificially affecting weather operations.

Chapter IV Legal responsibility

Article 28 is one of the following acts by the meteorological authorities and their staff at all levels, which are rectified by the unit of the institution or by the authority at the parent level; in the event of serious circumstances, are punishable by law; and constitutes a crime punishable by law:

(i) Approval of the eligibility of artificially affected weather operations units and operational personnel, as prescribed by time and procedures;

(ii) No application for the direct command of the operation of the air area;

(iii) Not to report on the operation as provided;

(iv) There are other acts of negligence, abuse of authority, favouring private fraud.

Article 29, a man-made impact on weather operations units or operating personnel, violates this provision, has one of the following acts, and is being redirected by the Meteorological Authorities (communes, areas) above:

(i) The introduction of man-made weather-affected weather operations at authorized operational stations (points);

(ii) Not to report on the operation at specified time;

(iii) The establishment of operational archives, as prescribed;

(iv) The organization of operations in violation of this provision, resulting in security accidents.

Article 31, in violation of article 27, is rectified by the responsibility of the meteorological authorities above the district (communes, zones); causes losses and bears liability under the law; and imposes penalties on the public security authorities in accordance with the provisions of the Law on the Safety and Security of the People's Republic of China; and criminalizes by law.
