In-house Mongolian self-government, a proportional approach to employment of persons with disabilities

(Summit 2nd ordinary meeting of the Government of the People of the Autonomous Region of Mongolia, 10 February 2011, considered the adoption of the Decree No. 180 of 17 March 2011 by the Government of the People's Government of the Mongolian Self-Autonomous Region, which came into force on 20 April 2011)

In order to guarantee the labour rights of persons with disabilities and to promote employment of persons with disabilities, this approach is based on the provisions of the People's Republic of China Act on the Protection of the Rights of Persons with Disabilities and the Act on the Protection of Persons with Disabilities.

Article 2

(i) The permanent population of the self-government area;

(ii) Within the legal age of employment;

(iii) There are certain labour capacity and employment requirements;

(iv) Holding the People's Republic of China Disability Evidence.

Article 3. Governments at all levels should strengthen their leadership in assigning employment for persons with disabilities, take affirmative measures, grant special assistance to persons with disabilities and guarantee the realization of the legitimate rights and interests of persons with disabilities.

The Disabled People's Federation at all levels is responsible for the proportional arrangements for employment of persons with disabilities in the current administration.

Sectors such as development reform, finance, human resources security, civil affairs, statistics, business administration and tax administration should be given proportional arrangements for employment of persons with disabilities in accordance with their respective responsibilities.

Article 4

Article 5 User units in the self-government area should arrange employment of persons with disabilities in accordance with the proportion of the total number of active workers in the Unit.

The number of persons with disabilities arranged by proportional unit means the number of persons with disabilities, as determined by the same-ranking Disabled Persons Federation, which is in line with the proportional employment criteria. One Braille was arranged for two persons with disabilities.

Governments at all levels encourage rural and urban individual businesses to organize employment of persons with disabilities. For welfare enterprises, persons with disabilities collectively operate and operate independently, all levels of the people's governments and their relevant sectors should grant tax relief and other support in accordance with the relevant provisions of the national and autonomous areas.

Article 6 provides a hierarchy of responsibility for the employment of persons with disabilities.

The self-government zone, allies and flags' associations of persons with disabilities are responsible for the employment of persons with disabilities by a proportion of government-owned agencies, groups, business units and non-commercial units registered in the same sector of business administration.

The proportional arrangement of employment of persons with disabilities in the Central Oriental and In-Ministry Zone Units is the responsibility of the Association of Persons with Disabilities in the Self-Autonomous Region and may also be commissioned by the Association of Persons with Disabilities of the Autonomous Region.

Article 7 provides medical units in the Moco or a health-care unit with a certain proportion of qualified blinds to work on a motor basis by motor personnel.

Schools with disability graduates should give priority to recommending employment for graduates with disabilities. Students with disabilities who have difficulties in employment should be assisted by the Federation of Persons with Disabilities of the Source.

Article 8. Placement of employment of persons with disabilities shall be in accordance with the law of employment contracts or labour contracts for persons with disabilities, and social insurance such as nursing, medical, unemployment, work injury, etc.; and the dismissal of labour contracts or personnel relations by a person's unit in accordance with the law of the disability worker shall be reported to the local Disability Federation.

Article 9. The user units shall arrange the appropriate types of work and positions for the disabled worker in accordance with the work needs of this unit and the level of disability, skills, specials, etc.

Various vocational training institutions should provide vocational training for persons with disabilities and, where appropriate, relief for training.

Persons with disabilities should be actively involved and trained to enhance employment capacity.

Article 10 Disabled People's Federation should conduct a review of the proportional arrangements for employment of persons with disabilities each year. The user unit should cooperate with the inspection and, as requested, the relevant information, if any.

Article 11. The human resources social security sector should include proportional arrangements for employment of persons with disabilities and the social security of workers with disabilities in the labour inspectorate, which guarantees the legitimate rights and interests of employment of persons with disabilities by law.

Article 12 arranges for persons with disabilities to be employed for less than the proportion of persons with disabilities, and shall pay the employment security of persons with disabilities. Each minor arrangement shall pay an employment security fund for persons with disabilities in accordance with the average annual salary of the parent worker published by the local statistical offices. A unit with a defined proportion of persons with disabilities may be exempted from the arrangements for employment of persons with disabilities, but the employment security of persons with disabilities should be calculated in proportion to the difference.

The employment security of persons with disabilities shall be paid by a person's unit, which is approved by the ITU in accordance with article 6 of this scheme.

The employment security of persons with disabilities paid by agencies, groups, business units is covered by the budget or the balance of payments, and the employment security of persons with disabilities paid by business units, civil service units, etc. The employment security of persons with disabilities paid by the enterprise may be deducted before the taxation of the enterprise.

Article 13. Employment guarantees for persons with disabilities are charged by the Disability Federation to the tax sector in accordance with article 6 of this scheme. The employment security of persons with disabilities to be paid by the financial allocation units may be transferred directly from the same financial sector.

The employment security of persons with disabilities collected by allies, flags and territories has been eliminated every year by 5 per cent of the total, with the establishment of an autonomous area specialised mediator for the purpose of an integrated transfer of persons with disabilities throughout the region.

An employment security fund for persons with disabilities must be used by the Office of Finance of the Self-Government Zone and the local tax offices of the self-government area have been harmonized in the production, distribution and management of a special contribution to the employment security of persons with disabilities in the self-government area of Mongolia.

Article 14.

Article 15. The user unit shall pay in full and on time the employment security of persons with disabilities without the approval of the late payment of employment guarantees for persons with disabilities, which shall be paid by the deadline for the collection of sectoral orders; the late non-payment shall be accompanied by five wards from the date of the contributory payment, and the lagurkin into the employment security of persons with disabilities.

A person's unit may apply for administrative review or administrative proceedings in accordance with the law; no administrative review shall be submitted or an administrative action shall be initiated without charge, and the payment of the decision shall apply to the people's courts in accordance with the law.

Article 16 Employment guarantees for persons with disabilities are government funds that are integrated into the management of financial budgets, are subject to exclusive storage and are not diverted to the following expenses:

(i) To subsidize the participation of persons with disabilities in vocational training, education and therapy;

(ii) Entrepreneurs of persons with disabilities in the town, in the private sector and in rural pastoral areas for the cultivation, reproduction, tourism, multiple operations and self-employment;

(iii) Subsidies for the purchase of public goods and social insurance for persons with disabilities;

(iv) To reward units and individuals with more proportional arrangements for employment of persons with disabilities and to make visible results in the organization of employment for persons with disabilities;

(v) Other expenses incurred directly for employment of persons with disabilities, as approved by the Government of the people at this level.

Article 17. The financial sector at all levels should organize, within a budget year, specific funds for the promotion of employment for persons with disabilities, and loans to concentrate on the employment of persons with disabilities may, where appropriate, give appropriate attention.

The Disabled People's Federation could contribute to employment organizations for persons with disabilities.

Article 18 provides recognition and incentives for units and individuals that have made a significant difference in the employment of persons with disabilities by proportional arrangements.

FIDH should establish a financial management system for the promotion of employment security for persons with disabilities, with specialized personnel responsible for management and receive inspection oversight in the financial and audit sectors.

The income and expenditure of employment guarantees for persons with disabilities and their use should be made available to society in accordance with the annual sub-region.

Article 20 violates article 10 of this approach by a user unit that reports, conceals or rejects statistical information and is dealt with by the Disability Federation with the statistical offices in accordance with the relevant provisions of statistical legislation.

Article 21 Staff at all levels of the Disabled People's Federation, the tax sector and the relevant government departments are in violation of articles 12, 13 and 16 of this approach. In accordance with the authority of management, the executive branch or the administrative inspectorate are lawfully disposed of by law; it constitutes an offence and is criminally prosecuted by law.
