Shenzhen Provisional Approach to Entrepreneurs

(Act No. 229 of the People's Government Order No. 2229 of 11 April 2011)

Chapter I General

Article 1 aims at accelerating the implementation of the talented urban strategy, optimizing the entrepreneurship environment and enhancing urban competitiveness, and developing this approach in accordance with the Shenzhen City Guarantee Housing Regulations and related provisions.

Article II applies to the use of municipal-level financial funds and other funds, in kind, raised by the municipal government, and to the operation of the talents for all categories of people in need of economic and social development in the city.

The talent referred to in this approach is determined in accordance with the Shenzhen Criteria.

Article 3. The municipal housing security sector is responsible for the admissibility, clearance, distribution and regulation of the talent security application; is responsible for the regular publication of the implementation of the talent and the establishment of a unified talent safety information system with the relevant authorities, the progressive realization of information-sharing among all the city's talents, familyhood, marriage, social insurance, housing and housing security, and the progressive realization of the function of the talent online application, access, access, screening, complaints, supervision, etc.; and the organization of regular and sectoral talent review and performance checks.

The relevant industrial authorities in the city are responsible for the regular development of the directory of the Emphasis Unit of the industry.

The urban human resources security sector is responsible for leading the development of the talent identification criteria to participate in the health insurance in accordance with the requirements of the municipal housing security sector.

The city's financial sector is responsible for the development of a talented monetary subsidy scheme with the municipal housing security sector and the planned allocation of monetary subsidies to the urban housing security sector.

The urban planning, public safety, the health-care population-bearing sector is responsible for providing, at the request of the municipal housing security sector, the registration of housing property necessary for the implementation of talents, householdization, family planning, etc.

Article IV. The joint meeting on talent security in the city was convened by the municipal authorities, with the participation of the municipal housing security sector, the office of the municipal leadership team, the urban human resources security sector, the municipal finance sector, the municipal sector, the relevant industry authorities, to study the consideration of major matters related to human security, and the day-to-day work is vested with the municipal housing security sector.

The directory of the business sector's focus centre developed by the relevant industrial authorities in the city is summarized by the municipal housing security sector to form the draft directory of the Emphasis Unit of the Empower Entrepreneurship in the city, which is made available to the city after the consideration of the report of the municipal government.

Article 5

In-kind configurations include forms such as rental housing, property grants and rental housing and the purchase of residential commodities, including the acquisition of housing subsidies and rental housing subsidies.

Article 6. The talent has been married and the family shall apply for renting public rental housing or for the acquisition of housing preferences, with their spouses and minor children being co-accused.

Each household can only rent a set of public rental housing, which can only be granted a concessionary policy; the talent is in line with the tenancy allowance, the requirement for public rental housing, which can only be granted a form of residence and cannot be repeated; the applicant and his or her spouse are eligible for the application and can apply for the benefit policy.

At the same time, the talent is in line with multiple levels of talent, and in accordance with the highest level of talent, its voluntary application in accordance with the low level of talent cannot be applied once again at the level of high talent; and after the upgrading of the talent level, the applicant can be reinvigorated.

The voluntary lease of the talent or the purchase of field-standard housing that is less than the level of its talent are not compensated for in part of the area.

Chapter II

Article 7. Advantages that have not been granted for the purchase of housing preferences in this city may apply to the urban housing security sector for the rental of 200 square meters in accordance with the following procedures:

(i) Upon application by the user's unit, the applicant's unit shall conduct the identification of the applicant's qualifications and requests for information, which shall be submitted by the user unit to the municipal housing security sector in accordance with article 31, paragraph 1, subparagraphs (i), (ii), (vi), (viii), (xi) and 11);

(ii) In five working days, the housing security sector conducted a review of the applicant, the spouse's access to the market's favourable policy;

(iii) Approval of qualifications, the municipal housing security sector arranges housing within 10 working days and enters home lease contracts with user units and applicants. The housing lease contract reproduces the urban human resources security sector and the municipal financial sector.

Article 8. The duration of rental contracts for the rental of homes for the outstanding talent shall not exceed 10 years; the ten-year period may be renewed.

The rent shall not be transferred. The expenses incurred during the rental period in respect of the management of the property, hydropower, etc. are borne by the lessee.

The outstanding talent left the original owner's unit without refunding and, prior to the receipt of the new user units in the city, paid a 50 per cent rent to the urban housing security sector in accordance with the standard of rent for public rental housing, which had not been recorded by the new occupants in the city after one year, paid rents in accordance with market rental guidance.

Article 9. Evantages of excellence in the present city have lived for 10 years or have been granted property rights with rented homes by the urban human resources security sector for a period of five years after their admission to work in the city by their user units.

The municipal housing security sector should be reviewed within five working days and submitted to the joint meeting on the work of the city's talent.

After the approval of the grant, the municipal housing security sector informed the applicant of a housing grant and contract within five working days. Housing property rights grant and contracts are reproduced to the urban human resources security sector, the city's financial sector, and the original home lease contract is removed.

Chapter III

Article 10 does not enjoy the preferential policy of buying houses in this city, the talent of the military who have not received the royalties for the tenancy of the royalties granted by the embassies, which may apply for a three-year rent-free housing in accordance with the procedure set out in Article 7 of this scheme, with local wings and back-up-level talents having the place of residence.

The standard of rental housing construction for the veterans is:

(i) Approximately 150 square meters of national-level leaders;

(ii) About 100 square meters of local-level leaders;

(iii) Some 80 square meters at the backup level.

The talents and their user units should be presented to the municipal housing security sector in the material specified in article 31, paragraph 1, subparagraphs (i), (ii), (iv), (v), (vi), (vi), (vi), (vi) and (xi).

Article 11

Unless the lease is required after the expiry of the lease period, the competent military personnel shall, through their user units, submit the material specified in article 10, paragraph 3, of the scheme for the extension of the lease. Upon review by the municipal housing security sector of compliance with the prescribed conditions, the rental rate is calculated in accordance with the standard of rental housing rental housing for a period not exceeding three years.

Article 12. The acquisition of commodity housing in the city without the benefit of the owner of the purchase of housing in this city may apply to the urban housing security sector for the acquisition of housing benefits, including local wings, back-up-up-level talents.

The personnel of the military should apply for the purchase of housing subsidies in accordance with the following procedures:

(i) Upon application by the user's unit, the applicant's unit test of the applicant's qualifications and application material, submitted to the municipal housing security sector the material specified in article 31, paragraph 1, subparagraphs (i), (ii), (iv), (v), (vi), (vi), (vi), (xi) and (xi) of the scheme, as well as a property certificate or contract for the sale of property (right or purchase of a person-owned applicant), a written certificate of the owner's unit's payment of the purchase subsidy and voucher in full;

(ii) The housing security sector, within 15 working days, has verified whether the applicant and his spouse have enjoyed preferential policies in the city;

(iii) To verify eligibility, five working days from the municipal housing security sector to the community on its website;

(iv) There was no objection or objection, and the municipal housing security sector was notified within five working days of the owner's unit and the applicant's contract for the purchase of housing subsidies. The acquisition subsidy contract reproduces the urban human resources security sector, the municipal finance sector, and the municipal property registration authority;

(v) Upon the signing of the rental subsidy contract, the municipal housing security sector issued a 30 per cent purchase subsidy to the occupants' talent and 70 per cent of the remaining 70 per cent was granted in five years at annual level, and was paid by the embassies with their own identity card and the purchase of housing benefits contract to the urban housing security sector at the end of the year.

Article 13 does not enjoy the concessionary policy for the acquisition of houses in this city, and the talent for the rental of rented homes may apply for a three-year rental subsidy in accordance with the following procedures:

(i) Upon application by the user's unit, the applicant's unit shall conduct the identification of the applicant's qualifications and application materials, and shall submit to the municipal housing security sector the material specified in article 31, paragraph 1, subparagraphs (i), (ii), (iv), (v), (vi), (vi), (vi), (xi), (xi) and (xi) of the scheme;

(ii) The housing security sector, within 15 working days, has reviewed the extent to which the applicant and his spouse have enjoyed the preferential policy of buying houses in the city, whether the rent-free housing has been rented in the city;

(iii) Approval of qualifications by the municipal housing security sector for five working days to the society on the Government's website;

(iv) There was no objection or objection, and the municipal housing security sector was notified within five working days of the owner's unit and the applicant's contract for rental housing benefits. The rental subsidy is transferred directly to the applicant's personal accounts. When the rental subsidy was not granted in the year, a one-time replacement for the next fiscal year should be paid.

Article 14. The acquisition of housing benefits does not exceed 50 per cent of the housing construction standard set out in article 10 of this scheme, with 80 per cent and 20 per cent respectively paid by the Government and the user units, and the acquisition of housing orders is based on the average price of the previous year market general commodities that are published in the planning of the land sector at the time of application.

The standard of rental housing benefits for military personnel is:

(i) S$4800/months for the National Leadership Army;

(ii) $32 million/monthly for local-level leaders;

(iii) $2560/monthly for the backup.

After the conclusion of the acquisition of the housing subsidy contract, the owner's talent has been working in the city for 10 years, and the property acquired could be transferred. The veterans of the veterans in the city apply for the processing of registrations for real estate transfers, mortgage registrations (other than mortgage registrations).

The former unit shall notify the municipal housing security sector in writing within 15 days of the date of separation of its departure. The municipal housing security sector has suspended the payment of its purchase subsidy and rental housing benefits.

After the new occupants in the city, the veterans are given the material of the talented social insurance card, labour contracts, identification certificates, etc., and apply to the municipal housing security sector for the continuation of the residual acquisition subsidy, rental housing benefits. After clearance, the municipal housing security sector should enter into supplementary agreements with new user units, talents, or inform the embassy and continue to grant the remaining acquisition benefits, rental housing benefits.

During the suspension of the payment of the housing allowance, the rental subsidy was not taken into account.

Chapter IV

Article 16 does not have any form of self-ownership in this city, the primary and new introduction of high-level talents without the acquisition of housing preferences in this city, which is part of the directory of the Empretecian of the Empower in the city and whose duties, degree, age conditions are in accordance with the provisions below, may apply for renting public rental housing or receive rental subsidies:

(i) Newly introduced senior talents (hereinafter referred to as high-level talents): At the same time as at the age of 46 years, the Deputy High Commissioner was appointed and was under 41 years of age;

(ii) Primary talent: full-time school completion at home and abroad, Dr. 36 years of age, graduated at 31 years and graduated from 26 years of age.

The age conditions set out in the previous paragraph are to be reviewed and judged by 1 January of the year.

The conditions, standards, procedures and supervision management of SICAs are implemented in accordance with the relevant provisions of the city's Synergy.

Article 17 High- and medium-sized junior talent households rented public rental housing, with construction area not exceeding 60 square meters; single-high, medium- and junior talents rented public rental housing, and construction area is generally not exceeding 40 square meters. A set of housing can be arranged for more than 10 square meters.

Public rental housing is available in the yards of the owner's unit, which should apply for public rental housing, free of charge of public rental housing and may apply for rental housing subsidies. High-level and medium- and junior talent rental standards are:

(i) High-level talented at the high level of service, 2000 yen/month;

(ii) High-level talent with a Deputy High-level Officer, US$ 1,500/month;

(iii) Primary talent with doctoral degrees, 1000/month;

(iv) Primary talent with master's degree, US$ 500/month;

(v) Primary talent with academic degrees, US$ 200/month.

High- and medium-term talents rent public rental housing or receive rental housing subsidies for no more than three years.

Article 18 High, medium- and primary talented public rental housing, rental housing subsidies are subject to a centralized review system.

The municipal housing security sector should publish information on the source, number, location, location, location, location, etc. of public rental housing on the municipal government website and the Government's website every year, as well as on the period of receipt of rental housing benefits and the place of receipt.

Article 19

(i) A license of business by a person's unit, an organization's code, a tax registration certificate, an enterprise legal representative's identity certificate, and the submission of requests to the housing security sector and an application form;

(ii) The municipal housing security sector, in conjunction with the industry authorities, will determine the public rental housing distribution programme within 30 working days and be made available on the Government's website, in accordance with the influence of the employed person's units, the degree of lack of work, the size of the tax contributions and their talents. To authorize the use of locally constructed public rental housing through the approval of the user's units, it is a priority for the talent of the user unit to meet the requirements;

(iii) In accordance with the number of homes identified in the lease programme, the number of applicants' qualifications and declaration materials are identified, the list of persons who apply for housing is determined by the unit and, within the time specified, the municipal housing security sector submits information material under article 31, paragraph 1, subparagraphs (i), (iii), (iv), (iv), (v), X), XI) of the scheme and the applicant's information materials signed by the head of the user unit and incorporated in the public chapter. The late submission shall be considered a waiver of this application;

(iv) The municipal housing security sector will verify the applicant and his spouse, the minor children's access to the city's housing preferential policy, the housing situation in the city and the payment of social insurance within 30 working days, in conjunction with the city's planning home, the urban human resources security sector;

(v) Verification of qualifications and the results of the review are presented at the municipal housing security sector website for five working days;

(vi) There is no objection or objection, and the municipal housing security sector enters a three-year public rental housing lease contract with the user unit. In accordance with the lease contract, the owner's unit pays a three-month rent to the municipal housing security sector.

The user's unit needs to change the number of people, and the identification, submission of material, in accordance with paragraph (iii) of the previous paragraph, may be changed by the municipality's housing security sector after the approval of the agreement.

Article 20 provides that a person's unit or the applicant is required to terminate the lease contract in advance and shall notify, in writing, the municipal housing security sector, return to the housing security sector in accordance with the contract agreement, verify non-compliance and return to the payment of the payment of the guaranteed housing security sector.

After the expiry of the lease contract, the owner's unit or the applicant are allowed to return to the bond after the housing security sector receives the housing guarantee. The owner's unit still needs for rental accommodation after the expiration of the contract, which shall apply for three months before the expiration of the contract.

The applicant has serious violations that are not appropriate for the enjoyment of the talent safety policy, and the municipal housing security sector can return to the guarantee and the unilateral termination of the lease contract.

Article 21

(i) Upon application by the user's unit, the applicant's unit shall conduct the identification of the applicant's qualifications and application materials, and shall submit to the municipal housing security sector the material specified in article 31, paragraph 1, subparagraphs (i), (iv), (v), (vii), (vii), (x), (xi) and (xi) of the scheme;

(ii) The municipal housing security sector will verify the applicant and his spouse, the minor children's access to the city's housing preferential policy, the housing situation in the city and the payment of social insurance within 40 working days;

(iii) To verify eligibility, five working days from the municipal housing security sector to the community on its website;

(iv) There is no objection or objection, and the municipal housing security sector shall notify, within 10 working days, the owner's unit of agreement to grant the applicant's rental housing allowance. The rental subsidy is transferred directly to the applicant's personal accounts. When the rental subsidy was not granted in the year, a one-time replacement for the next fiscal year should be paid.

The applicant's departure from the former owner's unit during the receipt of the tenancy allowance shall notify the municipal housing security sector in writing within 15 days of his departure. The municipal housing security sector suspended its rental subsidy.

In addition, the applicant was recorded by the directory of the Empower Entrepreneurship Unit in the city, with a request for information from the new unit, to apply for the continuation of the remaining rental subsidy to the housing security sector. After clearance, the municipal housing security sector should inform the new user unit of its agreement to continue to grant the applicant's rental subsidy. During the suspension of the payment of the rental housing allowance, it was not taken into account for the duration of the rental housing allowance.

Chapter V Legal responsibility

In article 23, the applicant makes a false application in a manner that conceals or misstatements of education, job titles, talent identification documents, social security, householdization, housing, etc., or treats the application by law in accordance with the Shenzhensan Housing Regulations and the relevant laws, regulations, etc.

The municipal housing security sector may be directly transferred to the public security authorities in accordance with the provisions of the Law on the Safety and Security of the People's Republic of China on the Control of Penalties; the alleged offence is transferred to the judiciary.

Article 24, after securing rental housing, public rental housing or monetary subsidies, has one of the following cases, and the municipal housing security sector should notify the user units in writing and dislocate the housing lease, buy-in agreement or terminate the grant of rental housing benefits, recover rental housing, public rental housing:

(i) The talent identification document was cancelled by the urban human resources security sector;

(ii) The applicant is punished with penalties that are not appropriate to the housing security policy.

Article 25 contains one of the following acts, with a fine of 500,000 dollars, and no longer receiving the application for public rental housing and rental housing for its employees within the next year:

(i) To conceal the facts, assist their employees in submitting applications or in decepting the physical configuration;

(ii) To rent or borrow public rental housing for persons incompatible with the conditions of the unit or for non-resident units;

(iii) The failure of its staff to carry out a licence for public rental housing violations in a timely manner;

(iv) The self-adjustment of the person by the owner;

(v) Reimbursement, expansion or renovation of rented homes or changes in the use of rented homes;

(vi) The use of public rental housing for unlawful activities.

Article 26 contains one of the following cases, which is being responsibly ordered by the municipal housing security sector, with a fine of 30,000 yen and no longer receiving the application for public rental housing and rental housing for its employees within the next year:

(i) Applications for rental housing subsidies for employees who are incompatible with conditions or non-resident units;

(ii) The applicant's departure from the user unit during the receipt of the rental housing allowance and the user unit did not inform the municipal housing security sector in accordance with this scheme.

In the case of the preceding paragraph, the user units should refund to the municipal housing security sector the rental subsidy that the applicant has received or received and may be paid to the applicant in accordance with the law.

Article 27, in violation of the relevant legislation and the provisions of this approach, the municipal housing security sector should include them in poor records of conduct and inform society on the website of the Government of the sector, and transmit them to its constituent units and institutions.

The licensor shall make the applicant's offence punishable by law as a record of misconduct.

Article 28, concerning the non-performance of the staff of the regulatory sector, the abuse of their functions, the negligence, the invocation of private fraud, is governed by the law, and the transfer of administrative responsibility by law to the judiciary for alleged crimes.

Annex VI

Article 29 of this approach refers to self-containable housing, including policy housing that has been granted a property certificate or purchases but does not have full titles, pooled housing, house demolitions, military properties, self-building and commodity housing.

The policy housing referred to in this approach refers to a variety of housing with a policy preference, including quasi-cost housing, full-cost housing, social micro-lihoods, affordable housing, economic application, and secure commodity housing.

The scheme referred to the purchase of housing preferences, including the purchase of policy housing or the acquisition of housing subsidies. The acquisition of premises for high-level personnel prior to the operation of this scheme is considered to be a subsidised under this scheme.

This approach refers to the new high-level talent that was introduced after 14 May 2010 to enter into a labour contract with the occupants' units in this city and to pay the high-level talent for social insurance for the first time in this city.

Article 33

(i) Applications for reports and requests;

(ii) Licence certificate from the human resources security sector in the city;

(iii) graduate certificate, degree certificates and valid identification, identification documents;

(iv) Social security or health insurance card (port, Macao, Cohesion and Foreigners may offer personal income tax credits as an alternative);

(v) Labour contracts;

(vi) The applicant's (sousal) identity card, family planning certificate that married persons are required to submit a marriage certificate and that the non-resident city's residence is required to submit a separate residence certificate, and the port, Macao, Coy and foreign nationals should provide a passport or other legal status certificate that family planning can not be provided;

(vii) The applicant (sousal, minor children) identification, household certificates, family planning evidence that married persons are required to submit a marriage certificate and that the non-resident city's family will be required to submit a residence certificate separately, and the port, ranium, and foreign nationals should provide a passport or other legal status certificate that family planning can not be provided;

(viii) The applicant, the spouse did not enjoy the declaration of the PPP policy in this city;

(ix) The applicant (sousal, minor) has no declaration of self-ownership in the city;

(x) The applicant (sousal, minor children) does not have any form of self-ownership in the city and does not have a declaration on the acquisition of housing preferences;

(xi) The security document of the unit of the person;

(xii) A lease contract for a registered or reserve house.

The period due to the registered or reserve rental contract has been submitted, and the applicant is required to submit a new registered or written home lease contract to the housing security sector by 10 years of the duration of the housing rental contract.

The municipal housing security sector should develop the text of the provisions of paragraph 1, subparagraphs (i), VIII, IX, X) and XI of this article and make available on this sector website for download by the applicant and the user unit.

The Thirty-first Session of the People's Government, the new district management body should, in the light of this approach or otherwise, develop specific approaches to the implementation of the talent.

The contracts relating to human rights units and talents signed by various sectors should be sent to the municipal housing security sector.

Article 32 does not have any form of self-ownership in this city, which does not enjoy a favourable policy for the acquisition of housing in this city, the primary and new introduced talent in the work of the municipal agency's units, in accordance with article 16, paragraph 1 (i), (ii), paragraph 2, of this scheme, may apply for renting public rental housing, but may not apply for rental subsidies.

Article 33 Specific forms of implementation, conditions, standards, procedures and procedures for human security should be adapted, and the municipal housing security sector should propose adaptation programmes that are published after the consideration of the joint meeting on talent security in the city.

The talent security policy and other housing security policies are not available at the same time.

The various categories of talent have been granted in the context of the capital housing currency in the province, and in the enjoyment of the talent safety policy in the city, the amount of the Hiroshima housing monetary subsidy should be deducted.

This approach is incompatible with the previous city's policy on talent housing and the approach.

Article 55 of this approach is implemented effective 1 June 2011.
