Decision of the Government of the Nationalities of the State to amend the Zhong State's Science and Technology Awards

(Adopted at the 59th Standing Conference of the People's Government of the State of 4 July 2011, No. 198 of 25 July 2011, published from the date of publication)

The Government of the Nationalities of the State has decided to amend the Science and Technology Approval Scheme of the State as follows:

In accordance with article 1 legislation, the Regulation for the Promotion and Protection of patents in the State of Hygiene is added.

Replace Article 3 with article IV by modifying paragraph 2 as follows:

“(i) Specialized awards for science and technology;

“(ii) Science and technology progress awards;

“(iii) patent awards.”

Replace Article 6 with Article 5 and delete paragraph 4: “The members of the Evaluation Committee shall be appointed for a three-year term”, with the following modifications:

Article 4 should be replaced with Article 6 and read as follows: “The award for special contributions to science and technology in the city is evaluated every two years, regardless of hierarchy. No eligible candidates could be vacant.

The Urban Science and Technology Progress Award is divided into awards such as special awards, one such award and two awards each year, and the total number of awards for each award is not more than 100, of which no more than five awards are awarded, and one such award project exceeds 15 awards. In addition, as paragraph 3: “Central patent awards are divided into one such award and two awards each year, the total number of each award project does not exceed 30, one of which exceeds 5 awards”.

Article 9 should be replaced with Article 7, with the amendment to read as follows: “The number of awards per award for a special contribution to science and technology in the city does not exceed 2 awards.

The Urban Science and Technology Progress Prize awards the main financiers directly involved, such as special awards, a single award for awards not exceeding 15, and the second awards for no more than 10 persons.

The number of municipal patent awards is not exceeding six.

Replace Article 8 with Article 9 and delete paragraph 5 with the words “to complete major technological inventions and to create greater economic benefits”, with the following modifications: “The Purin works have a clear and effective impact on the enhancement of the scientific integrity of citizens, the creation of a scientific and technological innovation environment and the promotion of the spirit of scientific innovation”.

Objections should be made by the objector to the municipal science and technology awards evaluation committee during the public notice period and to provide written object materials and the necessary proof material. The objector shall sign a true name or a seal of the unit in question.

The award for scientific and technological progress in the city amounts to US$ 10 million, US$ 60,000, and US$ 30,000. The number of awards for the municipal patent awards is $20,000, and 1 million for the award.

Article 23 was replaced with article 24, which read paragraph 2 as follows: “The Government of the urban people, in accordance with the economic development of the city, may adjust the total number of projects and awards for municipal science and technology awards”.

The words “three years” in article 27 were amended to read: “5 years”.

This decision is implemented since the date of publication.

The State's Referral of Science and Technology Awards are modified in accordance with the relevant language of this decision and re-published in the order of the articles.

Annex: Science and technology incentives in solemn states (as amended in 2011)

(Act No. 128 of 7 July 2003 of the Order of the People's Government of the State of Hygiene, dated 25 July 2011, as amended by the Decision of the Government of the State of Hygiene on the Modification of Science and Technology Awards in the State of Soyang

Chapter I General

Article 1 promotes the development of science and technology and economic construction, in accordance with relevant legal, legislative and regulatory provisions, such as the National Science and Technology Approval Regulations and the Patent Promotion and Protection Regulations of the State of Hygiene.

Article II applies to the establishment, recommendation, evaluation and award of the municipal science and technology awards.

Article 3. Science and technology incentives for the implementation of the approach to respect for knowledge, respect for talent, and encourage technological innovation, with a focus on science and technology levels and economic and social benefits.

Article IV sets up municipal science and technology awards by the Government of the city.

The municipal science and technology awards are divided into three awards:

(i) Specialized scientific and technological contributions awards;

(ii) Science and technology progress awards;

(iii) Patent awards.

Article 5. The municipal science and technology administration is responsible for the evaluation and management of the municipal science and technology awards.

The Government of the city has established the Urban Science and Technology Award Evaluation Commission responsible for the evaluation of municipal science and technology awards.

The Committee for the Evaluation of Municipal Science and Technology Awards consists of experts, scholars and administrators of science and technology in the relevant areas, which should not exceed one of the total members of the evaluation committee; the composition of the candidate is presented by the municipal science and technology executive branch for approval by the Government.

The Urban Science and Technology Awards Assessment Commission has engaged industry experts to participate in the evaluation of municipal science and technology awards in accordance with the provisions of this approach.

Introduction

Article 6. The city's special contribution award for science and technology is evaluated every two years. No eligible candidates could be vacant.

The Urban Science and Technology Progress Award is divided into awards such as special awards, one such award and two awards each year, and the total number of awards for each award project is not more than 100, of which no more than five awards, and one such award project exceeds 15 awards.

The municipal patent awards are divided into one such award, two awards each year, and the total number of each award project exceeds 30 awards, one of which exceeds 5 awards.

Article 7.

The Urban Science and Technology Progress Prize awards the main financiers directly involved, such as special awards, a single award for awards not exceeding 15, and the second awards for no more than 10 persons.

The number of municipal patent awards is not exceeding 6.

Article 8 is in accordance with one of the following conditions, and awards for special contributions to municipal science and technology:

(i) Considerable results in research in the field of science and technology, in particular in the area of high-technical technology, resulting in breakthroughs in disciplines or related disciplines and making a special contribution to promoting social development;

(ii) In technological innovation, the transformation of scientific and technological outcomes and the industrialization of high-technical technologies, access to major technological inventions, technological innovation, and the creation of enormous economic benefits or social benefits.

Article 9 is in accordance with one of the following conditions, and awards the Urban Science and Technology Progress Prize:

(i) In the implementation of technical development projects, scientific and technological outcomes, such as market value products, technologies, processes, materials, design and biomass, and access to major technological innovation, significant economic benefits or social benefits;

(ii) Significant economic benefits or social benefits in promoting the application of advanced scientific and technological outcomes and in achieving higher industrialization of new technologies;

(iii) Considerable social benefits in the implementation of social good projects for science and technology and soft scientific research;

(iv) The active application of advanced science and technology in the implementation of major engineering projects to promote scientific and technological innovation and their technical level to achieve national advanced levels;

(v) Princular works have a clear effect on raising the scientific integrity of citizens, creating an environment for science and technology innovation and promoting the spirit of scientific innovation.

The awards in paragraph (iv) of the previous paragraph are granted only to organizations.

Article 10 is also in accordance with the following conditions and award of a municipal patent award:

(i) ownership of intellectual property;

(ii) The former has not been invented or has not been made public;

(iii) Be advanced and creative;

(iv) After patent implementation, significant economic benefits or social benefits are achieved.

Chapter III Recommendations

Article 11. Municipal science and technology awards are recommended.

The following units or individuals may recommend municipal science and technology awards candidates or candidate projects to the municipal science and technology administration:

(i) The Chinese Academy of Sciences, and the Chinese Institute of Engineering;

(ii) Large medium-sized enterprises;

(iii) Schools and scientific colleges;

(iv) The composition of the Government of the city, its immediate institutions and institutions;

(v) The district (market), district science and technology administration;

(vi) Industry associations, institutes.

Article 12 states that:

(i) The disputed intellectual property;

(ii) The complete unit of scientific and technological results or the completion of the contentious;

(iii) Access to national or provincial scientific and technical incentives;

(iv) In accordance with the law, the licence shall be obtained without the approval of the competent administration;

(v) The defence, national security and the lawful confidentiality of the law are not open.

Article 13 recommended that candidates for municipal science and technology awards or candidate projects should be filled with proposals for a unified format and provide authentic and reliable evaluation certificates.

Candidates, candidate-selected project completion units or individuals, recommended units or individuals should sign a letter of good faith to assure the authenticity of the material.

Chapter IV Evaluation

Article 14. Science and technology incentives for evaluation should uphold the principles of openness, equity and justice.

Article 15. The recommended material for the executive branch of municipal science and technology to the recommended units or individual reports shall be reviewed within five working days. Upon review of compliance with the request, a review of the municipal science and technology awards evaluation committee is submitted; it is not in accordance with the request, that the recommended unit or individual be added within 10 working days; that the recommended materials are returned to the recommended material after completion of the process or the replenishment is still incompatible with the requirements.

In accordance with the needs of the evaluation process, the Urban Science and Technology Award Evaluation Commission established a number of disciplines (specialised) evaluation teams. The various disciplines (specialist) evaluation teams are responsible for the initial evaluation of the municipal science and technology awards recommended projects in their respective disciplines (specialised) and the submission of awards or awards projects and ratings to the municipal science and technology evaluation committees.

Article 17

The evaluation session of the Evaluation Committee shall be held by more than two thirds (two thirds) of its members.

Awards

Article 22 provides for a special contribution to municipal science and technology to be signed by the Mayor of the Municipal Government and awarded certificates and awards by the Government of the city.

The city's special contribution award for science and technology has contributed to the award of more than 500,000 dollars, with a specific amount determined by the Government of the city.

Article 23 of the Urban Science and Technology Progress Award, the Municipal patent awards are awarded by the Government of the city.

The award for scientific and technological progress in the city amounts to US$ 10 million, US$ 60,000, and US$ 30,000. The amount of the PCB awards is denominated at US$ 2 million and US$ 1 million.

Article 24

In accordance with the economic development of the city, the Government of the city may adjust the total number of projects and awards for the municipal science and technology awards.

Article 25 Urban Science and Technology Progress Awards, patent awards and project awards should be distributed in accordance with the scale of contributions. It was completed by the organization and the award for the principal completion of the award was not less than 810 per cent of the total awards.

The award of the municipal science and technology award is not the basis for determining the right to scientific and technical results.

Chapter VI Corporal punishment

Article 27, in which theft, seizure of the scientific and technological outcomes of others, or inadvertently for the municipal science and technology awards, has been verified by the municipal science and technology administration, the Government of the city has approved the withdrawal of incentives, the collection of certificates and awards and has no declaration of municipal science and technology awards within five years.

Chapter VII

Article 33 The incentives for scientific and technological progress in the city, issued by the Government of the people on 18 August 1997, were also repealed.
