Harmony service management approach for roads and public places in the sea

(It was considered at the 140th ordinary meeting of the Shanghai People's Government, held on 23 April 2012, through the publication of Decree No. 83 of 2 May 2012 of the People's Government Order No. 83 of 2 May 2012 effective 1 July 2012.

Article 1

In order to regulate the cleaning services of the city's roads and public places, to guarantee the legitimate rights and interests of the clean-up operation and to promote the development of the cause of sanitation in the city, and to develop this approach in the light of the provisions of the Article on the environmentally sound management of the city and other relevant laws, regulations and regulations.

Article 2

This approach applies to clean-up services and related management activities in the city's roads and public places.

The path described in the previous paragraph includes, inter alia, the following:

(i) Urban roads;

(ii) According to the Government of the People of the Region (Parliament) that specific road blocks operating in urban areas in accordance with urban road cleaning standards (hereinafter referred to as “special road routes”);

(iii) No streets and corridors in the area of the management of the material industry (hereinafter referred to as “the tunnels in the street”);

(iv) To connect village groups within the same administrative village to the villagers' team for the arrival of the gate or vehicle (hereinafter referred to as “in the village”).

Article 3 (Management responsibilities)

The city's greener administration sector is the competent authority for cleaning services in the city's roads and public places.

In accordance with the responsibilities set out in the Green City Administration Department of the Region (Parliament) is responsible for the management of the clean-up services in the administrative and public sites within the region.

Article IV

The responsibility for cleaning services in the city's roads and public places is determined in accordance with the following provisions:

(i) Urban roads, specific road routes and public places, which are responsible for the administration sector or communes (communes);

(ii) Street crossings, which are responsible for the Government of the town or the street offices;

(iii) In the village, the Village People's Committee is responsible.

Article 5

The management of cleaning services in the city's roads and public places should be guided by the principle of fair competition, ensuring quality, normative services.

The city has established a mechanism for regular growth in the income of clean-up operators.

Article 6 (Development planning)

The urban greener administration sector should incorporate the development of clean-up services in the city's roads and public places, in accordance with the development needs of the city's congestion of the cause of sanitation.

Article 7

The city's road and public space cleaning area is divided into four levels, in accordance with factors such as roads, commercial networks and the distribution of residential areas, human flows, vehicle flows. The specific scope of the various hierarchy of roads and public places is determined and published by the Greenhouse Administrative Region (Parliament) of the city's green administration sector.

The quality of clean-up in the area where the various levels of roads and public places are clear should be in line with the corresponding standard of quality of cleaning. The city's roads and public places are clear-quality standards, which are developed and published by the city's Quality Technician Administration, in conjunction with the city's green city administration.

Article 8

The operational service units of the urban roads, specific road routes and public places for clean-up operation services projects are determined by the greening administration sector or by the commune government through tendering. The operational service units should have a licence for the operation of garbage services that are nuclearly released by the city's green administration.

In the streets, the tunnels and the village corridors are managed by the Town People's Government, the Street Office or the Village People's Committee to organize the cleaning or cleaning of the population.

Article 9

Urban roads, specific road routes, and public premises cleaning services projects take the form of government buying services, which should be financed in accordance with the planned budget for the conservation of sanitation operations in the city, with financial guarantees from the zones (zones) or communes (communes).

The funds required for the cleaning of the corridor in the streets are arranged by the Government of the Towns or by the Street Office.

The funds needed to clean the roads in the village are raised by the Villagers' Commission.

The current municipal sanitation operation conservation budget is based on the principle of “Uniformity, classification guidance, differentiated management”, which is developed by the municipality's green administration and the administration sector such as city finance and transport.

The use of clean financial funds in roads and public places should be subject to supervision, inspection in the financial, auditing sector.

Article 10

The solicitation documents for the project on clean-up operation services in urban roads, specific road routes and public places should include the following key elements:

(i) The name of the clean-up operation service project, regional, time-bound, operational modalities, operating frequency, quality standards and means of payment;

(ii) Facilities, equipment, vehicles and places that are adapted to clean-up operations services projects and related management systems;

(iii) Professional technicians adapted to clean-up operations services projects.

Article 11

After the establishment of the operational services unit, the green administration sector or the commune (communes) government should enter into operational service agreements with the medium-sixed operating service units.

The city's greener administration sector should develop a model text of the market clearance operation service agreement.

Article 12

Urban roads, specific road routes and public service units should conduct clean-up operations in accordance with established operational modalities, operating frequency, and adhere to the following service norms:

(i) The uniformity of operational personnel;

(ii) Operational facilities, equipment cleaning, safety and effectiveness;

(iii) The operational noise of vehicles is consistent with the standards of national and local environmental noise;

(iv) Mechanic clean-up operations have escaped early traffic peaks and reduced the impact on road traffic;

(v) There is no apparent propagation at the time of operation;

(vi) The products, such as laundering agents used in the course of operations, are in line with the relevant product quality standards and environmental requirements;

(vii) The timely collection of garbage generated by the operation and the provision of designated garbage collection containers, which are not confused into the waste box or in the garbage collection container.

In the streets, the veterans of the tunnel and the village corridor should be cleared on a daily basis.

Article 13

The Government of the people of the city, the District (Parliament) and the commune (communes) should prepare a case of emergency preparedness for the clean-up services in urban areas, specific road blocks and public places, and be able to secure clean-up services in major events, harsh weather conditions.

The operational service units should prepare specific programmes for the emergency response of this unit, based on emergency preparedness scenarios for the cleaning service in the region, as well as a case for the administration of the green market in the area (the district).

Article 14 (Review)

The Government of the People's Government in the Green Metropolitan City or in the town should organize an annual review of the quality of the operation services and make public the results of the review. In the course of the review, the views of units and individuals in the area of clean-up operation services should be heard as an important basis for the outcome of the review.

Article 15 (Social publicity)

The urban and subtropolitan administration sector, the communes (communes), the people's Government and the streets' offices should promote a wide range of forms of knowledge about the integrity of roads and public sites, and increase the awareness of the city's self-sensitization of the urban environment, respect for the work of the operators, and cooperate with the cleaning operation.

Article 16

Any unit or individual has the right to lodge a complaint to the municipality or to the greener administration sector and to the urban administration sector.

The executive branch of the city or subdistrict (the district) and the municipal administration should deal with the respondent within 5 days of the receipt of the complaint.

Article 17

In violation of article 12, paragraph 1, or Article 14, of this approach, the operating service units are not required to carry out clean-up operations or to review the quality of the clean-up operation services, which should be restructured in accordance with the agreement of the operational service agreement, and the failure to renovate or be subject to correctional requirements, and the removal of operational service agreements shall be borne by the operating service units.

Article 18

In violation of article 12, paragraph 1, of the present approach, the operating service unit is not in compliance with the rules of service, which is being restructured by the law enforcement order in the city (the district), with a fine of up to $3000.

Article 19

In violation of this approach, the authorities of the city, the District (Parliament) and the communes (communes) in the greening city have one of the following acts, either by their units or by the superior authorities, to administratively dispose of the responsible and other direct responsibilities, in accordance with the law:

(i) Establish operating service units in violation;

(ii) Non-compliance with the law and non-compliance with the responsibility for the management and supervision of clean services in road and public places;

(iii) No law enforcement can be determined or in violation of the statutory procedures;

(iv) Other abuses of authority, omissions, provocative fraud.

Article 20

Public facilities are established in the city's roads and public places, with the responsibility of the owner or the management unit entrusted to it. The quality of tenure should be in line with the standard requirements for the clean-up of the roads and public places of the city.

Article 21

This approach has been implemented effective 1 July 2012. The provisional approach to the management of clean-up services in the Shanghai City, issued by Decree No. 68 of the Shanghai People's Government on 7 July 1999, was also repealed.
