Safeguards for the payment of wages for farmers in the Province of Sussi province (a pilot)

(Summit 14th ordinary meeting of the People's Government of the Republic of Western Province in 2012 to consider the publication, effective 1 October 2012, of People's Order No. 162 of 28 August 2012.

Article 1 establishes this provision in accordance with the laws, regulations and regulations of the People's Republic of China, in order to regulate the payment of wages by farmers and to preserve the legitimate rights and interests of farmers.

Article 2

Article 3. Governments of more than veterans at the district level should strengthen the leadership of the work of farmers in pay security, establish a joint mechanism for the payment of wages for farmers and coordinate the issues of arrears, chewing the wages of farmers.

The Government of the last-level people should strengthen the supervision of the work of the lower-level people's farmers in pay security.

Article IV. The human resources security sector is responsible for the payment of food security for farmers.

The Public Security Agency is responsible for refusing to pay for the investigation of the offence of labour pay, assisting the relevant authorities in dealing with incidents of belonging to groups that are in arrears in the wages of farmers; overseeing the duties of the executive branch and other personnel appointed by its staff and administrative authorities to perform the payment of the farmer's wages; directing legal services and legal aid agencies to provide legal services and legal assistance for the work of the farmers who have been in arrears or paid their wages; and assisting the housing sector in the development of human resources in the construction sector to pay for the work of farmers.

Sectors and units such as development reform, finance, land resources, transport, water, State asset management, business administration, railways are able, within their respective responsibilities, to secure the payment of wages for farmers.

Article 5 Trade unions at all levels are responsible for guiding, helping the user unit to establish a trade union organization under the law, establishing a collective bargaining system for wages, promoting regular wage growth and pay security mechanisms.

Trade unions should monitor the payment of wages by farmers in accordance with the law, provide legal aid to farmers for unpaid work and defend the legitimate rights and interests of farmers.

Article 6. The user unit shall enter into a labour contract with the farmers' workers, implement a real-scale management, establish a roster of workers, perform records, and pay management desks.

Article 7. A person's unit and a farmer shall participate in social insurance by law and pay social insurance contributions.

People's units should create conditions to improve collective welfare and improve the welfare of farmers.

Article 8. The use of farmer workers by a user unit should be made available to the local human security sector on 10 days from the date of recruitment.

Article 9. The user unit shall pay the wages of farmers in full in monetary form. The parties agreed to pay less than one month from their agreement.

The payment of farmer wages by a user unit shall not be lower than the minimum wage for the workplace.

Article 10. The user unit shall pay the wages of the farmer during the injury.

Article 11. The construction of a labour subcontractor has a direct responsibility for the payment of the salary paid to the employed farmers, which should be paid on a priority basis after receipt of the works. The construction unit or the engineering contractor's total contractor did not meet the wages of the farmers in accordance with the contract agreement with the construction of the engineering subcontractor, which was paid by the construction unit or by the engineering contractor's contractor's company for the payment of the wages of the farmers; and the engineering contractor's total contractor was in breach of the provision of transit packages, subcontracted works resulting in the payment of the wages of the farmers.

Article 12 Construction units and engineering companies shall be charged with the construction of works in accordance with the contract agreement and shall be guaranteed to the labour subcontractor to pay the wages of the farmers in full monthly.

The Government of the people of the urban, district and district areas in which it is established may establish a system of wages for farmers, in accordance with the relevant provisions of the State. Farmers' wage bonds are used to ensure payment of wages to farmers.

The wages guarantee that the metal is owned by the user unit, the bank's exclusive storage and the human resources security sector oversees the use.

Article 14.

It was encouraged to establish a dedicated account for the work of farmers by a total contractor or by a labour subcontractor, which was paid by the bank.

Article 15. Industrial labour disputes mediation organizations, grass-roots popular mediation organizations and labour dispute arbitration institutions should facilitate the conditions for farmers' workers and actively assist farmers in obtaining paid and chewing wages.

Article 16, when the People's Court hears cases involving arrears, chewing of the wages of farmers, requires information about the user's units, the development of such sectors as reform, human security, land resources, housing rural and urban construction, and business administration, should be provided in a timely manner, and the people's courts should cooperate actively when implementing the farmer wage cases.

Article 17 Legal aid institutions, grass-roots legal services organizations should provide legal services for farmers to claim unpaid wages.

Article 18 Governments at all levels should put in place appropriate emergency prestigation cases and address in a timely manner significant incidents arising from arrears, the deduction of farmer wages.

More than 19 years of the people's government should organize regular monitoring of the payment of wages for farmers and promptly identify and address problems arising from the work of the farmers' wage payment guarantees.

The human resources social security sector should strengthen daily monitoring inspections and promptly identify and address the arrears of user units and the chewing of the wages of farmers.

Article 20 Government investment projects do not have funds or funds to be implemented on time, and sectors such as development reform may not be approved.

The construction unit, using the Government's investment project in arrears in the wages of farmers, may not approve the construction of a new Government investment project in the construction unit and provide for a period of time to meet the feasibility of paying the wages of farmers.

Article 21, the arrears of business development enterprises resulting in the payment of wages to farmers, and the sectors such as land resources, rural and urban construction, and business administration should take measures to assist the human resources security sector in promoting the payment of their pre-payments of farm workers.

The construction industry and other user units are in arrears in the wages of farmers, and the administration sector should take the necessary measures, in accordance with the law, to promote their active financing with the human resources security sector, and to pay their outstanding farmers' wages in a timely manner.

Article 2 Human resources social security authorities should conduct oversight inspections on the following matters of the user unit:

(i) The case of labour contracts with farmers;

(ii) Establishment of a related management desk;

(iii) Compliance with the provisions relating to labour dispatch;

(iv) paying the wages of farmers;

(v) Other matters relating to the wages of farmers.

When the human resources social security sector conducts oversight inspections, the sectors such as development reform, public safety, inspection, land resources, rural and urban construction, transport, State asset management, and business administration should be assisted by inspection units and individuals.

The sectors such as human resources security should incorporate the payment of the wages of farmers in the management of the social credit system, establish a good record of the payment of the wages of farmers by the user unit and make public the society public.

Article 26 violates the provisions of Articles 6, 7, 8, 11, 12 and 12 by the Human Resources Social Security Department for the period of time being rectified, and by the human resources security sector, which is to be dealt with by law in the same sectors as development reform, public safety, inspection, land resources, rural and urban construction, transport, State asset management, and business administration.

Article 27, in arrears of labour dispatch units, chewing of the wages of farmers, is corrected by the human resources social security sector and other relevant departments; in serious circumstances, by fines of up to 5,000 dollars per person, and by the business administration sector to revoke the licence of business; and losses incurred for the dispatch of farmer workers, and the joint liability of labour dispatch units with the user units.

Article 28 violates other acts under this provision, which are regulated by law, legislation and regulations.
