Employment of persons with disabilities in the province

(Summit 2nd ordinary meeting of the Government of the Grand province, 17 February 2013, considered the adoption of Decree No. 100 of 24 February 2013, No. 100 of the Order of the People's Government of the Grand province, which came into force on 10 April 2013)

Chapter I General

Article 1, in order to guarantee the labour rights of persons with disabilities, to promote and promote employment of persons with disabilities, and to develop this approach in line with the relevant laws, regulations, such as the People's Republic of China Disabled Persons Guarantee Act, the Employment Regulations for Persons with Disabilities and the Gangong Province Protection for Persons with Disabilities Regulations.

Article 2 deals with employment of persons with disabilities as defined by this approach as the age of statutory employment, with persons with employment requirements engaged in paid labour.

Article 3 organs, groups, businesses, business units, non-commercial units (hereinafter referred to as personal units) within the province's administration should fulfil their responsibilities and obligations to promote employment of persons with disabilities, in accordance with the relevant laws, regulations and methods.

Article IV. The Government of the people at the district level should incorporate the employment of persons with disabilities into national economic and social development planning, develop and implement preferential policies and specific enabling safeguards for the employment of persons with disabilities, in accordance with the principle of concentration of employment and dispersion of employment.

Article 5 Governments at all levels encourage citizens, legal persons and other social organizations to promote employment of persons with disabilities through a variety of channels, in a variety of forms, and encourage persons with disabilities to organize employment more than the prescribed proportion of persons with disabilities, and encourage persons with disabilities to engage in multiple forms of employment, including through self-employment, ownership.

Persons with disabilities should improve their quality, enhance their employment capacity, adhere to the labour disciplines of the user's units and adhere to professional ethics.

Discrimination against persons with disabilities in employment is prohibited. Prohibition of forced labour of persons with disabilities by means of violence, threats or unlawful restrictions on the freedom of the person.

The Committee on the Work of Persons with Disabilities at the District level is responsible for organizing, coordinating, mentoring and promoting the employment of persons with disabilities in the relevant sectors.

More than the human resources and social security, civil affairs, finance, taxation, business administration, statistics, at the district level, are employed for persons with disabilities within their respective responsibilities and are upheld by law.

The Disabled People's Federation has been entrusted by the Government to implement and monitor organizations responsible for the employment of persons with disabilities, who are affiliated with the employment services of persons with disabilities.

Article 7. Governments at all levels give recognition and incentives to units and individuals that have made significant achievements in the employment of persons with disabilities.

Chapter II

Article 8.

Persons with disabilities who are admitted in cross-regional settings should be included in the number of persons with disabilities arranged. Chapter III Safeguards

Article 16 does not establish conditions and requirements for discrimination against persons with disabilities when recruiting staff in public.

Persons with disabilities may not be denied access to conditions, in addition to the special requirements of the post.

The various vocational colleges, vocational training institutions should give priority to the students of persons with disabilities when attending school.

The human resources and social security sectors at the district level should be prepared with the Civil Affairs, Disabled People's Federation to prepare a directory of jobs suitable for the employment of persons with disabilities, to develop jobs adapted to the employment of persons with disabilities and to guarantee employment for persons with disabilities.

The public good jobs developed by the Government that are suitable for the employment of persons with disabilities are arranged for the employment of persons with disabilities by less than 30 per cent.

In the sector concerned, high school graduates are employed, and employment for students with disabilities should be given priority under the same conditions.

In the development of community services by more people at the district level, employment of persons with disabilities should be encouraged and promoted.

More than 18 per cent of the population at the district level should establish a zero-employment assistance system for persons with disabilities to ensure that at least one of the families with disabilities with labour capacity and employment needs are employed.

Article 19 Governments of more people at the district level should grant tax relief to the user unit that concentrates on the use of persons with disabilities by law, and the relevant sectors should be supported in the areas of production, operation, technology, finance, material, site use.

Article 20 Governments and relevant departments should identify and promote products, projects that are suitable for the production, operation of persons with disabilities, prioritize the production or operation of user units that concentrate on the use of persons with disabilities, and identify certain products from their exclusive origins in accordance with the characteristics of the operation of the user units that concentrate on the use of persons with disabilities.

Under the same conditions, government procurement should give priority to the purchase of products or services that are produced by a pool of persons with disabilities and by enterprises with disabilities.

Article 21 encourages and promotes the self-employment and ownership of persons with disabilities. Persons with disabilities operate independently, the relevant sectors such as the administration of business, tax, health should give priority to the issuance of evidence and, as prescribed, exempt from administrative expenses.

For persons with disabilities whose application for microfinance is eligible, the Government's security institutions and financial institutions should give priority to providing guarantees and loans.

Article 22 Governments at all levels should raise funds to organize and promote the participation of persons with disabilities in the cultivation, reproduction, industrial and other forms of production.

The relevant sectors, financial institutions and grass-roots self-government organizations in rural and urban areas should provide assistance and services to persons with disabilities in the areas of production services, technical guidance, agricultural supply, agro-industry acquisition and credit.

More than twenty-third people at the district level and related sectors should place rural poverty-focused persons with disabilities as pro-poor development targets and arrange specific funding to support the provision of additional projects for rural poor persons with disabilities. The strengthening of the pro-poor base for persons with disabilities is supportive of a poverty-reduction base with a sizeable and consistent with the same-level agro-industrial enterprise standards, in line with national and provincial preferences.

Article 24 Governments of more people at the district level should develop and implement the Social Security Policy of Disabled Workers and to effectively increase the level of social security for persons with disabilities.

Persons with disabilities should be provided with basic old-age insurance, basic health insurance, work injury insurance, unemployment insurance, maternity insurance.

Responsibilities of persons with disabilities participate in basic old-age insurance, with a total of 15 years of payment, receive basic pensions upon application and after the approval of the human resources and social security sector.

Article 25 Rates of employment security for persons with disabilities to be paid by a person's unit shall be approved by the employment services of persons with disabilities affiliated to the Disabled at all levels in accordance with the relevant provisions of the State and the province.

The employment security of persons with disabilities paid by agencies, groups and utilities is charged by the same financial sector; the employment security of persons with disabilities paid by business, civil service non-commercial units is charged by local tax authorities; and the employment security of persons with disabilities paid by other user units that are non-local financial allocations is charged by provincial employment services.

The employment security of persons with disabilities collected by local tax authorities is directly entered into the treasury of the treasury of persons with disabilities, in accordance with the relevant provisions of the province, by proportional to the treasury of the treasury, municipal and district-level states.

The Employment Guarantee for Persons with Disabilities, which is paid by enterprise, civil service non-commercial units, is covered by the management costs and the employment security of persons with disabilities paid by agencies, groups and business units is shown from the unit budget.

The specific payment, management and use of employment guarantees for persons with disabilities is developed by the Ministry of Finance in conjunction with provincial disability.

Chapter IV Employment services

More than twenty-eight people at the district level and related sectors should incorporate employment services for persons with disabilities into the public employment service system and provide targeted employment assistance services for persons with disabilities in employment difficulties.

More than twenty-ninth human resources and social security sectors at the district level, the Disability Federation should organize regular competitions for vocational skills for persons with disabilities, develop and identify good talents, establish a pool of excellence in the professional skills of persons with disabilities and continuously increase the level of vocational skills for persons with disabilities.

The human resources and social security sectors at all levels should strengthen labour inspections on employment of persons with disabilities and guarantee the labour rights and interests of persons with disabilities in accordance with the law.

The public employment service institutions established by the Government of the above-ranking population should include information on the employment of persons with disabilities in the human resources market information network, create a disability service window, provide employment information counselling, vocational presentations and employment unemployment registration services free of charge, and distribut to the personnel archives of persons with disabilities, the custody of personnel relations.

Article 31: The executive branch at all levels should develop vocational education for persons with disabilities in accordance with the law, take advantage of the vocational training of persons with disabilities, promote the skills of persons with disabilities and enhance employment and entrepreneurial capacity.

Article 32 encourages and facilitates vocational training for persons with disabilities at all levels. Costs for participation of persons with disabilities in vocational skills training, vocational skills identification are subsidized from the employment security fund for persons with disabilities.

Article 33 should establish a system of employment statistics for persons with disabilities at all levels and promote and guide the delivery of employment information for persons with disabilities to the labour-service institutions of persons with disabilities.

Sectors such as human resources and social security, civil affairs, finance, statistics, tax, and business administration should provide assistance to persons with disabilities in the labour force survey statistics and unemployment registration.

Article 34 Governments and relevant departments should strengthen the normativeization of employment services for persons with disabilities, support institutional establishment, job creation and staffing, and the full inclusion of requirements in the current financial budget.

Article XV. Labour-care services for persons with disabilities affiliated to the Federation of Persons with Disabilities shall be provided free of charge to employment of persons with disabilities:

(i) Employment laws, regulations, policy advice;

(ii) The publication of vocational supplies and vocational training information;

(iii) Organizing vocational training for persons with disabilities;

(iv) Provide services such as vocational psychological counselling, vocational adaptation assessment, vocational rehabilitation training, job orientation and career presentations;

(v) Buddddhist work guidance and services;

(vi) To guide, support the complementary employment of persons with disabilities with intellectual, mental and retroactive disabilities;

(vii) To provide assistance and support for the self-employment and self-employment of persons with disabilities and to support and services for the pooling of persons with disabilities;

(viii) Provision of support and services for persons with disabilities in connection with their employment;

(ix) Support and services for persons with disabilities in agricultural production;

(x) Other services for employment of persons with disabilities.

Article 36, commissioned by the human resources and social security sector, the employment services of persons with disabilities are responsible for the registration of unemployment, employment of persons with disabilities and unemployment statistics; and, with the approval of the location's human resources and the social security sector, the employment services of persons with disabilities can conduct vocational skills identification.

Article 337, Staff of Persons with Disabilities, for employment and labour matters, should provide legal assistance to all levels of legal aid institutions and support and help at all levels of the Disabled's Federation.

Chapter V Legal responsibility

Article 338, in violation of this approach, provides that acts against the labour rights and interests of persons with disabilities are not promptly halted or provided with the necessary assistance to victims, causing serious consequences, which are taken by their offices or superior authorities in accordance with the law against the competent and other responsible persons directly responsible; and that criminal responsibility is lawful.

Article 39, in violation of this approach, stipulates that the relevant units responsible for corruption, misappropriation, interception, private employment guarantees for persons with disabilities, the competent persons directly responsible and other persons directly responsible, constitute criminal responsibility under the law; they are not criminalized by the law; and that they are not punishable by law.

Article 40 violates the provisions of this approach that the unit of a person does not assign employment to persons with disabilities in a proportional manner, and rejects the payment of employment guarantees for persons with disabilities, in accordance with the relevant provisions of the State.

Annex VI
