Non-moile vehicle management approach in the sea City

(Adopted by the 26th ordinary meeting of the Government of the city of 14 October 2013, No. 9 of 20 October 2013, by Decree No. 9 of the Shanghai People's Government Ordinance No. 9 of 1 March 2014)

Chapter I General

Article 1

In order to strengthen the management of non-moil vehicles, to guarantee the safety and accessibility of road traffic, to protect the legitimate rights and interests of citizens, legal persons and other organizations, to develop this approach in line with the laws, regulations, such as the People's Republic of China Road Traffic Safety Act, the People's Republic of China Product Quality Act, the People's Republic of China Road Traffic Safety Act.

Article 2

This approach applies to the production, sale, registration, movement and related management activities of non-mocile vehicles in the city's administration.

Article 3

The Municipal Public Security Agency is the administrative authority for the management of non-modile vehicles in the city. The transport management of the public safety authority is specifically responsible for the registration and movement of non-mobile vehicles.

The quality technical supervision sector is responsible for monitoring the quality of non-modile vehicle production.

The business administration sector is responsible for monitoring the sale of non-modile vehicles.

Sectors and units such as economic informationization, transport construction, environmental protection, urban administration, administrative law enforcement and disability associations are responsible for the management of non-moile vehicles in accordance with their respective responsibilities.

The zones, the people's governments are responsible for organizing the management of non-modile road parking in the relevant sectors.

Article IV

In accordance with urban road traffic development needs and environmental protection realities, the city has implemented a total of controls or measures to phase out specific types of non-moil vehicles.

Chapter II

Article 5 (Security technical requirements)

Non-mod vehicles produced and sold in this city should be in compliance with the relevant national standards.

The recommended project on power motives in national standards for electric vehicles, gas emissions from national standards for mobile chairs for persons with disabilities, is enforced in this city.

Article 6

The city introduces a product inventory management system for electric vehicles that meet the requirements of the State and the city's standards, mobile wheelchairs for persons with disabilities. Electrical vehicles, mobile chairs of persons with disabilities, which are not included in the product catalogue due to non-compliance with the requirements of the State and the present city, shall not be sold and registered in the city.

The directory of ITU's own vehicle products is developed by the Urban Economic Intelligence Commission and the City Quality Technician, the Municipal Chamber of Commerce and Industry, the Municipal Public Security Agency, the Urban Environment Agency and the relevant industry associations. The directory of mobile chairs car products for persons with disabilities is developed by the Urban Economic Intelligence Commission, the Municipal Disability Federation and the municipalities' Quality Technicians, the Municipal Chamber of Commerce and Industry, the Municipal Public Security Agency and the Urban Environment Agency.

Article 7

Article 8

The owner of electric vehicles, the chairs of mobile chairs of persons with disabilities should be accentuated at the sales sites to present the existing effective product catalogues and to make consumer commitments to sell their vehicles into the product catalogues, including through the hotels and the sales vouchers.

Consumer purchases of electric movable vehicles, mobile chairs of chairs for persons with disabilities who are not included in the product directory could be required by law.

Article 9

The prohibited units and individuals engage in the following acts:

(i) Filling non-modile vehicles;

(ii) Instruction of power devices, seating, high-broad audio or unauthorized tents on non-moil vehicles;

(iii) Changes in the size of non-mocile vehicles or unauthorized replacement of power devices;

(iv) The removal or modification of the audio, restricted and end-of-trainal treatment devices;

(v) Other changes in the technical parameters of the non-modile vehicle customization, loading and reloading that affect the safety of non-moil vehicles.

The sale of scripts, loadings and reloaded non-modile vehicles is prohibited.

Article 10 (Report of complaints)

In violation of the law, the sale of non-modile vehicles, units or individuals may report, file complaints to the quality technical supervision sector, the business administration sector. The quality technical supervision sector, the business administration sector, after having received reports and complaints, should be promptly checked by law.

The quality technical supervision sector, the business administration sector should inform the relevant sectors and units, such as the Municipal Economic Informationization Commission, the Federation of Disabled Persons.

Article 11 (Coherence mechanisms)

The public security authorities, the quality technical supervision sector, and the business administration sector have established coordinated enforcement mechanisms.

Public security authorities have found that the production of non-modile vehicles is in violation of the law and should notify the quality technical supervision sector, the business administration sector, the quality technical supervision sector, and the business administration sector, in a timely manner, in accordance with the law. Public security authorities should be stopped and addressed in accordance with the law by impeding the performance of duties by the quality technical supervision sector, the business administration sector.

Article 12 (Environmental requirements)

Article 13

This city introduces an updated subsidy system for mobile chairs for persons with disabilities. The mobile chairs of persons with disabilities that have been registered have been sent to the designated unit for recycling, which is subsidized by the Disability Federation.

Chapter III

Article 14.

The following non-modile vehicles should be registered by the transport management of the public security agencies in this city, with a non-modile vehicle number and a vehicle licence (hereinafter referred to as non-moil vehicle brands).

(i) Electrical vehicles;

(ii) Mobile wheelchairs for persons with disabilities;

(iii) Three human wheels;

(iv) The Government of the city stipulates that other non-modile vehicles should be registered.

Self-cycles, cranes chairs of persons with disabilities are registered voluntarily, all of whom apply for registration plates, and the transport management of public security agencies should be processed.

Article 15

For non-mod vehicles under article 14, paragraph 1, of this approach, all of them should, within 15 days of the date of the purchase of the vehicle, apply for registration by the transport management of the public security authorities, receive the following material:

(i) The identity of the owner of the lawful non-modile vehicle, such as identification, a household or a licence to operate;

(ii) The purchase of vehicle vouchers or other non-motive vehicles are lawfully certified;

(iii) A certificate of eligibility for non-modile vehicles;

(iv) Other material requested by the Transport Administration of the Public Security Authority.

All applications for the registration of a mobile chairs vehicle for persons with disabilities should be made available to the localities of the Standing Household Correspondents, to the transport management of the local public security authorities, in addition to the material provided in the preceding paragraph, and to the relevant certificates from the Federation of Persons with Disabilities.

Article 16

The mobile chairs vehicle for persons with disabilities is limited to those eligible for registration, and each person can be registered.

Three human vehicles are restricted to units such as municipalities, sanitation and others to register for operational requirements.

Article 17

Non-mod vehicles on applications for registration should be checked by the transport management of the public security authorities. The material is fully and in accordance with the provisions and should be registered and issued without the registration of a non-moile vehicle brand, and the reasons should be given in writing to the applicant.

Non-modile vehicle cards are harmonized by the transport management of public security agencies.

Article 18

Non-moile vehicles that have been registered are one of the following cases, and non-modile car owners should refer to the transport management of the public security authorities for a change registration:

(i) The replacement of vehicles and vehicles;

(ii) replacement of vehicles for quality reasons;

(iii) The replacement of power-efficient devices for persons with disabilities in line with safety technology requirements;

(iv) Changes in the location of the permanent household chairs for all persons with disabilities.

Article 19 (Transfer registration)

The transferee of non-modile vehicle titles that have been registered have been transferred, and the transferee of non-mocile vehicles should refer to the transport management of public security agencies to apply for registration.

Three human vehicles are not registered for transfer.

Article 20

Non-moile vehicles that have been registered have stolen, lost, lost or removed for quality reasons should apply to the transport management of public security authorities for write-off registration.

Article 21

Non-mod vehicles damaged, lost, and non-modile vehicles should be sent to the public security authorities for vehicles to apply for the replacement or replacement of non-modile vehicles.

Article 2 (Promotion of non-mobile vehicles in the municipality of Orientale Province)

The non-modile vehicles in the town of the province need to be made available in the city, and all non-moile vehicles should be registered in accordance with the provisions of this approach to the transport management of the public security authorities, obtaining a non-modile vehicle brand in the city.

Article 23

The transport management of the public security authorities should make registration of conditions, procedures, submissions and requests for demonstration texts to society and facilitate the registration of non-modile vehicles by the urban population, including through additional registration points, simplification of procedures.

Article 24 (Education)

The transport management of public security agencies should strengthen their road traffic safety awareness, in conjunction with non-moil vehicle registration management.

Article 25

Specific approaches to the registration of non-modile vehicles are developed by the Municipal Public Security Agency.

Chapter IV

Article 26

The following non-modile vehicles can take the road.

(i) Be registered as a vehicle of power, mobile chairs for persons with disabilities, and three human wheels;

(ii) Separate cars, cranes chairs for persons with disabilities;

(iii) The Government of the city provides for other non-modile vehicles available.

New purchase vehicles should be registered, and the driver could receive a ticket for the purchase of the vehicle for temporary movement within 15 days of the purchase.

The road is prohibited from other non-modile vehicles other than the provisions of paragraph 1, paragraph 2.

Article 27

Drivers have been registered for non-modile vehicles and should be subject to the vehicle vehicle's licence and, in accordance with the provisions for the installation of a non-moile vehicle number, to maintain a clear, complete and no intentional shield and humiliation.

Article 28 (Basic security requirements)

Article 29

The driving of non-modile vehicles should be guided by road safety laws, regulations on road traffic and the following provisions:

Article 33 (Specific provisions for passage)

In addition to compliance with article 29, the following provisions should be observed:

(i) The driver has attained the age of 16 years;

(ii) Not more than 15 km at the highest level;

(iii) No person with disabilities may be driving a mobile wheelchair vehicle for persons with disabilities.

Article 31

The following provisions should be observed:

(i) Drivering a minor under 12 years of age, with the exception of a hiding vehicle;

(ii) Drivering their own vehicles, sing their own vehicles with minors under six years of age and using fixed chairs;

(iii) The driving of minors under 16 years of age shall not be carried out.

Article 32 (Staker provisions)

Non-modile vehicles should be subject to the following provisions:

(i) In their own vehicles, electric motorcycles, persons with disabilities, cranes chairs, mobile chairs cars for persons with disabilities, with a high degree of no more than 1.5 metres from the ground, and lens must not exceed 0.15 m before the vehicle, and not later than the vehicle, and at the end of the period no later than 0.3 m;

(ii) Three rounds of vehicles, with a high altitude not exceeding 2 metres from the ground, shall not exceed 0.2 metres of the vehicle and the length shall not exceed 1 m;

Article 33 (Cessation of roads)

Non-moile vehicles should be stopped on the road.

Regions, zones should be structured in accordance with non-mobile road parking norms, the development of planning for non-mobile road parking sites in the region, districts and counties, the designation of specialized management to implement the establishment of non-moil vehicle road parks and the establishment of a specialized management team to strengthen the day-to-day management of non-moil road parks.

Article 34 (Up parking space)

Transport sites such as vehicle stations, terminals, orbital traffic sites, as well as hospitals, schools, chambers, tradefields, trade markets, walks, theatres, sports parks, exhibitions, etc., should be established by the operators to establish parking spaces dedicated to non-modile vehicles and to carry out the management of specialized service institutions.

Article XV (non-moil vehicle insurance)

The city encourages non-moile car drivers to insured third-party liability insurance, physical injury insurance and property loss insurance.

Chapter V Legal responsibility

Article XVI (Guide provisions)

In violation of the provisions of this approach, the Law on Road Traffic Safety of the People's Republic of China, the Regulations on Road Traffic Safety of the People's Republic of China, the Regulations on Road Traffic Management of the Shanghai City are regulated by laws, regulations and regulations.

Article 37 (Criminal penalties for the production, sale of non-modile vehicles in violation)

In violation of article 5, paragraph 1, of this approach, the production, sale of non-modile vehicles that are not in compliance with national standards is dealt with by the quality technical supervision sector, the business administration sector, in accordance with the provisions of the People's Republic of China Product Quality Act, the Shanghai Market Product Quality Regulations.

In violation of article 6, paragraph 1, of the present approach, the sale of electric vehicles that are not included in the product catalogue, the mobile wheelchairs of persons with disabilities, is fined by over 5,000 dollars in the Business Administration.

In violation of article 8, paragraph 2, of the present approach, the refusal was addressed by the business administration in accordance with the provisions of the Consumer Rights Protection Act of the People's Republic of China.

Article 338 (Criminal punishment for filing, loading, conversion of non-moil vehicles and their sale)

In violation of article 9 of the present approach, the business administration sector is fined by the quality technical supervision sector, in accordance with its respective responsibilities, of over $20,000.

Article 39 (Criminal penalties for non-moil road traffic safety offences)

In violation of article 14, paragraph 1, article 26, paragraph 3, of the present approach, provides for the driving of undocumented non-moil vehicles or forbiding the movement of non-modile vehicles, with a fine of up to $50 million from the Transport Administration of Public Security.

In violation of article 27, paragraph 1, 28, article 29, paragraph 1, article 29, article 30, article 31, article 32, article 33, paragraph 1, of the scheme, the Public Security Agency's Transport Administration warnings or fines of up to $50.

In violation of article 27, paragraph 2, of the present approach, theft, conversion or use of non-modile vehicle brands, and the non-modile vehicle plates using other vehicles are fined by 50 million dollars in the Transport Administration of Public Security; in serious circumstances, by more than 1000 dollars.

In violation of article 29, paragraph 2, of the present approach, the driving of the self-washing vehicle, the man's three buses, which are being redirected by the public security agency's transport management orders, warnings or fines of up to 50 dollars, driving other files, loading, reloading of non-modile vehicles, with the responsibility of the transport management authorities and placing over 500,000 fines.

In violation of article 33, paragraph 1, of this approach, non-modile vehicles are not stopped at a no-moile vehicle road terminal, affecting the movement of other vehicles and operators and the absence of actors on the ground, and the transport management of the public security authorities can clean on the ground with the urban administration of administrative law enforcement services.

Article 40

In violation of this approach, it constitutes a violation of the management of the law, punishable by law by public security authorities; constitutes an offence punishable by law.

Article 40

In violation of this approach, the relevant executive branch and its staff have one of the following acts, either by the unit or by the superior authorities, to be administratively disposed of by law to the competent and other direct responsible personnel directly responsible; and to be held criminally liable under the law:

(i) Non-modile vehicle production and marketing oversight functions are not carried out in accordance with the law and are not subject to the law of the commission of unlawful production and sale of non-modile vehicles;

(ii) Non-modile vehicle registration and movement management functions are not carried out in accordance with the law and are not subject to the lawful conduct of non-moile vehicles;

(iii) No law enforcement can be determined or in violation of the statutory procedures;

(iv) Other abuses of authority, omissions, provocative fraud.

Annex VI

Article 42

Those who had been purchased prior to the publication of the scheme but had not been included in the product's directory, all of whom had been able to obtain a provisional pass to the public security authorities within six months of the date of implementation of the scheme, which could take place within three years from the date of implementation of the scheme and adhere to the provisions relating to the management of non-mocile vehicle traffic; they would not have access to roads.

The specific approach to the management of the former is developed by the Municipal Public Security Agency.

Article 43

This approach has been implemented effective 1 March 2014. The non-modile vehicle management approach in the Shanghai City was also repealed by Decree No. 108 of 19 September 2001.
