Methodology for the management of guided personnel in the provinces of Zangang

(Act No. 227 of 27 November 2006 of the People's Government Order No. 227 of 27 November 2006 amended by the Decision of the People's Government of the Zangang Province to amend the nine regulations, such as the Modalities for the Management of the River Province, issued by the People's Government Order No. 321 of 13 March 2014)

Chapter I General

In order to regulate the guided tour activities, to guarantee the legitimate rights and interests of tourists and practitioners, to maintain a tourism market order and to promote the development of tourism, to develop this approach in line with the provisions of the Guideurs Regulations (hereinafter referred to as the Regulations) and other relevant laws, regulations.

The second approach refers to the acquisition of guided tour guide documents (including the Tour guide, the BAU and the Tourricane Touritories), which are assigned to travel agencies, sites' tourist service units to provide tourists with access, referrals and related tourism services, including the National Tourit, the Lobby and the Tourface.

The guided tourers may establish self-regulatory industrial organizations, in accordance with the law, to strengthen industrial self-regulation and to preserve their legitimate rights and interests. To guide and monitor the authorities of the tourism industry, in accordance with laws, regulations, regulations and statutes.

The executive authorities of the tourism industry should listen to the views of the organization's self-regulatory industry to address the problems in the management and service of the guided toured industry in a timely manner.

Chapter II

Article 7 provides for a national uniform examination system for guided tours, the eligibility of expatriate team personnel, which is organized by provincial tourist administrative authorities.

The qualifications of the guided tours in the landscape area apply to the provincial uniform examinations system, which is carried out by the municipal tourism administration authorities of the provincial tourist administrations.

Specific matters such as the examination directory, the issuance of the quasi-auction certificate are handled by the administrative authorities of the district (communes, areas).

Article 8

The National Toburs, the expatriate team's eligibility examinations are published by provincial tourist administration authorities. The qualification examinations for the guided tours in the landscape area are published by the local authorities in the city or in the district (market, area).

Article 9 shall apply for participation in the qualification examinations for guided tours, subject to the following conditions:

(i) Nationality of the People's Republic of China;

(ii) Higher secondary, secondary or higher education;

(iii) Physical health;

(iv) The right to guided tour knowledge and language expression, which should also be accompanied by a corresponding level of exonyms.

Article 10 Applications for participation in the qualification examinations for guided tours shall submit the following materials:

(i) Applications for registration forms;

(ii) Identification certificates;

(iii) Related academic certificates.

Article 11. Applications for participation in the qualification examinations for guided tours should be presented to the executive authorities of the tourism industry in the district (markets, districts) where the work is or where the household is located. The executive authorities of the district (markets, districts) shall be given the Toolkit by 10th examinations.

Article 12 Licence examinations for guided tours are divided into probationary and oral trials. Persons with the above-mentioned qualifications of the specialised colleges of guided tours may be dismissed. Persons with higher education in the foreign language can be dismissed.

Article 13

The qualification of the examinations is given to the executive authorities of the tourism industry to receive a guide certificate.

Article XIV The Tourcing Licence, the Leader's Licence is granted by the provincial tourist administration authorities or by the municipal or district (market, area) tourist administrative authorities in which they are entrusted to the establishment area; and the Tourit Licence of the Landscape Zone is granted by the municipal or district administration authorities (market, district).

Article 15. The executive authorities and their affiliated units shall not organize mandatory and mandatory pre-qualification examinations for guided tourers and shall not designate educational materials or other assistance materials.

Chapter III

Article 16 Persons who have obtained the Tourcing Licence or the Leader's Licence are required to perform the business, shall enter into a labour contract with the travel agency or register with the guided service company, with the labour contract signed or the registration of the material, and apply to the provincial tourist administrative authorities.

Those who have obtained the Tourcing Licence of the Landscape Zone require the executive branch to enter into a labour contract with the tourist service units in the landscape area and to submit an application for the operation to the city's administrative authorities in the area.

Article 17

The applicant should be informed in writing and the reasons for the non-approved business.

In one of the following cases:

(i) There is no civil capacity to conduct or to limit the capacity of civil conduct;

(ii) STIs;

(iii) Be criminally sanctioned, with the exception of miscarriage or rehabilitation and the qualifications and capabilities of the guided tour;

(iv) Removal of guided tour guide documents.

Article 19 provides for a period of three years for the operation of the guided tour documents, which is compiled by the provincial tourist administrative authorities in accordance with the national regulations.

The travel administration organizes the qualification examinations for guided tours, nuclear licensitization documents and guided tours documents, which should be in compliance with the provisions of the State and the province relating to the management of administrative expenses and shall not be charged with the offence.

In one of the following cases, guided tours need to continue their work, and requests to be made to the executive authorities of the nuclear-produced guided tour guide documents:

(i) A labour contract with a new travel agency, a tourist service unit in the landscape area or registered in a new Tourin Services company;

(ii) A high-level degree of qualification for guided tours, subject to the examination of qualifications, will require the receipt of the corresponding guide documents;

The requested information is fully and in accordance with the requirements, and the administrative authorities responsible for the receipt of the request shall be converted to the guide documents at the time.

The guided tourers will need to continue the period of effectiveness of the guided tour documents and shall apply to the administrative authorities of the tourist industry that have been dispatched to the nuclear guided tour documents by the expiry of three months prior to the expiry of the effective deadline. The executive authorities of the tourist application shall decide whether to grant continuity before the expiry of the period of effectiveness; the decision to be taken without delay shall be considered to be extended.

Article 21, the loss of guided tour documents, should be applied in a timely manner. The Tourism Administration shall be granted within one working day of the date of receipt of the request for additional requests.

Article 2 personnel with specific language capacity, while not eligible for the guided tour guide personnel, the travel agency, the site-based tourist service units are required to carry out the guided tour activities on a temporary basis, and the travel agency, the terminal tourist service units can apply to provincial tourist administrative authorities for the receipt of the Interim Tour guide, the Interim Architects, or the Touritories Touriting Certificate (hereinafter referred to as provisional guide documents).

The provincial tourist administrative authorities shall take decisions within five working days of the date of receipt of the request for provisional guided tour documents. In order to meet the conditions, the issuance of provisional guided tours documents should be communicated to the applicant in writing and justified.

The provincial tourist administrative authorities may entrust the establishment of a temporary guided tour documents to the local or district (market, area) tourist administrative authorities.

The provisional guided tour document shall not be effective for a period not exceeding three months; it has been repeated, with an effective period not exceeding three months in one year.

Article 23. Toury documents are restricted to their own use and cannot be forged, modified, borrowed or sold.

In the course of the operation, the guided tour guide documents should be assembled. No guide card is prohibited to carry out the guided tour operation.

The guided tours in the landscape area shall operate within the scope approved by the Toury of the Landscapes.

Article 24

Article 25 In the course of the operation of the guided tours, the reception plans of the assigned units shall be held and, in accordance with the operation of the travel contract signed by the dispatched units with the tourists, no unauthorized increase, reduction of the tourism project or suspension of the guided tour activity. Changes in the reception plan should be accompanied by written consent of the boarding units and tourists; the consent of the tourists and the receipt of service documents should be obtained as a result of the increased cost of contract changes.

The travel agencies, the tourist service units in the landscape area require the mutual borrowing of guided personnel for tourist missions, and borrowing agreements should be concluded.

Targets are used for the guided tour services in the landscape area. Tours in the landscape area should be delivered to tourists in accordance with the commitments made by the tourist service units in the landscape area.

Article 26

(i) The unauthorized suspension of the guided tour activity without the completion of the travel space;

(ii) To pay a small fee (consumables) to tourists in an express or implied manner;

(iii) selling, selling or buying goods to tourists;

(iv) In violation of the agreement of the tourism contract, without the consent of the tourists to arrange purchases or to impose goods and services;

(v) Deceive, coerctive tourist consumption or collusion with operators, deception and coercion of tourist consumption;

(vi) Removal, deduct or other interest to operators offering commodities or services to tourists;

(vii) Dispersion of elements that undermine the sovereignty, the dignity of the person and the violation of the socialist ethics;

(viii) Other acts prohibited by law, regulations and regulations.

The dignity of the person should be respected in the course of the operation of the guided tours, and its physical integrity was not violated. In one of the following cases, the guided tourers have the right to reject:

(i) The requirement to humiliate its human dignity;

(ii) In violation of its unreasonable requirements for ethics;

(iii) Requirements incompatible with our national customs practices;

(iv) Other acts prohibited by law, regulations and regulations.

Article 28, when guided tours operate, should guarantee the safety of tourists; in cases where tourists may endanger the safety of the tourists, they should make a true statement or a clear warning to the tourists and take measures to prevent the occurrence of harm, as required by the safety and productive management, the tourism administration and the travel agency or the local tourist service units.

In the event of emergency situations that may endanger the safety of tourists, with the consent of the majority of tourists, the guided tourers can adjust or change the reception plans, but they should be reported immediately to the team's travel agencies or to the local tourist service units.

When the tourists are physically damaged, the guided tourers should take effective rescue measures and report to the team's travel agencies in a timely manner or to the local tourist service units.

Article 29, the tourists have the right to submit complaints to the tourist administrative authorities for violations of the provisions of the scheme. The administrative authorities of the tourism industry should promptly investigate verification and inform the complainant of the proceedings.

Article 33 Travel agencies or guided services companies, the tourist service units in the landscape area shall enter into a labour contract with guided tours in accordance with the relevant provisions of the State and the present province, pay the salary of the guided tours shall not be lower than the minimum wage for local enterprises and pay the social insurance expenses in accordance with the law; and pay reasonable compensation for non-time or temporary visitors to their labour.

Chapter IV Legal responsibility

Article 31 provides for violations of the provisions of this approach, which are regulated by the Regulations or other relevant laws, regulations.

In violation of this approach, one of the following acts is punishable under articles 18, 19, 20 and 22 of the Regulations:

(i) Excellencies to increase or reduce tourism projects;

(ii) Recurrent changes in reception plans;

(iii) Urgent suspension of guided tour activities;

(iv) No guided tour guide activities;

(v) Private self-help operations without travel boards;

(vi) To carry out guided tour activities at a level of patience and undermine national interests and national dignity.

Article 33 Operators violate the provisions of article 20, paragraph 1 (i), (iii), of this approach, and do not provide for the conversion of new guided tours documents, which are converted by the administrative authorities at the district level and above, and which have not been corrected, may be fined up to $50 million.

In violation of article 23, paragraph 1, of this approach, the executive authorities of the city-level tourists are treated in accordance with the following provisions:

(i) Removal orders and fines of up to 1000 dollars;

(ii) Reimbursement, counterfeiting or selling the guided tourcing documents, with a fine of up to $3000 million in 2000; in serious circumstances, a fine of up to €300,000 and published.

Article 35, in violation of article 25, paragraph 3, of the present approach, provides that the guided tours in the landscape area exceed the payment of standard-based services, are warned by the district (market, area) price administration authorities and may be fined by more than 500 dollars.

Article XVI, guided tours, contrary to article 28 of this scheme, do not provide a true statement to the tourists or a clear warning of the safety concerns of the tourism industry, with a fine of more than 5,000 dollars from the administrative authorities of the district level, without the requirement for preventive measures, or if an accident has not been taken effective rescue measures or has not been reported in a timely manner, with a fine of more than 300,000 dollars being paid by the administrative authorities at the district level.

Article 37 Travel agencies or guided tours services companies, sites' tourism services units do not pay wages to guided tours or team personnel less than the minimum wage for local enterprises in accordance with the relevant provisions of the State and the province concerned, and are processed by the administrative authorities at the district level above in accordance with the relevant labour security laws, regulations and regulations.

Article 338, which causes losses to tourists due to the fault of the guided tours, is paid by the law by the travel agency or by the guided tour service company, the tourist service unit in the landscape area, which is sent by the Third Committee, and the travel agency or the guided tour service company, the tourist service unit in the landscape area, may be paid to third parties.

Article 39 of the Tourism Administration and its staff are one of the following cases, either by their units or by administrative inspection bodies, for administrative or disciplinary treatment of the competent person directly responsible or other directly responsible personnel; and constitutes a crime and is criminally criminalized by law:

(i) No matter of examination is published in accordance with the provisions;

(ii) No examination shall be granted in conformity with the conditions of the examination;

(iv) To grant to those who do not meet the prescribed conditions, the guided tourcing documents or the guided tour guide documents;

(v) Organizing mandatory pre-emptive pre-school training to designate teaching materials or other assistance materials;

(vi) Other acts of negligence, abuse of authority, favouring private fraud.
