(July 4, 2003 the State administration of work safety, State administration of coal mine safety supervision Bureau announced the 6th) Chapter I General provisions article in order to regulate the coal mine safety facilities of construction engineering supervision work to ensure coal mine safety production, according to the law, the coal mine safety supervision of production safety regulations as well as relevant provisions of laws and administrative regulations, this provision is enacted.

    Article fourth coal mine safety facilities of construction projects design and construction shall conform to the engineering construction compulsory standards, coal mine safety regulations and industry technical specifications.
    Article fifth coal mine construction projects construction, their designs of safety facilities should be reviewed by the coal mine safety supervision organization agreement completed and put into production or use, its safety and security conditions should be qualified by the coal mine safety supervision agencies.
    Article sixth design of coal mine safety facilities of construction project completion review and acceptance, by the coal mine safety supervision organization design or add new production capacity, responsible for grading.
    (A) the design or the production capacity of 1.2 million tons/year of underground coal mine construction projects and more than 4 million tons/year of open pit coal mine construction project, designed by the State administration of coal mine safety supervision Bureau is responsible for review and acceptance.
    (B) the design or the production capacity of 450,000 tons/year more than 1.2 million tons/year of underground coal mine construction projects and 4 million tons/year of open-pit coal mine construction projects, from the provincial coal mine safety supervision Bureau is responsible for the design review and acceptance.
    (C) design or production capacity of 450,000 tons/year of underground coal mine construction project, designed by the coal mine safety supervision Office was responsible for review and acceptance.
    Seventh is not the establishment of coal mine safety supervision authorities of provinces, autonomous regions, provinces, designated by the autonomous regional people's Government is responsible for the work of the coal mine safety supervision Department is responsible for the provisions of article sixth of the second item, third item of design review and acceptance.
    Article eighth by the provincial coal mine safety supervision organizations and coal mine safety supervision Office for examination and approval and acceptance of the project, should be reported to the coal mine safety supervision organizations at a higher level for the record.

    Design review of the 15th chapter designs of safety facilities in mine construction projects shall be reviewed by the coal mine safety supervision organization agreement without consent of the review, not construction. 16th designs of safety facilities in mine construction projects should be designed by a qualified entity.

Article 21st coal mine safety supervisory bodies to review the designs of safety facilities in mine construction projects shall review the applications received within 30th review has been completed.
    Upon agreement, should be approved as a file; do not agree, it shall submit a review, and reply in writing.
    22nd coal mining enterprises of coal mine safety facilities of construction projects approved design needs drastic changes, shall be subject to the review body for examination and approval.
    The fourth chapter construction and joint commissioning 23rd coal mine safety facilities of construction projects should be borne by the construction unit with appropriate qualifications.
    Construction units should be in accordance with the approved safety equipment design and construction, and responsible for the quality of safety facilities. 24th construction units during the construction period, find designs of safety facilities in mine construction projects unreasonable or when there is a major accident hazards should cease construction immediately and report coal mining enterprises.
    Required significant changes to the designs of safety facilities of coal mining enterprises shall, in accordance with the provisions of this article 22nd to review.

    Joint commissioning should be not less than 1 month, but shall not exceed 6 months.
    Joint commissioning of coal mine construction projects should be approved by the competent authorities, and in accordance with the provisions of the present article sixth coal mine safety supervision organization record.
    27th joint commissioning of coal construction project during the coal mining enterprises shall establish reliable safety measures, site testing, inspection, collection of relevant data, and prepare a joint commissioning report.

    (G) the safety assessment report and (VIII) other matters described. Article 32nd coal mine safety watchdog received upon acceptance of the application, shall review the report information and organize the site acceptance.
    Has following case one of of, for acceptance not qualified: (a) security facilities and security conditions not meet design requirements, or not through engineering quality certification of; (ii) security facilities and security conditions cannot meet normal production and using of; (three) not by provides established safety management institutions and equipped with safety management personnel of; (four) Manager and special job personnel not has corresponding qualification of; (five) not meet national coal mine security monitored Council provides of other conditions of.
    Article 33rd coal mine safety watchdog for coal mine construction project safety facilities and safety conditions for acceptance, shall from the date of receiving the application for acceptance within the 30th checked, signing the qualified or unqualified opinions and written replies. The sixth chapter supplementary articles

    34th in violation of this provision, by the coal mine safety supervision organization or province, designated by the autonomous regional people's Government is responsible for safety production of coal mine safety supervision work of the Department in accordance with administrative penalties against illegal acts and the coal mine safety supervision administrative penalties administrative penalty constitutes a crime, criminal responsibility shall be investigated according to law.
