    Provisions of this article applies to the People's Republic of China in the field of (excluding Hong Kong S.A.R., and Macau S.A.R. and Taiwan) in accordance with CCAR-121 and CCAR-135 for commercial operation of aircraft, according to investigations by the competent civil aviation authority under the State Council organization of major accidents, the State Council authorized the special major civil aircraft flight accidents investigation.
    Provisions of this article the following terms are defined as follows: civil aircraft flight accidents, refers to in the course of a public air transport, any person who boarded the aircraft ready to fly up, until it reaches its destination point within the period left the aircraft and the operation of aircraft incidents which lead to injury or death.

    Chapter II eighth flight of civil aircraft accident report after the accident, found that incidents of units or individuals shall immediately report the accident information Civil Aviation Administration, local civil aviation authority or the Agency, the local people's Government.
    Local civil aviation authority or its agency received information after the accident shall immediately report to the Civil Aviation Administration, and maintaining liaison with the Civil Aviation Administration of smooth, while the local people's Government.
    People's Government of the accident after receiving relevant information, level in accordance with the relevant provisions of the report and the local civil aviation authority or its agency.
    Nineth air traffic controllers lost contact with civil aircraft within the stipulated time, shall report for the first time the Civil Aviation Administration.

    20th after an emergency start, falling within the scope of these provisions to civil aircraft flight accidents, and disposed of by the national incident command post during the first hours of flight specified accident management coordination group, coordinated the emergency of civil aircraft flight accidents, coordination of public air transport enterprise and liaison between the families, and assist the investigation teams to carry out investigations.

    Public air transport enterprise of family assistance plan any changes shall be reported to the Civil Aviation Administration in the revised 10th record.
    32nd public air transport enterprise after learning of the civil aircraft flight accidents, should be immediately launched emergency response plans, and report the first time civil aviation administration.

    34th public air transport enterprise shall, as soon as possible has been informed that the victims, survivors, families of the missing notification and should be based on onboard information checked and boarding information be amended.
    35th to the co-ordination Group a public air transport enterprise shall provide certified copies of information on, and report further to verify the situation.
    36th article public air transport enterprise should to killed who, and survivors, and missing family provides assistance, including: (a) family starting, and arrived, and left accident site of traffic convenience; (ii) for family select meet requirements of live and activities places and other necessary of logistics guarantees; (three) sent after training of personnel for family provides spirit comfort; (four) for killed who, and survivors, and missing and family provides necessary of medical health guarantees; (five) for implementation family assistance provides necessary of funding;
    (Vi) relating to civil aircraft flight accidents and other necessary assistance.

    Airport emergency plans shall be reported to the Civil Aviation Administration or civil aviation authority approved emergency plan changes shall be reported to the original approval organ for the record.
    42nd airport administrative organ shall organize regular emergency drills and emergency exercise of specific requirements in accordance with the relevant regulations.
    43rd airports should be established by the local people's Government or its agency, civil aviation authority, the Airport Authority, the air traffic management sector, public air transport enterprise and others stationed units composed of the airport emergency response leading group, responsible for the airport and its surrounding area flight of civil aircraft in emergency rescue organization and coordination.
    44th flight of civil aircraft in the airport and its surrounding areas, airport emergency rescue leading group should be in action for the first time, rescue organizations, coordination of airport fire department, Health Department, public security organs sent rescue force.
    Article 45th airport administrative organ shall assist to civil aircraft flight accidents in public air transport enterprise of the family assistance, transportation, accommodation and so on to provide convenient conditions.
    Article 46th participation in emergency rescue units in the process of emergency rescue should protect the scene of the accident and relevant evidence, avoiding moving any aircraft debris, debris, the remains of victims.
    By expanding rescue workers, prevent accidents and other reasons need to move the scene of the accident, should make logo, photograph, video or draw diagrams, make a written record.
    Any instrument within the aircraft cockpit, parts, operation casualties before the move, must be taking pictures, drawing and making records.
    Sixth chapter supplementary articles article 47th these provisions come into force on January 1, 2006.
    48th civil aircraft flight accidents other than these provisions with reference to these provisions. 49th in these provisions before the entry into force has obtained a business license for a public air transport enterprise shall, within 180 days after the entry into force of these provisions in accordance with the requirements set out in the family assistance plan submitted to the Civil Aviation Administration.
    The provisions were applied for a public air transport enterprise operating license applicants, the plan shall be submitted when applying for a business license.
                                                50th article this provision does not make specific provision relates to matters of civil aircraft flight accidents, in accordance with the relevant provisions of the State.
