Chapter III supervision and inspection

The fourth chapter legal liability
18th mining enterprises failing to establish and improve the leadership shift logging system or failing to make the leadership shift monthly plans from wells, given a warning and a fine of 30,000 Yuan; on its head in a warning, and a fine of 10,000 yuan in serious cases, temporarily suspended its safety production license according to law shall be ordered to suspend production for rectification.
19th mining enterprises of one of the following acts, to order the rectification, and a fine of 30,000 Yuan; on its head in a warning, and a fine of 10,000 Yuan:
(A) the leadership shift system not in accordance with the regulations on safety supervision and management departments;
(B) failing to notice as stipulated under the leadership shift monthly plan;
(C) failing public leadership shift well completion of monthly plans.
Article 20th mining enterprise leaders failing to fill out the shift down the shift records, duty in registration files from wells, or deception, given a warning and a fine of 10,000 yuan.
Article 21st mining enterprise leaders failing to shift down the mine enterprises in a warning, of 30,000 yuan fines; the circumstances are serious, shall be ordered to suspend production for rectification in accordance with law; violation of provisions of the mining enterprise leaders treated as absent without leave, and a fine of 10,000 yuan.
22nd production safety accidents and not shift well under the leadership of mining enterprises according to law shall be ordered to suspend production for rectification, suspension or revocation of safety production license, and fined in accordance with the following provisions are serious, the attention of the relevant people's Government, be closed down according to law:
(A) the General accident, 200,000 yuan in fines;
(B) the larger accident, 500,000 yuan in fines;
(C) the major accident, a fine of 2 million Yuan;
(D) major accidents occur, the fine of 5 million Yuan.
Article 23rd production safety accidents and not shift well under the leadership of mining enterprises, its Chief withhold or revoke a safety certificate in accordance with law, and fines in accordance with the following provisions:
(A) the General accident, fine at previous annual income 30%;
(B) the larger accident, fine at previous annual income 40%;
(C) the major accident, fine at previous annual income 60%;
(D) major accidents occur, fine at previous annual income 80%.
Primarily responsible for grave and extremely serious production safety accidents of mining enterprises, heads of the main life shall not hold any mining Enterprise Manager (President and General Manager).
The fifth chapter by-laws
