Taxi driver qualification regulations
(December 26, 2011 Ministry of transport [2011] the 13th release since April 1, 2012) Chapter I General provisions
First in order to regulate the taxi drivers working to improve taxi services, according to the relevant regulations of the State, this provision is enacted.
The second taxi driver qualifications apply to the provision of article.
Third countries engaged in taxi service driver to implement professional qualification system.
Professional qualification system involving examination, registration, continuing education and qualification documents management system.
Fourth taxi driver qualification management should be fair, just, open and accessible.
Article fifth taxi drivers shall operate, being honest and trustworthy, civil service and security.
Sixth Department of transportation is responsible for directing the national taxi drivers ' qualification management.
Local people's Governments at or above the county level transportation departments in charge taxi driver qualification of organization and leadership within their respective administrative areas supervisory work.
Road transport authorities above the county level (including taxi authority, hereinafter the same) implementation of taxi driver qualification management of work within their respective administrative areas.
Chapter II examination
Article seventh taxi driver qualification examinations including national public accounts and regional subjects.
National public examination is the national taxi, laws and regulations, ethics, service standards, safety and other general knowledge test specification; regional examination is on taxi policy, the operation of regional geography and access to regional services, such as knowledge of the characteristics of the test.
Eighth taxi driver qualification test nationally unified examination program, according to the Ministry of transport prepared the test specification and procedure implementation. Transportation departments shall establish the corresponding examination.
National public examination questions prepared by the Department of transportation is responsible for regional examination question bank by the district, the municipal transportation authority prepared under guidance of the provincial administration of road transportation, municipalities directly under the area of examination question bank by the municipality belongs to the provincial administration of road transportation is responsible for the preparation.
The Nineth proposed taxi service driver, shall be made out of the taxi driver qualification card application form (model in annex 1), to the seat of the municipal road transportation management application for participation in the taxi driver's licensing exam.
Tenth applied for a taxi driver's licensing exam, shall comply with the following conditions:
(A) obtain a corresponding motor vehicle driver's license for more than 3 years;
(B) within the last 3 years no major more than equivalent responsibility and traffic accidents.
11th to apply for taxi driver's licensing exam, should be provided in accordance with article tenth of the information:
(A) the motor vehicle driver's license and a copy of;
(B) issued by relevant departments or units within the last 3 years of no major more than equivalent responsibility and accident record;
(C) and a copy of proof of identity.
Municipal Road 12th District transport authority to eligible applicants shall, in accordance with the taxi driver's licensing exam work conducts examinations in a timely manner.
Applicants participating in the taxi driver's licensing exam for the first time, the national public accounts and regional accounts shall apply for the first time in the exam completed. 13th district of the municipal road transport authority shall announce test scores within the test finished 10th.
Test scores are valid for 3 years.
Effective national public examination results in the country, subject test scores in the region located within the administrative area.
14th taxi driver qualification examination for national public accounts and regional subjects are eligible, districts, the municipal transport authority shall publish examination results within 10th of the issuance of the People's Republic of China Road transportation practitioners qualification certificate (hereinafter referred to as qualification). Chapter III registration
Taxi drivers of the 16th article qualification, qualification after registration shall be subject to the administration of road transportation agencies, may engage in taxi service.
Taxi driver qualification registration is valid for 3 years.

18th application qualification registration or continued registration of taxi drivers should fill out the qualifications for taxi driver registration form (model in annex 2), its qualification and taxi operators signing the labor contract or employment agreement or contract, to the location of the issuing authority and county road transportation management agencies applied for registration.
Individual taxi-operators driving a taxi engaged in business activities, its qualification certificate and the vehicle operating permit holders to apply for registration.
The 19th road transport authority accepting the application for registration shall go through the end of the registration procedure in the 5th, and affix a registration stamp in the qualification.
20th taxi driver has expired needs to be engaged in taxi service, shall, on the expiry of 30th to local city and county road transport authority renewal of registration.
21st taxi drivers do not have full legal capacity, or subject to criminal penalties and criminal penalties have not yet been completed, refuse to continue registration.
22nd taxi drivers within the qualification period of registration, and taxi operator terminates the labor contract, employment agreement, or contract, shall be reported to the registry in the 20th, and apply for cancellation of the registration.
Taxi drivers of changing service should be registered again.
The fourth chapter continuing education
23rd taxi driver during the registration period should be required to complete continuing education.
Continuing education cycle taxi driver qualification date of registration.
24th taxi drivers continuing education cycle for 3 years. Taxi drivers in each successive calculation period of continuing education shall receive no less than 54 hours of continuing education.
Today taxi driver registration time for 3 years, should also receive no less than 54 hours of continuing education.
Qualification achieved over 3 years have not yet applied for registration, and registration should be completed within 1 year of no less than 27 hours of continuing education. The 25th Ministry of transport uniform rental car drivers to educational programs and to the public.
Outline the content of continuing education, including taxi-related policies and regulations, social responsibility and professional ethics, service standards, safety operations, and knowledge of energy conservation and emission reduction.
Article 26th taxi driver taxi enterprise-oriented continuing education organization. Qualified taxi enterprise by the city and county road transport authority after filing and organize continuing education for taxi drivers.
Taxi enterprise and individual taxi drivers do not have conditions of continued education, borne by other institutions of continuing education, including the following:
(A) the Department of transportation or provincial departments of transportation network for remote education;
(B) in the road transport authorities above the county level for the record of the other forms of continuing education.
27th taxi driver upon completion of continuing education shall be by taxi operators to local city and county road transport authority report, road transport management body in the taxi driver's record in the qualification.
28th road transportation management agencies should be strengthened to taxi companies and continuing education institutions of continuing education of supervision and inspection.
29th taxi firms and continuing education institutions should establish training records, continuing education programs, continuing education of teachers, student registration form included in the archive and management, under the supervision and inspection of the road transport administration.
30th taxi enterprise and further education institution in violation of the provisions of article, any of the following circumstances, the road transport authority shall order rectification:
(A) without registration allowed to engage in continuing education or continuing education for providing false information;
(B) is not organized in the continuing education program of continuing education;
(C) publishing false information of continuing education.
Fifth chapter qualification certificate management 31st taxi driver qualification card issued centrally by the Ministry of transport and to develop number sequence.
District road transport authority is responsible for the qualification of municipal issuance and management.
Article 32nd taxi driver qualification certificate is lost, damaged, shall to the original issuing authorities for certificates fill (replacement) procedure. Article 33rd taxi driver's practice qualification certificates fill (replacement) procedure, should fill out the taxi driver qualification fill (replacement) registration form (model in annex 3).
Road transport management body shall meet the requirements of the qualification certificate, fill (replacement) application to be processed.
Article 34th in engaged in taxi service, taxi drivers shall carry the qualification certificate.
35th taxi driver qualification card shall not be transferred, leased, altered, forged or altered.
The 36th cab operators shall safeguard the legitimate rights and interests of the taxi driver, registered for taxi drivers ' qualifications, continuing education and other facilities.
37th of municipal and county road transport authorities should enhance taxi drivers ' business management, to record its violations as a basis for service quality assessment.
38th of municipal and county roads transport authority taxi driver qualification file management should be established.
Taxi driver qualification file management including: licensing exam application, qualification certificate, application, registration and fill (replacement) records, records of illegal, traffic accident, continuing education record and reputation for quality of service results, and so on. 39th taxi drivers have one of the following, by the issuing authority to remove his qualification certificate.
Qualification certificate cancelled, should recover in time; unable to recover, by issuing authority notice void.
(A) the holder is deceased;
(B) the holder to apply for cancellation;
(C) the holder reaches the statutory retirement age;
(Iv) holders of motor vehicle driver's license is cancelled or is revoked;
(E) for health and other reasons to be engaged in taxi service.
40th taxi drivers have safety conditions do not have one of the following, by the issuing authority to revoke its qualification certificate, and declared void:
(A) the health status of the holder no longer meet business requirement and did not take the initiative to apply for cancellation of certificate of qualification;
(B) significantly above equivalent responsibility and traffic accidents. 41st taxi drivers in the course of operation, should be law-abiding, civilized driving, quality service.
Taxi drivers may not be any of the following acts:
(A) refuse;
(Ii) bargaining power;
(C) on the left;
(D) the intentional detour.
Taxi driver violations in the preceding paragraph of this article, continuing education should be strengthened in serious cases, road transport management body should be an extension of the registration.
The sixth chapter legal liability
42nd article violates these provisions, any of the following acts, one of the officers, the road transport authorities above the county level shall order rectification, and a fine of less than 200 Yuan more than 2000 Yuan constitutes a crime, criminal responsibility shall be investigated in accordance with law:
(A) without qualification or beyond the scope approved by the qualification, driving a taxi engaged in business activities;
(B) using invalid or forged or altered certificate of qualification, driving a taxi engaged in business activities;
(C) lend, let, falsification of qualification.
43rd article violates these provisions, taxi drivers have one of the following acts, by the road transport authorities above the county level shall be ordered to correct, and a fine of 50 Yuan and 200 Yuan the following:
(A) not in accordance with the provisions to bring qualification certificate;
(B) operational activities of register is not driving a taxi;
(C) refusing hire, bargain, dumped or deliberately detour on the way.
44th in violation of this provision, the taxi operators have one of the following acts, the road transport authorities above the county level shall order rectification, and between 3000 and 1000 Yuan Yuan the following fines:
(A) the employment of persons without qualification, driving a taxi engaged in business activities;
(B) stipulates that registration of persons employed is not, driving a taxi engaged in business activities;
(C) in accordance with the provisions organizing the implementation of continuing education.
45th in violation of this provision, road transport management and staff, one of the following circumstances, the directly responsible person in charge and other direct liable persons shall be given administrative sanctions constitutes a crime, criminal responsibility shall be investigated in accordance with law:
(A) not complying with the prescribed conditions, procedures and time limit for qualification examination and the issuance of the qualification certificate of the Organization;
(B) found the violations did not promptly investigated;
(C) to ask for or accept other people's property, and gain other improper interests;
(Iv) other illegal activities.
The seventh chapter by-laws
46th before the implementation of these provisions has been made taxi driver qualifications, may apply during the period of original documents and issue a new certificate of qualification, and in accordance with the regulations to register. 47th article of the regulations come into force on April 1, 2012.
