Pipeline safety management of dangerous chemicals regulations

    (Released January 17, 2012 the State administration of work safety, the 43rd since March 1, 2012) Chapter I General provisions

    First in order to enhance pipeline security management of dangerous chemicals, prevention and reduction of pipeline production safety accidents of dangerous chemicals and protect people's lives and property, according to the People's Republic of China Law on production safety, and the safety management of dangerous chemicals Ordinance, these rules are formulated.

    The second production units and storage of hazardous chemicals in public areas outside the plant underground, ground and aerial pipelines of dangerous chemicals and affiliated facilities (hereinafter referred to as hazardous chemical pipeline) safety management, these provisions shall apply.

    Crude oil, natural gas, coal-bed gas and city gas pipeline security management, these rules do not apply.

    Article on hazardous chemicals right to ownership or management of pipeline unit (hereinafter referred to as pipe unit) shall, in accordance with the relevant legal regulations and these provisions, implementation of safety responsibilities, establish and improve rules and regulations related to dangerous chemicals pipeline safety and implement, and accept the supervision and inspection of production safety supervision and management departments according to law.

    Article production safety supervision and management departments at all levels are responsible for pipeline safety supervision and inspection of dangerous chemicals, and in accordance with the dangerous chemicals in pipeline construction project implementation review of security conditions.

    Chapter II hazardous chemical pipeline planning

    Chapter III construction of pipelines of dangerous chemicals

    (C) the substation, power stations, water stations and other public facilities.     But conditions in protecting the safety of dangerous chemicals, for flood control and waterway except for the smooth implementation of maintenance dredging operations.

    24th in hazardous chemical pipe tunnels 1000 metres on either side of center line within the geographical scope, pipeline units found to have implementation of quarrying, mining, blasting operations, should be stopped in time, cannot be disposed of should be reported to the local production safety supervision and management departments.

    Within the geographical scope of the provisions in the preceding paragraph, from the construction of railways, roads, water is absolutely necessary to the implementation of public works, such as quarrying, blasting operations, should be in accordance with the provisions of article 25th.

    (C) in the pipe line both sides of the line 200 metres and the accessory facilities 500 meters within the geographical scope, or blasting, seismic exploration engineering mining, engineering, drilling, mining and other operations.

    26th construction implementation of the provisions of article 24th, 25th article of the job, shall comply with the following conditions:

    (A) has been developed in accordance with pipeline safety requirements of construction scheme of dangerous chemicals;

    (B) has contingency plans;

    (C) construction workers have accepted hazardous chemical pipeline protection knowledge education and training;

    (D) to guarantee safe operation of the equipment and facilities.

    27th special facilities, ever protective of the hazardous chemical pipeline facilities, tunnels and other special auxiliary facilities shall not be used for any other purpose; needed for other purposes, should agree to consent of the pipeline unit, and take the appropriate safety precautions.

    28th tube unit shall, in accordance with the relevant provisions of the hazardous chemical pipeline emergency, equipped with the appropriate emergency personnel and equipment supplies, emergency drills are regularly organized.

    Pipe production safety accidents of dangerous chemicals, piping should be immediately launched emergency plans and response procedures, and take effective measures for emergency treatment to eliminate or reduce the hazard, and immediately to the accident in accordance with state production safety supervision and management departments at or above the county level report.

    29th article on converting, shutdown, stop using hazardous chemical pipelines, pipeline units shall take effective measures to promptly and properly disposed of and solution production safety supervision and management departments at or above the county level.

    Supervision and administration of the fifth chapter

    Article 30th Provincial and municipal work safety supervision and management departments should be divided into districts according to the State administration of work safety provisions related to dangerous chemicals safety supervision and management of construction project, on the newly-built, rebuilt or expanded pipeline construction project safety review based juice review, security facilities, pilot (used) programme documentation and acceptance procedures of safety facilities.

    32nd production safety supervision and management departments at or above the county level shall receive pipeline accident report of dangerous chemicals shall report accidents in a timely manner in accordance with the relevant provisions, and according to the actual situation of accident disposal measures.

    The sixth chapter legal liability

    33rd new construction, renovation or expansion pipeline construction project without a safety review of hazardous chemicals, safety supervision and management departments shall be ordered to stop construction, rectify; fails, fines of between 500,000 yuan and 1 million Yuan constitutes a crime, criminal responsibility shall be investigated according to law.

    Hazardous chemical pipeline pipeline construction project subcontractors do not have the appropriate level of qualification of the investigation, design, construction units or delegate does not have the appropriate level of qualification of project supervision, by the transfer of production safety supervision and management departments in charge of construction sector in accordance with the regulations on the management of construction engineering quality 54th shall be punished.

    34th under any of the following circumstances, work safety supervision and Management Department ordered corrective action and may be fined not more than 50,000 yuan; it refuses, fines of between 50,000 yuan and 100,000 yuan; the circumstances are serious, shall be ordered to stop production or business for rectifications.

    (A) pipelines pipelines of dangerous chemicals is not set clearly marked or not in accordance with the provisions of pipeline inspection and maintenance;

    (B) may endanger the safety of dangerous chemical pipeline construction jobs, construction unit unit of failing to notify pipeline or pipe joint contingency plans and take appropriate protective measures, pipe or pipe unit is not assigned to the field security guidelines.

    Article 35th of production, shut down, stop using hazardous chemical pipelines, pipeline unit did not take effective measures to timely and properly disposed of, by work safety supervision and Management Department ordered corrective action and fines of between 50,000 yuan and 100,000 yuan constitutes a crime, criminal responsibility shall be investigated according to law.

    For production, production, to stop using hazardous chemicals pipeline, pipeline units in accordance with the provisions of the disposal programme of production safety supervision and management departments at or above the county level, the production safety supervision and Administration Department shall order rectification can be fined not more than RMB 10,000 yuan; it refuses, the fines of between 50,000 yuan and 10,000 yuan.

    The seventh chapter by-laws

    Public areas in 37th article of the rules refers to the plant (including chemical industrial park, industrial park) outside the area.

    Hazardous chemical pipeline subsidiary in 38th article of the rules include:

    (A) pipeline compression station, metering stations, valve room, well, emptying facilities, storage tanks, loading and unloading, loading and unloading trestle bridge, station, relief stations and other stations;

    (D) the pipeline of other ancillary facilities.

    39th before the implementation of these provisions in pipeline protection range have been built in a densely populated place and inflammable and explosive materials production, operation, storage places, should be determined by local government based on the reality on the ground, planned and step by step moving, cleaning or taking the necessary protective measures. 40th article of the regulations come into force on March 1, 2012.
