Amateur radio station management

    (Released November 15, 2012, Ministry of industry and information technology, the 22nd since as of January 1, 2013) Chapter I General provisions

    First in order to strengthen the administration of amateur radio station, maintaining the order of radio, in order to promote amateur radio activities, in accordance with the People's Republic of China of the radio regulations, these measures are formulated.

    Article in the People's Republic of China set up, using amateur radio, exercise supervision over amateur radio station management, these measures shall apply.

    Amateur radio station in these measures refers to People's Republic of China regulations on the radio frequency allocation determined amateur service and amateur satellite service required for transmitter and the receiver or transmitter and receiver combination (including ancillary equipment).

    (D) have appropriate evidence of sufficient technical capability, original and copy operation.

    Verify local radio management institution in the preceding paragraph, the fourth provided evidence of its truth, originals shall be promptly returned to the applicant.

    Article eighth set in the provinces, autonomous regions and municipalities within the amateur radio communications, Mesa established by local radio regulatory agency approval.     Dedicated on amateur radio station radio transmission equipment type approval, should be based on the People's Republic of China regulations on the radio frequency allocation for provisions of radio transmission equipment specification as the basis.

    Amateur radio station dedicated radio transmitting equipment shall not be used for other radio services, its frequency in the amateur service and amateur satellite service band.

    12th application materials are incomplete and do not comply with the statutory format, radio management institution shall, on the spot or within five working days, inform the applicant needs to supplement the entire contents.

    Application materials are complete and comply with the statutory format, and these measures, radio management institution shall, on the spot or within 20 working days from the day of acceptance of the application, issuing amateur radio station licence does not meet the required conditions, shall notify in writing the applicant not be issued amateur radio license, and explain the reasons.

    13th amateur radio station license uniformly printed by the State radio regulatory agencies. Amateur radio station licence is valid for not more than five years.

    Amateur radio station should continue to use after the expiry date of the licence, shall, before the expiry of 30th to the radio regulatory agency to apply for continuation of the licensing procedure.

    14th amateur radio station licence shall include the approved by the technical parameters and transmitting equipment, information units of ham, which license shall include the amateur radio station owner and technical director. Technical parameters of the amateur radio station shall not exceed the scope approved by the amateur radio station license.

    Need to change the content approved by the amateur radio station licence, shall apply to the licences of radio management to handle change, new amateur radio station license.

    15th end the use of amateur radio station, shall apply to radio amateur radio station license issued by regulatory agencies to apply for cancellation of license.

    16th prohibits alteration, imitation, counterfeit, resell, rent, or lend the amateur radio station license.

    17th according to the State radio regulatory bodies for the purposes of the amateur radio station license issued by any of the local radio regulatory agency, from the issuance, renewal, cancellation within 20 working days from the date of the license, reported State radio regulatory agencies.

    Chapter III amateur radio station

    Article 18th amateur radio station, subject to the following conditions:

    (A) familiar with the radio regulations;

    (B) the State radio regulatory agency operation technical ability, made operation technical ability to demonstrate.

    19th radio frequency used should be consistent with the People's Republic of China regulations on the radio frequency allocation.

    Amateur service, the amateur satellite service as a secondary service using frequencies or frequency of use together with other main business, radio management institutions shall comply with the provisions on the frequency of use.

    Amateur radio station in the radio authority approved the use of frequency bands and enjoy the equal right to use the frequencies.

    National amateur radio free radio frequency occupation fee. Article 20th amateur radio communications should be limited to amateur radio.

    In major emergencies such as natural disasters, amateur radio and non-radio communication, but shall promptly report to the local local radio regulatory agencies, their communications should be limited to directly related to disaster relief emergency or emergency-related tasks assigned by the Department.

    23rd amateur radio station set shall be effective monitoring of radio transmitting equipment to ensure normal work, guaranteed to stop causing harmful interference.

    Article 24th amateur repeaters shall cover all the amateur radio station in the region to provide equal services and all technical parameters required to use amateur Repeater open.

    25th set up communications involving two or more of the provinces, autonomous regions, municipalities or involving outside the amateur radio station, may be set up in locations outside of the platform launch operations in different places, but shall comply with the relevant provisions of local radio, where authorities.

    Prohibit the use of amateur radio station to engage in the following activities:

    (A) publish, disseminate information that violate the law or public morals;

    (B) engaging in business or other profit-related activities;

    (C) other radio communications;
(D) other activities prohibited by laws and administrative regulations.

    Radio logs should be retained for two years for the radio authority to review.

    Fourth chapter of the amateur radio call sign

    31st amateur radio station set people, users should use an amateur radio call sign.

    Article 32nd amateur radio call signs allocated by the State radio regulatory agencies and. Radio regulation institutions issuing amateur radio licences, should at the same time equipped with amateur radio call sign.

    Amateur beacon and the space units, such as amateur radio special amateur radio call signs assigned by the State radio regulatory bodies, other amateur radio call signs assigned by local radio management agencies.

    Amateur radio station license issued by the Radio Authority has set people equipped with amateur radio call signs, not otherwise assigned other amateur radio call sign.

    33rd amateur radio station on each communication building and at the end of this call shall be actively sending; letters sent should be at least every ten minutes during the call.

    Fifth chapter of supervision and inspection 37th radio regulatory agency should supervise and check the amateur radio station.

    Amateur radio station set up people, using people should cooperate.

    38th under any of the following circumstances, issuing amateur radio licences radio management institution or its superior authority may revoke the licence of radio:

    (A) is not eligible or not eligible for licensing of the applicant;

    (B) obtain a license by fraud, bribery or other improper means;

    (C) may revoke the licence by law in other circumstances.

    39th under any of the following circumstances, radio amateur radio station license issued by regulatory agencies shall be revoked licenses:

    (A) setting up amateur radio's death or incapacity;

    (B) the amateur radio station license expiration is not renewed;

    (C) setting up amateur radio unit terminated according to law;

    (D) the amateur radio station licence is withdrawn, revoked according to law.

    The sixth chapter legal liability

    40th under any of the following acts, by the radio authority in accordance with the People's Republic of China article 43rd of the radio regulations shall be punished:

    (A) permission settings, using amateur radio station;

    (B) the interference of radio services;

    (C) the change approved projects, send and receive signal regardless of the amateur and amateur satellite operations.

    41st under any of the following circumstances, radio regulatory agencies should be ordered ex officio corrections may be warned or fined not more than 30,000 Yuan:

    (A) altered, copied, forged amateur radio station license, or resell, lease, loan and other forms of illicit transfer of amateur radio station license;

    (B) theft, rent, lend, assign, without preparation or unlawful use of amateur radio call sign;

    (C) unlawful use of the dire consequences of the amateur radio station;

    (D) obtained through improper means of amateur radio station license;

    (E) no longer sets or use continue to use amateur radio ham conditions;

    (Vi) to conceal from the radio management body responsible for supervision and inspection of the situation, the provision of false information or refuse to provide authentic materials reflect its activities;

    (G) outside the approved range frequency or other acts in violation of relevant regulations of the frequency management.

    The seventh chapter by-laws

    42nd People's Republic of China overseas organizations or individuals in the setting, the use of amateur radio station in the territory, the countries or regions with People's Republic of China signed a related agreement, in accordance with the agreement; agreement has been signed, according to the provisions of these measures. 43rd these measures come into force on January 1, 2013.

    

    This approach issued before the implementation of the relevant provisions is inconsistent with this approach, in accordance with these rules.
