Special and rare coal utilization and management interim provisions
(Released 16th December 9, 2012, the national development and Reform Commission, since January 9, 2013) Chapter I General provisions
First for the protection and rational development and utilization of special and rare coal, according to the People's Republic of China coal and related provisions of the law, these provisions are formulated.
Article in the People's Republic of China territory of special and rare coal development, production management, processing and utilization activities, must comply with this provision.
Article special and rare coal in these rules refers to some kinds of coal quality characteristic, exceptional performance and significant economic value, types of coal reserves with fewer resources, including coal, coke, coal and anthracite.
Energy Bureau of national development and Reform Commission, according to the economic development needs, timely publication of special and rare coal mining areas (published the first special and the scarcity of coal mining areas, see annex).

The fifth coal industry administration departments at or above the county level shall be responsible for special and rare coal development and utilization of such supervision.
Chapter II development and construction

In accordance with the General requirements of the country, the provincial coal industry administration based on the resource reserves, market supply and demand, utilization, arrange special and the scarcity of coal for coal enterprises in the region of production.

Chapter III production management
12th State to encourage very thin coal seam, mining technology for thin coal seam, thick coal seam and encouraging manufacturers to adopt, filling-mining technology without pillar to improve resources recovery rate.
Special and rare coal mining area of recovery: not less than 88% in thin seam, thick coal seam in not less than 83%, not less than 78% in thick coal seam.
13th production enterprises shall not exceed production shall not be used backward technology, not thin thickness up, picking easy disposal difficult.
14th State encourages manufacturers in a safe, reasonable, economic condition and complex of special and rare coal mining or exploitation of corner coal residue and very thin coal seams.
15th production enterprises should develop a management system of mining areas recovery complete for assessment.
Provincial coal industry administrative departments shall regularly appraise mining areas recovery of production enterprises and examination results reported to coal industry administrative departments of the State Council.
16th State in particular and the scarcity of coal conservation in mining and give awards to units and individuals that have made outstanding contributions.
Excellent production enterprises meet the requirements and the assessment, the national development and Reform Commission gives priority arrangement in approval of coal mine projects. 17th due to geological conditions, security conditions and other reasons, caused or recycling of resources cannot be mined in coal face in mining area, manufacturers should develop programmes in a timely manner, the provincial coal industry administration departments for examination and approval before they can write off.
Management review should be reported to provincial coal industry coal industry administrative departments of the State Council, and copy to the management of land and resources departments at.
18th provincial coal industry of coal mine reserves Management Department is responsible for reviewing production enterprises annual report, will review the results of reported coal industry administrative departments of the State Council, and copy to the management of land and resources departments at.
Processing and utilization of the fourth chapter 19th State encourages coal technology research and development, increase clean coal yield.

The fifth chapter legal liability
21st article violates this requirement, do not meet the prescribed recovery rate, rectification by the coal industry Management Department; still amounted to less than the required recovery of overdue, coal production license revoked.

(A) exceed the output quotas of the provincial coal industry administration departments to arrange for production;
(B) not in accordance with the provisions of article 17th called for treatment and reported to the audit;
(C) is not in accordance with the provisions of article 18th annual report required coal reserves.
State personnel in violation of the provisions of article 23rd, favoritism, dereliction of duty and abuse of power, by their organs or authorities shall be subject to punishment constitutes a crime, shall be investigated for criminal responsibility by judicial organs.
The sixth chapter supplementary articles
24th article manufacturing enterprises in these rules refers to coal enterprises engaged in special and rare coal production.
25th article of the rules by the national development and Reform Commission and the Department of energy is responsible for the interpretation.
26th provincial coal industry administration pursuant to this provision, combined with the local district actually adopted implementing regulations, and report to the coal industry administrative departments of the State Council for the record.
The 27th article of the provisions come into force after the release date of 30th.
