The Ministry of transport on amending the decision regularation for passenger transportation and management

Chapter I General provisions

Article road passenger transport and terminal management should adhere to people-oriented, the principle of safety first, follow the principle of fairness, impartiality, openness, convenience, break regional blockades and monopolies, and facilitation of road transport of unified, open, competitive and orderly market to meet the travel needs of the masses.
Regularation for passenger transportation and operator shall operate, honesty and credit, fair competition, and quality service.
Fifth country road passenger transport enterprise grading systems and quality assessment system, and road passenger transport operators are encouraged to implement large-scale, intensive, company operations, prohibition of affiliated undertakings.
Sixth National regularation for passenger transportation and management of Department of transportation work.
Local people's Governments at or above the county level transportation departments in charge of organization and leadership of the regional road passenger transport and terminal management.
Road transport authorities above county level shall be responsible for the implementation of road passenger transport and terminal management.
Chapter II business license
Seventh shuttle passenger lines under the operating area and operating the line length is divided into the following four categories:

Tenth section of road passenger transport undertakings, subject to the following conditions:

1. passenger car technical requirements:

Highway passenger transport in these rules refers to trading in line Expressway mileage 200 km above or highway mileage is 70% more than the total mileage of road passenger transport.
2. bus type rating requirements:
Engaged in highway passenger transport, travel and operating line length over 800 kilometers of passenger vehicles, the level of vehicle type shall meet the industry standard of operating passenger car type and rating (JT/T325) provides intermediate or above.
3. passenger number requirements:
(1) operating a passenger line of bus passenger transport operator shall own passenger car more than 100 roundtrip, and more than 3,000, including senior roundtrip passenger cars in more than 30, more than 900; or its own advanced operating bus roundtrip more than 40 vehicles, more than 1200;
(2) engaged in two passenger lines scheduled bus transport operator shall own passenger car in the class more than 50 roundtrip, and more than 1500, including senior roundtrip passenger cars in more than 15 cars, more than 450; or its own advanced operating bus roundtrip more than 20 vehicles, more than 600;
(3) operate three passenger lines of bus passenger transport operator shall own passenger car 10 or more roundtrip, and more than 200;
(4) operating four passenger routes of bus passenger transport operator shall own operating buses 1 or more;
(5) operating provincial chartered passenger transport operator shall own senior operating bus roundtrip more than 20 vehicles, more than 600;
(6) operate chartered passenger transport operators in the province, should be its own operating roundtrip passenger cars more than 5 cars, more than 100.
(B) driving personnel engaged in passenger operation, shall comply with the following conditions:
1. obtain a corresponding motor vehicle driver's license;
2. age less than 60 years of age;
More than 3.3 years without major traffic accident records;
4. the district municipal transportation authority passenger concerned regulations, motor vehicle maintenance and basic knowledge of first aid of passengers passing the examination and obtain the appropriate qualification.
Traffic accidents in these rules refers to equal or more responsibility of driver accidents.
(C) improve the safety management system, including safety procedures, safety responsibility, work safety supervision and inspection, driver and vehicle safety management system.
(D) applies to engage in the class line of road passenger transport undertakings, there should be a clear line and site plan.
Section 11th for passenger station operation, subject to the following conditions:
(A) passenger Organization project completion acceptance by the relevant departments, and stand-level acceptance of road transportation management organization;
(B) commensurate with the business professionals and managers;
(C) appropriate equipment and facilities, specific requirements in accordance with industry-standard Bus Terminal level and building requirements (JT/T200) regulations;
(D) have a sound business practice and safety management system, including service standards and safety rules, vehicles start previous inspection and safe production responsibility system for production safety, dangerous goods chadu, supervision and inspection of the system.
12th section of road passenger transport undertakings, an application shall be submitted in accordance with the following provisions:
(A) engaged in passenger transportation management in the administrative area at county level, to apply to the road transport authority at the county level;

(C) engaged in TRANS-provincial, autonomous region, municipality directly under the passenger operation of the administrative area, to the seat of the province, autonomous region, municipality directly under the administration of road transportation agencies to apply.
Article 13th passenger stations operated, shall apply to the road transport administration of the County.
14th section of road passenger transport undertakings, should provide the following materials:
(A) business commencement-related material:
1. the application form for road passenger transport operators (see annex 1);
2. the articles of the text;
3. head of investor, proof of identity, Attn proof of the identity and the power of Attorney;
4. the text of the safety management system;
5. the proposed investment vehicles undertaking, including bus number, type and grade, grade, number of seats, and coach profiles the long, wide, high, if put into buses belonging to the owner of, or existing, shall provide the certificate of driving permits, vehicle technology (vehicle technical inspection certificate), proof of grading of passenger cars;
6. has engaged or intends to engage a driver's license and qualification certificate and its copy, police issued more than 3 years without major traffic incidents are proof.
(B) apply for class line of road passenger transport undertakings, should provide the following materials:
1. the application form for road passenger transport routes operators (see annex 2);
2. the feasibility report, including line apply for passenger class passenger status surveys, operational programmes, efficiency analysis and the possible impact on other operators;

4. transport service quality commitment.
15th has obtained the appropriate road shuttle passenger license operators when applying for additional passenger routes, in addition to article 14th (b) provision of material, should provide the following materials:
(A) copies of the road transport operators permit;
(Ii) passenger routes adapted to the type of application by private passenger car driving license, copy of the road transport certificates;
(C) the investment vehicles undertaking, including bus number, type and grade, grade, number of seats, and coach profiles the long, wide, high, if put into buses belonging to the owner of, or existing, shall provide the certificate of driving permits, vehicle technology (vehicle technical inspection certificate), proof of grading of passenger cars;

Article 16th passenger stations operated, should provide the following materials:
(A) the application form for the road passenger transport undertakings (see annex 3);
(B) passenger acceptance certificates and stand-level acceptance certificates;
(C) to recruit professionals, identification of managers and professional certificate and its copy;
(D), proof of identity, Attn proof of the identity and the power of Attorney;
(V) the text of business operation and safety management system.
17th road transport authorities above the county level should be announced to the public on a regular basis within the administrative area of the passenger transport capacity, and passenger routes, the main traffic flow and traffic conditions.
Management agencies in the review of passenger road transport applications, should be given to passenger transport market supply and demand, universal service and convenience of the public, and other factors.
18th road transport management body shall, in accordance with the People's Republic of China Road transport regulations and traffic regulations on the implementation of administrative licensing procedures, as well as the program implementation of the standardized road passenger transport operations, business class line of road passenger transport and terminal management of administrative license.
19th road transportation management of road passenger transportation management application, road passenger transport routes management application to be admissible, it should be made from the date of acceptance of the 20th approval or disapproval decision; road transport terminal operating application to be accepted by the authorities, should be made from the date of acceptance of the 15th approval or disapproval of the decision.

Road transportation management organizations does not meet the statutory conditions apply no licensing, no communications administrative license shall be issued to the applicant of decision.

Provincial administration of road transportation agencies on cross-province passenger transportation class line business applications have different opinions and through consultation, by the acceptance of the application of the provincial administration of road transportation through its membership of the provincial transportation departments will be written opinions and materials Department of transportation decided, and notify the applicant in writing.
The Ministry of transport shall be from the date of acceptance of the decision in the 20th, and notify the relevant provincial departments of transportation, by the acceptance of the application according to the provisions of the provincial administration of road transportation agencies 19th, 22nd section going through the formalities for the applicant.
Article 21st licensee shall take the road transport business license registration with the industrial and commercial administrative authority according to law. 22nd licensee shall determine the time to be put into the vehicle's undertaking. Lower road transport authority has issued to the licensee of the road transport operators permit, superior transportation management agencies should be required to be renewed as described above.
25th Sino-foreign joint ventures, Chinese-foreign cooperative, foreign-owned investment in road passenger transport and terminal operators shall comply with the provisions on the administration of foreign investment in the road transportation.
26th road passenger transport operators to set up subsidiaries, should be required to set up road transport authorities to apply for business licenses; set up branch offices, should take to the road transport authority report.
27th passenger routes have more than 3 of the same applicant, or according to the actual need, road transport management body may take the form of service quality bidding implementation class line of road passenger transport licences. Provincial administration of road transportation agency negotiated through service quality bidding, cross-province passenger transportation class line operation license, the joint bid, bid separately or in other ways.
A province without bidding, does not affect the bidding in another province.
Road passenger transport routes the right quality of service bid management measures shall be formulated separately.
28th class of road passenger transport line operating in the licensing process, no unit or individual is allowed to peer delivery capacity or other improper reason refuse, obstruct implementation of passenger routes operating license.
Article 29th passenger transport operators, terminal operators need to change or terminate the business license matters, shall apply to the licensing authority, according to the relevant provisions of this chapter.
Passenger lines operating in the class body, place of departure and day shift changes and station change of business subjects, sites in accordance with the new permit.
Passenger operators and terminal operators in all operating permits without valid reason for more than 180 days do not put into operation or outage of more than 180 consecutive days after the operation, considered discontinued operations.
30th class passenger line's operating time by the provincial administration of road transportation agency in accordance with the People's Republic of China identified the relevant provisions of the regulations for road transport. 31st passenger line operators in the term of operation, suspended, terminated business class line should be 30th in advance an application to the licensing authority. Expiry of the term of operation, needs to extend passenger routes operated, an application should be submitted 60 days prior to the expiration. Passenger transport operator terminates its operation, shall in the 10th after discontinued operations, related to the road transport operators permit and the passenger road transport certificates, signs back to the original issuing authorities. Article 32nd terminal operator terminates its operation, shall inform the original licensing authorities early 30th and station operators. Original licensing authorities close the terminal may have a significant impact on the public interest, measures should be taken to stop streaming of the vehicles, and announced to the public.
Terminal operators should be terminated after the 10th will return the original of the road transport operators permit issuing authorities.
33rd class passenger operator in passenger line renewal after the expiry of the term of operation management, meets the following conditions, should be priorities Description:
(A) the operator in accordance with the provisions of article tenth;
(B) the operator in the course of operating the passenger line, without extra transportation safety accident;
(Iii) in the course of operating the passenger line, plotless poor service quality;
(D) the operator in the course of operating the passenger line, no serious illegal business;
(E) as required to fulfil the universal service obligation.
Chapter III administration of passenger vehicles
34th passenger transport operators should be based on relevant technical specifications for regular maintenance of passenger vehicles, ensure technology of passenger vehicles in good condition.
Passenger vehicle maintenance operations and procedures should be in accordance with national standards of the vehicle maintenance, inspection, diagnose technology specification (GB18344) and other relevant regulations of the technical standards.
Any unit and individual is strictly prohibited for passenger vehicle maintenance enterprises designated operators; the vehicle second class maintenance performance shall not be used as road transport management agency check, road test road project.
35th passenger shall regularly carry out passenger vehicle detection, vehicle inspection vehicle testing frequency is carried out together on a regular basis. (E) passenger terminal operators liability insurance for passenger vehicle insurance carriers.
Testing to meet the requirements of, road transport authority in the road transport certificates application recorded in column; do not meet the requirements, shall be ordered to correct or change procedures. Operators of passenger vehicle technical file shall mainly include: General information, main parts replacement of vehicles, repair and maintenance records (including factory certificate), technical grade record, type and grade records, changed records, mileage records, records of traffic accidents.
Road transport authority vehicle management main contents should include: basic conditions of vehicles, maintenance and inspection records II, technical grade records, type and grade records, changed records, records of traffic accidents, and so on. 42nd when handling the ownership change procedures for passenger vehicles, passenger transport operator shall transfer the vehicle technical documents are complete.
Road transport authorities above the county level shall supervise and administer the technical archives establishment operator vehicles.
Article 43rd passenger operators scrap to reach the national standards or testing does not meet national mandatory standards for passenger vehicles, road transport certificates shall be returned in a timely manner, not to continue passenger operations.
Fourth chapter of passenger management
44th passenger road transport operator shall, in accordance with regulatory agencies decide to license in the passenger business, shall not transfer, lease of road transport business licenses.
45th road passenger transport enterprises wholly owned or holding and operation of road passenger transport subsidiary of its own passenger car 10 or more or their own senior passenger car is more than 5, according to its parent company's business license for passenger operations.

50th of passenger transport operator shall comply with the tariffs rules, provisions on the use of tickets, no unauthorized price rise, malice price, fees.
51st passenger operator in passenger vehicles should be outside of the niche printing company name or logo, prominently publicized in the cars in the road transportation management agencies monitor telephone, ticket price and odometer.
52nd passenger transport operators should provide better travelling environment for passengers to ensure their equipment and facilities effective, keeping the vehicle clean, sanitary, and to take the necessary measures to prevent infringement from occurring during transport of passengers and property offences.
Occurred during the transport against personal and property security of public order offences, the availability of passenger transport operators in their own capacity, shall be reported to the public security organs in a timely manner and in line with the public security organs timely termination of security violations.
Passenger transport operators shall not in passenger vehicles involved in unhealthy activities such as playing video tapes on.
53rd passenger transport operator should cover the carrier's liability insurance for travelers.
54th passenger operator in the course of transit caused personal injury to passengers, luggage is damaged, destroyed or lost, the compensation amount agreed by the parties, in accordance with their agreement; no agreed, against the national carriage of passengers between the ports and rail passenger transport liability regulations. 55th passenger operator in China should strengthen the security, education and professional knowledge and practice for training of professional ethics.

Drivers of passenger vehicles shall comply with the regulations for road transport and road transport drivers operating procedures, safe driving, and civilized service.
56th passenger road transport operators should develop a public emergency contingency plans.
