Ministry of transport on the modification of the People's Republic of China ships crew competency examination and certification decision rules (amended in 2013)
(December 24, 2013 2013 18th release from the Ministry of transport as of December 24, 2013) Department of transportation decided to the People's Republic of China ships crew competency examination and certification rules (Transportation Department order 2011 of 12th) as follows:
First, modify the 30th to: "ships abroad in case of force majeure or other certified crew unable to perform the functions of special circumstances, unable to meet minimum safe manning requirements, require the vessel to the next level when crew temporarily the duties at a higher level shall be submitted to the maritime administrative agency issuing the seafarers ' certificates application for proof of privilege."
Second, the 31st article is revised as follows: "the crew other than specified in the first paragraph of this article of the other crew members, not proof of privilege." Chapter I General provisions

Article seventh certificate of competency levels are divided into:

(3) third-class certificate of competency: suitable for under 500 tons gross or the master of a ship propulsion under 750-kilowatt.
(B) the senior sailor on duty, senior mechanic on duty certificate of competency applicable to 500 gross tons and over or ship main propulsion 750-kilowatt and above.
(C) the sailor on duty, on-duty mechanic certificate of competency levels are divided into:
1. unlimited navigation qushi certificate applies of 500 tons gross and over or ship main propulsion 750-kilowatt and above;
2. coastal navigation qushi certificate is divided into two levels:
(1) first class certificate of competency: applies to 500 gross tons and over or ship main propulsion 750-kilowatt and above;
(2) second class certificate of competency: suitable for under 500 tons gross or the master of a ship propulsion under 750-kilowatt.
(D) electrical and electronics technician certificate of competency for main propulsion 750-kilowatt and above the ship.

Crew member functions according to the technical requirements are divided into:
(A) management level;
(B) operational level;
(Iii) to support the level. Tenth competency certificate holder should be on the certificate of competency within the scope of position or below the certificate of competency scope of duties.

Section II the issuance of certificate of competency
Achieved certificate of competency the 11th article, subject to the following conditions:
(A) hold a valid service book of crew members;

(C) completed the vocational training of the rules set out in the annex;
(D) sea tenure qualifications with the rules set out in the annex, and good service performance and safety record;
(E) through the corresponding competency examination.
To be on the oil tanker, chemical tanker, liquefied gas ships, passenger ships, high-speed vessels and other special types of crews serving on ships, also subject to the provisions of section III of this chapter training, qualifications, and other special requirements.
12th applying for certificates of competence on seagoing, shall submit the following materials:
(A) the application form for seafarers ' certificates of competency;
(B) the crew service book;
(C) the seafarers ' health certificates;
(D) identity documents;
(E) meet the requirements of the maritime administrative agency photos;
(Vi), vocational training certificates or diplomas of maritime education;
(VII) on board training record book;
(H) certificate of competency held;
(I) professional skills certificate of competency;
(J) certificate of competency examination.
Holds three, third Assistant Engineer certificate of competency application for second mate, Guan Lunshi Certificate II, submitted to the maritime administrative agency from the first paragraph of this article (vi), (VII), (IX), (x) provision of material;
Trainees from the ship in accordance with these rules, submitted to the maritime administrative agency from the first paragraph of this article (VII) provision of material;
First-time applications for certificates of competence on seagoing, submitted to the maritime administrative agency from the first paragraph of this article (VIII) provision of material.
Special types of vessels in accordance with article 20th to be served should also provide special training for seafarers.

13th the maritime administrative agency for the permit application and audited in accordance with conditions specified in these rules, shall be in accordance with the administrative licensing law, the traffic regulations on the procedures for the implementation of administrative licensing requirements issued the appropriate certificates of competency.
14th certificate of competency valid for not more than 5 years of expiry date of no more than 65 years old birthday of the holder.
15th master and officer certificate of competency within the validity of the certificate, to meet one of the following conditions, and through knowledge training commensurate with their duties, within 12 months before the expiry date of the certificate of competency has the appropriate administrative rights of the maritime administrative agency applying for certificate of competency valid:
(A) forward for 5 years from the date of application with their certificate of competency within the recorded range of at least 12 months of sea service, and good service performance and safety record;
(B) forward for 6 months from the date of application with their certificate of competency within the recorded range of corresponding accumulated at least 3 months of sea service, and service performance and safety record is good.
16th article does not meet the provisions of this rule 15th masters and officers, application for certificate of competency valid, shall comply with the following provisions:
(A) the article does not meet the 15th (a), (b) the provision or competency certificates expires 5 years or less, shall attend simulator training and updating training, and through the corresponding sampling project to assess;
(B) the competency certificate has expired more than 5 years and 10 years shall attend simulator training and knowledge training and corresponding inspection subjects theory exam and project evaluation;
(C) competency certificate expired 10 and above should attend simulator training and updating training, through the corresponding inspection subjects theory exam and project assessment and competency certificate recorded in the corresponding area, rank, in accordance with the provisions on board training record book completed ship of not less than 3 months on probation.
Article 17th when damage or loss of the certificate of competency, holders in addition to the original certificate issued by the maritime administrative agency shall submit applications for replacement and the 12th article of these rules (a), (d) and (e) to request materials, should also meet the following requirements:
(A) the damage of certificate of competency shall surrender the damaged certificates;
(B) loss of certificate of competency shall be issued nationwide newspaper lost certificate of competency bulletin, or to submit the original certificate issued by the maritime administrative agency issued by the local notary public certificate publishing notices for competency certificate missing since 30th may apply after the date of the announcement.
Replacement certificate of competency expiry date same as the yuanshi certificate expiry date.
Article 18th for violation of maritime administrative competency certificate has been revoked, since after 2 years from the date on which the certificate is revoked, by low job competency examination, in accordance with the provisions of the present rule 12th to submit appropriate materials, the original certificate of competency issued by the maritime administrative agency applying for certificate of competency of the low post.
The maritime administrative agency through the competency examination, and good safety record, shall issue the appropriate certificate of competency.
Article 19th in inland waterway vessels, marine fishing vessels or military personnel serving on ships, meet the following requirements, in accordance with the provisions of the national maritime authority to apply for the corresponding certificate of competency:
(A) the proposed certificate grades and posts is not higher than in inland waterway vessels, marine fishing vessels or military ships on the corresponding certificate grades and posts, which you can apply for the highest rank as a Chief Officer or second engineer;
(B) in inland waterway vessels, marine fishing vessels or military ships on the water service to adapt with this sea service rules, and good service performance and safety record;
(C) vocational training in the corresponding position and position applied corresponds with the theory test and evaluation.
Section III special requirements for special types of ship crews
Article 20th on the oil tanker, chemical tanker, liquefied gas ships, serving on special types of vessels, such as passenger vessels, high speed, should also complete the corresponding special training, and training for seafarers.

(Ii) application applies Yu passenger second mate suitable any certificate who, should in other type of 3000 total tons and the above ships Shang served as second mate full 12 months, served performance and security records good, and at least in passenger Office trainee second mate 3 months; or holds passenger three suitable any certificate and in corresponding airlines district, and ship grade of ships Shang served as three many Yu 18 months, served performance and security records good, which had served as passenger three at least 6 months.
(Three) application applies Yu passenger mate suitable any certificate who, should in other type of 3000 total tons and the above ships Shang served as mate full 24 months, served performance and security records good, and at least in passenger Office trainee mate 3 months; or holds passenger second mate suitable any certificate and in corresponding airlines district, and ship grade of ships Shang served as second mate many Yu 12 months, which had served as passenger second mate at least 6 months, through mate exam, at least in passenger Office trainee mate 3 months, served performance and security records good.
(Four) application applies Yu passenger Captain suitable any certificate who, should in other type of 3000 total tons and the above ships Shang served as Captain full 24 months, served performance and security records good, and at least in passenger Office trainee Captain 3 months; or holds passenger mate suitable any certificate and in corresponding airlines district, and ship grade of ships Shang served as mate many Yu 18 months, served performance and security records good, which had served as passenger mate at least 6 months, through Captain exam, and at least in passenger Office trainee Captain 3 months.
Article 23rd initial application applicable to the voyage between the two Hong Kong 50 nautical miles and above passenger ships chief engineer and engineer certificate of competency shall be in other kinds of 3,000-kilowatt on board a seagoing ship in corresponding positions over 12 months and above, good service performance and safety records, and passenger Office trainee positions for 3 months.
After three rounds of competency examination, performed in the passenger boats required 18 months on probation, good service performance and safety record can apply for the third Assistant Engineer certificate of competency applicable to passenger ships.
Zhang Shi III examination
Article 24th seafarers the competency examination, including examination and assessment.
Theory test theoretical knowledge as the main content, focus on mastery of the seafarers ' professional knowledge and comprehension tests.
Assessment of the corresponding operation of ships, simulators and other equipment, international language listening tests and interviews or any other means, focused on seafarers ' expertise using for skills assessment, operation and emergency capacity. 25th competency examination subjects, outlining uniformly formulated and published by the national maritime administrations.

Article 26th applied for a competency examination, an application shall be in accordance with the published procedures to the maritime administrative agency has the appropriate permissions to provide the following information:
(A) identity documents;
(B) apply for a certificate of competency area of the exam, level, job title;
(C) meet the requirements of the maritime administrative agency photos.
27th start any examination of the maritime administrative agency shall Yu Shi 5th ticket issued to the applicant, and inform the applicant of such matters as ways to query competency exam. 28th competency examination has failed in the account or project, you can first competency examination within 3 years from the date of the ticket issuance 5 times the make-up.

(C) apply for second mate and second engineer proves, should hold a third officer, third Assistant Engineer certificate of competency, and from the first 5 years of the date of filing, with not less than 12 months of less than recorded in the certificate of competency marine, aviation qualifications, job tenure, and good service performance and safety record;
(Four) application three, and three tube round special from proved of, should holds senior duty sailor, and duty sailor or senior duty mechanic, and duty mechanic suitable any certificate, and in since application of day up Qian 5 years within, has many Yu 12 months of not below its suitable any certificate by records ship, and airlines district, and positions of served qualifications, served performance and security records good.
Crew stipulated in the first paragraph of this article other than the crew, not proof of privilege.
32nd applications from certified, shall be submitted to the maritime administrative agency include the following applications:
(A) the grounds of the application;
(B) the ship name, sailing area, port;
(C) the qualifications of the intention to apply for the object;
(D) the relevant supporting documents. Article 33rd applications related to the maritime administrative agency shall verify the information received, to meet the conditions of article 31st shall be issued in the 3rd period not exceeding 6 months from certificate, but the captain or chief engineer from proof of validity not exceeding 3 months.
Does not meet the criteria, and shall inform the applicant within the 3rd reason for no proof of privilege.
Article 34th on board a ship at the same time, a special proof of masters and officers a total of not more than 3. 35th vessels involved, after arriving at the first port in China, has proved that failure-free.
Fail-proof of privilege shall surrender the original certificate issued by the maritime administrative agency in a timely manner.
Fifth chapter recognizes visa
Article 36th for seafarers, 1978, as amended, training, certification and Watchkeeping standards, the Convention (hereinafter referred to as STCW Convention) issued by a State party of foreign certificates of competency of crew on ships in service, shall be made by the national maritime administration recognition of foreign certificates of competency issued by Visa.
37th applied for visas, shall be submitted to the State maritime administration the following materials:
(A) the State issued certificate of competency;
(B) indicate that applicants comply with the STCW Convention provisions relating to crew management and contracting documents;
(C) the seafarers ' identity document of the applicant.
Article 38th national maritime safety authority should be in accordance with the STCW Convention and the standards and conditions laid down in these rules, and more, applied for visa crew member State assessment for crew management system from the following aspects:
(A) the seafarers ' training, examination and certification system meets the requirements of STCW Convention;
(B) whether the crew in accordance with the STCW Convention called for the establishment of an effective quality control system;
(C) the seafarers ' conditions, and performance requirements are below the standards provided for in these rules. In accordance with the first paragraph of this article visa issued recognized evaluation results should serve as a basis for the crew management system evaluation results indicate that the State party not less than STCW Convention and the requirements of these rules, and the information provided by the applicant in accordance with section 37th real, comprehensive, national recognition of the maritime administrative agency shall issue the corresponding visas.

The sixth chapter the responsibility of shipping companies and related organisations

(B) familiar with the ship's furnishings, fittings, equipment, processes, characteristics, and limitations of the relevant circumstances;
(C) with good language and communication skills, and ensure that in urgent cases and implement safety, pollution prevention and security functions, to effectively carry out its responsibilities.
41st shipping companies and related agencies should establish and perfect training system, in accordance with the following requirements to strengthen the company and crew training:
(A) in accordance with the provisions of the national maritime authority develop and implement relevant training, work experience and other aspects of the training program, and fill in the training, student record books or records;
(B) take effective measures to ensure that should be undertaken by the company, institutions responsible for other types of training and effective implementation.

Supervision and administration of the seventh chapter
Article 43rd crew of the maritime administrative agency shall perform its duties, the security record of conducting supervision and inspection, strengthen the supervision of crew competence.

Assessment results show that the crew no longer meet the conditions for eligibility, the maritime administrative agency shall cancel its certificate of competency or recognition of visas.
Article 45th in accordance with article 44th cancelled certificate of competency of crew members, may participate as requested by the maritime administrative agency the low rank, position or area of assessment, the maritime administrative agency issuing its examination results certificate of competency.
Article 46th responsible for seafarers exam and certification of the maritime administrative agency shall fulfill the competency examination, certification requirements for personnel, equipment, premises and materials, related to the establishment of the quality management system and accredited by the national maritime administrations. 47th crew of the maritime administrative agency shall strengthen the competency examination, certification of staff training and appraisal.
Job conditions are not met, may not engage in crew competency examination, certification of work.

49th the maritime administrative agency shall publicize the seafarers competency examination and certification matters of management policies, procedures, information such as telephone hotlines, and consciously accept the supervision of society.

The eighth chapter legal liability

52nd obtained through fraud, bribery or other improper means competence certificate, privileged certificate, recognition of visa, certificate issued by the maritime administration or the higher maritime administrative agency revoked certificate, and a fine of less than 2000 Yuan and 20,000 yuan.
53rd forged, altered, or trade certificate of competency, exempt from certification, recognition of visas, collected by the maritime administrative agency the relevant certificates, fined a maximum of 20,000 yuan and 100,000 yuan, has illegally obtained, and shall confiscate the illegal income.
54th of the crew is not in training, work experience and fill in the record book or recording, by the maritime administrative agency fined 1000 Yuan and 10,000 yuan in serious, and temporarily suspended the crew service book, seafarers ' certificates for more than 6 months to 2 years until revoked the crew of service book, punishment of seafarers ' certificates.
55th Captain does not truthfully recorded the crew in the crew services Book service qualifications and job performance, by the maritime administrative agency fined 2000 Yuan and 20,000 yuan in serious and withholding certificate of competency for more than 6 months to 2 years until the penalty of revocation of certificate of competency.
For breach of 56th article of these rules or other provisions of marine traffic safety regulations, revoke a certificate of competency by the maritime administrative agency, within 2 years from the date of the revocation, shall apply for a certificate of competency.
57th of the maritime administrative agency shall have any of the following circumstances, by the national maritime administrations shall be ordered to correct serious, restrict or cancel the competency examination and certification of permission:
(A) regulations on violations of administrative license procedure competency examination and certification of work;
(B) ultra vires conduct competency examination or to issue a certificate of competency;
(C) fails to meet the conditions of issuance of certificate of competency of the applicant.
Nineth chapter by-laws
