(March 13, 2002 the 56th Executive meeting of the State Council on March 19, 2002, People's Republic of China promulgated by Decree No. 348, announced as of May 1, 2002) first in order to strengthen the management of weather, preparedness for and mitigation of meteorological disasters, according to the People's Republic of China relevant provisions of the law, this Ordinance is enacted.
    Article in the People's Republic of China in the field of weather modification activities should be subject to the regulations.
    Weather modification referred to in article III of the regulations, is to avoid or alleviate meteorological disasters, rational utilization of climatic resources under appropriate conditions by means of science and technology of the local atmosphere of the physical and chemical processes for artificial effects, achieving increased rain and snow, hail, rain, fog, Frost-proof and other activities.
    Article fourth work in accordance with the scale of operation and influence of weather, in the job under the leadership and coordination of local people's Governments at or above the county level, carried out by the competent Meteorological Organization and management. Article fifth weather, weather modification work plan should be developed.
    Weather modification work plan by the local competent meteorological departments concerned at the establishment, the people's Governments at the corresponding level for approval.
    Weather modification work approved by the relevant people's Government planned weather modification work belonging to an undertaking, the requirements for inclusion in the budget of the local government.
    Article sixth artificial weather modification, shall have suitable climatic conditions, taking full account of local needs and effect of disaster prevention and mitigation.
    Seventh national weather modification to encourage and support scientific and technological research, to promote the use of advanced technology.
    Local people's Governments at or above the county level shall organize experts to assess the effect of artificial weather modification, and based on the assessment results, rewards and punishments given to provide the basis of the relevant units.
    Article eighth of weather sites, by provinces, autonomous regions and municipalities directly under the meteorological authorities in accordance with local characteristics, geographical and climatic conditions, in accordance with the People's Republic of China civil aviation law and the People's Republic of China relevant provisions of the basic rules of flight, in conjunction with the relevant flight control Department.
    Nineth weather operations unit, shall comply with the provisions of meteorological departments of provinces, autonomous regions and municipalities directly under the conditions.
    Tenth Article weather modification operations personnel, by provinces, autonomous regions and municipalities directly under the competent meteorological training, after passing the examination, artificial weather modification can be implemented.

    Flight control department concerned upon receipt of the application, it shall make a decision and notify the applicant.
    12th artificial weather modification, airspace and jobs must be approved within the time limits, in strict accordance with the competent Meteorological Department under the State Council provisions of the operating norms and procedures, and accept the local meteorological departments at and above the county level of command, management and supervision, ensuring job security.
    The implementation of artificial weather modification, meteorological departments shall, as the case of the job announcements in advance and notify local public security organs to do security work.
    13th operation shall promptly provide the free weather station with weather modification required for meteorological data, information and forecasts.
    Agriculture, water conservancy, forestry and other relevant departments shall promptly provide the free weather required for disaster, water, fire and so on.
    Article 14th needs across provinces, autonomous regions and municipalities to carry out artificial weather modification, determined by consultations with the Governments of provinces, autonomous regions and municipalities concerned through consultation, are concerned by the competent Meteorological Department under the State Council determines the people's Governments of provinces, autonomous regions and municipalities.
    15th artificial weather modification using rocket launchers, artillery shells, rockets, by the competent Meteorological Department under the State Council agencies and departments concerned jointly designated by the enterprise in accordance with the relevant mandatory technical standards and requirements for organizing production.
    Required by operations purchase equipment in the preceding paragraph, by provinces, autonomous regions and municipalities directly under the meteorological departments in accordance with State provisions on government procurement organization. 16th transport, storage, artificial weather modification using anti-aircraft guns, rocket launchers, artillery shells, rockets, and shall comply with the relevant State laws and regulations on management of weapons, explosives.
    Implementation of artificial weather modification using shells, rockets, by the army, the people's armed forces departments to assist in the local store; need to transporting, by the relevant authorities in accordance with national weapons and explosives management laws and regulations formalities.
    Article 17th artificial weather modification using anti-aircraft guns, rocket launchers, and organized by the meteorological departments of provinces, autonomous regions and municipalities directly under the annual inspection; failed to pass the annual examination, should immediately repair and maintenance is still not up to the standards and requirements, to be scrapped.
    18th prohibits the following acts: (a) artificial weather modification equipment transfer to non-artificial weather modification entity or individual, (ii) artificial weather modification equipment used in connection with weather related activities; (c) inspection unqualified, expired or artificial weather modification equipment for scrap.
    Weather artificial weather modification operations needs to be transferred between devices, should be reported to the relevant provinces, autonomous regions and municipalities directly under the meteorological departments for approval.
    19th article violation this Ordinance provides, has following behavior one of, caused serious consequences of, in accordance with criminal on dangerous items accident crime, and major accident crime or other crime of provides, law held criminal; is enough criminal punishment of, by about meteorological competent institutions according to management permission ordered corrected, give warning; plot serious of, canceled job qualification; caused loss of, law bear compensation responsibility: (a) violation artificial effect weather job specification or operation of;
    (Ii) not according to approved of airspace and job time implementation artificial effect weather job of; (three) will artificial effect weather job equipment transfer to non-artificial effect weather job units or personal of; (four) without approved, artificial effect weather job units Zhijian transfer artificial effect weather job equipment of; (five) will artificial effect weather job equipment for and artificial effect weather has nothing to do of activities of.
    20th in violation of the provisions of this Ordinance, organizing the implementation of artificial weather modification, resulting in extraordinarily serious safety accidents, the authorities charge directly responsible and other persons directly responsible shall, in accordance with the State Council on regulations on administrative accountability for extraordinarily serious safety accidents.
    Article 21st weather modification activities for military purposes, specific management methods, formulated by the Central Military Commission.
                                                                22nd article of the regulations come into force on May 1, 2002.
