Regulations on population and family planning work

First in order to strengthen population and family planning work, and management services, safeguarding the legitimate rights and interests of floating population, stabilizing the low fertility level, according to the People's Republic of China on population and family planning law, this Ordinance is enacted. Second population referred to in these regulations refers to leave the domicile of the counties, cities or municipal districts, to work and live for the purpose of adult persons of reproductive age living in different places.

However, excluding the following:

(A) for business trips, medical care, schooling, travel, family, friends and living in different places, are expected to return to the domicile resident personnel;

(B) in the municipal districts of the city in the administrative area of district and between persons living in different places.

Third local people's Governments at or above the county level shall lead the population and family planning work in the administrative area, population and family planning work into local economic and social development planning, and to provide the necessary protection mechanism of establishing and perfecting the coordination of population and family planning work, organize and coordinate the relevant departments of the integrated management of population and family planning work; implementing target management responsibility system, assessment of population and family planning work of the relevant departments, oversight.

Fourth floating population in population and family planning work by the domicile and residence of responsible Government, now living in government-dominated Hukou supporting local government.

Fifth State population and family planning departments in charge of the national population and family planning work, development of population and family planning work planning and implementation; establishment of floating population's family planning information management system, realize the domicile and residence of floating population family planning information sharing and related sector information management systems for sharing information about the population.

Local people's Governments at or above the county level population and family planning departments in charge of the population and family planning work in the administrative area, implementation of the people's Governments at the corresponding level of floating population family planning management and services; organizing the implementation of population and family planning work inspection and examination of established system of floating population's family planning communications, summaries, information about family planning; accept and promptly dealing with reports concerning population and family planning work, protection of migrants ' rights.

People's Governments above the county-level public security, civil affairs, human resources and social security, housing and urban-rural construction, health, price departments and industrial and commercial administrative departments at and above the county level shall, within the scope of their respective duties, be responsible for population and family planning work.

The sixth Township (town) people, neighborhood offices responsible for population and family planning work within their respective jurisdictions, on the implementation of the family planning management of the floating population and family planning publicity and education organizations engaged in family planning technical service institutions to guide couples of childbearing age in the population (hereinafter referred to as couples of childbearing age) selection of safe, effective and proper contraceptive measures, provided free of charge to couples of childbearing age as prescribed by the State according to law the basic items of family planning technical service.

Floating residence and domicile of the township (town) people's Governments, establish a system of floating population's family planning communications between subdistrict office, collecting floating population's family planning information in a timely manner and verify the use of floating population's family planning information management system, information about family planning. Article seventh among the floating population of the adult women of childbearing age (hereinafter referred to as the adult women of childbearing age) before you leave the domicile, should present their identity cards to the domicile of the township (town) people's Governments or neighborhood offices handle marriage certificate; married, go through the marriage certificate should also produce a marriage certificate.

Marriage certificate shall set forth the name of the adult women of childbearing age, age, citizenship, number, marital status and spouse information, fertility, contraception, and more.

Domicile of the floating population of the township (town) people, neighborhood offices shall give timely proof of marriage. Eighth adult women of childbearing age should reach the date of residence submit a marriage certificate in the 30th.

Adult women of childbearing age to now living in the township (town) people's Governments or neighborhood offices submit a marriage certificate, can also be passed to the residence of villagers ' committees and residents ' Committee of township (town) people's Governments or neighborhood offices submit a marriage certificate.

Migrants now living in the township (town) people's Government, the subdistrict office shall examine the marriage certificate, urged not to handle the adult women of childbearing age in time for a replacement marriage certificate of the marriage certificate; inform migrants in the residence can enjoy the family-planning services and rewards, preferential treatment, and shall perform the obligations of family planning.

Villagers ' committees and residents ' Committee shall assist the township (town) people's Government, the subdistrict offices to carry out the provisions of the second paragraph of article work, marital situation of the floating population register.

The Nineth migrants now living in the county public security, civil affairs, human resources and social security, health and other departments and industrial and commercial administrative departments at the county level should be combined with sector responsibilities, integrating population and family planning work into relevant management system in time to inform the local population and family planning departments at the relevant registration and licenses in the understanding of marriage certifications of floating population family planning information.

Received shall promptly inform the population and family planning departments, in conjunction with the township (town) people's Governments, neighborhood offices implement the population and family planning programme management and service.

Tenth population in residence to enjoy the following family planning services and rewards, preferential treatment:

(A) free access to knowledge about population and family planning law and reproductive health activities;

(B) free access to contraceptives in accordance with law, free access to other basic items of family planning technical services stipulated by the State;

(C) the late marriage and late childbirth or current place of residence the purpose of planning operations, in accordance with the place of residence of provinces, autonomous regions, municipalities or the provisions of a major city, enjoying a vacation;

(D) family planning, according to the migrants now living in the provinces, autonomous regions, municipalities or the provisions of a major city, in terms of production and management support, preferential, and enjoy priority in social assistance.

11th migrants now living in the local people's Governments and relevant departments of the local people's Governments at or above the county level shall take measures to implement this regulation article tenth of the floating population's family planning services and rewards, preferential treatment.

Domicile of the floating population's family planning departments of people's Governments at the county level and township (town) people's Governments or neighborhood offices shall not be required to return to the domicile of contraceptive among married checks.

14th migrants now living in villagers ' committees and residents ' Committee shall assist in the location of the township (town) people's Governments or neighborhood offices understand the situation or in the residential area of the village population and family planning, in time to the township (town) people's Governments or neighborhood offices to notify the relevant information.

Housing rental agencies, housing for rent (borrow) and property service enterprises and other relevant organizations and individuals in the villagers ' committees and residents understand the floating population's family planning situation, shall provide relevant information.

15th employer should do to the population and family planning work, implementation of laws and regulations and in accordance with law regulations of the floating population's family planning reward and privileges and accept the seat of township (town) people's Governments or sub-district offices and local people's Governments at or above the county level population and family planning departments of supervision and inspection. Couples of childbearing age of the 16th article of the first child, now living in the township (town) people's Governments or neighborhood offices for fertility services registration.

Registration for fertility services, shall provide the following information:

(A) the couple's identity card;

(B) the marriage certificate;

(C) the woman's marriage certificate and the husband's domicile of township (town) people's Government or the subdistrict office proof of the marriage of materials. Couples of childbearing age now living in the township (town) people's Governments or neighborhood offices shall receive the woman's marriage certificate and his marriage proved within 7 working days from the date of the material, to the conjugal domicile of childbearing age of township (town) people's Governments or neighborhood offices to verify the situation. Couples of childbearing age domicile of township (town) people's Governments or neighborhood offices shall, upon receiving the verification within 15 working days from the date a request for feedback.

Verification infallible, couples of childbearing age now living in the township (town) people's Governments or neighborhood offices shall, after receiving the feedback reproductive services registration rates; the situation is wrong, refuse to handle, and shall state the reasons in writing.

Now living in the township (town) people's Governments or neighborhood offices shall go through the fertility services to couples of childbearing age, within 15 working days from the date of registration of domicile of township (town) people's Governments or neighborhood offices informed of handling results.

17th issue a marriage certificate or other proof of family planning materials shall not charge any fee.

Requirements for population and family planning work, in accordance with the relevant provisions of the State to protect it.

18th the local people's Governments at all levels and relevant government departments as well as assist in the identification of the marriage certificate of the villagers ' committees and residents ' Committee and its staff, should be against the privacy of the citizen population information be kept confidential.

19th the people's Government above the county level population and family planning departments in accordance with the provisions of this Bill to discharge the responsibilities of population and family planning work, and by the people's Government of the people's Governments at the corresponding level or by the population and family planning department ordered corrective action and criticized serious cases, directly responsible for directors, managers and other persons directly responsible shall be disciplined.

20th domicile of the floating population of township (town) people's Governments or neighborhood offices in population and family planning work in any of the following circumstances, respectively, by the township (town) people's higher level people's Government or the establishment of the people's Government of the subdistrict office ordered corrective action and criticized serious cases, directly responsible for directors, managers and other persons directly responsible shall be given disciplinary action:

(A) fails to comply with the regulations for the issue of floating population family planning materials that produce false proof of family planning materials, collect fees or proof of family planning materials;

(B) violation of the provisions of this Ordinance, required married women of childbearing age birth domicile returned checks;

(C) failing to implement the population and family planning reward and privileges;

(D) not in accordance with the provisions of this Ordinance to the migrants now living in the township (town) people's Government, the feedback the subdistrict office of floating population's family planning information;

(E) violations of other provisions of this Ordinance.

21st migrants now living in the township (town) people's Governments or neighborhood offices in population and family planning work in any of the following circumstances, respectively, by the township (town) people's higher level people's Government or the establishment of the people's Government of the subdistrict office ordered corrective action and criticized serious cases, directly responsible for directors, managers and other persons directly responsible shall be given disciplinary action:

(A) fails to comply with the provisions of this Ordinance provided free of charge to couples of childbearing age national basic items of family planning technical service, or fails to implement the population and family planning reward and privileges;

(B) fails to comply with the provisions of this Ordinance the identification certificate of marriage;

(Iii) not in accordance with the provisions of this Ordinance for the registration of couples of childbearing age for fertility services, or proof of false family planning materials, collect fees or proof of family planning materials;

(D) the domicile of the Roma is not in accordance with the provisions of this Ordinance to the township (town) people's Government, the subdistrict office information about population and family planning;

(E) violations of other provisions of this Ordinance.

22nd migrants now living in the county public security, civil affairs, human resources and social security, health and other departments and industrial and commercial administrative departments at the county level in violation of the provisions of section Nineth, by the people's Government of the people's Governments at the corresponding level or by the competent authority shall order rectification, criticized.

23rd migrants are not in accordance with the provisions of this Ordinance apply for proof of marriage, now living in the township (town) people's Governments or neighborhood offices shall notify them within 3 months for a replacement limit; otherwise, or refuses to submit the certificate of marriage, residence of the Roma by Township (town) people's Governments or neighborhood offices given criticism.

24th if an employer violates the provisions of section 15th of the Ordinance, by the local people's Governments at the county level population and family planning department ordered corrective action and informed criticism.

Housing rental agencies, housing for rent (borrow) and property service enterprises and other relevant organization or individual information of the Roma is not provided in accordance with the provisions of this Ordinance, by the seat of the township (town) people's Governments or neighborhood offices shall be ordered to correct, given criticism. 25th article of the regulations come into force on October 1, 2009. On August 6, 1998 approved by the State Council, September 22, 1998, the former State Planning Commission published regulation on population and family planning work of the repealed simultaneously.
