  Chapter I General provisions

First in order to strengthen the Taihu lake basin water resources protection and water pollution prevention and control, protection of flood control and drought relief and life, production and ecological safety of water and improve ecological environment in the Taihu basin, this Ordinance is enacted.

Article of the Ordinance mentioned in the Taihu lake basin, Jiangsu Province, Zhejiang Province and Shanghai Municipality (hereinafter referred to as the two provinces and one city), South of the Yangtze, Qiantang River North of maoshan mountain and the Valley Watershed East of the area.

Article in Taihu lake basin management should follow a comprehensive plan, integrated and conservation priorities, and abolish the harmful, comprehensive management and scientific development principle.

Fourth River basin management with administrative division of Taihu lake basin management system.

States establish and perfect the management and coordination mechanism in Taihu lake basin, coordinating on major issues in the Taihu lake basin management.

Fifth water, environmental protection and other administrative departments of the State Council in accordance with the laws, administrative regulations and determine the Division of responsibilities under the State Council, is responsible for the related work of the Taihu lake basin management.

Taihu Basin Authority established by the water conservancy administrative departments of the State Council (hereinafter referred to as the Taihu Basin Authority) in the jurisdiction, laws, administrative rules and regulations and supervision and management of water Administrative Department under the State Council to grant duty.

Relevant departments of the local people's Governments at or above the county level in the Taihu basin in accordance with laws and regulations, is responsible for the administrative area of Taihu lake basin management related work.

Sixth State of Taihu lake basin water resources protection and water pollution prevention and control to implement target responsibility system and evaluation system of the local people.

Local people's Governments at or above the county level shall be in Taihu lake basin water resources protection, water pollution control, flood control and drought relief, water and shoreline protection and life, production and ecological safety of water into national economic and social development planning, adjusting the economic structure, optimizing industrial layout, and strictly limit the construction projects of high water consumption and pollution.
  Drinking water safety in the second chapter

Article seventh local people's Governments at or above the county level shall reasonably determine in the Taihu basin drinking water sources, and in accordance with the People's Republic of China water and the People's Republic of China Law on water pollution prevention and control regulations drinking water source protection areas, protection of drinking water supplies and water quality.

Article tenth local people's Governments at or above the county level shall be in accordance with the water in Taihu lake basin complementary, scientific scheduling principles, planning, building emergency and standby water source and joint water projects across boundaries.

Calculated in accordance with normal water consumption for planning water supply coverage, emergency and standby water source shall meet the water supply capacity of not less than 7 days.

Local people's Governments at or above the county level in Taihu lake basin water supply authorities shall, according to requirements of the national standard for drinking, preparation of technical transformation of water supply facilities plan, reported to the people's Governments at the corresponding level for approval organization. 11th local people's Governments at or above the county level shall organize in Taihu lake basin water administration, environmental protection, Department of housing and urban-rural development emergency response plan for water supply in their respective administrative areas.

Relevant departments shall, in accordance with the administrative emergency plan for implementation of the water supply programme.

Water of Taihu lake basin water supply emergency plan shall, according to the Administration, to develop appropriate emergency response programme of work and water supply departments.

12th water emergency plan should include the following main elements:

(A) emergency and standby water source and water supply facilities;

(B) monitoring, early warning and information reports and processing;

(C) Organization and command system and emergency response mechanisms;

(D) emergency and standby water source to enable or emergent water solution;

(E) financial, material, technical and other support measures.

13th city and county governments should be organized in the Taihu basin for drinking water sources, water supply and water quality monitoring; outbreaks of blue-green algae and other special sessions, should increase the frequency of monitoring and surveillance, timely water quality.

City and county governments found that drinking water in Taihu lake basin water sources, water supply and water quality anomalies, which may affect the security of water supply, should take immediate measures to prevent, control and warning information to the public in a timely manner.

Article 14th water supply safety accident occurs, local people's Governments at or above the county level in the Taihu basin should be reported immediately in accordance with the prescribed procedures, and according to the severity and extent of water accidents, in accordance with the functions and powers, to launch the corresponding water supply emergency plan and give priority to safeguard residents ' drinking.

Water safety accident occurs, you need to implement cross-Valley or across provinces, municipalities directly under the administrative emergency dispatch of water resources, management of Taihu Lake in Taihu lake basin and the taipu River, the new Meng he, wangyu river water issued the dispatch order.

  Chapter III protection of water resources

In lakes and rivers in the Taihu basin production and construction and other development activities, shall comply with the Ribbon of water protection requirements which production building and other development activity in Taihu Lake, before the relevant authorities to obtain approval, whether it meets water protection requirements of the Ribbon should be seeking the views of Taihu lake basin management agency.

21st local people's Governments at or above the county level in Taihu lake basin water Administrative Department and Taihu lake basin management should strengthen supervision and inspection of water function zone protection, regularly publish water resources; water feature area does not meet water quality goals, governance measures should promptly report to the relevant people's Government, and to inform the competent Department of environmental protection.

22nd local people's Governments at or above the county level shall be in accordance with the Taihu lake basin in the Taihu basin comprehensive planning and water environment comprehensive treatment in Taihu lake basin overall programme requirements, organizations adopt environmentally friendly dredging measures, ecological dredging of lakes and rivers in the Taihu lake basin, and harmless treatment of silt dredged.

Article 23rd local people's Governments at or above the county level shall strengthen the water quota management in Taihu lake basin and to take effective measures to reduce water consumption, water efficiency, and encourage the reuse of reclaimed water and utilization of rain water, seawater, brackish water. Need to get new, renovation or expansion project, should report on water resources assessment in industry water quota requiring water conservation measures, and supporting the construction of water conservation facilities.

  Water pollution control in the fourth chapter

28th sewage emissions per unit of water pollutants, shall not exceed the approved total discharge of water pollutants, and shall be in accordance with the requirement of ease of inspection, standardization of sampling outlets, hanging signs and not private pipe or other round regulation of pollutants discharged.

Banned in the Taihu lake basin set not in line with State industrial policies and the requirements of the comprehensive management of water environment paper, leather, brewing, alcohol, starch, metallurgy, printing and dyeing, electroplating and other pollutants discharged in production projects, existing production emissions cannot be achieved, it shall be closed.

In newly established enterprises in the Taihu basin should meet the state-mandated cleaner production requirements, existing enterprise has yet to meet the requirements of cleaner production, should be carried out in accordance with the planning requirements of cleaner production technology, two provinces and one municipality should strengthen supervision and inspection.

29th new Meng he, wangyu River other than the main river into Taihu Lake, estuary date back to 50,000 m 10,000 metres inside and coastline on both sides of the river shoreline within 1000 m, the following actions are forbidden:

(A) the new, expanded chemical and pharmaceutical production projects;

(B) the new, expanded outside the centralized sewage treatment facilities sewage outfall;

(C) expand the scale of aquaculture.

30th article Taihu Lake Bank line within and bank line around 5000 meters range within, dianshan Lake Bank line within and bank line around 2000 meters range within, taipu River, and new Meng he, and wangyu river bank line within and bank line sides the 1000 meters range within, other main into Taihu Lake River since estuary began to 10,000 meters river bank line within and bank line sides the 1000 meters range within, ban following behavior:

(A) setting up highly toxic substances, hazardous chemical storage, transport facilities and waste recycling and garbage dumps;

(B) set the water management facilities;

(C) the new, expanded golf course;

(D) construction, expansion of livestock and poultry farms;

(E) construction, expansion construction project discharging pollutants into the water body;

(F) the acts provided for in article 29th of this Ordinance.

Has set the first item of the preceding paragraph, a second provision facilities, local people's Governments at the county level shall be ordered to be dismantled or shut down.

31st local people's Governments at or above the county level should be promoted in the Taihu basin soil testing and fertilizer, precision fertilizer, biological pest control and other advanced applicable agricultural technology, pesticides, reducing chemical fertilizer application project, reducing the amount of chemical fertilizer and pesticide use, development of eco-agriculture in green and clean-type small watersheds building, effective control of agricultural non-point source pollution.

Article 32nd two provinces and one municipality people's Government shall strengthen the management of aquaculture in Taihu basin, rationally determine the scale and distribution of aquaculture, promotion of recycled water, without food farming and ecological farming techniques, reduce pollution in aquaculture. National phase-out fence culture in Taihu Lake.

People's Government of Jiangsu Province, Zhejiang Province, China fishery administrative departments shall, in accordance with the consolidated plan, step by step, the principle of fair compensation, organization fence culture facilities to clean up Taihu Lake.

Article 33rd in Taihu basin of livestock and poultry farms, farming cooperatives, the farming community should be harmless treatment of manure, wastewater, achieving effluent discharge; meet the scale of two provinces and one municipality, shall have methane-generating pit and the fermentation pools under construction, such as livestock manure, and comprehensive utilization of waste water or treatment facilities, and to ensure its normal operation. Article 34th Taihu basin planning and construction of local people's Governments at or above the county level shall be reasonable public sewer network and sewage treatment facilities, implement rainwater and sewage shunting.

Within 5 years from the day of enforcement of this Act, where the local people's Governments at or above the county level in the Taihu basin towns and key town domestic sewage should be fully incorporated into the public sewer system and sewage treatment facilities.

People's Governments at the county level in Taihu lake basin to the rural settlements within the administrative area is equipped with sewage, refuse collection facilities and centralized treatment of sewage, garbage collection.

35th new sewage treatment facilities in the Taihu lake basin, shall conform to the advanced treatment of nitrogen and phosphorus requirements of existing sewage treatment facilities do not meet the requirements of advanced treatment of nitrogen and phosphorus, local city and county governments should be organized within 1 year from the date of enforcement of this Act to carry out technical transformation.

City and county governments shall make an overall planning and construction in Taihu lake basin sludge treatment facilities, and sewage treatment units for treatment of sewage sludge and other wastes for treatment to avoid secondary pollution.

Countries encourage sewage treatment units have reclaimed water facility under construction. Article 36th shall, according to requirements of ships sailing in the Taihu lake basin is equipped with sewage, waste oil, waste collection facilities, garbage, feces and other pollutants. Without a valid ship waters pollution prevention certificate, instrument, not sailing in the Taihu lake basin.

Ships transporting highly toxic substances, hazardous chemicals, shall enter the Taihu Lake.

Taihu basin ports, terminals, Terminal and ship repairing plant shall be equipped with ship pollutants of water pollution, waste reception facilities and the necessary emergency facilities, and accept supervision by the local port administration and the Environmental Protection Department.

Taihu basin above the county level people's Governments and relevant maritime administrative agency shall establish and improve marine pollution accident emergency system, marine pollution adopted emergency measures immediately after the accident. 37th people's Governments at the county level in the Taihu basin formation of professional salvage team, responsible for the local focus of cyanobacterial harmful algal blooms, such as fishing in the waters.

Salvage of the cyanobacterial harmful algal blooms should be transported to the designated places for treatment.

State encourages the use of technology is mature, safe and reliable method for ecological control of cyanobacterial harmful algal blooms.
  The fifth chapter flood control and drought relief and water, shoreline protection

Article 38th of Taihu basin flood control and drought relief commanding mechanism under the leadership of the State flood control and drought relief commanding body, unified organization, command, direction, coordination and supervision of Taihu basin flood control and drought relief, its specific work by the Taihu lake basin management agency. 39th in Taihu Basin Authority shall, in conjunction with two provinces and one municipality, development of Taihu basin flood control solution, the State flood control and drought relief commanding authority.

Taihu basin flood control solution is the fundamental basis of Taihu basin flood control.

41st Taihu water level and other scheduling-related hydrologic data, is subject to basic hydrological station of the State test data; not the establishment of the national basic hydrological station, the Taihu lake basin management bodies, in recognizing the hydrologic data shall prevail. 42nd in Taihu lake basin management should organize two provinces and one municipality water conservancy administrative departments of transportation authorities, according to the flood control and drought relief and water protection of shoreline management plans need to be developed, with inputs from the two provinces and one municipality of land resources, environmental protection, urban and Rural Planning Department, water conservancy administrative departments under the State Council and by the approval of the State Council.

Shoreline management plan should be to clarify the Taihu Lake, taipu River, new Meng he, wangyu River shoreline delineation, utilization and management requirements.

County of Taihu basin should follow the shoreline management plans, organization of Taihu Lake, taipu River, new Meng he, wangyu River shoreline, set landmarks, and reported to the Taihu basin authority record.

43rd article in Taihu Lake, and taipu River, and new Meng he, and wangyu river bank line within built construction project, should meet Taihu lake basin integrated planning and bank line using management planning, shall not narrowed waters area, shall not reduced line Hong He adjustable storage capacity, shall not unauthorized change waters, and beach using nature; cannot avoid narrowed waters area, and reduced line Hong He adjustable storage capacity of, should while built equivalent alternative engineering or take other function remedy measures. Temporary occupation of Taihu Lake, taipu River and 44th new Meng he, wangyu River shoreline waters, beaches should be agreed by the Taihu lake basin management bodies, and the relevant procedures under the law.

Temporary occupation of waters, beaches may not exceed 2 years.
Expiry of temporary occupation, temporary occupier shall promptly restore waters, floodplain status quo; temporary occupation of waters, beaches and other loss of production to local residents should be compensated according to law.

Article 45th shall comply with polder construction in Taihu lake basin and the governance of river basin flood control requirements, appropriate control of polder area standards, co-ordination arrangements outside the polder drainage scale, strict control of Wei and Wei, playing on the vast water area of the Lake is prohibited within the Wei, ban on narrow polder waters area. Two provinces and one municipality of water Administrative Department shall prepare a polder construction and governance programme, and reported to the people's Governments at the corresponding level for approval organization.

Taihu Lake, taipu River and new Meng he, wangyu River, and administrative areas of the two provinces and one municipality boundary river of polder construction, governance programme before its ratification, should ask the Taihu Basin Authority permission.

Article 46th prohibited in the Lake shoreline circle Wei or Lake; Wei has been completed shall not be raised and the widened levee, has land ground surrounding land may not be blocked up by the Lake.

Two provinces and one municipality of water Administrative Department shall, in conjunction with the Ministry of land and resources departments, prepared within 2 years from the date of enforcement of this Act has been built within the shoreline of Lake Taihu Wei Lake and surrounding land clearing work programme under the water conservancy administrative departments and provinces upon approval of a municipal organization.
  Chapter sixth safeguard

47th local people's Governments at or above the county level in Taihu lake basin and its relevant departments to take measures to protect and improve the ecological environment of Taihu Lake, Taihu Lake shoreline within 500 meters, drinking water source protection areas around 1500 meter range and mainly into Taihu River shoreline within the 200 meters on each side, reasonable construction of ecological protective forest.

48th local people's Governments at or above the county level forestry, water in the Taihu basin Administration, environmental protection, agriculture and other departments should carry out comprehensive control, protection of wetlands, promote ecological restoration.

Two provinces and one municipality people's Government departments of fishery administration shall, according to the Taihu lake basin aquatic resources, important fishing resources law of propagation and germplasm resources protection of fishery, releasing aquatic biological resources, introduction of system of closed areas and closed seasons, and designate aquatic germplasm resources conservation areas. 49th upstream regions did not complete water pollutant emissions reduction plans, administrative boundaries and control phase water quality does not meet water quality goals, should be compensated in the lower reaches upstream regions completed water pollutant emission reduction and control plans, administrative boundary cross-sectional reach water quality goals, should be compensated in the upper reaches in the lower reaches. Compensation through financial transfer payment or payment determined by the relevant local people's Governments.

The specific measures shall be formulated by the financial, environmental protection formulated by the competent authorities and the two provinces and one municipality. 50th discharge unit and individual shall pay a sewage treatment fee in accordance with the regulations. Through the public water supply facilities, water supply, sewage treatment fees charged and billed; use self-provided water, sewage treatment and water resources fee collection. Sewage charge should be integrated into the local financial budget management, for use in the construction and operation of sewage treatment facilities.

Sewage treatment fee can compensate for normal operating costs of the sewage treatment units, local people's Governments at the county level shall give appropriate subsidies.

51st to reduce pollutant discharge a voluntary closure, relocation, change of technological transformation of enterprises, two provinces and one municipality should adopt financial, credit, government procurement, and measures to encourage and support.

State encourages pollutants discharged by enterprises in the Taihu basin pollution liability insurance, and the specific measures shall be formulated by the competent Department of environmental protection in conjunction with the insurance regulatory agency.

52nd to clean aquaculture, livestock, implementation of return grain fields to the Lake, returning fish to the Lake led to production workers, such as farmers, local people's Governments at the county level should subsidize and support, and through skills training, the social security system and guarantee their basic living.

Works against reduced by the application of pesticides, fertilizers and other income reduction or expenditure increases farmers, subsidize local people's Governments at the county level.
  The seventh chapter monitoring and supervision

53rd State Council development and reform, environmental protection and water administration, housing and urban-rural construction departments shall, in accordance with the relevant provisions of the State Council, on two provinces and one municipality and water resources protection and water pollution control objectives undertake an annual assessment of the implementation and evaluation results to the State Council.

Under local people's Governments at or above the level of people's Governments at the county level in Taihu lake basin water resources protection and water pollution control objectives implementation annual appraisal.

60th water administration under the people's Governments above the county level, environmental protection, housing and urban-rural construction departments and their staff, such as violation of the provisions of this Ordinance, any of the following acts, by the people's Governments at the corresponding level correction is criticized, directly responsible in charge and other direct liable persons shall be given disciplinary actions constitute a crime, criminal responsibility shall be investigated in accordance with law:

(E) failure to comply with the regulations of other responsibilities.
