LIMITS THE EXECUTION OF WORKS BY CONTRACTING COMPANIES IN THE FAENAS THAT INDICATES Having present that the National Congress has given its approval to the following Bill: " Single article.-Enter the following modifications to the Code. 1.-Substitute the third paragraph of Article 64, as follows: '' The worker, in establishing the application against his direct employer, may also sue all those who may respond in such a capacity as to their rights. ' 2.-Add, following Article 64, the following Article 64a, New: " Article 64a. The owner of the work, company or faena, when requested, shall have the right to be informed by the contractors of the amount and state of compliance with the labor and financial obligations that correspond to their workers, as well as the same kind of obligations as subcontractors with their employees. The same right will have the contractors for their subcontractors. In the event that the contractor fails to accredit the full compliance of the labor and the pre-viewing obligations in the form indicated, as well as when the owner of the work, company or faena is sued subsidiary in accordance with the Article 64 provides that the latter may retain the obligations it has in favour of the latter, the amount of which it is responsible for subsidizing. The same right will have the contractor with respect to its subcontractors. In any case, the owner of the work, company or faena, or the contractor in his case, may pay by subrogation to the worker or creditor pension institution. The amount and state of compliance with the labor and pension obligations referred to in the first paragraph of this article may be accredited by certificates issued by the respective Labour Inspectorate. The Labor Department must inform the owner of the work, company or faena, the infractions to the labor or pension legislation that are recorded in the audits that are practiced to its contractors or subcontractors. The same obligation shall be for the contractors, in respect of their subcontractors. ''.
