FACILITATES THE DENUNCIATION IN CASE OF SEXUAL ATTACKS AND ALLOWS FOR BETTER INVESTIGATION OF THE CRIME Having present that the National Congress has given its approval to the following Bill: " Article 1.-Add, to Article 11 of the Code of Criminal procedure, the following second indent, new: "Public criminal action is always granted for the pursuit of the offences referred to in Articles 361 to 366c of the Criminal Code, committed against minors." Article 2.-The first and second points of Article 369 of the Penal Code are replaced by the following, passing the current third indent to be the fourth indent: " Article 369.-You cannot proceed because of the offences provided for in the articles 361 to 366 quater, without at least the fact that the fact was reported to the court, the Public Ministry or the police by the person offended or by his legal representative. If the offended person is not free to make the complaint by itself, nor shall he have a legal representative, or if, having been prevented or involved in the crime, he may proceed on his own initiative with the Public Ministry, which shall also be the power to deduct the civil actions referred to in Article 370. Without prejudice to the foregoing, any person who becomes aware of the event may report it. However, in the case of minor victims, the provisions of Article 53 (2) of the Criminal Procedure Code will be provided for.
