"Article 1.-from September 1, 2004, the amount of widowhood pensions laid down in the pension schemes administered by the Instituto de normalización Previsional and the governed by Act Nº 16.744, shall not be inferior to fifty-five per cent of the pension of the deceased or of which would have corresponded to perceive, excluding those in which there are children of the deceased owners of orphan's pension." For this purpose, these pension adjustments should be done in as appropriate.
Starting from September 1, 2005, the amount of pensions referred to in the preceding paragraph, may not be less to sixty per cent of the pension of the deceased or of which would have corresponded him to perceive, and which satisfy the same requirements set forth in the preceding paragraph.
Counting from the dates referred to in the preceding subparagraphs, they will have to increase pensions granted in accordance with article 24 of the law Nº 15.386, when there are no children of the deceased owners of orphan's pension, in proportion to the new amount of the respective pension for widowhood.
Also, from September 1, 2004, the pension that referred to in article 45 of the law Nº 16.744, when there are no holders of orphan's pension if the deceased children, will be equivalent to 33% of the basic pension which would have corresponded to the originator if any overridden completely or basic pension that he perceived at the time of death. That percentage will rise to 36% from 1 September 2005.
The increases referred to in the preceding subparagraphs, shall apply to the benefits currently in force or to be awarded in the future. Holders of pensions outlined above, where there are holders of orphan's pension, shall be entitled, in any case, the increases mentioned in preceding paragraphs from the first day of the month following that in which the totality of the respective orphan's pensions is extinguished.
Holders of pensions referred to in the preceding subparagraphs, who are receiving or receive some subsidies laid down in law No. 19.403 and Nº 19.539, will no longer receive such bonuses in the amount equivalent to the increase experienced by the respective pension corresponding to previous paragraphs.
