LAW NO. 20,745 ESTABLISHES TRANSITIONAL RULES TO DEAL WITH THE CONSEQUENCES IN THE ARTISANAL FISHING SECTOR OF THE EARTHQUAKE AND SUBSEQUENT TSUNAMI OF APRIL 1, 2014 IN THE REGIONS OF ARICA AND PARINACOTA, AND OF TARAPACA Having present that the H. National Congress has given its approval to the following Bill " Article 1.-For all the purposes of Law No 18.892, General of Fisheries and Aquaculture, the cessation of extractive operations will not be considered during the years 2014 and 2015 in the the craft fishermen and their vessels, registered in the Artisan Register of the XV Region of Arica and Parinacota and I Region of Tarapaca, provided that they have operated and reported catches to the National Service for Fisheries and Aquaculture during the years 2012 or 2013, in accordance with the terms laid down in Articles 63 and following of that law and its regulation. Article 2.-Authorizase for the period of two years, counted from the date of entry into force of this law, to the craft shipowners registered in the XV Region of Arica and Parinacota and I Region of Tarapaca, to replenish their vessels sinister in accordance with the information provided to the National Service for Fisheries and Aquaculture, other than their property. Vessels entering in accordance with the foregoing shall comply with the other requirements laid down in Article 2 No. 14 of Law No. 18,892, General Fisheries and Aquaculture. If the vessel is registered in the Craft Fishing Register in the name of another shipowner and prior to the commencement of operations, the non-owner-owner shall be required to carry out a temporary replacement of the vessel, in which the vessel is registered. Case must be registered with the National Service for Fisheries and Aquaculture the title, whatever the title, under which it holds the holding of the same one, being suspended, during the validity of the respective title, the registration of the shipowner owner with respect to the vessel that will not operate. Vessels which comply with the provisions of the preceding subparagraphs may only be vessels of equal or lesser class in accordance with the classification laid down in Article 2 of the Supreme Decree No 388 of 1995 of the Ministry of Economy, Development and Reconstruction, or the rule that replaces it. They must also be registered in the 'Register of Ships' by the Maritime Authority, have a certificate of navigability in force and be in operational conditions to carry out extractive activities in accordance with the requirements laid down by the said authority. The National Fisheries and Aquaculture Service in the field of its powers of oversight and control shall establish, by resolution, the procedure to make compliance with this law effective. Once the period laid down in the first subparagraph has expired, the authorization granted in accordance with this article shall be without effect, by the sole ministry of the law, and may henceforth operate the artisanal shipowner welcomed by this law only with a the vessel of its property, whether it is originally registered or a different property, by virtue of a request for substitution in accordance with the provisions of Article 50 of Law No. 18,892, General of Fisheries and Aquaculture, and of the Supreme Decree No. 388, 1995, of the Ministry of Economy, Development and Reconstruction. After the period laid down in Article 55 (a) of Law No 18,892, General Fisheries and Aquaculture, without the owner of this law having operated in accordance with the previous subparagraph, the National Service for Fisheries and Aquaculture ".................................................................
