I read number 3,782.-As soon as the National Congress has given its approval to the following LEI PROJECT: Article 1.o Consent to the Lebu Carbonifera Company or the person or society to whom it transfers their rights, permission to build and A steam railway, of a metre of sixty-eight centimetres, will be splendid, which will be taken from the port of Lebu to the State Railways, at the station of Los Sauces, passing through Cunete. The work will be executed in accordance with the plans that the Company has accepted in all its parts and which have been approved by the following supreme decrees: numbers 418, February 20, 1911; 2,014, July 6, 1911; 3,321, 13 December of 1911; 151, of 16 March 1912; 200, of 27 March 1912; 753, of 11 September 1912, and 834, of 12 October 1912. The President of the Republic is authorized to accept the modifications of the plans cited, provided that they do not increase the value that must serve as a basis for the amount of the guarantee, according to Article 9. Article 2: 1.o The use of the necessary fiscal grounds for the construction of the road, stations, docks and buildings annexed thereto; and 2.o The use of the part of the public roads that crosses the line, provided that this use does not damage to traffic. Art. 3.o The municipal and private land that will be needed during the time of the construction of the railway line, its stations, buildings and annexes are declared to be of public use. The procedures laid down in Article 12 shall be subject to the procedures laid down in this authorization. Article 4. The concessionaire is obliged to start the work within the year following the publication of this lei in the Official Journal and to deliver the complete line to public traffic within the four years counted from the said publication. Art. 5.o The line will be divided into four sections: the first, from the port of Lebu to the port of Peleco, in the lagoon of Lanalhue; the second, from the port of Peleco to the station of Contulmo; the third, from the station of Contulmo To Puren; and the fourth, from Paren to the station of Los Sauces. The first and fourth sections must be completed within two years, which have been counted since the publication of this reading in the Official Journal. Art. 6. If the concessionaire does not start the work or will not terminate them within the deadlines, the concession will expire and the government will be able to acquire the accumulated work and materials, paying ten percent less than the cost value of the material that they have the date of expiry. The compensation shall be deemed to follow the procedure laid down in Article 12. Art. 7.o The rates of freight and tickets will be fixed and modified with the President of the Republic, not being able to exceed by more than twenty percent to those that are collected in the central network of the State Railways. This provision is without prejudice to the provisions of Articles 50, 51 and 52 of the lei of 6 August 1862, in so far as they are not contrary to the provisions of the preceding paragraph. 8.o The persons and charges that are transferred to the State and the coal that are transferred for the service of the State Railways and the National Navy, will pay a lower rate of 10 percent than the one set for the public. Art. 9. The State guarantees to the businessman, during twenty years, the interest of 5% on the cost of the work, not exceeding for the first section of four million pesos, for the second, of two million thousand pesos, for the third one; of three For the fourth, two million pesos legal gold coin or its equivalent in current currency, without which more than eighteen pence can be exempted by weight. The guarantee will be made effective for each section since they are finished and delivered to the public traffic, and must be done at the end of each year the liquidation of their tickets and the difference that will result between the amount of the interest will be paid to the Company guaranteed and the liquid entry of the respective section. When the liquid product of some or some of the sections is greater than the guaranteed interest, the excess will enter to reimburse the National Treasury all the sums that have been made by the guarantee that establishes this lei, until its full payment. The right of the concessionaire to charge the security shall be prescribed in one year from the date of each settlement. Article 10. The President of the Republic shall appoint a fully authorized financial controller to take stock of the work, examine the books and accounts of the Company and contribute to the formation of the balance sheets. The financial controller will earn a salary of twenty thousand pesos a year ($20,000) from the company. The government reserves the right to check the effectiveness of the balance sheets by means of an official of the Court of Auditors appointed by the same government. Art. 11. The State will be able to purchase the railway and its accessories at any time, either in the construction period or in the construction period, paying ten per cent more than the price set by experts. The compensation or price for the property shall be estimated in accordance with Article 12. Article 12. If the government resolves to use the power given to it by articles 6.o and 11 of this reading, a commission of three appointed experts will be appointed: one by the President of the Republic, one by the Supreme Court of Justice, and the other by the Company, to make the corresponding estimates. This value will be credited to the Tax Treasury of Santiago, and at the disposal of the interested parties. The State shall take possession of the goods immediately after their value is credited to the Treasury. The experts ' estimate shall be made by a majority of votes and shall be published in the Official Journal. If the persons concerned do not conform to the law, they may complain to the judge in the civil case of Santiago, within sixty days of their publication. The complaint shall be followed by the procedure referred to in Article 6 (1) of Directive No 3,108 of 14 September 1916. Article 13. Any transfer of the domain or the enjoyment of the rights granted by this lei can only be carried out with the prior authorization of the President of the Republic, under the penalty of the expiration of the concession, the works being left for tax benefit. Article 14. The present concession is for the term of 99 years, from its grant, which will be transferred, the railway and its accessories will pass to the power of the Fisco without charge or charge. Article 15. I shall read in this way from the date of its promulgation. And as soon as I hear the Council of State, I have had to approve and sanction it; therefore, promulgate and take effect as I read from the Republic.
