FACILITA THE PATENT OBTENTION OF MUSIC HEALTH IN LIFE BY THE ESTABLISHMENTS

Bearing in mind that the H. National Congress has approved the following

Bill:

"Unique item. Enter the following modifications article 3 of the Law No. 19.925on the sale and consumption of alcoholic beverages:

1. Verbatim (a) of letter B:

I. Add next to the point and apart, which becomes point and followed, the following prayer: "The hotels and annexes of hotels that have this type of patents will be able to perform artistic shows consisting of live music, dance, humor shows, cultural shows and in general all kinds of shows of such nature, without the need for an additional patent."

ii. Insert the following second paragraph:

"For these purposes, it will be understood as an annex to the hotel that has a material or functional continuity with the hotel, whether it is located adjacent to the building that houses the latter, or because there is continuity of functions and activities between them. In any event, a unit that is located more than 100 metres away from the main hotel building cannot be considered as an annex to the hotel. ".

2. Replace the final paragraph of the letter Q) with the following:

"This patent can only be granted, as an accessory, to the establishments that have one of the patents listed in the letters C), E, F), G, I, M) and Ñ. It shall be accorded prior to compliance with the zoning and detachment requirements set out in article 8, the noise emission regulations and the respective municipal ordinances, once the compliance with the requirements set out in alkali decree has been accredited. ".

For purposes of this letter, the patent of live music halls will be considered as an accessory character, which, prior to the sanitary, detachment and zoning requirements, accesses those conferred in the letters C), E, F), G), I, J), M) and Ñ.

If the technical report referred to in Articles 15 and 21 of Decree No. 38 of 2011 of the Ministry of the Environment, which establishes a standard for the emission of noises generated by source that indicates, elaborated after the revision of Decree No. 146 of 1997, of the Ministry of the General Secretariat of the Presidency, finds the non-compliance of the maximum permissible levels of noise, the municipality may declare the expiration of the accessory patent.

In the case of letter J, it can be granted only in the areas of the enclosure dedicated exclusively to the sale for promotional and tourist purposes or to the tasting. "..

Having complied with the provisions of article 93, paragraph 1, of the Constitution of the Republic, and since I have had the right to adopt and punish it, therefore, to promute and take effect as the Law of the Republic.

Constitutional Court

Bill amending Law No. 19.995 on the Expendium and Use of Alcoholic Beverages, to facilitate the obtaining of live music halls by the establishments it indicates, corresponding to Bulletin No. 14.534-06

The Attorney-General of the Constitutional Court, who subscribes, certifies that the Honorable Chamber of Deputies and Deputies sent the bill set out in the heading, approved by the National Congress, so that the Court would exercise constitutionality control over paragraph 2 of the single article of the bill; and by judgement of 21 December 2022, in Rol No. 13.781-22-CPR.

That this Magistracy does not issue a ruling, in a preventive review of constitutionality, regarding the provisions contained in paragraph 2 of the single article of the bill amending Law No. 19.925 on the Expenditure and Use of Alcoholic Beverages, to facilitate the obtaining of patents of live music halls by the establishments that it indicates, corresponding to Bulletin No. 14.534-06, for not to see organic matter.
