THE NATIONAL ASSEMBLY




Having regard to the Constitution;




In view of resolution No. 001-2015/AN of 30 December 2015 on validation


The mandate of Members;






Deliberated at its meeting on 14 May 2019


And adopted the law with the following content:

Article 1:


Law No. 013-2016/AN of 03 May 2016 on the regulation of the Bureaux


Information on credit (BIC) in Burkina Faso is amended as follows:


Instead of:


Article 53:


Any collection of information, use and sharing and dissemination of


Personal information, including credit information, is


Subject to prior consent of the client, natural person or


, concerned.


The customer's consent must be registered as part of the


Credit application or credit agreement.


Consent once obtained, users can proceed with the


Information from the CIO for the duration of the business relationship; and


For the purposes authorized by this Act. Information may not, in


No cases, focus on customer's deposits.


The obligation to obtain the prior consent of the client provided for in the paragraph


Above, does not apply to public data. It does not concern


The information requested by the central bank, by the


UMOA banking commission, tax administration or authority


Judicial proceedings in the course of criminal proceedings.
