amending and supplementing the law on Bulgarian identity documents (official SG. 93 of 1998; amend., SG. 53, 67, 70 and 113 of 1999, no. 108 of 2000, 42/2001 and 45/54 by 2002, no. 29 and 63 of 2003, no. 96, 103 and 111 in 2004, issue 43 , 71, 86, 88, and 105 by 2005, issue. 30, 82 and 105, 2006, issue. 29, 46 and 52 of 2007, PC. 66, 88 and 110 in 2008, PCs. 35 and 47 of 2009.)

§ 1. The name of the Act is replaced by the following: "the law on Bulgarian identification documents."

§ 2. The title of chapter I is amended as follows: "Bulgarian personal documents".

§ 3. In art. 1 make the following amendments and additions:

1. In paragraph 8. 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

2. in the Al. 2 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents" and the words "Ministry of transport" shall be replaced by "the Ministry of transport, information technology and communications.

3. Paragraph 3 is replaced by the following:

"(3) the refusal of Bulgarian personal documents, repossession and the imposition of other restrictions associated with their use and storage, are governed by law."

4. in the Al. 4, the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

5. a para. 5:

"(5) the Bulgarian personal documents within the meaning of this law are:

1. identity documents;

2. driving a motor vehicle;

3. the documents for the residence. "

§ 4. In art. 2 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

§ 5. Article 3 is amended as follows:

"Art. 3. (1) the identity documents certifying the identity and, if necessary, and citizenship, through the data.

(2) the identity of the Bulgarian citizens may be certified with replacement papers or other documents in order and in cases specified by law.

(3) the driving of a motor vehicle shall certify the right ability for driving a motor vehicle, and for Bulgarian citizens-and the identity of the territory of the Republic of Bulgaria, through the data contained therein.

(4) the documents for residence shall certify only the right of residence on the territory of the Republic of Bulgaria. "

§ 6. In art. 4 make the following amendments and additions:

1. Paragraph 2 shall be replaced by the following:

"(2) an alien resident in the territory of the Republic of Bulgaria shall be entitled to a document of identity or residence document, as well as the driving licence in the cases specified by law."

2. a new paragraph. 3:

"(3) the citizens of the European Union (EU), the citizens of States-parties to the agreement on the European economic area (EEA), Switzerland the Swiss citizens and their family members who are not nationals of the EU, EEA and Switzerland Confederation which, by virtue of the international treaties concluded with the EU are entitled to free movement are entitled to a residence document and driving licence issued in the Republic of Bulgaria in accordance with the procedure and in cases specified by law. "

3. The current paragraph. 3 it al. 4 and in her words "Bulgarian identity document" shall be replaced by "Bulgarian personal documents".

§ 7. Article 5 is amended as follows:

"Art. 5. For issuance of Bulgarian personal documents the persons under art. 4 appear before that authority under art. 1, al. 2 in the cases and under the conditions laid down in this law. "

§ 8. In art. 7 the following modifications are made:

1. In paragraph 8. 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

2. in the Al. 2 the words "identity document" shall be replaced by "personal documents".

§ 9. In art. 8 is hereby amended as follows:

1. In paragraph 8. 1 the words "identity documents" shall be replaced by "Bulgarian personal documents".

2. Paragraphs 2 and 3 shall be read with the following adaptations:

"(2) in the loss, theft, damage or destruction of the personal document Bulgarian person is obliged within three days to declare it at the nearest structural unit of the Ministry of internal affairs or diplomatic or consular representations of the Republic of Bulgaria abroad, and in the cases under art. 39 – the Ministry of defence or in the diplomatic and consular representations of the Republic of Bulgaria abroad.

(3) in the case of loss, theft, damage or destruction of the personal document Bulgarian person within three days may submit a Declaration on these circumstances by electronic means in a row set by decision of the Council of Ministers. "

3. in the Al. 4 the word "application" is replaced by "Declaration".

§ 10. Article 9 is amended as follows:


"Art. 9. (1) in the event of a change of name, the single civil number (personal number/personal number of alien), sex, nationality or when major and lasting changes of the image the person is required to submit an application for the issue of a new Bulgarian personal documents within 30 days.

(2) within the period referred to in paragraph 1. 1 in the event of a change of permanent address the person is required to submit an application for the issuance of the new ID card, residence permit under art. 59, para. 2, item 2 and 4, map, map of refugee alien asylum and received a map of alien with humanitarian status. In the event of a change of permanent address from one location to another location within 30 days of the issuance of the new document, the person is required to submit an application for the issue of a new driving licence.

(3) upon issue of a new Bulgarian previous ID of the same kind shall be returned to the issuing authority. "

§ 11. In art. 10 make the following amendments and additions:

1. The current text becomes paragraph 1 and in it:

and in the text) before item 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents";

b) in paragraph 2, after the word "nationality" is added "except for the driving of a motor vehicle";

in) item 5 shall be inserted:

"5. the expiry of their validity."

2. a para. 2:

"(2) the returned Bulgarian personal documents are subject to destruction. The methods of their destruction are governed by instruction of the relevant authority under art. 1, al. 2. "

§ 12. In art. 11 the words "Bulgarian identity document" shall be replaced by "Bulgarian personal documents".

§ 13. In chapter one the title of section II shall be replaced by the following: "types of Bulgarian personal documents".

§ 14. In art. 13, para. 2, item 2, the words "frontier pass" are replaced by "work sheet found crossing the border".

§ 15. Article 14 shall be amended as follows:

"Art. 14. (1) the residents of the Republic Bulgaria foreigners are issued the following IDs:

1. map of refugee;

2. map of the alien who has obtained the asylum;

3. alien map with humanitarian status;

4. a provisional map of the foreigner;

5. certificate of travel abroad as refugees;

6. certificate for traveling abroad to an alien who has received asylum;

7. certificate for travel abroad on the alien with humanitarian status;

8. certificate of travel abroad of a stateless person;

9. temporary certificate of departure from the Republic of Bulgaria;

10. certificate of return in the Republic of Bulgaria on the alien.

(2) The residents of the Republic of Bulgaria foreigners who have obtained a residence permit under the law on foreigners in the Republic of Bulgaria, shall be issued a residence permit documents – residence permit, in accordance with the requirements of Regulation (EC) No 1030/2002 of 13 June 2002 laying down a uniform format for residence permits for third-country nationals, hereinafter referred to as "Commission Regulation (EC) No 1030/2002.

(3) residents of the Republic of Bulgaria members of the families of citizens of the EU, members of the families of citizens of the Member countries of the EEA Agreement, members of the families of citizens of the Swiss Switzerland who are not citizens of the EU, EEA and Switzerland Confederation which, by virtue of the international treaties concluded with the EU have exercised their right of free movement under the conditions and pursuant to the law on the entry , residence and exit of the Republic of Bulgaria of the citizens of the European Union and members of their families, documents shall be issued a residence permit – residence permit with a note card, exercised their right of free movement ".

(4) The EU citizens, citizens of member countries of the EEA Agreement, Switzerland the Swiss citizens residing in the Republic of Bulgaria under the conditions and pursuant to the law on the entry, residence and departure of the Republic of Bulgaria of the citizens of the European Union and members of their families, shall be issued a certificate of residence of a Union citizen.

(5) an employee in the diplomatic mission or consular post or international organization, received accreditation in the Republic of Bulgaria shall be issued with a card of an accredited employee. "

§ 16. In chapter one the title of section III shall be replaced by the following: "data in Bulgarian personal documents".

§ 17. In art. 16 is made the following changes and additions:

1. In paragraph 8. 1:

and in the text) before item 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents";

b) in point 3, the words "or personal number for foreigner" shall be replaced by ' personal number or personal number for foreigner ".

2. in the Al. 2, after the word "status" added "military ID card, residence permit under art. 59, para. 2. "

3. Paragraph 3 is replaced by the following:

"(3) the names of the data in the Bulgarian personal documents are given in Bulgarian and English. In the case of obligations under the international instruments the names of the data can be picked and the French. "

4. a para. 5:

"(5) the personal number uniquely identifies the EU's citizens, citizens of member countries of the EEA Agreement, Switzerland the Swiss citizens and their family members who are not nationals of the EU, EEA and Switzerland Confederation which, by virtue of the international treaties concluded with the EU have the right to move freely. The manner of its formation is determined by the Council of Ministers. "

§ 18. In art. 17 the following amendments and supplements shall be made:

1. In paragraph 8. 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

2. Al are created. 4, 5 and 6:


"(4) are not taken biometrics-fingerprints of children under 12 years of age and persons with physical inability to capture fingerprints. Not taken biometrics-fingerprints of children up to 6 years of age and persons with physical inability to capture fingerprints for submission of applications for the issue of documents for residency under art. 59, para. 2 and 3.

(5) the person may not appear in person for an application for the issue of Bulgarian personal documents when: 1. the name change, the single civil number (personal number or number of alien), gender, or nationality are not major and lasting changes of the image of the person, and 2. have taken the necessary biometric data for up to two years from the date of submission of the application;

3. provided for in law.

(6) English ID gets personal, and in exceptional cases where the application has been lodged personally – by an authorised person after submission of a notarized power of Attorney specifically. "

§ 19. Article 18 shall be amended as follows:

"Art. 18. (1) application for issue of identity documents of Bulgarian citizens contains the following personal data:

1. the names;

2. date of birth;

3. place of birth;

4. Paul;

5. personal identification number;

6. the presence of another nationality;

7. eye color;

8. growth;

9. permanent address;

10. marital status;

11. contact phone.

(2) the application for the issuing of documents for residency under art. 59, para. 2 and 3 contain the following personal information:

1. the names;

2. date of birth;

3. place of birth;

4. Paul;

5. personal identification number (personal number or personal number of foreigner);

6. citizenship;

7. changed names;

8. the presence of another nationality;

9. permanent address;

10. current address (address);

11. education;

12. marital status;

13. telephone number;

14. number of another document of identity or residence permit.

(3) the applications for the issue of documents for residency under art. 59, para. 4 contain the following personal information:

1. the names;

2. date of birth;

3. place of birth;

4. Paul;

5. personal number;

6. citizenship;

7. changed names;

8. the presence of another nationality;

9. address;

10. number of national identity document;

11. education;

12. marital status;

13. contact phone.

(4) applications for the issue of identity documents to foreigners include the following personal data:

1. the names;

2. date of birth;

3. place of birth;

4. Paul;

5. personal identification number (personal number or personal number of foreigner);

6. citizenship;

7. changed names;

8. the presence of another nationality;

9. eye color;

10. growth;

11. special features;

12. permanent address;

13. present address (address);

14. education;

15. place of work;

16. marital status;

17. telephone number;

18. number (s) of other identification, if the person is issued, and the previous document of identity.

(5) Applications for the issue of a driving licence for foreigners include the following personal data:

1. the names;

2. date of birth;

3. place of birth;

4. Paul;

5. personal identification number (personal number or personal number of foreigner);

6. citizenship;

7. permanent address;

8. current address (address);

9. telephone number;

10. number (s) of another document of identity or document of residence if the person is issued. "

§ 20. In art. 18 and the following modifications are made:

1. Paragraph 1 shall be amended as follows:

(1) application for issue of the Bulgarian personal documents may be filed electronically under conditions and in accordance with procedures laid down by an act of the Council, when:

1. the person was issued a Bulgarian personal document on application personally to the two years before the date of filing of an application for a new document;

2. the person holds a valid certificate;

3. the person's biometric data required have been dropped. "

2. Paragraph 3 shall be amended as follows:

"(3) does not prevent the submission of application for issue of the Bulgarian personal documents electronically with the name change, the single civil number (personal number or number of alien), sex, nationality or when major and lasting changes of the image of the person."

3. Paragraph 5 shall be replaced by the following: "(5) where an application for the issue of Bulgarian personal document is submitted electronically, the document gets personal."

§ 21. Art is created. 18 (b):

"Art. 18B. The conditions and procedures for the storage and destruction of applications on the basis of which the Bulgarian personal documents have been issued, shall be determined by decision of the Council of Ministers. "

§ 22. In art. 19 is hereby amended as follows:

1. In paragraph 8. 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

2. in the Al. 2 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

3. Paragraph 3 is replaced by the following:

"(3) in the Bulgarian personal documents the names of Bulgarian citizens are given without abbreviations, as indicated in the submitted supporting documents, except in cases where their length exceeds that laid down the technical capability."

§ 23. In art. the following 20 amendments:

1. In paragraph 8. 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

2. in the Al. 2: a) on the text before point 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents";

(b)) in item 9, after the words "personal identification number" a comma and add a "personal number".

3. in the Al. 3 the words "identity document" shall be replaced by "Bulgarian personal documents".

4. in the Al. 4 Add "and documents referred to in art. 14, para. 5. "

§ 24. In art. 20 and following amendments and supplements shall be made:


1. In paragraph 8. 1, after the words "humanitarian status" a comma and add "military ID card and documents for residency under art. 59, para. 2 and 3 ".

2. paragraph 2 is replaced by the following:

"(2) the electronic media of information contains data under art. 20, para. 2, photo facial, his fingerprints and signature, taken upon submission of the application, as well as place of birth, written in Latin, and the names of the person written in Cyrillic. "

3. a new paragraph. 3:

"(3) in the documents for residency under art. 59, para. 3 contains electronic information in which you are enrolled and photo facial data under art. 20, para. 2. "

4. The current paragraph. 3 it al. 4.

5. a para. 5:

"(5) in cases where the electronic media information is available for reading due to damage, at the request of the person is issued a new document under para. 1 the duration of the validity of a damaged document. "

§ 25. Article 21 shall be amended as follows:

"Art. 21. (1) the names of the foreigners in Bulgarian personal documents are displayed in a row and number as listed in the travel documents with which they entered the Republic of Bulgaria. When foreigners receive asylum, refugee or humanitarian status, do not have such documents, their names are given in the order in which they indicate in a declaration signed by them before the competent authority. In the Bulgarian personal documents the names of persons are given without abbreviations, as indicated in the submitted supporting documents, except in cases where their length exceeds that laid down the technical capability.

(2) the names of the persons referred to in para. 1 in the Bulgarian personal documents are written with Bulgarian transliteration rules laid down by the Act of the Council of Ministers. "

§ 26. In art. 22, para. 1 is hereby amended as follows:

1. In the text before item 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

2. In paragraph 3 the words "25 mm and 35 mm" shall be replaced by ' 31.5 mm and 36 mm.

§ 27. In art. 26 the following modifications are made:

1. In paragraph 8. 1 item 11 is repealed.

2. paragraph 2 is replaced by the following:

"(2) an application for an identity card in addition to the data referred to in art. 18, al. 1 contains data for:

1. parents (names, date of birth);

2. spouse (names, personal identification number, a personal number/personal number of foreigner);

3. legal representative (name, personal identification number, a personal number/personal ID of the foreigner identity card number, date of issue, issuing authority, which issued the cookie);

4. the Decree of the President of the Republic of Bulgaria for a change of citizenship. "

§ 28. Article 31 is amended as follows:

"Art. 31. (1) the identity cards are issued and replaced by the Ministry of the Interior on the permanent address of the person after submission of the application and documents on civil status issued by the local administration in order, established by an act of the Council of Ministers.

(2) in cases where the identity card has expired, damaged, destroyed, lost or stolen, the person shall, within 30 days to submit an application for the issuance of the new ID card.

(3) at the request of the person a new identity card may be issued before the expiry of its validity.

(4) identity cards shall be issued within 30 days of the date of submission of the application.

(5) where an application for the issue of an identity card is submitted at the consular or diplomatic representations abroad, the time-limit for the issue is up to 90 days. "

§ 29. Art is created. 31A:

"Art. 31. (1) an application for an identity card shall be submitted personally.

(2) an application for an identity card of minors and of persons placed under guardianship shall be filed in person and in the presence of a parent, guardian or custodian who is making a signature in the application.

(3) in cases in which the child is of unknown or deceased parents or other legal representatives or guardian has not been appointed, as well as in cases in which, at the time of the age of 14 years of age the parents or legal representatives have not appeared to lay the signature in the application:

1. the application for the issuing of identity cards to minors, housed for breeding in specialised institutions, shall be filed in person and in the presence of the Director of the institution in which the child is placed in the order that signature in the application;

2. the application for the issuing of identity cards to minors, accommodated by a court decision with a foster family for rearing, is submitted in person and in the presence of a foster parent signature in the application;

3. the application for the issuing of identity cards to minors, housed by a court decision for growing into a family of relatives or loved ones, is submitted in person and in the presence of a close relative, or to whom the minor is placed, which signature in the application.

(4) Personal card receives a personal and exceptionally, where the application has been lodged personally – by an authorised person after submission of a notarized power of Attorney explicitly or by a person whose data are referred to by the applicant in the application to the officer at the time.

(5) identification of minors and of persons placed under guardianship shall be obtained from a parent, guardian or custodian, and exceptionally, by the authorized person after submission of a notarized power of Attorney explicitly or by a person whose data are referred to by a parent, guardian or custodian before the official in the application at the time.

(6) identification of minors issued on an application made in accordance with para. 3, is derived from the face, rendered in the application signature. "

§ 30. In art. 36 following amendments and supplements shall be made:


1. In paragraph 8. 2 the words "Ministry of transport" shall be replaced by "the Ministry of transport, information technology and communications.

2. a new paragraph. 3:

"(3) in cases where it is impossible to capture biometric data fingerprints from the face due to a temporary physical incapacity, may be issued a passport with a validity of 12 months."

3. the Previous para. 3 and 4 become Al respectively. 4 and 5.

§ 31. In art. 38, para. 1, item 4, the words "the State Inspectorate of the Mariners ' shall be replaced by" the Ministry of transport, information technology and communications.

§ 32. In art. 39 following amendments and supplements shall be made: 1. In paragraph 1, after the words "up to" 12 months "is added consistent with the time needed for the return of the Republic of Bulgaria".

2. point 2 shall be replaced by the following:

"2. a work sheet found crossing the border – to be issued by the Ministry of Internal Affairs of persons, and with the possibility of extension in accordance with international treaties;".

§ 33. In art. 41 the following modifications are made:

1. In paragraph 8. 1 item 3 shall be repealed.

2. paragraph 2 is repealed.

3. Paragraph 3 is replaced by the following: "(3) application for issue of passports and replacement documents in addition to the data referred to in art. 18, al. 1 contains data for:

1. parents (names, date of birth);

2. spouse (names, personal identification number, a personal number/personal number of foreigner);

3. legal representative (name, personal identification number, ID number, date of issue, issuing authority of issue);

4. the Decree of the President of the Republic of Bulgaria for a change of citizenship. "

§ 34. In art. 41 and item 9 shall be established:

"9. biometrics."

§ 35. In art. 44 para. 3 shall be amended as follows:

"(3) passport or substituting document it obtained personally, and in exceptional cases where the application has been lodged personally – by an authorised person after submission of a notarized power of Attorney explicitly or by a person whose data are referred to by the applicant in the application to the officer at the time."

§ 36. In art. 45 following amendments and supplements shall be made:

1. The current text becomes paragraph 1.

2. a para. 2:

"(2) a passport or substituting document it of minors and of persons placed under guardianship shall be obtained from a parent, guardian, custodian or a person authorized by them after the submission of a notarized power of Attorney explicitly or by a person whose data are referred to by a parent, guardian or custodian before the official in the application at the time."

§ 37. In art. 49 following amendments and supplements shall be made:

1. In paragraph 8. 1:

(a)) in the text before paragraph 1, after the word "Passport" is added "or documents representing them;

b) in paragraph 2, after the word "Passport" is added "or the document";

c) in paragraph 3, after the word "Passport" is added "or a substitute document it."

2. Paragraphs 2 and 3 shall be read with the following adaptations:

"(2) the unavailability of documents referred to in para. 1 shall be declared by the issuing authority.

(3) persons are required to return their passports and documents representing them to the issuing authority within three months after the expiry of their validity or dropping of the reason for their release or use. "

§ 38. In art. 50 al. 2 shall be amended as follows:

"(2) the driving of a motor vehicle and serves as an identification document for identification of Bulgarian citizens in the territory of the Republic of Bulgaria."

§ 39. In art. 53 following amendments and supplements shall be made:

1. In paragraph 8. 1 creating a 12:

"12. the emblem of the European Community for the driving licence containing the distinguishing sign of the Republic of Bulgaria."

2. paragraph 2 is repealed.

§ 40. The title of chapter v shall be replaced by the following: "Bulgarian personal documents issued to foreigners residing in the Republic of Bulgaria".

§ 41. Article 55 shall be amended as follows:

"Art. 55. (1) every alien who has obtained asylum, refugee or humanitarian status in accordance with the conditions and in accordance with the law on asylum and refugees, issued Bulgarian identity document.

(2) any person referred to in paragraph 1. 1 is required after the age of 14 years of age within 30 days to file an application for an identity document under art. 14, para. 1, item 1, 2 and 3.

(3) every alien who is permitted to reside in the Republic of Bulgaria under the conditions and pursuant to the law on foreigners in the Republic of Bulgaria for a period greater than three months, the residence permit is issued pursuant to Regulation (EC) No 1030/2002.

(4) The members of the families of citizens of the EU, the members of the families of citizens of the Member countries of the EEA Agreement, the members of the families of citizens of the Swiss Switzerland who are not citizens of the EU, EEA and Switzerland Confederation which, by virtue of the international treaties concluded with the EU have the right of free movement, residence permit shall be issued under the conditions and pursuant to the law on the entry , residence and exit of the Republic of Bulgaria of the citizens of the European Union and members of their families.

(5) The Union citizens, citizens of member countries of the EEA Agreement, citizens of the Swiss Switzerland which, by virtue of the international treaties concluded with the EU have the right of free movement, residence certificate shall be issued under the conditions and pursuant to the law on the entry, residence and departure of the Republic of Bulgaria of the citizens of the European Union and members of their families.

(6) The accredited in the Republic of Bulgaria diplomatic or consular posts or international organisations shall be issued cards confirming their status. "

§ 42. In art. 57 al. 1 shall be amended as follows:


(1) aliens who are allowed residence in the Republic of Bulgaria under the conditions and pursuant to the law on foreigners in the Republic of Bulgaria, identify themselves with national travel document and verify their right of residence with a residence permit in accordance with the requirements of Regulation (EC) No 1030/2002. "

§ 43. In chapter v the name of section II shall be replaced by the following: "types of identity documents of foreigners and residence documents.

§ 44. Article 59 shall be amended as follows:

"Art. 59. (1) The resident in the Republic of Bulgaria aliens shall be issued the following types of identity documents:

1. a refugee card – issued by the authorities of the Ministry of the Interior of a person with refugee status with a term of validity up to 5 years;

2. map of the alien who has obtained the asylum – issued by the authorities of the Ministry of the Interior of a person to whom asylum has been granted with a term of validity up to 5 years;

3. alien map with humanitarian status – issued by the authorities of the Ministry of the Interior on the alien with the provided humanitarian status, valid for up to three years;

4. temporary alien card – issued by the authorities of the Ministry of Internal Affairs of foreigners, whose national identity papers are taken away in cases provided for by law;

5. certificate of travel abroad to refugee – issued by the authorities of the Ministry of the Interior of a foreigner with refugee status with a term of validity up to 5 years, but no more than the period of validity of a refugee card;

6. certificate for travel abroad of the alien who has obtained the asylum – issued by the authorities of the Ministry of the Interior on the alien with the granted asylum valid for up to 5 years, but no more than the period of validity of the card of the alien who has obtained the asylum;

7. certificate for travel abroad on the alien with humanitarian status – issued by the authorities of the Ministry of the Interior on the alien with the given humanitarian status for a period of validity of up to three years, but no more than the period of validity of the card on the alien with humanitarian status;

8. certificate of travel abroad of the person without citizenship – issued by the authorities of the Ministry of Internal Affairs of foreigners who have the status of a stateless person and permitted permanent residence on the territory of the Republic of Bulgaria;

9. temporary certificate of departure from the Republic of Bulgaria – issued by the Ministry of Foreign Affairs.

(2) The residents of the Republic of Bulgaria, the following documents are issued aliens residence permit:

1. the residence permit of a long-term resident in the Republic of Bulgaria of foreign-issued by the authorities of the Ministry of the Interior with the term of validity of up to one year;

2. residence permit of permanent resident alien in the Republic of Bulgaria – issued by the authorities of the Ministry of the Interior for a period depending on the validity of the national identity document with which the person entered into the Republic of Bulgaria;

3. the residence permit of a long-term resident family member of an EU citizen who has not exercised the right of free movement, with indication "member of the family", issued by the authorities of the Ministry of the Interior with a term of validity up to 5 years;

4. residence permit permanent resident family member of an EU citizen who has not exercised the right of free movement, with indication "member of the family", issued by the authorities of the Ministry of the Interior with the term of validity of up to 10 years;

5. the residence permit of a long-term resident status by marking "beneficiary under article 3(2) of Directive 2004/38/EC", issued by the authorities of the Ministry of the Interior with a term of validity up to 5 years;

6. residence permit permanent resident with noteworthy "beneficiary under article 3(2) of Directive 2004/38/EC", issued by the authorities of the Ministry of the Interior with the term of validity of up to 10 years.

(3) The members of the families of citizens of the EU, the members of the families of citizens of the Member countries of the EEA Agreement, Switzerland the Swiss citizens who are not nationals of the EU, EEA and Switzerland Confederation which, by virtue of the international treaties concluded with the EU have the right to move freely, the following documents shall be issued a residence permit:

1. the residence permit of a long-term resident, Member of the family of a Union citizen who has exercised his right of free movement, with the note "card, exercised their right of free movement" – issued by the authorities of the Ministry of the Interior with a term of validity up to 5 years;

2. residence permit permanent resident family member of a Union citizen who has exercised his right of free movement, with the note "card, exercised their right of free movement" – issued by the authorities of the Ministry of the Interior with the term of validity of up to 10 years.

(4) The EU citizens, citizens of member countries of the EEA Agreement, citizens of the Swiss Switzerland which, by virtue of the international treaties concluded with the EU have the right to move freely, the following certificates shall be issued a residence permit:


1. for long-term residence – issued by the authorities of the Ministry of the Interior with a term of validity up to 5 years;

2. the permanent residence permit – issued by the authorities of the Ministry of the Interior with the period of validity of 10 years.

(5) an employee in the diplomatic mission or consular post or international organization accredited in the Republic of Bulgaria, the following types of cards are issued by the Ministry of Foreign Affairs for a period of validity depending on the period of accreditation: 1. a diplomatic card;

2. consular card;

3. map of administrative-technical personnel;

4. site support staff.

(6) a certificate of return in the Republic of Bulgaria to an alien is issued by diplomatic and consular representations of a stateless person or a foreigner with protection in the Republic of Bulgaria, Bulgarian abroad lost personal documents under para. 1, item 3, 4, 7 and 8. The same document and is issued to an alien under art. 34, para. 7 of the law on asylum and refugees, when not holding a valid national travel documents. "

§ 45. Article 60 shall be repealed.

§ 46. In chapter v the name of section III shall be replaced by the following: "the data contained in the identity documents of foreigners and residence documents.

§ 47. Article 61 shall be replaced by the following:

"Art. 61. (1) the identity documents of foreigners under art. 59, para. 1, item 1 – 4 in addition to the data referred to in art. 16, al. 1 contain the following data:

1. photograph of the holder;

2. place of birth;

3. growth;

4. eye color;

5. permanent address;

6. the signature of the holder;

7. the number of the document;

8. date of issue;

9. date of expiry;

10. the authority which issued the document;

11. number of national travel document;

12. other data provided for by law.

(2) identity documents of foreigners under art. 59, para. 1, item 5 – 9 in addition to the data referred to in art. 16, al. 1 contain the following data:

1. photograph of the holder;

2. place of birth;

3. signature of the holder;

4. the number of the document;

5. the date of issue;

6. date of expiry;

7. the authority which issued the document;

8. other particulars provided for by law. "

§ 48. Art is created. 61A:

"Art. 61. (1) the documents for residency under art. 59, para. 2 and 3 in addition to the data referred to in art. 16, al. 1 contain the following data:

1. photograph of the holder;

2. place of birth;

3. the number of the document;

4. address;

5. signature of the holder;

6. the date of issue;

7. date of expiry;

8. the authority which issued the document;

9. number of national travel document;

10. other data provided for in Regulation (EC) No 1030/2002.

(2) Documents for residency under art. 59, para. 4 in addition to the data referred to in art. 16, al. 1 contain the following data:

1. photograph of the holder;

2. address;

3. the number of the document;

4. signature of the holder;

5. date and place of issue;

6. date of expiry;

7. the authority which issued the document.

(3) the documents for residency under art. 59, para. 5 in addition to the data referred to in art. 16, al. 1, item 1, 2, 4 and 5 contain the following data:

1. photograph of the holder;

2. signature of the holder;

3. the number of the document;

4. date of issue;

5. date of expiry;

6. the authority which issued the document;

7. the signature of the Director of State Protocol;

8. the diplomatic mission or consular post or international organization to which the staff member is accredited;

9. the diplomatic rank or position.

(4) in the documents for the residence address is entered as:

1. under art. 59, para. 2, paragraphs 1 and 3 shall be entered this address;

2. under art. 59, para. 2, item 2 and 4 fits the permanent address.

(5) in the documents for residency under art. 59, para. 2, item 5 and 6 para. 3 and 4 address fits in the Republic of Bulgaria, he resides. "

§ 49. In art. 62 al. 1 shall be amended as follows:

"(1) an identity document of a foreigner or residence document issued on application to the relevant authority against presented national travel document with which the person entered into the country."

§ 50. Article 63 shall be amended as follows:

"Art. 63. An application for an identity document of the alien and the alien residence permits unless the relevant data under art. 18, al. 2 and 4 contain details of:

1. parents (names, date of birth, citizenship and personal number of foreigner);

2. brothers and sisters (names, date of birth, citizenship and personal number of foreigner);

3. spouse (names, date of birth, nationality, personal number on foreigners, he/she was Bulgarian citizen and how long until when, the residence at the time);

4. children up to 14 years (names, date of birth, nationality, personal number of foreigner);

5. legal representative (name, date of birth, nationality, personal number of foreigner);

6. the Decree of the President of the Republic of Bulgaria for a change of citizenship;

7. address abroad;

8. occupation abroad;

9. travel document (series, number, date, place of issue, period of validity);

10. visa (type, number and date of issuance, place of issue and the period of residence indicated in the visa);

11. date and place of entry into the Republic of Bulgaria;

12. the purpose of the visit in the Republic of Bulgaria;

13. the grounds of the authorised stay in the Republic of Bulgaria;

14. duration of residence in the Republic of Bulgaria;

15. address in the Republic of Bulgaria (names of the owner or user of the property);

16. institutions, organizations and persons, underwriting the cost of the person;

17. was the face of Bulgarian citizen, when to when and under what names;

18. additional persons under 14 years listed in the Passport, over which the person has parental rights or tutorial (name, nationality, date of birth, place of birth, addresses, personal numbers);


19. previous stays in the Republic of Bulgaria (when, for what period, addresses);

20. other circumstances and documents provided for by law. "

§ 51. Art is created. 63A:

"Art. 63. (1) a refugee Card, the card of an alien who has received asylum, and a map of the alien with humanitarian status are issued and replaced by the Ministry of the Interior on the permanent address of the person.

(2) in cases where the document referred to in paragraph 1. 1 has expired, damaged, destroyed, lost or stolen, the person shall, within 30 days to submit an application for the issuance of a new one.

(3) the application for the issuing of documents in the Al. 1 shall be submitted personally.

(4) the application for the issuing of the documents referred to in para. 1 minors and of persons placed under guardianship shall be filed in person and in the presence of a parent, guardian or custodian who is making a signature in the application.

(5) the application for the issuing of the documents referred to in para. 1 minors housed for breeding in specialised institutions, shall be filed in person and in the presence of the Director of the institution in which the child is placed in the appropriate order, only in cases where the child is of unknown or deceased parents or other legal representatives or guardian has not been appointed, as well as in cases in which, at the time of the age of 14 years of age the parents or legal representatives are not appeared to lay the signature in the application. "

§ 52. Art is created. 63 (b):

"Art. 63 (b) (1) refugee Map, map of the alien who has obtained asylum and alien card with humanitarian status gets personal, and exceptionally, by the authorized person after submission of the notarized power of Attorney explicitly.

(2) a refugee Card, the card of an alien who has received asylum, and a map of the alien with the humanitarian status of minors and of persons placed under guardianship shall be obtained from a parent, guardian or custodian, and exceptionally, by the authorized person after submission of the notarized power of Attorney explicitly.

(3) a map of refugee, alien card, received asylum, and a map of the alien with the humanitarian status of minors placed in institutions for children deprived of parental care is given by the Director of the institution in the cases under art. 63A, al. 5. "

§ 53. Article 64 shall be repealed.

§ 54. The title of Chapter vi shall be replaced by the following: "information funds with data related to Bulgarian personal documents".

§ 55. In art. 65 the following modifications are made:

1. In paragraph 8. 1:

and in the text) before item 1 the words "identity documents" shall be replaced by "personal documents";

(b)) in item 1, 2 and 3 the words "identity documents" shall be replaced by "Bulgarian personal documents".

2. Paragraph 3 shall be amended as follows:

"(3) on the basis of the automated information funds under para. 1 creating a National Automated informative Fund for Bulgarian personal documents – "national register of the Bulgarian personal documents."

§ 56. In art. 66 is hereby amended as follows:

1. In paragraph 8. 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

2. paragraph 2 is replaced by the following:

"(2) in the Fund under para. 1 data are stored and enforced measures for state coercion related to identity documents and residence permits of foreigners or their residence in the Republic of Bulgaria. "

§ 57. In art. 69, para. 1 the words "identity documents" shall be replaced by "Bulgarian personal documents".

§ 58. In art. 70 is made the following changes and additions:

1. In paragraph 8. 1: a) on the text before point 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents";

(b) in item 1) add "and to persons entrusted with by law to perform public functions;

in points 2 and 3) are hereby amended:

"2. citizens holding Bulgarian personal documents only if the data does not affect third parties;

3. legal persons on the basis of law or by an act of the judiciary. "

2. Paragraph 3 shall be amended as follows:

(3) Citizens holding Bulgarian personal documents, have the right to obtain information held in funds with data related to Bulgarian personal documents related to third parties, only on the basis of law or by an act of the judiciary. "

§ 59. In art. 72 words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents" and the words "with the Convention for the protection of individuals with regard to automatic processing of personal data" shall be replaced by "the law on protection of personal data and with the Convention No 108 of the Council of Europe by 28.01.1981 on the protection of individuals with regard to automatic processing of personal data, done at Strasbourg on 28 January 1981. , ratified by law (SG 56/02) (SG. 26 of 2003).

§ 60. In art. 74 following amendments and supplements shall be made:

1. a new paragraph. 2:

(2) withdrawal of identity cards shall be kept by the issuing authority, took to dropping the measure, immediately notify the appropriate structure of the Interior Ministry, which issued the document. "

2. The current paragraph. 2 it al. 3.

§ 61. In art. 75 following amendments and supplements shall be made: 1. In the text before item 1 the comma and the words "and replacement passports and documents shall not be issued" shall be deleted.

2. point 3 shall be replaced by the following: "3. persons sentenced to imprisonment to serving their sentence, except in the cases under art. 66 and 70 of the Penal Code; ".

3. an item 6:

' 6. persons failing to comply with the judicial enforcement Act, by virtue of which they are convicted to pay a monetary obligation in large sizes to Bulgarian individuals and legal entities or foreign persons, unless duly submit collateral. "


§ 62. In art. 76 following amendments and supplements shall be made:

1. In the text before item 1 the comma and the words "replacement passports and documents to be issued" shall be deleted.

2. In paragraph 1, the word ' three ' is replaced by ' five '.

3. Sections 2, 3, 4, 5, 6, 7 and 8 are hereby repealed.

4. In paragraph 9, after the words "that have no" add "notarized".

§ 63. In art. 76 a, para. 1 the words "during his residence abroad ' shall be deleted.

§ 64. In art. 79, para. 2 the words "item 1 – 3" shall be deleted.

§ 65. In section I of chapter seven establishes the art. 79A:

"Art. 79. The conditions and procedures for the storage and destruction of files in the application of the measures referred to in this section shall be determined by decision of the Minister of the Interior, the Chairman of the State Agency for national security and the Chairman of the State Commission on information security. "

§ 66. In art. 80 the following modifications are made:

1. In paragraph 1 the words "identity documents" shall be replaced by "Bulgarian personal documents".

2. In paragraph 2, the words "identity document" shall be replaced by "Bulgarian personal documents".

3. In paragraph 3 the words "Bulgarian identity document" shall be replaced by "Bulgarian personal documents".

4. In paragraph 5, the words "identity document" shall be replaced by "Bulgarian personal documents".

§ 67. Article 81 shall be replaced by the following:

"Art. 81. (1) a fine of 20 to 150 EUR a person who:

1. do not apply for replacement of their Bulgarian personal documents within 30 days of a change in name, the single civil number, gender, nationality, permanent address or in the major and lasting changes of the image;

2. do not make the necessary as a parent, guardian or custodian for the supply of identity card of the person who has completed 14 years of age;

3. do not submit an application for the issue of an identity card within 30 days after it is stated that she is damaged, destroyed, lost or stolen;

4. If the person concerned is over 18 years and has not submitted an application for the issue of an identity card;

5. do not apply within 30 days for a replacement ID card after the expiry of its validity;

6. do not return his passport or replacement document it issuing authority within three months after the expiry of its validity, or if the reason for the issue or its usage.

(2) a fine of 30 to 200 EUR a person who: 1. is a Bulgarian citizen and not declare to the competent Bulgarian authorities the acquisition of identity documents issued by another Member State, within the time limit;

2. lose, damage or destroy Bulgarian personal documents;

3. is not addressed within three days, loss, theft, damage or destruction of the Bulgarian personal documents;

4. has declared Bulgarian personal documents for damaged, destroyed, lost or stolen and found that continues to use it;

5. announce false data upon application for the issue of Bulgarian personal documents, if not subject to more severe punishment under other law;

6. use irregular Bulgarian personal documents;

7. prevent the authorities to conduct an inspection for identification.

(3) in the event of a repeated offence under subsection. 2 the penalty is a fine of 50 to 300 EUR

(4) diplomatic and consular representations of the Republic of Bulgaria abroad shall impose and collect fines, restated in USD, euro or in local currency. "

§ 68. Article 82 shall be replaced by the following:

"Art. 82. For minor infractions of this law shall apply the provisions of art. 28 of the law for the administrative offences and sanctions or imposed a fine on a receipt up to 20 EUR by authorised officials. "

§ 69. In the additional provision, the following amendments and supplements shall be made:

1. The title shall be replaced by the following: "additional provisions".

2. In paragraph 1:

a) point 2 is replaced by the following:

"2." Irregular Bulgarian personal document is one that:

a) has not been issued in accordance with this Act and does not contain the particulars provided for therein;

(b)) is not officially endorsed by the issuing authority, where this is required, or is issued by a person or body not competent;

in) does not allow to establish identity of the holder in the picture;

(d)) has prepravki, deletions, additions, deletions and other;

e) there are traces of the replacement of the photograph, the seal is unclear or image of the person in the photo does not match the actual image;

is) is missing or new pages added;

(g)) has expired;

h) is inconsistencies between the data in the electronic medium of information and the Visual part of the document;

and) is available for reading electronic format of information because of a disability. ";

(b) in item 9), the words "identity documents" shall be replaced by "Bulgarian personal documents";

c) in item 10 the words "identity documents" shall be replaced by "Bulgarian personal documents";

d) in 11 words "identity documents" shall be replaced by "Bulgarian personal documents";

(e)) is hereby set up item 19:

"19." persons entrusted by law to perform public functions "are private notaries and bailiffs."

3. § 1a shall be inserted:

"§ 1 (a). Bulgarian personal documents issued in electronic format of information with stored biometric data in the presence of technical possibility. "

§ 70. In the transitional and final provisions the following modifications are made:

1. paragraph 2 shall be replaced by the following:


㤠2. Bulgarian personal documents are made in accordance with the recommendations of the International Civil Aviation Organization (ICAO) (document 9303), the requirements of Regulation (EC) No 1030/2002 of 13 June 2002 laying down a uniform format for residence permits for third-country nationals, the requirements of Regulation (EC) No 380/2008 of 18 April 2008 amending Regulation (EC) No 1030/2002 laying down a uniform format for residence permits for third-country nationals (OJ , 115 L/1 of 29 April 2008), the requirements of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, amending Regulation (EEC) No 1612/68 and repealing directives 64/221/EEC , 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC, 90/365/EEC and 93/96/EEC, the requirements of Regulation (EC) No 2252/2004 of 13 December 2004 on standards for security features and biometrics in passports and travel documents issued by Member States, the requirements of Regulation (EC) no 444/2009 of the European Parliament and of the Council of 28 May 2009 amending Commission Regulation (EC) No 2252/2004 on standards for security features and biometrics in passports and travel documents issued by Member States (OJ L 142/1 of 6 June 2009), Directive 91/439/EEC of 29 July 1991 on driving licences, Convention No 108 for the national identity certificates for seafarers , adopted at Geneva on 13 May 1958, ratified by Decree of the State Council (SG. 93 of 1976) (SG. 33 of 1978), and the Convention relating to the status of refugees, done at Geneva on 28 July 1951, ratified by law (promulgated, SG. 36 of 1992; amend., SG. 30 of 1993) (SG. 88 of 1993).

2. paragraph 3 shall be amended as follows:

„§ 3. The models of the Bulgarian personal documents approved by decision of the Council of Ministers, on a proposal from the Minister of the Interior, the Minister of Foreign Affairs, the Minister of transport, information technology and communications and the Minister of Defense. "          

3. In paragraph 4, the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

4. In paragraph 10, the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

5. Article 20 shall be amended as follows:

"§ 20. Applications for service passports shall be submitted to the Ministry of transport, information technology and communications, where more work time are sent to the Sofia Directorate of internal affairs or the district Directorate of the Ministry of the Interior (SDVR/the MINISTRY of the INTERIOR), in which the applicant appears in person to capture biometric data. The applicant may not appear personally to capture biometric data, if there is no change of name, the single civil number, gender, citizenship or are not major and permanent changes to the image of his face and taken the necessary biometric data for up to two years from the date of submission of the application. The custom passport is derived from the place where the application is made. "

6. Article 21 shall be amended as follows:

"§ 21. Applications for the issue of Bulgarian personal documents of foreigners of the Ministry of Internal Affairs shall be submitted at the MINISTRY of the INTERIOR in SDVR/and migration Directorate in the order, established by the Council of Ministers. The custom ID is derived from the place where the application is made. "

7. In paragraph 23, the words "Minister of transport" shall be replaced by the words "the Minister of transport, information technology and communications.

§ 71. In the transitional and concluding provisions of the law amending and supplementing the law on Bulgarian identity documents (official SG. 105 of 2006; amend., 110/2008) make the following amendments and additions:

1. paragraph 25 shall be repealed.

2. § 28 para. 1:

(a)) in the text before paragraph 1, after the words "identity documents" a comma and add "documents";

b) point 1 shall be amended as follows:

"1. the repayment of debts to contractors companies in connection with the acquisition of assets or services pursuant to a contract relating to the issue of identity documents for residence in the Republic of Bulgaria and for driving a motor vehicle;".

Final provisions

§ 72. In the code of civil procedure (promulgated, SG. 59 of 2007; amend., no. 50 of 2008; the Decision the Constitutional Court No. 3 of 2008 – No. 63 by 2008; amend., SG. 69 since 2008, issue 12, 18, 32 and 42 by 2009; No. 4 Decision of the Constitutional Court of 2009 – No. 47 of 2009) in art. 310, p. 5, the words "the law on Bulgarian identity documents" shall be replaced by ' the law on Bulgarian identification documents. "

§ 73. In the family code (promulgated, SG. 47 of 2009; amend., 74/2009) in art. 137, para. 4, the words "the law on Bulgarian identity documents" shall be replaced by ' the law on Bulgarian identification documents. "

§ 74. In the law on Bulgarian citizenship (official SG. 136 of 1998; amend. 41/2001, no. 54 of 2002, 109 and 52/2007, no. 74 of 2009) in art. 37, para. 2, item 2, the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

§ 75. In the law on civil registration (official SG. 67 of 1999; amend., SG. 28 and 37 of 2001 No. 54 of 2002, 63/2003, no. 70 and 96 of 2004, no. 30 of 2006 and 48/59 of 2007 No. 105 of 2008, issue 6, 19, 47 and 74 of 2009) make the following changes :

1. In art. 95, para. 1 the words "the law on Bulgarian identity documents" shall be replaced by ' the law on Bulgarian identification documents. "


2. In art. 97 words "Bulgarian identity document" shall be replaced by "Bulgarian personal documents".

3. In art. 112, para. 1 the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

4. In art. 114, para. 3 the words "the law on Bulgarian identity documents" shall be replaced by ' the law on Bulgarian identification documents. "

5. In art. 115, para. 1, item 1, the words "Bulgarian identity documents" and "identity documents" shall be replaced by "Bulgarian personal documents".

§ 76. In the law on income tax of individuals (official SG. 95 2006; amend., SG. 52, 64 and 113 (2007), no. 28, 43 and 106 since 2008, issue 25, 32, 35 and 41 of the 2009) § 1, item 2 of the supplementary provisions, the words "the law on Bulgarian identity documents" shall be replaced by ' the law on Bulgarian identification documents. "

§ 77. In the Access Act and the disclosure of the documents and announcement of the affiliation of Bulgarian citizens to the State security and intelligence services of the Bulgarian people's Army (official SG. 102 of 2006; amend., SG. 41, 57 and 109 from the 2007 No. 69 since 2008, issue 25, 35 and 42 since 2009) in art. 21, para. 4, the words "Bulgarian identity documents" shall be replaced by "Bulgarian personal documents".

§ 78. The State Agency for national security (promulgated, SG. 109 of 2007; amend., SG. 69 and 94 since 2008, issue 22, 35 and 42 since 2009) in art. 41, para. 3 the words "the law on Bulgarian identity documents" shall be replaced by ' the law on Bulgarian identification documents. "

§ 79. § 81. In the law on protection of persons endangered in relation to criminal proceedings (official SG. 103 of 2004; amend. 82/06, 33/66 and since 2008) is hereby amended as follows:

§ 82. § 87. § 90.
