amending and supplementing the law on electronic communications (promulgated, SG. 41 since 2007; amend. and Suppl., SG. 109 (2007), no. 36, 43 and 69 since 2008, issue 17, 35, 37, 42 of 2009; the Decision the Constitutional Court No. 3 of 2009 – No. 45 of 2009; amend., SG. 82 from 2009.)
§ 1. In art. 3 paragraph 2 shall be replaced by the following:
"2. the State bodies and their administrations in relation to national security."
§ 2. In art. 10 is hereby amended as follows:
1. In paragraph 8. 1 the words "Ministry of transport" shall be replaced by "the Ministry of transport, information technology and communications", and the words "Ministry of emergency situations" and "State Agency for information technology and communications" shall be deleted.
2. in the Al. 2:
a) in the first sentence the words "the Chairman of the State Agency for information technology and communications" shall be replaced by the words "the Minister of transport, information technology and communications;
(b) in the third sentence the words), "State Agency for information technology and communications" shall be replaced by "the Ministry of transport, information technology and communications.
3. in the Al. 4, the words "State Agency for information technology and communications" shall be replaced by "the Ministry of transport, information technology and communications.
§ 3. In chapter three the title of section III shall be replaced by the following: "Minister of transport, information technology and communications.
§ 4. Article 15 shall be amended as follows:
"Art. 15. Minister of transport, information technology and communications is a specialised body of the Executive power, which shall carry out the State policy in the field of electronic communications and the information society. "
§ 5. In art. 20, para. 1, item 14, after the words "calamity" is placed to the end point, and the text is deleted.
Additional provision
§ 6. In other texts of law: 1. the words "Chairman of the State Agency for information technology and communications" and "Chairman of the State Agency for information technology and communications" shall be replaced respectively with "the Minister of transport, information technology and communications and the Minister of transport, information technology and communications.
2. "State Agency for information technology and communications" shall be replaced by "the Ministry of transport, information technology and communications.
3. "Ministry of transport" and "Minister of transport" shall be replaced respectively with "the Ministry of transport, information technology and communications and the Minister of transport, information technology and communications.
Transitional and final provisions
§ 7. Issued prior to the entry into force of this law, the regulations retain the action, in so far as they do not contradict it.
§ 8. The law shall enter into force on the day of its publication in the Official Gazette.
The law was adopted by 41-Otto National Assembly on 28 October 2009 and is stamped with the official seal of the National Assembly.
