amending and supplementing the law on postal services (official SG. 64 since 2000; amend., SG. 112 of 2001 and 45/76 of 2002, no. 26 of 2003, issue 19, 88, 99 and 105 by 2005, issue 34, 37, 80 and 86 by 2006, issue 41, 109 and 53 of 2007, 109/2008 and no. 35 of 2009.)

§ 1. In art. 2 is hereby amended as follows:

1. In paragraph 2, the words "carrying out the universal" are replaced by "ensuring completion of the universal".

2. point 3 shall be replaced by the following:

"3. the liberalization of the market in postal services and the establishment of conditions for competition;".

§ 2. Article 5 is amended as follows:

"Art. 5. (1) postal services are carried out through postal networks, which may include stationary and/or mobile post offices, postal agencies and exported postal counters, circulation and sorting centers and units, transportation and technical means.

(2) the contact points and means of postal networks are related to organizational and technological order acceptance, transport and delivery of postal items and postal remittances. "

§ 3. In art. 6, al. 2 the words "direct mail" are deleted.

§ 4. In art. 7 in the text before item 1 the words "on the basis of an individual licence or registration" shall be deleted.

§ 5. The title of chapter II shall be replaced by the following: "governance and regulation of the postal services".

§ 6. In chapter II the title of section I shall be replaced by the following: "Government of the postal services".

§ 7. Article 9 is amended as follows:

"Art. 9. State administration of postal services is carried out by the Minister of transport, information technology and communications. "

§ 8. Art is created. 9A:

"Art. 9A. (1) the Council of Ministers shall, on a proposal from the Minister of transport, information technology and communications delivered by the Postal Sector policy decision on the guidelines for the sustainable development of postal services in the market of postal services and of the postal infrastructure. The decision on the adoption of the Sectoral policy and mail are published in the "Official Gazette".

(2) Segment mailing policy is updated at least once every four years. "

§ 9. Article 10 is amended as follows:

"Art. 10. Minister of transport, information technology and communications is conducting the State policy in the field of postal services. "

§ 10. In art. 11 is hereby amended as follows:

1. In paragraph 8. 2, the words "to the Minister of State administration and administrative reform" are replaced by "to the Minister of the Interior".

2. in the Al. 3 the words "on a proposal from the Minister of State administration and administrative reform" shall be replaced by ' on a proposal from the Minister of the Interior ".

§ 11. In art. 12, al. 1 the words "the Chairman of the State Agency for information technology and communications" shall be replaced by the words "the Minister of transport, information technology and communications.

§ 12. In art. 13 make the following amendments and additions:

1. In the text before point 1, the words "the Chairman of the State Agency for information technology and communications" shall be replaced by the words "the Minister of transport, information technology and communications.

2. point 1 shall be amended as follows:

1. draw up and submit for adoption by the Council of Ministers draft sectoral policy for postal guidelines for the sustainable development of postal services in the market of postal services and of the postal infrastructure; ".

3. a new paragraph 2:

2. prepare and issue regulations relating to the implementation of its powers provided for in this law; ".

4. The current paragraph 2 becomes paragraph 3 and shall be amended as follows:

"3. to represent the Republic of Bulgaria in the Universal Postal Union, as well as in European and regional organizations and bodies in the field of postal services;".

5. a new item 4:

4. ensure the fulfilment of the obligations of the Republic of Bulgaria in the field of postal services, related to membership in the European Union and in international organizations; ".

6. Current item 3 becomes item 5.

7. an item 6:

6. determine the composition of Specialized expert advice on markoizdavane; ".

8. The current paragraph 4 becomes item 7 and in it:

a) in paragraph (a), the words "analysis and prediction" shall be replaced by "analyzing and forecasting development";

(b)) (c) shall be replaced by the following:

"in organizing and controlling) the activities of national and international exchange markohraniliŝe of postage stamps."

§ 13. Article 13A shall be replaced by the following:

"Art. 13. (1) the Minister of transport, information technology and communications before issuing or depositing in the Council of Ministers of acts under art. 9 a, para. 1 and art. 76 issued projects drawn up in the national daily newspaper, and the message along with the text of the draft of the page of the Ministry of transport, information technology and communications on the Internet.

(2) the notice shall specify a period of not less than 30 days, within which interested parties may submit written comments on the draft.


(3) the Minister of transport, information technology and communications examines the opinions and reflects the accepted proposals.

(4) the procedure for public comment ends with the publication on the website of the Ministry of transport, information technology and communications in the Internet bids, locations and texts, which are reflected in the adopted proposals, and the reasons for the inadmissible. "

§ 14. In art. 14 is hereby amended as follows:

1. In paragraph 8. 1, the words "of a universal postal service or part thereof and the operators of non-General postal services ' shall be deleted.

2. in the Al. 2 the words "the Chairman of the State Agency for information technology and communications" shall be replaced by the words "the Minister of transport, information technology and communications.

§ 15. Article 15 shall be amended as follows:

"Art. 15. (1) the Communications Regulation Commission regulates the performance of the postal services in accordance with this law, such as:

1. ensure the conditions for carrying out universal postal service throughout the country;

2. ensure the conditions for effective competition in the market of postal services and equality of postal operators;

3. shall issue, amend, Supplement, suspend, terminate and takes individual licences for:

a) carrying out universal postal service;

(b)) services, included in the scope of the universal postal service;

in carrying out postal) money transfers;

4. fit the faces in a public register of operators performing non-General postal services under art. 38, item 2 and/or 3 and, on request, issue a certificate of registration in the register;

5. protect the interests of users of postal services;

6. lays down measures to protect the secret of correspondence and supervises their implementation;

7. determine norms for universal postal service quality and efficiency of service, which shall be published in the Official Gazette;

8. adopt a system for the formation of the postal codes of the networks of the postal operator with the obligation to carry out the universal postal service and the postal operators providing services included within the scope of the universal postal service; the system shall be promulgated in the State Gazette;

9. may make to postal operators justified written requests for information, including financial, in the volume, duration and detail necessary for the exercise of regulatory functions, ensuring her protection, if it is a trade secret of the operator; in the grounds of the request shall state the reasons and purposes for which the information is sought;

10. develop and adopt criteria for determining trudnodost″pnost of areas in the country and villages in them;

11. develop, in agreement with the Commission for protection of competition of the project methodology for proving the deficit by carrying out universal postal service, including the uneconomic conditions; the methodology shall be adopted by the Council of Ministers on a proposal from the Commission for communications regulation;

12. develop and adopt regulations for determining the density of access points within the postal network of the postal operator with the obligation to carry out the universal postal service, to match the number and density of the needs of users;

13. develop methodology for determining affordability of the universal postal service; the methodology shall be adopted by the Council of Ministers on a proposal from the Commission for communications regulation;

14. the agreed price of the universal postal service by type of services;

15. reconcile the information provided by the postal operator with an obligation to universal postal service system for the allocation of costs by type of services; defines the procedure and the timetable for the line to establish coherence;

16. Approves the proven deficient in implementation of universal postal service, including the uneconomic conditions for the following calendar year, in accordance with the procedure referred to in paragraph 11;

17. give an opinion on disputes between consumers and postal operators on the claims made in connection with the operation of the universal postal service;

18. coordinate data provided by postal operators terms and conditions of the contract with users;

19. develop, in agreement with the Commission for protection of competition draft Ordinance on the rules for providing access to the network of postal operator with the obligation to carry out the universal postal service and the formation of prices for access; the Ordinance is adopted by the Council of Ministers on a proposal from the Commission for communications regulation;

20. the agreed prices for the provision of access to the network of postal operator with an obligation to universal postal service;

21. following a reasoned written request provided by the Minister of transport, information technology and communications information needed for carrying out the State policy in the field of postal services.

(2) the Communications Regulation Commission shall publish the decisions referred to in para. 1, item 6, 7, 8, 10 and 12 in the information your newsletter and on your page on the Internet. "

§ 16. In art. 15 and following amendments and supplements shall be made:

1. In paragraph 8. 1:

a) in paragraph 2 the word "provision" is replaced by "carrying";

5. obligations of operators performing non-General postal services under art. 38, item 2 and/or 3, in accordance with this law; "

is the current point 7) becomes point 8.

2. in the Al. 2 the words "organized" and "level of ' shall be deleted, and then added," on the basis of the results of the measurements referred to in art. 36 a, para. 1. "

§ 17. (B) article 15 is amended as follows:

"Art. 15B. (1) in the drafting of the acts provided for in this law, as well as on other issues of importance for the development of Community postal services, the Commission for communications regulation procedures for public comment, issued the project and the reasons for its preparation in a national newspaper and on your page on the Internet.

(2) in the notice referred to in paragraph 1. 1 shall indicate the location where interested parties can obtain project, and a period of not less than 30 days of the publication in which they may submit written comments on it.

(3) the Communications Regulation Commission shall study the opinions and reflects the accepted proposals.

§ 18. Art is created. 15 c:

"Art. 15. § 19. Art is created. 16A:

"Art. 16A. The Communications Regulation Commission shall notify the European Commission about regulations under art. 15, para. 1, item 7 and the criteria of art. 15, para. 1, item 10.

§ 20. In art. 17 the following modifications are made:

1. In paragraph 8. 1:

a) in paragraph 2 the words "types of services from the scope of the universal postal service" are replaced by "the way we have solved";

(b)) point 3 shall be repealed.

2. in the Al. 2 the words "in its information bulletin and in the" replace with "of".

§ 21. In art. 19 the following amendments and supplements shall be made:

1. In paragraph 1, the words "resolution making" are replaced by "for making" and the words "or in a part thereof ' shall be deleted.

2. Create a new item 2 and item 3:

"2. the issued individual license for the provision of services falling within the scope of the universal postal service;

3. the issued individual license to perform postal remittances; ".

3. The current paragraph 2 becomes paragraph 4 and the words "registration certificate" shall be replaced by the words "submitted written notification".

§ 22. In art. the following 20 amendments:

1. In paragraph 8. 1:

a) a new item 5:

"5. the requirements for the protection of personal data;"

(b)) the current item 5 becomes item 6 and shall be amended as follows:

6. create conditions for the implementation of the monitoring and control of postal services by the competent authorities of the Ministry of the Interior and the State Agency for national security and delivered, installed, bring into service and maintain at its own expense the necessary for their activity technical devices and software provide, if necessary, using them for consideration by other postal operators or use where appropriate such resources for consideration of other postal operators; "

§ 23. In art. 21 the following amendments and supplements shall be made:

1. Paragraph 2 shall be replaced by the following:

"(2) the postal operator with the obligation to carry out the universal postal service and postal operators, licensed to perform the services under art. 39, item 2 and/or 3, include the terms and conditions of the contract with customers: 1. the scope and characteristics of the services performed;

2. conditions of access;

3. the conditions for the acceptance and delivery of postal items, postal parcels and postal remittances;

4. term of delivery of postal items, postal parcels and postal remittances;

5. method of payment;

6. rights and obligations of consumers and postal operators;

7. prohibited in mail and postal parcels substances and articles;

8. claims and compensation procedures, with specific amounts of compensation for delayed, lost, totally or partially damaged or spoiled mail and postal packages and non-repatriation in the amount of the delivery to the sender;

9. procedure for settlement of disputes;

10. other significant conditions on conduct and the use of postal services. "

2. a new paragraph. 3:

(3) postal operators providing universal postal services under art. 38, item 2 and/or 3, include the terms and conditions of the contract with users:

1. the types of services performed;

2. the conditions for the acceptance and delivery of postal items;

3. time limits for delivery;

4. rights and obligations of consumers and postal operators;

5. banned in postal items substances and articles;

6. claims and compensation procedures, with specific amounts of compensation for delayed, lost, totally or partially damaged or spoiled mail and postal packages and non-repatriation in the amount of the delivery to the sender;

7. procedure for settlement of disputes;


8. other significant conditions on conduct and the use of postal services. "

§ 24. In art. 23 is made the following changes and additions:

Access to contracts in which the parties agree on the specific technical, financial, technological and other terms and conditions of the connection.

(2) the postal operator with an obligation to universal postal service can provide and negotiate access to the postal network and with postal operators providing universal postal services under art. 38, item 2 and/or 3 when practicable. "

2. a new paragraph. 3:

(3) postal operators providing services included within the scope of the universal postal service, may provide and negotiate reciprocal access to their networks with each other and with the postal operators of non-General postal services. "

3. The current paragraph. 3 it al. and 4 shall be replaced by the following:

"(4) in case of acceptance, transport and delivery of postal items and postal money transfer by postal operators, contracted for access to their networks, each of the operators be liable to the other operator for the operation of the service only for its part of the adoption, transfer and delivery."

4. The current paragraph. 4 it al. 5, and shall be amended as follows:

"(5) the postal operators providing postal services by contract for access to their networks, shall be jointly and severally responsible to consumers for the damage or injury occurred when, transport and delivery of postal items and postal remittances."

5. The current paragraph. 5 it al. 6 and in it:

a) in the first sentence the word "operators" is replaced by "postal operators", and the word "mutual" shall be deleted;

§ 25. Article 23 (a) shall be replaced by the following:

"Art. 23A. Postal operators providing services included within the scope of the universal postal service, organize and carry out reporting on their activities in accordance with the applicable accounting standards as general trading company, and analytical and separately for:

1. services included in the scope of the universal postal service;

2. neuniversalnite postal services, in the event that such;

3. other commercial activities. "

§ 26. In chapter three the title of section II shall be replaced by the following: "Postal operator with an obligation to universal postal service".

§ 27. Article 24 is amended as follows:

"Art. 24. (1) the postal operator required under this Act to carry out universal postal service through the postal network throughout the country, including in the uneconomic conditions, is the company "Bulgarian post" EAD.

(2) for carrying out universal postal service of a postal operator in al. 1 individual license is issued. "

§ 28. In art. 25 the following modifications are made:

1. In paragraph 8. 1 the words "the main postal operator but universal" are replaced by "the postal operator with the obligation to carry out the universal postal service in addition to this".

2. in the Al. 2 the words "the primary postal operator" shall be replaced by ' the postal operator with an obligation to universal postal service ".

§ 29. In art. 26 the following modifications are made:

1. In paragraph 8. 1 the words "the main postal operator ' shall be replaced by ' the postal operator with an obligation to universal postal service".

2. in the Al. 2 the words "the primary postal operator" shall be replaced by ' the postal operator with an obligation to universal postal service ".

§ 30. In art. 27, the words "the primary postal operator is liable" shall be replaced by ' the postal operator with an obligation to universal postal service is required.

§ 31. In art. 28 the words "the main postal operator ' shall be replaced by ' the postal operator with an obligation to universal postal service" and the words "the Chairman of the State Agency for information technology and communications and the Minister of transport in his capacity as principal of the primary postal operator ' shall be replaced by the words" the Minister of transport, information technology and communications.


§ 32. In art. 29 following amendments and supplements shall be made:

1. 3. in the Al. 3:

§ 33. In art. 29 and the following amendments and supplements shall be made:

1. In paragraph 8. 1 the words "the main postal operator ' shall be replaced by ' the postal operator with an obligation to universal postal service", the word "implementing" shall be replaced by "carrying", and after the word "service" is add "including".

2. in the Al. 2, the words "by type of service and a total of implementation of universal postal service" are replaced by "for the pursuit of universal postal service both globally and in types of services" and the words "item 12" shall be replaced by "11".

§ 34. In art. 30 the words "main postal operator" is replaced by "postal operator under art. 24, para. 1. "

§ 36. In chapter three, section II is creating art. 31: "art. 31. The postal operator with an obligation to form a universal postal service prices to ensure access to the postal network in accordance with the rules laid down by the Ordinance under art. 15, para. 1, item 19.

§ 37. In art. 32 the words "item 8" are replaced by "7" and the words "if available" are replaced by "affordable".

§ 38. In art. 33 following amendments and supplements shall be made:

1. In paragraph 8. 1, item 2, the words "postal operators providing universal postal service or part thereof ' shall be replaced by" postal operator with an obligation to universal postal service "and the word" provision "is replaced by" carrying ".

2. in the Al. 2 the word "Provision" is replaced by "Carrying", and the words "in whole or in part" and "reference periods" shall be deleted.

3. in the Al. 3, after the words "access points" is added to the "postal network" and "users" sleddumata sedobavâ "and comply with the regulations of art. 15, para. 1, item 12.

§ 39. In art. 34 following amendments and supplements shall be made:

1. In paragraph 8. 1:

(a)) in the text before paragraph 1, after the word "following" is added "zip";

b) in item 1 (c) shall be repealed;

in) point 3 shall be repealed.

2. in the Al. 3, after the word "be" is added "and" and the words "and to reach the limit for weight, as defined in the acts of the Universal Postal Union ' shall be deleted.

3. in the Al. 4 before the words "para. 2 "insert" a ".

§ 40. In art. 35, para. 2 the words "postal operators of universal postal service or part thereof ' shall be replaced by ' the postal operator with the obligation to carry out the universal postal service and postal operators providing services included within the scope of the universal postal service" and a comma.

§ 41. In art. 36 the following modifications are made:

1. In paragraph 8. 1 the comma after the words "mail" is replaced by "and" and the words "and the postal money transfers ' shall be deleted.

2. in the Al. 2 the comma after the words "mail" is replaced by "and" and the words "and the postal remittances" and "in coordination with the State Agency for information technology and communications" shall be deleted.

§ 42. In chapter IV, section I, article is created. 36: "art. 36. (1) the postal operators providing universal postal service, shall ensure that expense annually perform a execution of measurement regulations under art. 15, para. 1, item 7 of the independent organization under conditions which comply with the current standards for the quality of postal services. The specific technical conditions of measurement shall be agreed with the Commission for communications regulation.

(2) the postal operators providing universal postal service, provide measurement results under para. 1 of the Communications Regulation Commission shall, before 30 April of the following year, together with the annual report in connection with the performance of their issued individual licences. "

§ 43. Article 37 shall be amended as follows:

"Art. 37. are all non-General postal services postal services outside the scope of the universal postal service. "

§ 44. In art. 38 item 4 is created:

"4. the postal remittances."

§ 45. In the name of chapter v the word "registrations" is replaced by "notifications".

§ 46. Article 39 shall be replaced by the following:

"Art. 39. An individual licence within the meaning of this law is an individual administrative act which is issued for:

1. carrying out universal postal service on the territory of the Republic of Bulgaria by an operator with such service;

2. the provision of services falling within the scope of the universal postal service, in the territory of the Republic of Bulgaria or of part thereof;

3. carrying out postal money transfers on the territory of the Republic of Bulgaria or of part of it. "

§ 47. Article 40 shall be repealed.

§ 48. In art. 41 after the word "licences" added "to perform services under art. 39, item 2 and/or 3 '.

§ 49. In art. 42 after the word "licences" added "to perform services under art. 39, item 2 and/or 3 '.

§ 50. In art. 43 the following modifications are made:

1. In paragraph 8. 1:

and in the text) before item 1 the words "universal postal service or part thereof ' shall be replaced by ' services under art. 39, item 2 and/or 3 ';


b) in paragraph 2, the word "services" is replaced by "types of services";

c) in paragraph 3 the word "beginning" is replaced by "estimated date.

2. in the Al. 2:

a) point 5 is replaced by the following:

"5. the current certificate for entry in the commercial register;

(b) in point 6), the words "throughout the country, corresponding in number and density of users ' needs ' are deleted.

§ 51. In art. 44, para. 1 the words "the composition – three professionals in postal services, a financier and lawyer" shall be deleted.

§ 52. In art. 45 the following modifications are made:

1. In paragraph 8. 1 the words "the Commission under art. 44, para. 1 "shall be replaced by" the Commission under art. 44. "

2. in the Al. 2 the words "the Commission under art. 44, para. 1 "shall be replaced by" the Commission under art. 44. "

3. in the Al. 3 the word "Commission" shall be replaced by "the Commission for communications regulation.

4. in the Al. 4, the words "the Commission under art. 44, para. 1 "shall be replaced by" the Commission for communications regulation.

§ 53. Article 46 shall be amended as follows:

"Art. 46. Within two months from the filing of the application under art. 43 the Commission under art. 44 offers from the Commission for communications regulation to grant or to refuse to issue an individual licence. "

§ 54. In art. 47 following amendments and supplements shall be made:

1. In paragraph 8. 1 the words "the Commission under art. 44, para. 1 "shall be replaced by" the Commission under art. 44 "and the words" universal postal service or part thereof ' shall be replaced by ' services under art. 39, item 2 and/or 3 '.

2. in the Al. 2:

(a)) in the text before paragraph 1, after the word "licence" shall be inserted "to perform services under art. 39, item 2 and/or 3 ' and the words ' the Commission under art. 44, para. 1 "shall be replaced by" the Commission under art. 44 ";

b) points 2 and 3 are repealed.

§ 55. In art. 48 following amendments and supplements shall be made:

1. In paragraph 8. 1 the second sentence is deleted.

2. a new paragraph. 3:

"(3) the issued individual license for carrying out universal postal service is not subject to the transfer."

3. a para. 4:

"(4) Izdadeniteindividualnilicenzii to perform the services under art. 39, item 2 and/or 3 can be transferred to third parties – merchants, only with the consent of the Communications Regulation Commission under the terms of the initial licensing. "

6. the amount, terms and ways to pay for the licence set out in the individual license fees;

7. provision of information to licensing in respect of the implementation of the individual licence, including the cast returns in number and how they are resolved;

8. immediate notification of licensing in the case of a declaration of the licensed insolvency, bankruptcy or the commencement of winding-up proceedings;

9. ability to ensure access to the postal network of licensed;

10. keeping the required analytical accounting by types of postal services and other commercial activities;

11. the performance of tasks or constraints to perform postal services in the circumstances under art. 12, al. (2);

12. amendments, supplements, transfers, suspension or termination of the individual licence when the measures provided for in law;

13. withdrawal of the individual licence in cases provided for by law;

14. admission by the licensing of individual licence;

15. sanctions and order for their implementation;

16. start date for commencing operations and access to the postal network under the plan-scheme;

17. use of datni stamps and prints according to art. 77, para. 3. "

§ 62. In art. 54 following amendments and supplements shall be made:

1. In the text before item 1 the words: "the basic postal operator" is replaced by "postal operator with an obligation to universal postal service".


2. Create new item 1-7:

' 1. must perform the universal postal service throughout the country;

2. ensure a sufficient density of points of access to the postal network, taking into account the needs of users and the conditions for the delivery of mail and postal parcels under art. 36;

3. implementation of the norms of universal postal service quality and efficiency of services under art. 15, para. 1, item 7;

4. provide annually perform measurement of regulations under art. 15, para. 1, item 7 of the independent organisation according to art. 36 a, para. 1;

5. compliance with the rules to ensure access to the postal network of licensed;

6. presentation of the universal postal service in services for coordination of licensing prior to the date of their application;

7. presentation of prices to ensure access to the postal network for coordination of licensing. "

(7) the Communications Regulation Commission shall issue the certificate within 14 days of receipt of the request.

§ 68. Articles 59A and 59B shall be repealed.

§ 69. In art. 60 the following modifications are made:

(7) the postal operator in al. 1 may file a notice of making of the same non-General postal services not earlier than 6 months from the date of entry into force of the decision to suspend the activity. "

§ 71. Article 61 (a) is repealed.

§ 72. In Chapter five, in the name of section V the word "registry" is replaced by "certification".

§ 73. In art. 62 the following modifications are made:

1. In paragraph 8. 2:

a) in paragraph 1 the words "universal postal service or part thereof ' shall be replaced by ' services under art. 39 ";

b) in paragraph 2 the word "universal" is deleted;

c) in paragraph 3 the words "para. 3 "shall be replaced by" para. 5. "

2. Paragraph 3 shall be amended as follows:

(3) postal operators providing universal postal services under art. 38, item 2 and/or 3, paid a one-time fee for issuing of certificate for registration in the register under art. 59, para. 5. "

§ 74. In art. 63 the words "registration fees" shall be replaced by ' fee for the issue of a certificate of entry in the register under art. 59, para. 5. "

§ 82. Article 72 shall be amended as follows:

"Art. 72. (1) the sale of postage stamps, which are not disposed of shall be made at par in the territory of the Republic of Bulgaria.

§ 83. § 84. § 85. In art. 75 is hereby amended as follows:

1. Paragraph 1 shall be amended as follows:

§ 86. Article 76 shall be amended as follows:

"Art. 76. § 87. In art. 77 following amendments and supplements shall be made:

§ 94. Article 88 shall be repealed.

§ 95. In art. 93 following amendments and supplements shall be made:

§ 104. § 105. New art. 105 (b):

§ 109. In the transitional and final provisions are made the following amendments and additions:

1. In paragraph 6:

(a)) in the Al. 3:

BB) in paragraph 2 the word "aerial" shall be deleted and the words "the basic postal operator" is replaced by "postal operator with an obligation to universal postal service";

(b)) in the Al. 7, after the words "postal service" is add "more services";

in) in the Al. 9, the words "the services included in the universal postal service" are replaced by "making the universal postal service by types of services".

2. Article 10 shall be amended as follows:

"§ 10." Bulgarian posts PLC – pays license fees at the rates determined by the procedure of art. 63. "

Additional provision

§ 110. This law introduced provisions of Directive 2008/6/EC of the European Parliament and of the Council of 20 February 2008 amending Directive 97/67/EC with regard to the full accomplishment of the internal market of Community postal services (OJ L 52/3 of 27 February 2008).

Transitional and final provisions

§ 111. Issued prior to the entry into force of this law, the regulations retain the action, in so far as they do not contradict it.

§ 112. The Communications Regulation Commission within 6 months from the entry into force of this Act aligns with it issued individual licences.

§ 113. In the law on limitation of administrativnotoregulirane and administrative control over the business (edu., SG. 55 by 2003, Corr; No. 59 of 2003; amend., 107/2003/39 and 52 of 2004 No. 31 and 87 by 2005, issue 24, 38 and 59 06, 11 and 41/2007 16/2008. , PC. 23, 36 and 44 of 2009.) in the annex to article 2. 9, para. 1, item 2 is hereby amended as follows:

1. Section 34 is amended as follows:

"34. Carrying out universal postal service or services included in the scope of the universal postal service."

2. an item 34 (a):

"34. Making the postal remittances."

§ 114. In the law on payment services and payment systems (promulgated, SG. 23 of 2009; amend., issue 24 of 2009) in art. 124, para. 2 the words "the Chairman of the State Agency for information technology and communications" shall be replaced by "the Commission for communications regulation.

§ 115. The law shall enter into force on the day of its publication in the Official Gazette with the exception of the provision of § 109, item 2, which shall enter into force on 1 January 2011.
