amending and supplementing the law on Forests (promulgated, SG. 125 of 1997; amend., SG. 79 and 133 of 1998 No. 26 of 1999, no. 29 and 78 of 2000, no. 77, 79 and 99 of 2002 16/107 and 2003/72 and 105 by 2005, issue 29, 30, 34 , 36, 80, 82 and 102 in 2006, PCs. 17, 24, 53 and 64 since 2007, PCs. 43 and 54 of 2008, decision No. 4 of the Constitutional Court from 2008 – PCs. 63 since 2008, amend., SG. 69, 70 and 91 by 2008 and PC. 6, 12, 19, 32 and 74 of 2009.)

§ 1. In art. 5, al. 1 the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food or an official authorised by him, on a proposal from the Executive Director of the Executive forest Agency and".

§ 2. In art. 7 make the following amendments and additions:

1. In paragraph 8. 1 the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food or an official authorised by him".

2. in the Al. 6, the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food or an official authorised by him".

3. a para. 7: "(7) in proceedings against administrative acts of the directors of the regional directorates for agriculture" in connection with the application of art. 19, para. 12 of the law on ownership and use of agricultural lands, the State shall be represented before the Court by the Executive Director of the Executive forest Agency. "

§ 3. In art. 13 al. 2 shall be amended as follows:

"(2) the inclusion in the forest fund area under para. 1 shall be made by order of the Minister of agriculture and food or an official authorised by him, on a proposal from the Executive Director of the Executive forest Agency. "

§ 4. In art. 14 and the following modifications are made:

1. In paragraph 8. 1 the words "on a proposal from the President of the State forestry agency, and the area up to 100 acres of privately owned – by the President of the State forestry agency" shall be replaced by ' on a proposal from the Minister of agriculture and food, and the area up to 100 acres of privately owned – by the Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency ".

2. in the Al. 2 the words "the President of the State Forestry Agency and 100 acres – the Chairman of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food, and up to 100 acres, from the Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency".

§ 5. In art. 14 is hereby amended as follows:

1. In paragraph 8. 1 the words "the President of the State forestry agency" are replaced with "Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency".

2. in the Al. 2 the words "the President of the State forestry agency" are replaced with "Minister of agriculture and food or an official authorised by him".

§ 6. In art. 15 and the following modifications are made:

1. In paragraph 8. 1 in the text before point 1, the words "State forestry agency" shall be replaced by the words "the Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency".

2. in the Al. 2:

a) in the first sentence the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency";

(b) in the second sentence) the words "the President of the State forestry agency" are replaced with "Minister of agriculture and food".

3. in the Al. 5, the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency".

§ 7. In art. 15 (b) is hereby amended as follows:

1. In paragraph 8. 1 the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food".

2. in the Al. 2, item 2, the words "the President of the State forestry agency" are replaced with "Minister of agriculture and food".

3. in the Al. 4:

a) in the first sentence the words "the President of the State forestry agency" are replaced with "Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency";

(b) in the second sentence) the words "the President of the State forestry agency ' shall be deleted.

§ 8. In art. 15 (e) is hereby amended as follows:

§ 11. In art. 16 in, al. 1 in the text before point 1, the words "the President of the State forestry agency" are replaced with "Minister of agriculture and food".

§ 12. In art. 17 the following modifications are made:

1. In paragraph 8. 4, the words "National Fund" Bulgarian forest "are replaced by" the Executive forest agency ".

2. in the Al. 6, the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency".

§ 13. In art. 19 is hereby amended as follows:

1. In paragraph 8. 2 the words "State forestry agency" shall be replaced by the words "the Executive forest agency".

2. in the Al. 3 the words "National Fund" Bulgarian forest "are replaced by" the Executive forest agency ".

§ 14. In art. 20 the following modifications are made:

1. In paragraph 8. 1 the words "State forestry agency" shall be replaced by the words "the Executive forest agency" and after the word "dependent" for the rest, the text is deleted.

2. paragraph 2 is repealed.

3. in the Al. 3 the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency".

4. in the Al. 4, the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency".

5. in the Al. 5, the words "State forestry agency" shall be replaced by the words "the Executive forest agency".

§ 15. In art. 22 the following modifications are made:

1. In paragraph 8. 1 the words "State forestry agency" shall be replaced by the words "the Executive forest Agency, tertiary authorising officers.

2. in the Al. 2 the words "the President of the State forestry agency" are replaced with "Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency" and finally adds a "tertiary" authorising officers.

3. in the Al. 3 the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency", and the words "State forestry agency" shall be replaced by the words "the Executive forest agency".

§ 18. In art. 24 (b) make the following amendments and additions:

1. a new paragraph 1:

' 1. Minister of agriculture and food; ".

2. The current paragraph 1 becomes paragraph 2 and shall be amended as follows:

"2. the Executive Director of the Executive forest agency;".

3. The current paragraph 2 becomes paragraph 3.

§ 19. In art. 24 the following amendments and supplements shall be made:

1. In paragraph 8. 1:

and in the text) before item 1, the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency";

b) points 1, 2 and 3 are repealed;

in point 11) is repealed.

2. in the Al. 2 the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency".

3. a para. 3:

"(3) the Minister of agriculture and food:

1. exercise the property rights of the State in public forest holdings;

2. approve regulations on the structure and activity of State-owned forest farms;

3. take action in accordance with art. 6 of the law on State property;

4. adopts decisions for disposal of tangible fixed assets, establishing property rights and for the rental of real estate, managed by State-owned forest farms. "

§ 20. In art. 24 d, para. 1 the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food".

§ 21. In art. 24 (g) is hereby amended as follows:

1. the text before point 1 shall be replaced by the following: "Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency can perform."

2. paragraph 2 is replaced by the following:

(2) upon termination of the State-owned enterprise under para. 1, item 1, the Minister shall determine who shall be granted the property of the undertaking concerned.

§ 22. In art. 25 the following modifications are made:

1. In paragraph 8. 2, the words "by the President of the State forestry agency" shall be replaced by "by the Minister of agriculture and food".

§ 24. In art. 39, para. 2 the words "State forestry agency" shall be replaced by the words "the Executive forest agency", and the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food".

§ 25. In art. 40 al. 3 shall be replaced by the following: "(3) Approved by the Executive Director of the Executive forest Agency resources for reproduction of forests cannot be expended for other purposes."

§ 26. In art. 41 the following modifications are made:

1. In paragraph 8. 1 the words "State forestry agency" shall be replaced by the words "the Executive forest agency".

2. in the Al. 2 the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food".

§ 43. In art. 93 following amendments and supplements shall be made:

1. In the text before point 1, the words "State forestry agency" shall be replaced by the words "the Executive forest agency".

2. Section 1 is repealed.

3. In paragraph 10, the words "State forestry agency" shall be replaced by the words "the Executive forest agency".

§ 44. In art. 94 is hereby amended as follows:

1. In the text before point 1, the words "in the budget of the State forestry agency" shall be replaced by "through the budget of the Ministry of agriculture and food in the Executive forest agency".

2. In paragraph 1, the words "State forestry agency" shall be replaced by the words "the Executive forest agency".

§ 45. Article 96 (a) is repealed.

§ 46. Article 96 (b) is repealed.

§ 47. Article 96 shall be repealed.

§ 48. Article 96 shall be repealed.

§ 49. Article 96 (e) is repealed.

§ 50. In art. 113 is hereby amended as follows:

1. In paragraph 8. 1, the words "with the Chairman of the State forestry agency" shall be replaced by "with the Executive Director of the Executive forest agency", and the words "by the President of the State forestry agency" shall be replaced by "by the Minister of agriculture and food".

2. in the Al. 2 the words "State forestry agency" shall be replaced by the words "the Executive forest agency".

§ 51. In § 10 of the transitional and final provisions, the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food".

§ 52. In the transitional and concluding provisions of the law amending and supplementing the law on Forests (promulgated, SG. 43 of 2008; amend., SG. 54 and 91 of 2008) is hereby amended as follows:

1. In § 70dumite "instruction of the President of the State forestry agency" shall be replaced by "Decree issued by the Minister of agriculture and food".

2. In paragraph 72:

(a)) in the Al. 1 the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food";

(b)) in the Al. 2 the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency".

3. In paragraph 93, the words "the President of the State forestry agency" are replaced with "Minister of agriculture and food".

Additional provisions

§ 53. Throughout the Act, the words "State forestry agency", "the President of the State forestry agency" and "the President of the State forestry agency" shall be replaced respectively with "the Executive forest agency", "the Executive Director of the Executive forest agency" and "the Executive Director of the Executive forest agency".


§ 54. The law does not override the decision of the National Assembly on 3 September 2009, to stop turning off when you change the function of forests and lands of the forest fund, acquired by natural and legal persons, with the exception of the municipalities, by replacing with forests and lands of the forest fund – a private State property (SG. 72 by 2009).

Transitional and final provisions

§ 55. Regulations on the application of the law, issued by the President of the State forestry agency, shall apply to the issuance of the relevant acts of the Minister of agriculture and food, in so far as they do not contravene this law.

§ 56. Pending the entry into force of this Act, proceedings pursuant to § 123 of the transitional and concluding provisions of the law amending and supplementing the law on Forests (official GAZETTE 16/2003; amend., SG. 29 and 34 in 2006) shall be reversed in the current order of the Minister of agriculture and food or by an official authorised by him.

§ 57. (1) National Fund "Bulgarian forest" is closed. The available resources of the Fund shall be transferred to the indoor budget of the Executive Agency for the forests.

(2) the Executive forest Agency is the successor of the assets, liabilities, rights, duties and the archives of the indoor National Fund "Bulgarian forest".

(3) the employment of the staff of national fund "Bulgarian forest" are governed under the conditions and by the procedure of art. 123 of the labour code.

§ 58. Minister of finance to make the necessary adjustments in the budgets of the Ministry of agriculture and food and the State Forestry Agency for 2009, with effect from 1 October 2009.

§ 59. Until 31 December 2009 for the collection of revenue and making the payments to the Executive forest agency enjoy previous bank accounts and codes in the system for electronic budgetary payments of converted State forestry agency.

§ 60. § 61. In the hunting and game management (promulgated, SG. 78 from 2000; amend., no. 26 of 2001 No. 77 and 79 since 2002, no. 88 of 2005 No. 82 and 108 of 2006.64/2007, no. 43, 67, 69 and 91 by 2008 and no. 6 of 2009) make the following changes :

1. In art. 4:

(a)) in the Al. 1 the words "State forestry agency" shall be replaced by the words "the Minister of agriculture and food";

(b)) in the Al. 2 the words "State forestry agency" shall be replaced by the words "the Minister of agriculture and food".

2. In art. 7:

(a)) in the Al. 3 the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food, in consultation with the Minister of the Interior";

(b)) in the Al. 6, the words "the President of the State forestry agency" shall be replaced by the words "the Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency";

in) in the Al. 7 the words "proposed" shall be deleted and the words "jointly by the State forestry agency" shall be replaced by "by the Minister of agriculture and food, on a proposal from the Executive Director of the Executive forest agency".

3. In art. 9:

(a)) in the Al. 3 the words "the President of the State forestry agency" shall be replaced by the words "the Executive Director of the Executive forest agency";

§ 63. In the law of internal audit in the public sector (official SG. 27 of 2006; amend., SG. 64 and 102 in 2006, issue 43, 69, 71 and 110 from 2008 and 42 and 44 of 2009) point 8 in the annex to article 2. 12, al. 1, item 5 shall be amended as follows:

§ 64. In the law on biological diversity (edu., SG. 77 of 2002; amended and 88/105 by 2005, issue 29, 30, 34 and 80 of 2006, issue 52, 53, 64 and 94 in 2007, no. 43 of 2008 and no. 19 of 2009) is hereby amended as follows:

In the law for the restoration of ownership on forests and lands of the forest fund (official SG. 110 of 1997; amend., 33/59, and 133 of 1998, no. 49 of 1999, no. 26 and 36 in 2001, no. 45, 63 and 99 of 2002 16/2003, 36/2004, 30/07/2006. , PC. 13, 24 and 59 since 2007, PCs. 36, 43 and 91 by 2008 and PC. 6 of 2009) the following modifications are made:

1. In the law on genetically modified organisms (official SG. 27 of 2005; amend., SG. 88 and 99 of 2005, no. 30 of 2006, no. 31 of 2007, issue 36, 43 and 54 of 2008 and no. 74 of 2009) in art. 109, para. 1 the words "State forestry agency" shall be replaced by the words "the Executive forest agency".
