Law amending the Law on Physical Education and Sports (prom. SG. 58 of 1996 .; Decision № 8 of the Constitutional Court of 1997 . - SG. 53 of 1997 .; amend. pcs. 124 of 1998, pcs. 51 and 81, 1999, issue. 53 of 2000 .; corr. § 1. In art. 4 shall be amended as follows:
1. In item. 9, "and youth" are deleted.
2. In item. 12 words "and youth" are deleted.
§ 2. In art. 4a pt. 1, 't. 2 "are replaced by" item. 3 '.
§ 3. Article 4b is repealed.
§ 4. In art. 6 The following amendments and additions:
1. In para. 1 the words "education, training and management" is replaced by "The process of education and training system."
2. A new paragraph. 2:
"(2) Department of Physical Education and Sports to keep a register of persons under par. 1. "
third. Former para. 2 becomes para. 3 and the words "Council of Ministers shall" be replaced with "Minister of Physical Education and Sports issued" and a second sentence: "The regulation defines the procedure for keeping the register under par. 2. "
§ 5. In art. 7 following amendments and additions:
1. A new item. 2:
"2. for adoption by the National Assembly National Strategy for Development of Physical Education and Sport for a period of 10 years. "
2. Previous items. 2 and 3 become items. 3 and 4.
§ 6. In art. 8 made the following amendments:
1. In para. 1, 'Chairman of the State Agency for Youth and Sports "replaced with" Minister of Physical Education and Sports ".
2. Paragraph 2 is amended as follows:
"(2) The Minister of Physical Education and Sports manages and represents the Ministry of Physical Education and Sports."
Third. In para. 3:

A) teksta before item. 1, 'Chairman of the State Agency for Youth and Sports "replaced with" Minister of Physical Education and Sports ";
B) point 1 shall be amended as follows:

§ 7. A new art. 8:
"Art. 8a. (1) The Minister of Physical Education and Sport creates advisory unit - Expert advice on physical education and sports.
(2) Expert Council of Physical Education and Sport includes representatives of the Ministry of Physical Education and Sports, Ministry of Education and Science, Ministry of Defence, Ministry of Interior, the National Association of Municipalities in Republic of Bulgaria, universities National sports Academy, Bulgarian Olympic Committee, sports schools, sports organizations and other legal entities with non-profit activity in the field of physical education, sport and social tourism, as well as professionals in these areas.
(3) Expert Council of Physical Education and Sport discuss and give opinions on:
1. national strategy and national program for development of physical education and sport;
2. draft legislation in the area of ​​physical education and sport; 3
. research, methodological, experimental and implementation activity in physical education and sport;

4. the development and establishment of criteria for public introduction of sports and social tourism effectiveness of the system of physical education and sport.
(4) The organization of work of the Expert Council on physical education and sport is determined by an act of the Minister of Physical Education and Sports. "
§ 8. The former Art. 8a becomes art. 8b and in it the words "State Agency for Youth and Sports" are replaced by "the Ministry of Physical Education and Sports".
§ 9. Article 9 is amended as follows:
"Art. 9. Ministers and other state bodies develop, coordinate and promote programs in the field of physical education, sport and social tourism with the Minister of Physical Education and Sports. "
§ 10. In art. 10, para. 5 the word "one" is replaced by "three" and the words "State Agency for Youth and Sports" are replaced by "the Ministry of Physical Education and Sports".
§ 11. In art. 11, para. 2 t. 4 is amended as follows:
"4. build, manage, maintain and use sports facilities; '.
§ 12. In art. 13 pt. 4 the word "out" is replaced by "available".
§ 13. In art. 14 be made the following amendments:
1. In para. 3, 'Chairman of the State Agency for Youth and Sports "are replaced by" the Minister of Physical Education and Sports ".
2. In para. 4 after the words "profit" is added "for the public benefit."
§ 14. In art. 17 be made the following amendments:
1. Paragraph 1 shall be amended as follows:
"(1) The Minister of Physical Education and Sports issued, renewed, refuses and takes sports license of sports federations and national sports organizations under this law and order determined by an ordinance issued by it . "
2. In para. 2:
a) in item. 2 the words "sports clubs" are replaced by "at least 7 sports clubs, registered in at least three districts of the Republic of Bulgaria";
B) the item. 5:
"5. committed categorization of its member sports clubs on criteria defined in the regulations implementing the law. "
third. In para. 3 in the text before item. 1 numeral "4" is replaced by "2".
§ 15. In art. 17b are made the following amendments:
1. In para. 1, 'once every four years "are deleted.
2. In para. 2 in the text before item. 1, 'Chairman of the State Agency for Youth and Sports "are replaced by" the Minister of Physical Education and Sports ". 3
. A new paragraph. 3:
"(3) The sports license be renewed for a period of four years."
4. Former para. 3 becomes para. 4 and there in the text before item. 1, 'Chairman of the State Agency for Youth and Sports "replaced with" Minister of Physical Education and Sports ".
§ 16. In art. 17c par. 1 made the following amendments:

1. In the text before item. 1, 'Chairman of the State Agency for Youth and Sports "replaced with" Minister of Physical Education and Sports ".
2. Created pt. 9 and 10:
"9. unlawfully cost funds provided under this Act;
10. failed to fulfill one or more of the requirements of Art. 17b para. 2. "
§ 17. In art. 17d para. 1 is amended as follows:
"(1) The Minister of Physical Education and Sports organizes creation and keep a public national register of licensed sports organizations and their member sports clubs."
§ 18. In art. 19 be made the following amendments:
1. In para. 1:
a) point 3 is amended as follows:
"3. confer titles to athletes, coaches and sports figures; "
b) a new item. 4:
" 4. the Minister of Physical Education and Sports to provide the status of High bit-athlete athletes with high performance sports; "
c) the previous items. 4, 5, 6, 7 and 8 become items. 5, 6, 7, 8 and 9;
D) the previous item. 9 becomes p. 10 and amended as follows:
"10. the sporting justice and sports arbitration, adopt rules for the activities of the arbitration body to them, which shall decide on the creation, suspension, revocation and termination of competition rights and disputes defined by the federations; "
e) the previous item. 10 becomes so. 11.
2. A par. 3:
"(3) The granting of the status of High bit-rate athlete and confer titles of athletes, coaches and sports figures are carried out under conditions and procedures specified by the Minister of Physical Education and Sports."
§ 19. Art. 22, para. 6 words "by the Minister of Education and Science in coordination with the Chairman of the State Agency for Youth and Sports" are replaced by "by the Minister of Education and Science and the Minister of Physical Education and Sports".
§ 20. Article 23 is amended as follows:
"Art. 23. (1) After verification of their abilities in the sport students can continue their education in V, VI, VII, VIII and IX class sports schools.
(2) sports schools provide educational, sports, and then completed Class VIII - and professional training. The training of students for vocational training is carried out under the terms and provisions of the Law on Vocational Education and Training.
(3) The state sports schools are financed from the state budget through the Ministry of Physical Education and Sports and opened, transformed and closed by the Minister of Education and Science of the Minister of Physical Education and Sports under the terms and in order and in accordance with criteria determined by the implementing regulation of the law.

(4) The municipal sports schools are funded by municipal budgets and opened, transformed and closed by the Minister of Education and Science in coordination with the Minister of Physical Education and Sports under the terms and conditions set out in the Act Public Education.
(5) The Minister of Education and Science approves academic programs in sports training in sports schools at the proposal of the Minister of Physical Education and Sports.
(6) directors of the state sports schools are appointed by the Minister of Physical Education and Sports based on competition held under the Labour Code, and under conditions specified in the Regulations for Implementation of the Physical Education and Sports.
(7) directors of the municipal sports schools are appointed by the head of the regional inspectorate of education based on competition held under the Labour Code, and under conditions determined by the regulations implementing the Law of Education.
(8) occupying the post of director of sports school can apply person who has completed higher education degree "master" and a minimum of three years teaching experience or experience in the field of Physical Education and Sports.
(9) The state admission plan for state and municipal sports schools is approved by the Minister of Physical Education and Sports in coordination with the Minister of Education and Science.
(10) The Minister of Physical Education and Sports in coordination with the Minister of Education and Science adopt an ordinance the conditions and procedures for admission and sports training students in sports schools. "
§ 21. In art. 26 new paragraph. 5:
"(5) At the proposal of Minister of Physical Education and Sports and following a decision of the academic council at universities may be accepted without competitive examination medalists from the Olympics, world and European championships outside approved under the Act higher education annual number of enrolled students. "
§ 22. In art. 35d make the following changes and additions:
1. The previous text becomes para. 1 and it creates so. 3:
"3. is entered in the register of persons who carry out mediation in the licensed sports federation. "
2. Create to par. 2 and 3:
"(2) The licensed sports federations adopt rules on the register of persons under par. 1.
(3) Unless a person under par. 1 athlete can be represented in negotiating the acquisition or transfer of rights from racing:
1. lawyer;
2. parent or spouse. "
§ 23. In art. 37 para. 2 is repealed.
§ 24. In art. 40, para. 2 words "Art. 37, para. 2 "are replaced with" Art. 8a. "
§ 25. In art. 41 para. 2 is repealed.
§ 26. In art. 43 is amended as follows:

1. In para. 1, 'Chairman of the State Agency for Youth and Sports "are replaced by" the Minister of Physical Education and Sports ".
2. In para. 2 the word "medical" is replaced by "medical" and the words "the Chairman of the State Agency for Youth and Sports" are replaced by "the Minister of Physical Education and Sports".
§ 27. In art. 47 be made the following amendments:
1. In para. 1:
a) in Item. 1 and 2 the word "urban" is replaced by "development";
B) in item. 3, after the words' sports buildings and facilities "insert" and the standards for building an accessible environment in urban areas ";
C) Point 4 is repealed.
2. A new paragraph. 2:
"(2) The construction and operation of sports facilities - outdoor sports shooting, outside the urban areas is carried out under conditions and procedures specified by the Minister of Regional Development and Public Works in coordination with the Minister of Physical Education and sport and Minister of Interior. "
third. Former para. 2 becomes para. 3 and in it after the word "schools" insert "and standards for building an accessible environment in urban areas."
4. Former para. 3, 4, 5 and 6 become par. 4, 5, 6 and 7.
5. A par. 8:
"(8) Amendment of detailed plans for conversion of the plots of land allocated for the construction of sports facilities and change of use of sports facilities can be made after written consent of Minister of physical education and sports under the terms and conditions of Art. 39, para. 3 and art. 134, para. 7 of the Law on Spatial Planning. "
§ 28. In art. 47a para. 2 pt. 1 the words "national sport organizations" are replaced by "sports federations."
§ 29. A Art. 47b:
"Art. 47b. (1) engineering and technical requirements for the security of the sports venues and facilities during sports events organized on stadiums and sports halls are determined by an ordinance adopted by the Council of Ministers.
(2) In municipalities to create municipal committees for audit and control compliance with engineering and technical requirements for sports facilities in terms of their security.
(3) municipal committee under par. 2 includes employees of the municipal administration appointed by the mayor, officials from the regional directorates of the Ministry of Interior or the regional offices and stretches them, representative of Ministry of Physical Education and Sports and a representative of the Regional Directorate for National Construction Control.

(4) Municipal Commission under par. 2 prepare a report containing an assessment of the sports facility and its suitability for use. A copy of the minutes shall be served on the owner or user of the site or his authorized representative within three days of service may refer the objections to the content of the protocol.
(5) protocols and submitted objections sent to the Minister of Physical Education and Sport, which within three days of receipt sent a copy to the Minister of Regional Development and Public Works and the Minister of Interior.
(6) The Minister of Regional Development and Public Works and Minister of Interior within 7 days of receipt of the documents under par. 5 submitted to the Minister of Physical Education and Sports opinion on the suitability for use of the site.
(7) Where opinions par. 6 contain a positive assessment of suitability for use of the facility, the Minister of Physical Education and Sports issued an act which authorizes the use of sports facilities for conducting sports events. "
§ 30. In art. 50 make the following additions:
1. In para. 2 after the words "sport organizations" insert "and sports schools."
2. In para. 3 after the word "general" is added "sport".
§ 31. In art. 50c make the following changes and additions:
1. In para. 3, 'Chairman of the State Agency for Youth and Sports "are replaced by" the Minister of Physical Education and Sports ".
2. In para. 4 after the words "student sports organizations" insert "sports schools".
§ 32. Article 57b is amended as follows:
"Art. 57b. Minister of Physical Education and Sports in coordination with the Minister of Finance approves the distribution of proceeds from the Bulgarian Sports Totalizator. "
§ 33. In art. 58, para. 1 is amended as follows:
1. Point 1 is amended as follows:
"1. construction, reconstruction and modernization of sports facilities and sites for social tourism of national importance, as well as sports facilities and sites for social tourism - state and municipal property. "
2. In item. 2 the words "secondary special sports" are replaced by "sports". 3
. Point 10 is amended as follows:
"10. Program for development of sport excellence. "
§ 34. In art. 59 para. 2 after the words "sports bodies" a comma and add "sports schools".
§ 35. In art. 59a be made the following amendments:
1. In the text before item. 1, 'the State Agency for Youth and Sports "are replaced by" the Ministry of Physical Education and Sports ".
2. In item. 1, 'the State Agency for Youth and Sports "are replaced by" the Ministry of Physical Education and Sports ". 3
. Point 2 is amended as follows:

"2. support for the construction, modernization, rehabilitation and maintenance of sports facilities and sites for social tourism of national importance, as well as sports facilities and sites for social tourism - state and municipal property. "
4. In pt. 6 after the words "reward" insert "High bit-athletes" and a comma.
5. In pt. 7 conjunction "and" is replaced with a comma after the word "veterans" insert "and coaches."
6. Created so. 11-15:
"11. financing activities program for Olympic preparation;
12. financing activities program for the development of sport excellence;
13. financing of activities related to medical and doping control;
14. supporting research and applied work in the field of Physical Education and Sports;
15. Support the preparation and conduct of World and European Championships, hosted by the Republic of Bulgaria. "
§ 36. In art. 59b are made the following amendments:
1. In para. 1, 'the State Agency for Youth and Sports "are replaced by" the Ministry of Physical Education and Sports ".
2. In para. 2:
a) in item. 3, after the word "games" insert "and similar championships and games for people with disabilities";
B) point 4 is amended as follows:
"4. construction, restoration and management of sports facilities and sites for social tourism of national importance, as well as sports facilities and sites for social tourism - state and municipal property. "
§ 37. In art. 64a is amended as follows:
1. In para. 1, 'Chairman of the State Agency for Youth and Sports "are replaced by" the Minister of Physical Education and Sports ".
2. In para. 3 words "and youth" are deleted and the words "State Agency for Youth and Sports" are replaced by "the Ministry of Physical Education and Sports".
§ 38. In art. 64b is amended as follows:
1. In the text before item. 1, 'federations and sports clubs established as non-profit organizations "are replaced by" organizations "and the words" State Agency for Youth and Sports "are replaced by" the Ministry of Physical Education and Sports ".
2. In item. 2 the words "the Chairman of the State Agency for Youth and Sports" are replaced by "the Minister of Physical Education and Sports".
§ 39. In art. 64 years of age be made the following amendments:

§ 40. In art. 66 be made the following amendments:
1. Paragraph 1 shall be amended as follows:
"(1) Violations shall be established by the specialized control bodies of the Ministry of Finance, Ministry of Defence, Ministry of Interior, Ministry of Health, Ministry of Regional Development and Public Works, Ministry of Education youth and science, the Ministry of Labour and social policy, Ministry of transport, information technology and Communications, the Ministry of physical education and sports and Anti-Doping Centre. "
2. In para. 2 after the word "authority" insert "under par. 1 "and the word" authorized "is replaced by" authorized ". 3
. In para. 4 the words "the State Agency for Youth and Sports" are replaced by "the Ministry of Physical Education and Sports".
§ 41. In art. 67, para. 1, 'the National Commission on Doping Control "is replaced by" Anti-Doping Centre ".
§ 42. In art. 68 words "National Commission on Doping Control" is replaced by "Anti-Doping Center".
§ 43. Article 69 is amended as follows:
"Art. 69. (1) A sports federation or national sport organization that performs sports activities without a license, a property sanction amounting to 10 000 Levs.
(2) Sports Club performing sports activities without member licensed sports organization, a pecuniary sanction from 5,000 to 10,000 lev.
§ 44. § 1 of the additional provisions be made the following amendments:
1. Items 23, 24, 25, 26 and 27 are canceled.
2. A t. 33:
"33. "High bit-athlete" is a sportsman who has achieved high sporting results in the European and world championships and Olympic Games. "
§ 45. In other texts of law the words" the Chairman of the State Agency for Youth and Sports, "" Chairman of the State Agency for youth and sports "and" State Agency for youth and sports "are replaced by" the Minister of physical education and sports "," Minister of physical education and sports "and" Ministry of physical education and sports ".
Transitional and Final Provisions
§ 46. Ministry of Physical Education and Sports is the successor of the State Agency for Youth and Sports.

§ 53. In the Law for protection of public order at sports events (prom. SG. 96 of 2004 .; amend. Pcs. 103 and 105 of 2005, pcs. 30, 34 80 and 82 of 2006, pcs. 53 2007 SG. 69 of 2008, pcs. 12, 19 and 32 of 2009) is amended as follows:
1. In art. 43 words "the Chairman of the State Agency for Youth and Sports" are replaced by "the Minister of Physical Education and Sports".
2. In § 7 of the transitional and final provisions, the words "the Chairman of the State Agency for Youth and Sports" are replaced by "the Minister of Physical Education and Sports".

§ 54. In the Law on Privatization (prom. SG. 28 of 2002 .; amend., SG. 78 of 2002, pcs. 20 and 31, 2003, issue. 39, 2003 - Decision № 5 of the Constitutional Court from 2003 .; amend., SG. 46 and 84 of 2003, pcs. 55 and 115 of 2004, pcs. 28, 39, 88, 94, 103 and 105 of 2005, pcs. 36, 53, 72 and 105 of 2006, pcs. 59 of 2007, pcs. 36, 65, 94, 98 and 110 of 2008, pcs. 24 42, 82 and 99 of 2009 and SG. 18 of 2010) in Annex № 1 to Art. 3, para. 1 made the following amendments:
1. In Section V t. 3 and 6 are canceled.
2. Section XI:
a) the title is amended as follows:
"XI. Ministry of Physical Education and Sports ";
B) the item is. 2 and 3:
"2. "Academica 2000" EAD - Sofia. 3
. "Academica - sports" EAD - Sofia. "
§ 55. In the Tourism Act (prom. SG. 56 of 2002 .; amend. Pcs. 119 and 120 in 2002, pcs. 39 2004 pcs. 28, 39, 94, 99 and 105 of 2005, pcs. 30, 34, 80, 82 and 105 of 2006, pcs. 42, 53 and 80 of 2007, No. . 31, 36 and 66 of 2008, pcs. 19 and 82 of 2009 and SG. 15 of 2010) made the following supplements:
1. In art. 9a, para. 5 after the words "and Tourism" insert "and a representative of the Ministry of Physical Education and Sports".
2. In art. 51, para. 5 and 7 finally added "together with the Minister of Physical Education and Sports".
§ 56. In the Law on Vocational Education and Training (prom. SG. 68 of 1999 .; Amend. No.. 1 and 108 in 2000, pcs. 111 of 2001 pcs. 103 and 120 of 2002, pcs. 29 2003 pcs. 28, 77 and 94 of 2005, pcs. 30 and 62 of 2006 .; corr. SG. 63 of 2006 amended .; . No.. 13 and 26 of 2008, pcs. 36 and 74 of 2009) the following amendments:
1. In art. 9, para. 1:
a) creates a new item. 2:
"2. sports schools; "
b) the previous item. 2 becomes item. 3 and the words" sports "are deleted.
2. In art. 11 pt. 3 after the word "art" insert "and sports schools." 3
. In art. 15, para. 1 conjunction "and" is deleted and finally added "and sports schools - by the Minister of Education and Science and the Minister of Physical Education and Sports".
4. In art. 18:
a) creates a new item. 4:
"4. sports schools; "
b) the previous item. 4, 5 and 6 become items. 5, 6 and 7.
5. In art. 19:
a) in the title conjunction "and" is replaced with a comma after the word "art" insert "and sports schools";
B) a new paragraph. 6:
"(6) sports schools provide vocational education for acquiring third level of vocational qualifications up to four years after primary education."
C) the previous paragraph. 6 becomes para. 7.
6. In art. 25:
a) in the title conjunction "and" is replaced with a comma after the word "art" insert "and sports schools";
B) in para. 3 after the word "art" insert "and sports schools";
In) a new paragraph. 7:
"(7) The state plan for admission to sports schools approved by the Minister of Physical Education and Sports under the Law on Physical Education and Sports."

7. In art. 30:
a) in para. 1 created item. 5:

§ 57. In the Law on Spatial Planning (prom. SG. 1 2001 .; amend., SG. 41 and 111 of 2001, pcs. 43 2002 pcs. 20 65 and 107 of 2003, pcs. 36 and 65 of 2004, pcs. 28, 76, 77, 88, 94, 95, 103 and 105 of 2005, pcs. 29, 30, 34, 37 65, 76, 79, 80, 82, 106 and 108 in 2006, pcs. 41, 53 and 61 of 2007, pcs. 33, 43, 54, 69, 98 and 102 of 2008, No. . 6, 17, 19 and 80 of 2009 and SG. 41 of 2010) the following amendments:
1. In art. 39, para. 3, the first sentence after the words "culture or" insert "as well as sports facilities or parts of them."
2. In art. 56 para. 6 words "the Chairman of the State Agency for Youth and Sports" are replaced by "the Minister of Physical Education and Sports". 3
. In art. 134, para. 7 after the words "culture or" insert "and sports facilities."
§ 58. In the Gambling Act (prom. SG. 51 of 1999 .; amend. Pcs. 103 of 1999, pcs. 53 of 2000, pcs. 1, 102 and 110 2001 pcs. 75 2002 SG. 31 of 2003, SG. 70 of 2004, pcs. 79, 94, 95, 103 and 105 of 2005, pcs. 30 and 54 2006 pcs. 109 and 110 of 2007, pcs. 42, 74 and 82 of 2009) is amended as follows:
1. In art. 9:
a) in para. 1, 'the State Agency for Youth and Sports "are replaced by" the Ministry of Physical Education and Sports ";
B) in para. 2 the words "the Chairman of the State Agency for Youth and Sports" are replaced by "the Minister of Physical Education and Sports";
C) in para. 3 p. 1 is amended as follows:
"1. Minister of Physical Education and Sports in coordination with the Minister of Finance - for proceeds of Bulgarian Sports Totalizator for the needs of physical education and sports, as well as maintenance, repair and new construction of sports facilities in schools; Minister of Physical Education and Sport allocates funds for maintenance, repair and new construction of sports facilities in schools on the proposal of the Minister of Education and Science. "
2. In § 11 para. 3 of the transitional and final provisions, the words "State Agency for Youth and Sports" are replaced by "the Ministry of Physical Education and Sports".
§ 59. The issued before the enactment of this Act sporting licenses retain their duration of action.

§ 60. In 6 months after the entry into force of this Act shall be issued provided therein regulations, and existing regulations are brought in line with its requirements.
§ 61. The Council of Ministers within six months from the entry into force of this Act to the National Assembly the National Strategy for the Development of Physical Education and Sport in Art. 7, p. 2.
§ 62. Paragraphs 20, 21, § 48 pt. 1, § 52 pt. 1 and 3 and § 56 shall enter into force from the academic year 2011-2012 g.
