Amendment of the law for the promotion of scientific research (official SG. 92 of 2003; amend., 36/2008 and no. 74 and 82 of 2009.)

§ 1. In art. 4 al. 3 shall be amended as follows:

"(3) the promotion of research under para. 1 includes promoting international scientific cooperation, participation in European and trans-European research programmes, and participation in the creation of the European research area. "

§ 2. In art. 5 item 4 shall be amended as follows:

"4. the national and/or international expert independent evaluation and monitoring of research and of the results thereof;".

§ 3. In art. 6 make the following amendments and additions:

1. In paragraph 8. 2:

create a new) item 2 and 3:

' 2. create conditions for policy coherence in the field of education, science and innovation;

3. Encourages the interaction between research and the economy by building tools for common action; "

(b)) the current item 2 becomes item 4;

in the past) item 3 becomes item 5 and the word "professionals" is replaced by "scientists";

(d)) the current item 4 becomes item 6 and add "and projects";

(e)) a new point 7:

"7. Encourages the establishment of scientific infrastructure, access to electronic scientific databases;"

is the current item 5) and (6) shall become item 8 and 9;

(g)) are 10-13:

"10. creates tools to stimulate the zaâvitelskata activity for the protection of inventions and utility models, developed as a result of the research activity;

11. assist in reaching the scientific product and its distribution in all areas of the economy;

12. supports activities aimed at opening up the labour market and the creation of bridge structures between universities, scientific organizations and businesses;

13. support and encourage research through support of international programs and initiatives based on the principle of shared funding; "

(h)) the current item 7 becomes item 14;

and so is created) 15:

"15. a specialized framework terms and conditions for the operation of a unique scientific infrastructure."

2. a new paragraph. 3:

"(3) the Council of Ministers shall lay down the conditions and procedures for supporting and stimulating the implementation of scientific products and their distribution in all areas."

3. The current paragraph. 3 it al. 4.

§ 4. Art is created. 6a:

"Art. 6. (1) in order to stimulate the Bulgarian scientists and scientific groups, the Minister of education, youth and science can establish awards for contribution and achievements in the field of research.

(2) awards at al. 1 are awarded under the conditions and in accordance with procedures laid down by the Act of establishment. "

§ 5. In art. 7 the following modifications are made:

1. In paragraph 8. 3:

a) in paragraph 1 the words "analysis and report" shall be replaced by "analysis of the situation";

b) in paragraph 2, the words "and the action plan" shall be deleted and the word "including" shall be replaced by "including".

2. in the Al. 4, the words "the report and prepare the analysis" are replaced by "Analysis" is drawn up.

§ 6. Create art. 7A and 7B:

"Art. 7. (1) the Minister of education, youth and science shall issue rules of procedure for the monitoring and evaluation of the research conducted by universities and scientific organizations, as well as the activities of the Fund "scientific research".

(2) the research activities of universities and scientific organizations, as well as the activities of the Fund "scientific research" be evaluated periodically on the basis of criteria and subject to the conditions and in line with the rules set out in para. 1.

Art. 7B. (1) the Ministry of education, youth and science maintains a register of scientific activity in the Republic of Bulgaria, which contains the following data:

1. scientific organizations and higher education institutions;

2. scientists in the Republic of Bulgaria;

3. information on national and international scientific projects, the source of funding, the managers, scientific achievements and publications related to projects, unless it contradicts the law on the protection of classified information;

4. the resulting from scientific organizations and higher education resources from the national budget, the Community budget and from other sources;

5. scientific infrastructure and research complexes;

6. programmes in the field of research, funded by the State.

(2) natural and legal persons, applied for and received funding for research activities in accordance with this law and other regulations and Fund "scientific research", sent to the Ministry of education, youth and science data according to para. 1 for inclusion in the register of scientific activity. "

§ 7. In art. 8 the words "National Research Council" shall be replaced by "National Council for science and innovation".

§ 8. In art. 10, para. 1 the words "Ministry of agriculture and food" shall be replaced by the "Ministry of agriculture and food".


§ 9. In art. 11 the words "National Research Council" shall be replaced by ' the National Council for science and innovation ".

§ 10. In art. 13 make the following amendments and additions:

1. Paragraph 2 shall be replaced by the following:

(2) National Science Fund aims to support projects and activities for the promotion of scientific research, in accordance with:

1. National strategy for scientific research;

2. framework programmes with defined priorities of the European Union, as well as other European and trans-European initiatives;

3. European and national roadmap for research infrastructure. "

2. a new paragraph. 3:

"(3) Fund research works in coordination with other funding institutions of applied research."

3. The current paragraph. 3 it al. 4.

4. The current paragraph. 4 it al. 5, and shall be amended as follows:

"(5) the Minister of education, youth and science review of the activities of the Fund" scientific research. "

§ 11. Article 15 shall be amended as follows:

"Art. 15. (1) to fund "research" to create temporary and permanent scientific and expert committees.

(2) the provisional scientific and expert committees organise and carry out evaluation ranking of applicants in the competitions research projects in accordance with the criteria of art. 25 and the methodology for the evaluation and ranking of applicants for funding projects approved by the Executive Board.

(3) the Permanent scientific and expert committees carry out analysis and evaluation of the implementation of the projects financed in their respective competitive scientific trends. "

§ 12. In art. 16 is made the following changes and additions:

1. a new paragraph. 2:

(2) national and international evaluators be remunerated on the basis of a contract concluded with the Manager of the Science Fund. "

2. The current paragraph. 2 it al. 3.

§ 13. Articles 19 and 20 shall be repealed.

§ 14. In art. 22 is made the following changes and additions:

1. In paragraph 3, after the word "fundamental" is added "and applied".

2. a new item 4:

4. maintain a scientific infrastructure and research complexes; ".

3. The former item 4, 5, 6, 7, 8, 9, 10 and 11 shall become item 5, 6, 7, 8, 9, 10, 11 and 12.

§ 15. In art. 23, para. 1 create item 4 and 5:

4. support research and professional development of young scientists, graduate students and post-doctoral students;

5. Fund projects based on schemes to fund research with the participation of the business as a beneficiary of the scientific product. "

§ 16. In art. 25 the following amendments and supplements shall be made:

1. a new paragraph 1:

"1. the focus of the studies in accordance with the national strategy for scientific research;".

2. The former item 1, 2 and 3 shall become paragraph 2, 3 and 4.

3. The current paragraph 4 becomes item 5 and after the words "related to" add "new knowledge".

4. Section 6 is repealed.

5. Current item 5 becomes item 7 shall be amended as follows:

"7. the legality, efficiency, relevance and equilibrium."

§ 17. In art. 27, first sentence, after the words "Central daily newspaper" there shall be added "and on the website of the Fund" scientific research ".

§ 18. Art is created. 27A:

"Art. 27. The competition research projects must contain:

1. analysis of the situation of the studies on the problem;

2. project objectives, hypotheses and approaches for achieving them;

3. methods, instrumentation and research techniques;

4. plan of research and of the activities carried out by the participants and members of the scientific team;

5. expected results;

6. plan for implementation and dissemination of the results of the research project;

7. justified financial plan. "

§ 19. Article 28 shall be amended as follows:

"Art. 28. the assessment and classification of the submitted projects shall be carried out in accordance with the criteria of art. 25, the procedure under art. 15, para. 2 and under the conditions and in accordance with procedures laid down by the rules of Science Fund. "

§ 20. Article 29 shall be amended as follows:

"Art. 29. (1) the process is evaluated by independent national and/or international assessors.

(2) the provisional scientific and expert committees of the Executive Board presented the results of the competitions and the successful projects according to grades.

(3) on the basis of the classification for each contest, carried out by the procedure of art. 28, the Executive Board in decision sets the projects to be funded and the amount of funds that are provided to them, within the total amount of financial resources allocated to the contest.

(4) on the basis of the decision referred to in paragraph 1. 3 Fund Manager "research contract", which lay down the conditions for the financing and implementation of each of the projects. "

§ 21. Art is created. 29A:

"Article 29A. Each project is funded independently from other projects, according to planned objectives, implementation plan, financial plan and expected outcomes."

§ 22. Article 31 is amended as follows:

"Art. 31. (1) members of the Executive Board of the Fund "scientific research" may not apply during its mandate independently and/or as members of scientific groups for financing by the Fund.

(2) the members of the provisional scientific and expert committees can not apply during its mandate independently and/or as members of scientific groups for financing by the Fund in the competitions which they organize and monitor.

(3) the members of the Permanent scientific and expert committees are unable to assess the performance of on-going projects involving self and/or as members of the teams. "

§ 23. Article 32 shall be amended as follows:


"Art. 32. resources of the Fund "research" can be spent for the acquisition and maintenance of intellectual property rights, including costs associated with the acquisition and maintenance of patents. "

§ 24. In § 1 of the supplementary provision the following amendments and additions:

1. point 5 shall be replaced by the following:

"5." young scientist "is a person who carries out research and scientific and educational activities in higher education and/or scientific organization after acquiring the degree" master "but not more than 10 years after the acquisition."

2. Create t. 6, 7 and 8:

"6." doctoral student "is a scientist who is in the process of acquiring educational and academic degree" doctor ".

7. "Postdoktorant" is a scientist who has acquired PhD degree "doctor", but not more than 5 years after the acquisition.

8. "Unique scientific infrastructure" are facilities, research centers and integrated complexes that have highly specialised equipment and apparatus, offer specialized scientific services have no analogue on the national level and/or peer infrastructures structure laid down by the European strategy Forum on research infrastructures and included in the European roadmap for research infrastructures.

Final provision

§ 25. Within three months of the entry into force of this Act, the Minister of education, youth and Science:

1. issue regulations under art. 7A;

2. brought into conformity with this Act the Minister of finance in agreement with the National Science Fund.
