LAW

amending the law to feed (official SG. 55 of 2006; amend., 36/54 and 100 from 2008 and 41/2010)

§ 1. In art. 1 make the following amendments and additions:

1. In paragraph 8. 1.8:

a) a new letter "c":

"c) Regulation (EC) no 669/2009 of 24 July 2009 implementing Regulation (EC) No 882/2004 of the European Parliament and of the Council as regards the increased level of official controls on imports of certain feed and food of non-animal origin and amending Decision 2006/504/EC (OJ L 194/11 of 25 July 2009) (Regulation (EC) no 669/2009); "

b) previous letters "c" and "d" shall become letters "d" and "e";

in) a new letter "e":

"e) Regulation (EC) no 767/2009 of the European Parliament and of the Council of 13 July 2009 on the placing on the market and use of feed, amending Regulation (EC) no 1831/2003 of the European Parliament and of the Council repealing Council Directive 79/373/EEC, Commission Directive 80/511/EEC, directives 82/471/EEC, 83/228/EEC , 93/74/EEC, 93/113/EC and 96/25/EC and decision 2004/217/EC (OJ L 195/1 of 1 September 2009) (Regulation (EC) no 767/2009); "

(d)) shall be letter "g":

"(g)) Regulation (EC) No 152/2009 of 27 January 2009 laying down the methods of sampling and analysis for the official control of feedingstuffs (OJ L 54/1 of 26 February 2009) (Regulation (EC) No 152/2009); "

(e)) previous letters "d" and "e" shall become letters "h" and "and".

2. a para. 4:

(4) specific requirements for the direct supply of small quantities of primary production of feed at local level by the producer to local farms for use on these farms shall be determined by an Ordinance of the Minister of agriculture and food. "

§ 2. In art. 4 and following amendments and supplements shall be made:

1. Paragraph 2 is repealed.

2. a para. 3:

"(3) prohibits the placing on the market or use in animal nutrition feed set out in art. 6 of Regulation (EC) no 767/2009. "

§ 3. In art. 5 the word "productive" is deleted, and the words "Regulation (EC) No 178/2002" insert "and art. 4 of Regulation (EC) no 767/2009 ".

§ 4. In art. 6 is hereby amended as follows:

1. Paragraph 3 is replaced by the following:

(3) feed materials and compound feedingstuffs shall be placed on the market in accordance with the requirements of Regulation (EC) no 767/2009. "

2. Paragraphs 4 and 5 are repealed.

3. in the Al. 6, the words "the Ordinances under art. 11, para. 3 "are replaced by" the Ordinance under art. 11, para. 3 defining ".

4. Paragraph 8 shall be repealed.

§ 5. In art. 7, para. 1, after the words "Regulation (EC) No 178/2002" insert "and chapter IV of Regulation (EC) no 767/2009".

§ 6. In art. 8 make the following amendments and additions:

1. In paragraph 8. 1:

a) points 1 and 2 shall be read with the following adaptations:

' 1. are authorised under Regulation (EC) no 1831/2003;

2. are used in accordance with the requirements of Regulation (EC) no 1831/2003 and in accordance with the conditions laid down in the individual authorizations for use of the feed additive; "

(b) shall be so) 6:

6. are included in the register of the European Community, of the authorised feed additives in accordance with art. 17 of Regulation (EC) no 1831/2003. "

2. in the Al. 2, the words ' paragraph 1 ' shall be replaced by "6".

3. in the Al. 5, the words "Regulation 1831/2003/EC of the European Parliament and the Council ' shall be replaced by ' Regulation (EC) no 1831/2003.

4. a para. 6:

"(6) in the use of feed additives in feed materials which are intended to further the production of complete feedingstuffs or complementary feedingstuffs production, meet the requirements of art. 8 of Regulation (EC) no 767/2009. "

§ 7. In art. 11 is hereby amended as follows:

1. The first subparagraph of paragraph 1 shall be repealed.

2. Paragraph 3 shall be amended as follows:

"(3) the maximum permissible concentrations of undesirable substances and products in feedingstuffs and the terms and conditions of use of special-purpose feed shall be determined by regulations the Minister of agriculture and food."

§ 8. In art. 13 the following modifications are made:

1. Paragraph 1 shall be amended as follows:

(1) Authorisation, refusal, amendment, renewal, extension, suspension or revocation of the use of a feed additive shall be effected under the conditions laid down in Regulation (EC) no 1831/2003. "

2. paragraph 2 is repealed.

§ 9. In art. 14 (a), para. 1 the word "productive" is deleted.

§ 10. In art. 15 and the word "productive" shall be deleted and the words "intended" are replaced with "captive".

§ 11. In art. 23 (a), para. 1, the words "of GMOs for use in or as a feed" are replaced with "GMOs for feed use.

§ 12. In art. 24 the word "productive" is deleted.

§ 13. In art. 25 al. 2 and 3 are amended:

"(2) to meet the requirements of para. 1 the organizations under art. 56, para. 1 develop guidelines for the application of the good practices and procedures based on the principles of the system of hazard analysis and critical control points (HACCP). The Ministry of agriculture and food, the national veterinary service, National plant protection organisation and the national grain and feed submit opinions on the draft guidelines. In the preparation of opinions shall be taken into account:

1. compliance with regulatory requirements;

2. applicability of the sector for which they are designed;


3. consistency with the guidelines of the European Commission for the implementation of the procedures based on the principles of the system of hazard analysis and critical control points (HACCP);

4. compliance with the requirements of the guidelines of the Codex Alimentarius (Codex Alimentarius).

(3) the Minister of agriculture and food on the basis of the opinions referred to in paragraph 1. 2 approve the developed guides. "

§ 14. In art. 26, al. 5 the word "productive" is deleted.

§ 15. In art. 33 the word "productive" is deleted.

§ 16. In art. 34, para. 3 creating 12:

"12. the conformity of feedingstuffs with special purposes."

§ 17. In art. 45, para. 1 paragraph 1 the word "productive" is deleted.

§ 18. In art. 48 the following modifications are made:

1. In paragraph 8. 1 in the text before paragraph 1 the word "productive" is deleted.

2. in the Al. 2, item 2, the word ' three ' is replaced by ' five '.

§ 19. In art. 50, para. 1, after the words "in accordance with" art "is added. 5. "

§ 20. In art. 50 and following amendments and supplements shall be made:

1. Paragraph 1 shall be amended as follows:

"(1) for the performance of official controls to take and analyse samples in compliance with the requirements of art. 11 of Council Regulation (EC) No 882/2004. "

2. a new paragraph. 2:

"(2) the taking and analysis of samples for the official controls shall be carried out in accordance with the methods referred to in Regulation (EC) No 152/2009."

3. The current paragraph. 2 it al. 3.

§ 21. In art. 51A, al. 1, after the words "provisions of" art "is added. 27-29 of ".

§ 22. In art. 53 and following amendments and supplements shall be made:

1. a new paragraph. 4:

"(4) where a certificate is required under para. 1 contains data on the qualitative composition and/or feed p″lnocennostta, the official veterinarian at the animal health takes a sample and send it to study in an accredited laboratory.

2. Paragraphs 5 and 6 are repealed.

3. a para. 7:

(7) the head of the laboratory of al. 4 send original test report and/or analysis to the Director of the regional veterinary department in whose territory the seat of the official veterinarian. "

4. The current paragraph. 4 it al. 8 and after the word "certificate" is added "under para. 1. "

§ 23. In chapter six you create art. 53 b-53 is:

"Art. 53B. (1) where the certificate referred to in art. 53A, al. 1 required registration data other than those referred to in art. 53A, al. 4, which should be certified by the Protocol of test and/or analysis, the official veterinarian shall take a sample of the feed and sends it in an accredited laboratory of the national veterinary service.

(2) the head of the laboratory of al. 1 send the original of the minutes of the examination and/or analysis to the Director of the regional veterinary department in whose territory the seat of the official veterinarian.

Art. 53. in The receipt of test protocols and/or analysis under art. 53A, al. 7 and art. 53 b, para. 2 the term for the issue of a certificate for the export of feed in third countries shall be suspended.

Art. 53. (1) upon issue of a certificate for the export of feedingstuffs in third countries, it shall be accompanied by a certified copy of the minutes of the examination and/or analysis under art. 53A, al. 7 and art. 53 b, para. 2.

(2) the official veterinarian shall enter the data of the protocols under art. 53A, al. 7 and under art. 53 b, para. 2 in the certificate for the export of feed to third countries.

Art. 53 e. Costs for issuing of test reports and/or analysis under art. 53A, al. 7 and art. 53 b, para. 2 shall be payable by the owner of the feed.

Art. 53. For the issue of a certificate for the export of feed to third countries shall collect the fee in the amount set out in the tariff referred to in art. 14, para. 2 of the law on animal health activities. "

§ 24. In chapter nine is created art. 57A:

"Art. 57. (1) a person who contravenes the provisions of art. 4 (a), para. 3, is punishable by a fine of 1000 to 3000 BGN, and for repeated violation the fine is from 3000 to 5000 EUR

(2) when the offence under para. 1 is committed by a legal person or sole proprietor, a penalty payment in the amount of 3000 to 5000 BGN, and for repeated infringements, the penalty is from 5000 to 10 000 LEVs. "

§ 25. In art. 58, the word "productive" is deleted, and the words "Regulation (EC) No 178/2002" insert "and art. 4 of Regulation (EC) no 767/2009 ".

§ 26. In art. 60, para. 1, after the words "Regulation (EC) No 178/2002" is added "and Chapter IV of Regulation (EC) no 767/2009".

§ 27. Art is created. 62 (b):

"Art. 62 (b) (1) a person who contravenes the provisions of art. 8, al. 6, is punishable by a fine of 5000 to 10 000 BGN, and for repeated violation fine of 10 000 to 15 000 LV.

(2) when the offence under para. 1 is committed by a legal person or sole proprietor, a penalty payment in the amount of 8000 to 15000 EUR and repeated violation the penalty is 15 000 to 20 000 LV. "

§ 28. In art. 66 (b), para. 1 the words "productive animals intended for food production," shall be replaced by "animals."

§ 29. In paragraph 1 (a) of the additional provisions that 40 is amended as follows:

"40." animals ' means animals kept for food production, and/or animals not kept for food production. "

Transitional and final provisions

§ 30. Regulations issued under the repealed provisions in § 7, retained its action, in so far as they do not contravene this law and to express their cancellation.

§ 31. The law shall enter into force on the day of its publication in the Official Gazette.

The law was adopted by 41-Otto National Assembly on 27 October 2010 and is stamped with the official seal of the National Assembly.
