LAW

amending the law on the guaranteed claims of employees insolvency of the employer (official SG. 37/04; amend. and Suppl., no. 104 and 105 by 2005, issue 30, 34, 48, 80 and 105 of 2006, no. 53 of 2007 and no. 12 and 32 from 2009.)

§ 1. In art. 4, al. 1, item 1 and 2 the word "publication" shall be replaced by ' entry in the commercial register.

§ 2. In art. 6 is hereby amended as follows:

1. In the text before item 1 the words "publication in the" Official Gazette "shall be replaced by ' entry in the commercial register.

2. point 3 shall be replaced by the following:

"3. the opening of insolvency proceedings, winding up the business of the undertaking, the notification of the debtor in bankruptcy and stay of proceedings due to failure of the property to cover the costs of the proceedings."

§ 3. In art. 20 the following modifications are made: 1. In para. 3 the words "paid or accrued gross wages" are replaced by "received, including accrued and outstanding, gross wages and salaries or monthly" nenačislenite.

2. in the Al. 4: a) in the first sentence the words "Guarantee claims" shall be replaced by "Secured claims";

(b)) the second sentence shall be replaced by the following: "When the rewards are accrued but not paid or accrued contributions shall be submitted by the end of the month following the month in which it is performed."

§ 4. In art. 22 the following modifications are made:

1. In paragraph 8. 1:

a) in paragraph 1 the word "published" is replaced by "registered";

b) in paragraph 2 the word "publication" shall be replaced by "registration".

2. in the Al. 2 the words "publication of the decision ' shall be replaced by" registration in the commercial register of the decision ".

§ 5. In art. 23 is hereby amended as follows:

1. In paragraph 8. 1 the word "date" is replaced by "month".

2. in the Al. 2 the word "publication" shall be replaced by ' entry in the commercial register.

3. in the Al. 4, the words "or cash" are replaced by "and cash".

§ 6. In art. 25 the words "application-Declaration ' shall be replaced by" application-Declaration ".

§ 7. In art. 27 para. 1 shall be amended as follows:

(1) the territorial divisions of the National Social Security Institute shall pay the guaranteed claims on eligible persons within 7 days of receipt of the order of the Director of the Fund and the payment of amounts by the Fund in respect of their personal current bank accounts or savings demand. "

§ 8. In art. 28, para. 3 the words "insolvency proceedings" shall be replaced by "bankruptcy".

§ 9. In art. 31, the words "of 20 to 250 leva." shall be replaced by ' from 100 to 2000 BGN. on a case by case basis ".

Final provision

§ 10. In the commercial law (promulgated, SG. 48 of 1991; amend. and Suppl., no. 25 of 1992, no. 61 and 103 of 1993, 63/1994, no. 63 of 1995, no. 42, 59, 83, 86 and 104 of 1996, 58/100 and 124 of 1997, no. 21, 39, 52, and 70 of 1998. , PC. 33, 42, 64, 81, 90, 103 and 114 in 1999, St. 84. Since the year 2000, PCs. 28, 61 and 96 in 2002, PCs. 19, 31 and 58 from 2003, PCs. 31, 39, 42, 43, 66, 103 and 105 of 2005, St. 38, 59, 80 and 105, 2006, issue. 59, 92 and 104 from 2007, PCs. 50, 67, 70, 100 and 108 of 2008, PCs. 12, 18, 32, 47 and 82 from 2009, PCs. 41 and 101 of 2010 and PC. 14 by 2011.) in art. 632 Al is created. 6:

(6) within one month from the entry of judgment in the Al. 1 the debtor should perform the termination of employment relationships with employees, to send notices to this effect to the respective territorial Directorate of the National Revenue Agency, to issue the necessary documents for work and retirement and insurance income, to perform the procedure for the information of employees, to prepare reports for the persons with the right of secured claims under the law on the guaranteed claims of employees insolvency of the employer and the normative acts for its implementation and to forward change the numbers in the relevant territorial unit of the National Social Security Institute.

The law was adopted by 41-Otto National Assembly on 16 February 2011 and is stamped with the official seal of the National Assembly.
