for addition of the insurance code (promulgated, SG. 103 from 2005; amend., SG. 105 by 2005, issue 30, 33, 34, 54, 59, 80, 82 and 105 of 2006, issue 48, 53, 97, 100 and 109 from the 2007 No. 67 and 69 by 2008, 24 and 41/2009 and no. 19, 41, 43 , 86 and 100 by 2010.)

§ 1. Art is created. 186:

"A ban on the placement of marks, scars or other indications

Art. 186. (1) it is prohibited to the affixing of marks, scars or other indications on or in a visible place in the motor vehicle, which directly or indirectly indicate the presence of concluded insurance contract in connection with a motor vehicle.

(2) an insurer or reinsurer may not require any form of placing signs, marks or other indications of Pará. 1 as a prerequisite for conclusion and/or entry into force of the insurance contract in connection with a motor vehicle and/or for one or more risks in the insurance contract, and could not negotiate or include in the terms and conditions for such insurance the placement of signs, markings or other indications under para. 1 as an obligation of the insured person, the zastrahovaŝiâ or the third person. The lack of such marks, scars or other indications may not be a ground for exclusion from the coverage of one or more risks in the insurance contract, for the modification or termination of the insurance contract or to be obv″rzvano with any adverse legal consequences for the insured person, zastrahovaŝiâ or the third person.

(3) the prohibition under para. 1 does not apply to signs, markings or other indications whose goal is expressly governed by a normative act, as well as for the characters, scars or other indications that advertise any natural or legal person, a trade mark or brand name, a product, a product, service, brand or similar and they are not bound by the conclusion of the insurance contract, where:

1. the motor vehicle is owned by the same person or is taken from him, hire, leasing or any other legal basis, contracted, or 2. their goal is the implementation of a written contract concluded with the natural or legal person who is the owner, tenant, tenant or lessee of a motor vehicle, on which are placed the marks, scars or other indications. "

§ 2. Art is created. 315:

"Responsibility for affixing of markings, scars or other indications

Art. 315a. A person who drives a motor vehicle with placed signs, scars or other indications in violation of the prohibition under art. 186 a, para. 1, with the exception of those referred to in art. 186 a, para. 3, or of those who represent mikrogravirovka when she directly or indirectly does not indicate the presence of concluded insurance contract, is punishable by a fine of up $ 50. "

§ 3. Art is created. 317 (b):

"Responsibility for the introduction of a requirement for placement of marks, scars or other indications

Art. 317b. An insurer who perform or allow execution of violation of art. 186 a, shall be punished with a proprietary sanction from 30 000 to 60 000 BGN, and for repeated infringement – from 60 000 to 120 000. "

§ 4. In art. 320, para. 1 and 2, after the words "art. 315, para. 1 and 2 "shall be inserted" and art. 315.

Transitional and final provisions

§ 5. The insurers shall in accordance with this law, the terms and conditions or other liabilities existing arrangements for insurance of motor vehicles within three months of its entry into force.

§ 6. (2) and (4) come into force 15 months following the promulgation of the law in the Official Gazette.

The law was adopted by 41-Otto National Assembly on 22 June 2011, and is stamped with the official seal of the National Assembly.
