LAW

amending and supplementing the law on movement make a real difference on the road (official SG. 20 of 1999; amend., no. 1 of 2000 and 43/76 of 2002, no. 16 and 22 of 2003, issue 6, 70, 85 and 115 of 2004, no. 79, 92, 99, 102, 103 and 105 by 2005, issue 30, 34, 61 , 64, 80, 82, 85 and 102 in 2006, PCs. 22, 51, 53, 97 and 109 from 2007, PCs. 36, 43, 69, 88 and 102 by 2008, PCs. 74, 75, 82 and 93 from 2009, PCs. 54, 98 and 100 by 2010, PC. 10, 19, 39 and 48 by 2011; Decision No. 1 of the Constitutional Court by 2012 – PCs. 20 by 2012; amend., SG. 47, 53 and 54 by 2012.)

§ 1. In art. 12 al. 6:

"(6) on intersections with heavy traffic reporting devices are placed on the duration of the light signal.

§ 2. In art. 63 item 1 is repealed.

§ 3. In art. 70 al. 3 shall be amended as follows:

"(3) in the day motor vehicles move with included daytime running lamps or lamps."

§ 4. Article 80 shall be amended as follows:

"Art. 80. the driver of a bicycle is obliged:

1. to use the reflective jacket in his reign outside the settlements, during the dark part of the day and in reduced visibility;

2. to move as close as possible to the right border on roads. "

§ 5. In art. 98, para. 2, item 4 the word ' disabled ' is replaced by ' people with permanent disabilities ".

§ 6. In art. 99 and the following endorsements are added:

1. In paragraph 8. 1:

a) after the words "disabled" is added "permanent," and after the word "municipality" is added "form in accordance with Annex";

(b)) the second sentence shall be: "card is valid on the territory of the whole country."

2. in the Al. 2, after the words "disabled" is added "durable".

3. in the Al. 3, after the words "disabled" is added "durable".

§ 7. In art. 107, item 3 the word "disabled" is replaced by "who are permanently disabled and".

§ 8. In art. 109 the word "Handicapped" is replaced by "people with disabilities".

§ 9. In art. 116 the word "handicapped" is replaced by "people with disabilities" and after the word "stick" a comma and add "to slepo-deaf who move with the red-and-white cane."

§ 10. In art. 137 a, para. 2 make the following amendments and additions:

1. a new paragraph 3:

"3. persons with permanent disabilities of upper limbs and/or musculoskeletal system who drive motor vehicles, adapted to their needs;".

2. The former item 3 and 4 shall become paragraph 4 and 5.

§ 11. In art. 152, para. 3, after the words "the commercial law" is added "or law of non-profit legal entities".

§ 12. In art. 153 (b) is hereby amended as follows:

1. In paragraph 8. 1:

a) in item 1 (a), the words "General transport hospitals of the Ministry of transport, information technology and communications" shall be replaced by ' hospitals for active treatment ";

b) point 2 is amended as follows:

"2. the third psychological study – Executive Agency" automobile administration. "

2. paragraph 2 is replaced by the following:

"(2) Methodological guidance for conducting psychological research is carried out by an Executive Agency" automobile administration. "

§ 13. In art. 153 the following amendments and supplements shall be made:

1. In paragraph 8. 4 the word "14 days" is replaced by "30 days".

2. in the Al. 7 create new item 2, 3 and 4:

"2. when in the course of the work of organizing and conducting psychological research from the person working with the holder of the certificate of registration, used false document or false document;

3. where, on completion of the work of organizing and conducting psychological research from the person working with the holder of the certificate of registration has been issued a certificate of psychological suitability without psychological research has been carried out;

4. in the case of assignment of the rights conferred by the certificate of registration for organizing and conducting psychological research; ".

3. The former item 2, 3 and 4 shall become item 5, 6 and 7.

§ 14. In art. 154, para. 2, after the words "category with" insert "or" Ttb category.

§ 15. In art. 166 al. 3 is repealed.

§ 16. In art. 171 the following endorsements are added:

1. In paragraph 2 shall create letters "h" and "and":

"(h)) to the owner who drives a motor vehicle without holding the appropriate licence and/or he used alcohol with concentration in the blood above 0.5 per thousand, or other intoxicating substance – for a period of up to one month;

and) of the owner who allowed or provides the management of the motor vehicle to a person who does not have the appropriate certificate for the management and/or is used with alcohol concentration in the blood above 0.5 per thousand, or other intoxicating substance – for a period of up to one month. "

2. point 7 is created:

"7. the suspension of the activities of persons who have received a certificate of registration by the procedure of art. 153 in – to eliminate the violations. "

§ 17. In art. 172 is do the following amendments and additions:

1. In paragraph 8. 1 the words "art. 171, item 1, 2, 4, item 5 (a) and 6 ' shall be replaced by "art. 171, item 1, 2, 4, item 5 (a), item 6 and 7 ".

2. a new paragraph. 4:


"(4) in the cases under art. 171, paragraph 2, letters "h" and "and" the registration certificate of the vehicle forfeited with the drafting of the Act establishing administrative infringement of the person driving the motor vehicle and shall be returned to the owner of the vehicle by an order determined by the Minister of the Interior. "

3. the Previous para. 4 and 5 become respectively al. 5 and 6.

§ 18. In art. 174 the following modifications are made:

1. Paragraph 1 shall be amended as follows:

' (1) is Punishable by deprivation of the right to operate a motor vehicle, tram, or a self-propelled machine for a period of 6 to 12 months and a fine of 500 to 1000 EUR, which operate a motor vehicle, tram, or a self-propelled machine with a blood alcohol concentration above 0.5 per thousand up to 1.2 per thousand including down with medical research and/or technical resources determining the content of alcohol in the blood by measuring in the exhaled air.

2. in the Al. 3 the words "12 to 18 months" shall be replaced by "two years", and the words "of 500 to 1000 EUR" is replaced by "EUR 2000".

§ 19. In art. 177 is hereby amended as follows:

1. In paragraph 8. 3 the words "1000 to 5000" shall be replaced by ' 500 to 3,000.

2. in the Al. 4, ' 150 to 1500 "shall be replaced by ' 300 to 1500 ' and the words ' 500 to 3000" are replaced by "1000 to 5000.

§ 20. In art. 178 b, para. 4 point 7 is created:

7. carry out or is conducted training of candidate for driving a motor vehicle in category c, D, Ttb, Ttm and subcategory C1 and D1 without the applicant holds a valid certificate of psychological fitness. "

§ 21. Article 178 is amended as follows:

"Art. 178. (1) a fine or penalty payment in the amount $ 3000. natural or legal person who:

1. organize and conduct psychological research on the order of the Ordinance under art. 152, para. 1, item 2 and al. 2 without a certificate of registration issued for organizing and conducting psychological research;

2. organize and conduct psychological research on the order of the Ordinance under art. 152, para. 1, item 2 and al. 2 after his registration for organizing and conducting psychological research has been deleted or has been applied after his compulsory administrative measure under art. 171, s. 7;

3. denied employees of Executive Agency "automobile administration" performing functions in carrying out methodological guidance and control of psychological research, to the psychological laboratory during the conduct of psychological research and documentation for it.

(2) a fine or penalty payment in the amount $ 1500. a natural or legal person holding certificate for registration for organizing and conducting psychological research that:

1. inform the Executive Agency "automobile administration" for a change of address, the number of premises, workplaces and equipment of psychological laboratories in the list to the certificate within the time limit set by the Ordinance under art. 152, para. 1, item 2;

2. use the methodologies set out for conducting psychological research for purposes other than those laid down by the Ordinance under art. 152, para. 1, item 2;

3. disclose the methodologies set out to conduct psychological research;

4. organizes and carries out training of the persons subjected to psychological testing, before the meeting;

5. arrange for the admission to the psychological study of individuals outside the list of graphics to conduct psychological research;

6. order or allow the issue of a certificate of psychological suitability based on missing data or on the basis of the non-compliant with the methodologies of psychological research results;

7. do not execute orders and/or recommendations to the authorities to control and/or to the officers of the Executive Agency "automobile administration" performing functions in methodological guidance and control of psychological research.

(3) a fine in the amount $ 500. a psychologist who in the conduct of psychological research:

1. allow to study person outside the list of graphics to conduct psychological research;

2. start the conduct of psychological research later than the hours determined by the Ordinance under art. 152, para. 1, item 2;

3. disrupt the sequence and/or number of methodologies for conducting psychological research from the established guidelines;

4. issue a certificate for psychological suitability based on missing data or on the basis of the non-compliant with the methodologies of psychological research results;

5. issue a certificate for psychological suitability was conducted without psychological study.

(4) the punishment under para. 3 and having a person who fails to comply with the requirements for the keeping of records in connection with organizing and conducting psychological research.

(5) a fine in the amount $ 500. taxi driver who carried out or public transport of passengers or goods without a valid certificate of psychological fitness.

(6) where the infringement under para. 1-5 is repeated, the penalty provided for the offence is a fine or penalty payment double the size. "

§ 22. Art is created. 178 (e):

"Art. 178 e. A fine amounting to 200 EUR a person who, without this law, the designated place for a vehicle servicing people with permanent disabilities, or for a vehicle adapted and controlled by people with disabilities. "

§ 23. In art. 179, para. 1, item 5, the words "the signals of traffic lights" and the comma after them are deleted.

§ 24. In art. 183 following amendments and supplements shall be made:

1. In paragraph 8. 1 item 5 is created:


"5. manages the bike without reflective jacket in violation of art. 80, item 1. "

2. in the Al. 4:

a) point 1 shall be repealed;

(b)) point 3 shall be repealed.

3. Al are created. 5 and 6:

"(5) a fine $ 100. driver:

1. when the signal passes the traffic light that does not permit passage;

2. do not provide an edge when going through a walkway.

(6) where the infringement under para. 5, item 1 or 2 is repeated, the driver shall be punished with fine in extend 200 LV. and deprivation of the right to operate a motor vehicle for a period of one month. "

§ 25. In art. 184 following amendments and supplements shall be made:

1. In paragraph 8. 1. t 6 is repealed.

2. a new paragraph. 2:

"(2) with a fine of $ 50. Walker, who will be punished:

1. passes through the wire by railings or chains;

2. does not comply with light signals of the road traffic lights and signals the regulirovčika. "

3. The current paragraph. 2 it al. 3 and in her words "to $ 10" shall be replaced by "$ 20." and finally "be added outside the cases referred to in para. 2. "

4. The current paragraph. 3 it al. 4.

5. The current paragraph. 4 it al. 5 and in her words "under para. 1 and 2 "shall be replaced by" under para. 1, 2 and 3 ", and the words" from 10 to 50 Leva "are replaced by" 20 to $ 50. ".

§ 26. In § 6 of the supplementary provisions the following amendments and additions:

1. The former item 60, 61, 61 and 62 shall become item 60, 61, 62 and 63.

2. an item 64:

"64." a person with a permanent disability "means a person specified in § 1, item 2 of the additional provisions of the law on integration of people with disabilities."

§ 27. In § 39 of the transitional and concluding provisions of the law amending the law on road traffic (SG. 54 of 2010) the following amendments and additions:

1. In paragraph 8. 2, after the word "retain" the way the text is deleted.

2. a para. 3:

(3) persons who possess the aptitude for driving a motor vehicle in category Ttb, training for driving a motor vehicle of category D to 19 January 2013. "

§ 28. It creates an annex to art. 99 a, para. 1:

"Annex to art. 99 a, para. 1

1. Map for preferential parking the vehicle carrying people with permanent disabilities, dimensions: height 106 mm and width of 148 mm.

2. the colour of the parking card is light blue with the exception of the white sign for "disabled", which is a deep blue background.

3. for preferential parking must be laminated.

4. Fields on the front and back of the card for preferential parking are divided vertically into two parts.

Front left side contains:

– the wheelchair symbol in white on dark blue background;

-the date of expiry of the card for parking;

-the serial number of the parking card;

– the name and stamp of the issuing authority/organisation.

The front right hand side contains:

– in capital letters the words "parking card for people with disabilities" in the Bulgarian language, and the appropriate spacing in small print, the words "parking card" in the other languages;

-the words "European Communities model" in the Bulgarian language;

– the distinctive background code of the Republic of Bulgaria – BG, surrounded by a circle of 12 stars, symbolising the European Union.

The left side of the back contains:

-the last name of the holder;

-the first (first) name (s) of the holder;

– the signature of the holder or other identifying sign;

-the photograph of the holder.

The right side of the back contains:

– the statement that this card entitles the holder to use the place for preferential parking the vehicle carrying people with disabilities;

– the statement that the card is placed at the front of the vehicle so that the front part can be seen in full in order to verify.

The data are of Bulgarian language ".

Final provisions

§ 29. Road Transport Act (promulgated, SG. 82 in 1999; amend., SG. 45 and 11 of 2002, 99/2003, no. 70 by 2004, no. 88, 92, 95, 102, 103 and 105 by 2005, issue 30, 85, 92 and 102 in 2006, issue 42, 80 and 109 from the 2007 No. 102 by 2008. , PC. 93 2009 PCs. 41 of 2010, PC. 17 of 2011, issue. 38 and 50 by 2012.) art is created. 96:

"Art. 96. Who appoints the driver of a light car or taxi driver of car, with which the public transport of passengers or goods, without the driver must hold a valid certificate for psychological fitness, is punishable by a fine or penalty payment in the amount $ 1000. "

§ 30. The law shall enter into force on the day of its publication in the Official Gazette with the exception of paragraph 1, which shall enter into force one year after the promulgation of the law in the Official Gazette.

The law was adopted by 41-Otto National Assembly on 24 July 2012 and is stamped with the official seal of the National Assembly.
