amending the law on protection from discrimination (official SG. 86 from 2003; amend., SG. 70 by 2004, 105/2005 30/68 and by 2006, and 59/100 of 2007, issue 69 and 108 of 2008, issue 42, 74 and 103 of 2009, issue 97 of 2010. , PC. 23 and 39 from 2011, and St. 38 by 2012.)

§ 1. In art. 6 make the following amendments and additions:

1. The current text becomes paragraph 1.

2. a para. 2:

"(2) in the elaboration of the draft regulations, as well as in their implementation of State and public bodies and bodies of local self-government shall comply with the purpose to prevent the direct or indirect discrimination on the basis of the signs referred to in art. 4, al. 1. "

§ 2. In art. 7, para. 1 creating a t. 19:19. different treatment of individuals with regard to the taking of measures aimed exclusively or principally initiatives to promote entrepreneurship among women in cases where they are not the sex, or to prevent or compensate for disadvantages in professional careers. "

§ 3. In art. 37 following amendments and supplements shall be made:

1. The current text becomes paragraph 1.

2. Al are created. 2 and 3:

(2) there shall be no discrimination on the basis of the signs referred to in art. 4, al. 1 in the public or the real sector, directly or indirectly, related to the conduct of business, including with respect to the establishment, equipment or extension of a business or the launching or extension of any other form of such activity.

(3) the activities referred to in para. 2 rejection or incurred by an individual for conduct that constitutes harassment or sexual harassment shall not serve as a basis for a decision which affects that person. "

§ 4. In art. 47 make the following amendments and supplements: 1. a new item 12:

12. inform the public through the mass media for the existing provisions in the area of protection from discrimination; ".

2. Current t. 12 becomes item 13.

§ 5. In the additional provisions the following amendments and additions:

1. In paragraph 1:

a) in paragraph 1, after the word "hostile" is added "prinizâvaŝa, humiliating";

b) in paragraph 2, after the word "hostile" is added "prinizâvaŝa";

c) in item 5, after the words "discrimination", the text is deleted the rest.

2. a paragraph 1 (b):

"§ 1 (b). This law introduces the requirements of Directive 2010/41/EC of the European Parliament and of the Council of 7 July 2010 on the application of the principle of equal treatment between men and women engaged in an activity in a self-employed capacity and repealing Directive 86/613/EEC (OJ L 180/1, of 15 July 2010 on). "

Final provisions

§ 6. In the social security code (promulgated, SG. 110; since 1999 decision No 5 of the Constitutional Court from 2000 – 55/2000; amend., no. 64 of 2000, issue 1, 35 and 41 of the 2001, issue 1, 10, 45, 74, 112, 119 and 120 of 2002, no. 8, 42, 67, 95, 112, and 114 from 2003. , PC. 12, 21, 38, 52, 53, 69, 70, 112 and 115 of 2004, PCs. 38, 39, 76, 102, 103, 104 and 105 of the 2005 St. 16, 30, 34, 56, 57, 59, 68, 76, 80, 82, 95, 102 and 105, 2006, issue. 41, 52, 53, 64, 77, 97, 100, 109 and 113 of 2007, PC. 33, 43, 67, 69, 89, 102 and 109 from 2008, PCs. 23, 25, 35, 41, 42, 93, 95, 99 and 103 of 2009, PCs. 16, 19, 43, 49, 58, 59, 88, 97, 98 and 100 by 2010; Decision of the Constitutional Court No. 7 of 2011-PCs. 45 by 2011; amend., SG. 60, 77 and 100 by 2011, and St. 7, 21, 38, 40 and 44 by 2012.) make the following changes and additions:

1. In art. 4:

a) a new para. 9:

(9) the spouses of the persons referred to in para. 3, paragraphs 1 and 4, with their consent when they participate in the exercise of their employment, may be provided on your own and at his own expense for disability due to sickness, old age and death and sickness and maternity insurance, if you are not insured under para. 1 and/or al. 3, items 1, 2 and 4, and/or art. 4. The contributions of the spouses of the persons referred to in para. 3, item 1 is due on the minimum insurance income for self-employed persons as defined by the law on State social insurance budget, and to the spouses of the persons referred to in para. 3, item 4 – the minimum insurance income for registered agricultural producers and tobacco producers as defined by the law on State social insurance budget. ";

(b)) the current al. 9 it al. 10 and in her words "para. 7 and 8 "are replaced by" para. 7, 8 and 9.

2. In art. 4 (a), para. 5, the words "para. 9 "shall be replaced by" para. 10. "

3. In art. 5, al. 4, paragraph 2 establishes the second sentence: "a statement of the amounts of contributions to State social insurance and the additional compulsory pension insurance shall be filed for persons under art. 4, al. 5 and 9.

4. In art. 8, al. 1 the words "Insurers and self-employed persons" shall be replaced by ' Insurer, self-employed persons and persons under art. 4, al. 9. "

5. In art. 70 a, para. 2, item 9, the words "article. 4, al. 5, 7 and 8 "are replaced by" article. 4, al. 5, 7, 8 and 9.

6. In paragraph 1 (a) of the additional provisions establishes a point 7: "7. Directive 2010/41/EC of the European Parliament and of the Council of 7 July 2010 on the application of the principle of equal treatment between men and women engaged in an activity in a self-employed capacity and repealing Directive 86/613/EEC (OJ L 180/1, of 15 July 2010 on). "


§ 7. The law shall enter into force on 1 August 2012.

The law was adopted by 41-Otto National Assembly on 26 July 2012 and is stamped with the official seal of the National Assembly.
