To be published in the "Official Gazette" Law amending the Law on Publicity of property of persons occupying high state positions adopted by the National Assembly HLI on March 12, 2013

Law amending the Law on Publicity of property of persons occupying high state positions (prom. SG. 38 of 2000 .; amend., SG. 28 and 74 of 2002, pcs. 8 2003, SG. 38 of 2004, No. 105 of 2005, pcs. 38 and 73, 2006, issue. 109 2007, pcs. 33, 69 and 94 of 2008, pcs. 93 2009 n. 18 and 62 of 2010, pcs. 38 of 2012)
§ 1. In the name of the law terms "public office" are replaced by "state, public and other positions in the public and private sectors."
§ 2. In art. 1, 'Public Officials in Bulgaria "is replaced by" state, public and other positions in the public and private sectors. "
§ 3. In art. 2 made the following amendments:
1. In para. 1:
a) pt. 15 finally put a comma and added "the chief inspector and inspectors in the Inspectorate at the Supreme Judicial Council";
B) in Item. 25 finally added "and the directors of the Central Customs Administration";
C) t. 26 after the word "director" a comma and added "the deputy directors and the chief secretary," and finally added "and the directors of the central management and the directors of the regional directorates"
D) in Item. 26 finally added "and directors of its territorial units";
E) create a new item. 31 and so on. 32-38:
"31. Members of management and supervisory bodies of the representative organizations of workers and employers whose representatives are permanent members of the National Council for Tripartite Cooperation;
32. Members of the European Parliament of the Republic of Bulgaria;
33. Commissioners from Bulgaria and Bulgarian citizens occupying positions in the European Union, elected or appointed by a decision or proposal of the Bulgarian state body;

34. Bulgarian citizens holding posts in the North Atlantic Treaty Organization, who are elected or appointed by a decision or proposal of the Bulgarian state body;
35. heads of missions of the Republic of Bulgaria;
36. Bulgarian citizens in decision or proposal of the Bulgarian state bodies are members of management or supervisory bodies of international organizations, financed by the Republic of Bulgaria;
37. Members of the Management Board and the Supervisory Board of the Bulgarian Development Bank;
38. Members of management and supervisory bodies of the National Electricity Company, the Bulgarian Energy Holding and entities that operate regulated by the State Energy and Water Regulatory Commission; "
e) the previous item. 31 becomes item. 39. | || 2. In para. 2, the second sentence: "For persons under par. 1, p. 33, 34 and 36 notification shall be made by the head of the authority adopted the decision or proposal made. "
§ 4. In art. 3, para. 1 made the following amendments:
1. A new item. 5:
"5. Income for the position obtained during the preceding calendar year. "
2. Previous item. 5 becomes item. 6.
Final provisions
§ 5. (1) The persons for which the entry into force of this Act an obligation arises under Art. 2 para. 1 filed declarations under Art. 4 para. 1 within 14 days of its publication in the "Official Gazette". Declarations shall be published immediately on the National Audit Office on the Internet.
(2) The persons under par. 1 can make changes in declarations filed by them within 7 days from their publication. The changes are published immediately.
§ 6. In the Political Parties Act (prom. SG. 28 of 2005 .; amend. Pcs. 102 of 2005, pcs. 17 and 73, 2006, issue. 59 and 78 of 2007 pcs. 6 2009 n. 54 and 99 of 2010, pcs. 9 and 99 of 2011) in art. 30 is amended as follows:
1. In para. 3 words "government officials" are replaced by "state, public and other positions in the public and private sectors."
2. Paragraph 4 is repealed.
§ 7. In Judiciary Act (prom. SG. 64 of 2007 .; amend., SG. 69 and 109 of 2008, pcs. 25, 33, 42, 102 and 103 2009 n. 59 of 2010, pcs. 1, 23, 32, 45, 81 and 82 of 2011 .; Decision № 10 of the Constitutional Court from 2011 - SG. 93 of 2011 amended .; ., No. 20, 50 and 81 of 2012, pcs. 15 and 17 of 2013) in art. 228, para. 1, 'Public Officials "are replaced by" state, public and other positions in the public and private sectors. "
§ 8. In the Law on State Agency "National Security" (Prom. SG. 109 of 2007 .; amend., SG. 69 and 94 in 2008, pcs. 22, 35, 42 82 and 93 of 2009, pcs. 16, 80 and 97 of 2010, pcs. 9 and 100 in 2011, pcs. 38 of 2012, pcs. 15 of 2013) shall be amended :
1. In art. 4 para. 1, p. 4 the words "government officials" are replaced by "state, public and other positions in the public and private sectors."

2. In § 1, p. 4 of the supplementary provision everywhere the words "public officials" are replaced by "state, public and other positions in the public and private sectors."
§ 9. The Act shall enter into force on the day of its promulgation in the "Official Gazette".
The law was adopted by the 41 th National Assembly on March 12, 2013 and was affixed with the official seal of the National Assembly.
