LAW

amending the law on the guaranteed claims of employees insolvency of the employer (official SG. 37/04; amend., no. 104 and 105 by 2005, issue 30, 34, 48, 80 and 105 of 2006, 53/2007, no. 12 and 32 from 2009, issue 18 of 2011 No. 94 by 2012 and 15/2013)

§ 1. In art. 4 al. 2 shall be amended as follows:

"(2) the persons referred to in para. 1 can enjoy rights under this law, provided that the employer did so at least 12 months prior to the date of insolvency, according to over-indebtedness, referred to in the decision under art. 6. "

§ 2. In art. 22, para. 1 paragraph 1 shall be replaced by the following:

"1. the past six accrued but unpaid monthly salaries and benefits in cash during the last 12 calendar months preceding the month in which the decision has been registered under art. 6, but a month not more than definitions for these cases, the maximum amount of guaranteed claims, if the employee has been in employment with the same employer for not less than three months; ".

§ 3. In art. 23 al. 1 shall be amended as follows:

(1) the guaranteed claims of employees under art. 4, al. 1, item 2 of the last six accrued but unpaid monthly salaries and benefits in cash during the last 12 calendar months before the month of termination of the employment relationship, but a month not more than definitions for these cases, the maximum amount of guarantee claims if they have been in employment with the same employer for not less than three months. "

§ 4. In art. 25 word "30 days" shall be replaced by "two".

Final provisions

§ 5. In the law on State social insurance budget for 2013 (official SG. 99 by 2012, Corr, issue 102 of 2012; amend., SG. 57 by 2013) in art. 15, para. 2, the words "EUR 1000" shall be replaced by "EUR 1200".

§ 6. The law shall enter into force on 1 October 2013.

The law was adopted by the 42-Otto National Assembly on 18 September 2013 and is stamped with the official seal of the National Assembly.
