LAW amending the law on roads (official SG. 26 of 2000; amend., 88/2000, 111/2001, and 47/118 of 2002, no. 9, 112 since 2003, issue 6 and 14 of 2004, no. 88 and 104 of 2005, no. 30, 36, 64, 102, 105 and 108 of 2006. , PC. 59 since 2007, PCs. 43 and 69 since 2008, PCs. 16, 32, 41, 42, 75, 82 and 93 from 2009, PCs. 87 from 2010, PC. 19, 39, 55 and 99 from 2011, issue. 38, 44, 47 and 53 by 2012 PCs. 15 and 66 by 2013, PCs. 16, 53 and 98 by 2014 and PCs. 10, 14, 37, 61, 95 and 101 by 2015.)

§ 1. In art. 26, al. 5, the words "including the objects of art. 28 (b), para. 1 ' shall be deleted.

§ 2. Chapter four "a" with art. 28 a-28 and is repealed.

§ 3. In art. Al 30. 2 is repealed.

§ 4. In art. 38, para. 4, paragraph 1, the words "or the Executive Director of the national company" strategic infrastructure "or authorized officer" shall be deleted.

§ 5. In art. 40, para. 2, the words "or National Strategic infrastructure projects" are deleted.

Transitional and final provisions

§ 6. Stop the activity of the State Enterprise National Strategic infrastructure projects "from the day of entry into force of this law.

§ 7. (1) employment relationships with employees of the State-owned enterprise their suspended National Strategic infrastructure projects "are governed under the terms of art. 328, para. 1, item 1 of the labour code, the provisions of art. 123 of the labour code does not apply.

(2) the Minister of regional development and public works to take appropriate action for cancellation of their suspended state enterprise National Strategic infrastructure projects "from the commercial register and to terminate the contracts of Management Board members within one month of the entry into force of this law.

(3) the authority of the Executive Director and members of the Governing Board of their suspended state enterprise National Strategic infrastructure projects "are terminated from the date of the entry under para. 2. § 8. All assets, liabilities, and other rights and obligations of their suspended state enterprise National Strategic infrastructure projects "pass to the Agency" road infrastructure ".

§ 9. (1) the funds available to the State-owned enterprise their suspended National Strategic infrastructure projects "shall be refunded by transfer on the budget of the Ministry of regional development and public works.

(2) the Minister of regional development and public works to carry out changes in the budget of the Ministry of regional development and public works in accordance with art. 112, para. 3 of the Act on public finances at the expense of the portion of the amount prescribed for their suspended state enterprise National Strategic infrastructure projects "shuttle for 2016.

§ 10. The Council of Ministers to carry out the procedure of art. 79 and art. 81, para. 2 of the law on the State budget of the Republic of Bulgaria for 2016, resulting from the application of section 5, 6, 7 and 8 of this law, the changes in the indicators under art. 22, para. 1, section II "cost", paragraph 1.1 and al. 3 of the Act on the State budget of the Republic of Bulgaria for 2016.

§ 11. Available on the day of the entry into force of this law, information and documentation in the original in relation to objects under the revoked art. 28B-HEMUS motorway, Struma motorway and highway "Cherno More", as well as other sites and all projects funded under the operational programme "transport" 2007-2013 and the operational programme "transport and transport infrastructure" 2014-2020, including in electronic form, shall be submitted to the authorised by the Chairman of the Management Board of the Agency "road infrastructure" officials within one month from the entry into force of this law.

§ 12. Road infrastructure agency ensures the maintenance of up-to-date information on the progress of all the procedures opened by their suspended state enterprise National Strategic infrastructure projects ".

§ 13. Within one month from the entry into force of this law, authorized by the Executive Director of their suspended state enterprise National Strategic infrastructure projects "submitted to the officials authorised by the Chairman of the Management Board of the Agency" road infrastructure "officials all files on applications and open procedures, related to the objects under the revoked art. 28B-HEMUS motorway, Struma motorway and highway "Cherno More", which have not been completed. After the transmission of correspondence procedures begun prior to the entry into force of this law shall be completed by agency "road infrastructure".

§ 14. Due at the time of the entry into force of this Act shall be administered by the Agency "road infrastructure".


§ 15. Property-State property and the personal property of their suspended state enterprise National Strategic infrastructure projects "is used by agency" road infrastructure "for performance of the functions of the Agency to grant them under the conditions and pursuant to the law on State property.

§ 16. The head of the managing authority of the operational programme "Transport" 2007-2013 and the head of the managing authority of the operational programme "transport and transport infrastructure 2014-2020", and the Chairman of the Management Board of the Agency "road infrastructure" – head of the beneficiary sign an agreement for the implementation of the projects financed by the operational programme "transport" 2007-2013 and the operational programme "transport and transport infrastructure 2014-2020", the Cohesion Fund and the European Fund for regional development of the European Union to which the beneficiary is their suspended state enterprise National Strategic infrastructure projects ".

§ 17. Generated, but outstanding pending the entry into force of this law the administrative and court proceedings in connection with the objects under the revoked art. 28 (b) completed by agency "road infrastructure".

§ 18. The costs of termination of the activity of the State Enterprise National Strategic infrastructure projects, "including for benefits under the labour code, are charged to the budget of the Ministry of regional development and public works.

§ 19. The law shall enter into force on the day of its publication in the Official Gazette.

The law was passed by the National Assembly-43 on April 7, 2016 and is stamped with the official seal of the National Assembly.
