DECREE OF November 25, 2003.

Declares of social interest, for purposes of agrarian reform, the rural real estate it mentions, and gives others providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplemental Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18,, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Dependant Engineering", with area of three hundred and thirty-eight hectares and forty ares, situated in the Municipality of Tracunhaém, object of Record # R-4-102, fls. 05, Book 2-E, of the Real Estate Registration Office of the Comarch of Nazareth of the Mata, State of Pernambuco (Case INCRA/SR-03/nº 54140.001217 /2003-12);

II-"Engineer Taquara", with area of eight hundred and sixty and one hectares and twenty ares, situated in the Municipality of Tracunhaém, object of the Registry # R-4-104, fls. 62, Book 2-G, of the Estate Registration Office of the Comarch of Nazareth of the Mata, State of Pernambuco (Process INCRA/SR-03/nº 54140.001183 /2003-66);

III-"Papicu engineer", with seiscented area and seventy three hectares and fifty ares, situated in the Municipality of Tracunhaém, object of the Registry # R-5-101, fls. 05, Book 2-F, of the Estate Registration Office of the Comarch of Nazareth of the Mata, State of Pernambuco (Process INCRA/SR-03/nº 54140.001215 /2003-23); and

IV-"Tocos engineer", with seventy-six hectares and fifty ares, situated in the Municipality of Tracunhaém, object of the Registration # R-1-103, fls. 17, Book 2-B, of the Real Estate Registration Office of the Comarch of Nazareth of the Mata, State of Pernambuco (Case INCRA/SR-03/nº 54140.001214 /2003-89).

Art. 2º Excludes from the effects of this Decree the Semoters, the agricultural machinery and implements, as well as the existing benfeits in the real estate referred to in art. 1º and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the dispropriations of rural real estate from which treats this Decree, in the form provided for in the Supplementary Act No. 76 of July 6, 1993, and to keep the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferentially in single gleba, so as to reconciling the settlement with the preservation of the environment.

Art. 4º This Decree comes into force on the date of its publication.
