DECREE NO. 5,943, OF October 26, 2006.

Disposes on the implementation of the Third Additional Protocol to the Economic Supplementation Agreement no 59, between the Governments of the Federative Republic of Brazil, of the Argentine Republic, of the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and the Governments of the Bolivarian Republic of Venezuela, the Republic of Colombia and the Republic of Ecuador, of June 30, 2006.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, and

Whereas the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by Brazil on August 12, 1980, and approved by the National Congress, through the Legislative Decree no 66, of November 16, 1981, provides for the modality of Complementation Agreement Economic;

Considering that the Plenipotentiaries of the Federative Republic of Brazil, of the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and the Bolivarian Republic of Venezuela, the Republic of Colombia and the Republic of Ecuador, based on the Treaty of Montevideo 1980, signed, in Montevideo, on October 18, 2004, the Economic Supplementation Agreement no 59, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to the Mercosur, and the Bolivarian Republic of Venezuela, of the Republic of Colombia and of the Republic of Ecuador, incorporated into Brazilian domestic law by the Decree no 5,361, of January 31, 2005;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, of the Argentine Republic, of the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and the Bolivarian Republic of Venezuela, the Republic of Colombia and the Republic of Ecuador, based on the Treaty of Montevideo of 1980, signed, in Montevideo on June 30, 2006, the Third Additional Protocol to the Economic Supplementation Agreement no 59, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and of the Bolivarian Republic of Venezuela, the Republic of Colombia and the Republic of Ecuador;

DECRETA:

Art. 1st The Third Additional Protocol to the Economic Supplementation Agreement no 59, among the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to Mercosur, and the Bolivarian Republic of Venezuela, the Republic of Colombia and the Republic of Ecuador, apensed by copy to the present Decree, it will be executed and fulfilled as entirely as it contains.

Art. 2nd This Decree goes into effect on the date of its publication.

ECONOMIC COMPLEMENTATION AGREEMENT No 59 SIGNED BETWEEN THE GOVERNMENTS OF THE ARGENTINE REPUBLIC, OF THE FEDERATIVE REPUBLIC OF THE BRAZIL, FROM THE REPUBLIC OF PARAGUAY AND THE EASTERN REPUBLIC OF URUGUAY, STATES PARTIES TO MERCOSUR AND THE GOVERNMENTS OF THE REPUBLIC OF COLOMBIA, THE REPUBLIC OF ECUADOR AND THE BOLIVARIAN REPUBLIC OF VENEZUELA, MEMBER STATES OF THE ANDINA COMMUNITY

Third Additional Protocol

The Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and of the Eastern Republic of Uruguay, in its condition of States Parties of the Common Market of the South (MERCOSUR) on the one hand, and of the Republic of Colombia, the Republic of Ecuador and the Bolivarian Republic of Venezuela, Paises-Members of the Andean Community, by another, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely in the General Secretariat,

HAVING IN A VIEW TO Resolution N ° 1/06 (REX)-ACE No 59, approved by the Administrative Commission of the Economic Supplementation Agreement No 59 in its II Extraordinary Meeting, celebrated in Montevideo, June 10, 2006,

DECK IN:

Article 1. -Extend the specific transient source requirements for the capital goods sector, between Brazil, Colombia, Ecuador and Venezuela, until December 31, 2006.

Article 2.-Extend the specific transient source requirements applied between Brazil and Colombia, up to 31 from December 2006.

Article 3. -Extend the specific transient source requirements for PET preforms, between Brazil, Ecuador and Venezuela, until December 31, 2006.

Article 4. -This Protocol shall enter into force bilaterally between the Signatary Parties which have communicated to the General Secretariat of the ALADI that it has been incorporated into their domestic rights, pursuant to their respective legislations. The General Secretariat of ALADI will inform the respective Signatary Parties on the date of the bilateral term.

Signatary Parties will be able to apply this Agreement in an interim manner as long as they are met the necessary tramites for the incorporation of this Protocol to their domestic law. The Signatory Parties shall communicate to the General Secretariat of ALADI the provisional application of this Protocol, which by its side shall inform the Signatary Parties the date of bilateral application when they correspond.

The General Secretariat of the Latin American Integration Association (ALADI) will be the depository of this Protocol, of the which will send duly authenticated copies to the Governments of the Signatary Parties.

IN FÉ OF THE THAT, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the thirty days of the month of June of the year of the thousand and six, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
