DECREE OF June 19, 2012

Declara of public utility, for the purposes of misappropriation, in favor of the concessionary Autopista Sul S.A., the real estate it mentions, located in the Municipality of Governor Celso Ramos, State of Saint Catherine.

THE VICE PRESIDENT OF THE REPUBLIC, in the exercise of the post of PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, caput, inciso IV, of the Constitution, with a view to the willing in the arts. 3º, 5º, caput, points "h" and "i", and 6º of the Decree-Law No. 3,365, of June 21, 1941, in the arts. 29, caput, inciso VIII, and 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and what is stated in the ANTT Process No. 50500.139134 / 2011-18,

D E C R E T A:

Art. 1 ° Ficam declared of public utility, for the purposes of dispropriation, in whole or in part, in favour of the Autopista Coastal South S.A., the real estate covered and delimited by the topographical coordinates described below, excluded the goods from public domain, adjacent to the Highway Governor Mário Covas, 101/SC, necessary for the execution of the pedestrian walkway implantation works at km 180 + 240m:

I-Area 01, with the following characteristics: starts the perimeter at point P01, of Plants Plants in the UTM-SIRGAS 2000 System, respectively E: 734,293 ,544m and N: 6,968,904 ,663m; of this, follows with AZPlano= 138 ° 14 ' 25 "and distance of 16 ,97m, up to the point P02, E: 734,304 ,848m and N: 6,968,892 ,003m; of this, follows with AZPlano= 159 ° 11'28" and distance of 26 ,78m, up to P3, E: 734,314 ,362m and N: 6,968,866 ,968m; of this, follows with AZPlano= 176 ° 20 '57 " and distance of 17 ,20m, up to the point P4, E: 734,315 ,457m and N: 6,968,849 ,803m; of this, follows with AZPlano= 286 ° 08' 58 and distance of 30 ,43m, up to the point P7A, E: 734,286 ,229m and N: 6,968,858 ,267m; of this, follows with AZPlano= 8 ° 57 ' 33 " and distance of 46 ,97m, up to the point P01, E: 734,293 ,544m and N: 6,968,904 ,663m, with perimeter of one hundred and thirty-eight meters and thirty-five centimeters, and total area of nine hundred and forty eight square meters and twenty-nine decimeters squares; and

II-Area 02, with the following characteristics: starts the perimeter at the point P05, of Coordinates Plants in the UTM-SIRGAS 2000 System, respectively E: 734,305 ,776m and N: 6,968,820 ,654m; of this, follows with AZPlano= 231 ° 14 ' 24 " and distance of 32 ,35m, up to the point P06, E: 734,280 ,546m and N: 6,968,800 ,397m; of this, follows with AZPlano= 290 ° 57 '16 "and distance from 3.47m, up to point P7, E: 734,277 ,302m and N: 6,968,801 ,640m; of this, follows with AZPlano= 8 ° 57' 33" and distance of 57 ,33m, up to point P7A, E: 734,286 ,188m and N: 6,968,858 ,279m; of this, follows with AZPlano= 106 ° 10 ' 23 and distance from 30 ,40m, up to point P04, E: 734,315 ,457m and N: 6,968,849 ,803m; of this, follows with AZPlano= 198 ° 19 ' 11 " and distance of 30 ,70m, up to point P05, E: 734,305 ,776m and N: 6,968,820 ,654m, with perimeter of one hundred and fifty-four metres and twenty-six centimeters, and total area of a thousand, two hundred and thirty-six square meters and eighty and one square decimeters.

Art. 2 ° It is the concessionaire Coastal Sul S.A. authorised to promote, with own resources, the disappropriation of the areas of land and benfeits of which it treats art. 1º, in the form of the prevailing legislation and regulations.

Single paragraph. The expropriate is allowed to invoke the character of urgency in the process of misappropriation of which it treats the caput, for purposes of immission in the possession, in the terms of the art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3 ° The public utility statement of which it treats this Decree does not exonerate the dealership of the prior obtaining of the licensing and the fulfilment of the obligations attached to the environmental entities and other public administration bodies, necessary to effectivation of the works and activities referred to in art. 1 °.

Art. 4 ° This Decree comes into effect on the date of its publication.
