DECREE OF December 15, 2004

Declares of social interest, for the purposes of agrarian reform, the rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplemental Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Finance Good Reshoot", with area of two thousand, one hundred and ninety and four hectares, sixty four airs and twenty-seven centiars, situated in the Municipality of Figueirópolis, object of the Records in the R-1-2.416, fls. 186, Book 2-A7; R-1-3.013, fls. 233, Book 2-A9; R-3-1.372, fls. 243, Book 2-A3; R-3-008, fls. 171, Book 2-A; R-1-2.650, fls. 140, Book 2-A8; R-2-1.556, fls. 139, Book 2-A4, of the Estate Registration Office of the Comarch of Fish and R-1-255, fls. 55, Book 2-B, of the Estate Registration Office of the Comarch of Figueirópolis, State of the Tocantins (Case INCRA/SR-26/nº 54400.000755 /2004-62);

II-"Inajá Fazenda", with area of three thousand, six hundred and twenty four hectares, fifty and nine airs and seventy four centiars, situated in the Municipality of Caseara, object of the Registry in the R-1-055, fls. 55, Book 2, of the Estate Registration Office of the Judicial District of Caseara, Comarch of Araguacema, State of the Tocantins (Process INCRA/SR-26/nº 54400.001087 /2003-18);

III-"Farm Grota of Stone", with area of two thousand, three hundred and seventeen hectares, sixty five airs and ninety-five centiars, situated in the Municipality of Divinopolis of the Tocantins, object of the Records in the R-2-1.594, fls. 135, Book 2-F; R-2-1.595, fls. 136, Book 2-F; R-2-1.596, fls. 137, Book 2-F; R-2-1.597, fls. 138, Book 2-F; R-2-1.598, fls. 139, Book 2-F and R-2-1.599, fls. 140, Book 2-F, of the Estate Registration Office of Paradise of Tocantins, State of the Tocantins (Process INCRA/SR-26/nº 54400.000518 /2004-00);

IV-"Farm Passes Three and St. George", with area of two thousand and four hundred and twenty hectares, situated in the Municipality of Monte do Carmo, object of the Registry in the R-18-1.258, fls. 242, Book 2-E, of the Estate Registration Office of the National Port Comarch, State of the Tocantins (Case INCRA/SR-26/nº 54400.001240 /2003-07);

V-"Fazenda Barreiro", with area of six hundred and eighty-two hectares, seven ares and ten centiars, situated in the Municipality of Caseara, object of the Records in the R-2-095, fls. 95, Book 2-A and R-2-096, fls. 96, Book 2-A, of the Estate Registration Office of the Judicial District of Marianópolis of the Tocantins, Comarch of Paradise of the Tocantins, State of the Tocantins (Case INCRA/SR-26/nº 54400.000580 /2004-93); and

VI- "Farmstead São José", with area of a thousand, seven hundred and ninety hectares, sixty-five airs and thirty-one centiars, situated in the Municipality of Divinopolis of the Tocantins, object of the Registry in the R-2-381, fls. 81, Book 2-B, of the Estate Registration Office of the Paradise Of the Paradise of the Tocantins, State of the Tocantins (Process INCRA/SR-26/nº 54400.000458 /2004-17).

Art. 2º Excludes from the effects of this Decree os semovens, agricultural machinery and implements, as well as existing benfeits in the real estate referred to in art. 1º and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the dispropriations of rural real estate from which treats this Decree, in the form provided for in the Supplementary Act No. 76 of July 6, 1993, and to keep the areas of Legal Reserve and permanent preservation, provided for in Law No. 4,771, of September 15, 1965, preferentially in single gleba, so as to reconciling the settlement with the preservation of the environment.

Art. 4º This Decree comes into force on the date of its publication.
