DECREE NO 7,495, OF June 7, 2011

Cria the National Commission for the United Nations Conference on Sustainable Development, the National Committee of Organization of the United Nations Conference on Sustainable Development, the Extraordinary Advising to the United Nations Conference on Sustainable Development and provides on the remanding of positions in committee of the Group-Direction and Senior Advising-DAS.

The CHAIRWOMAN OF THE REPUBLIC, in the use of the assignment that confers him the art. 84, inciso VI, point "a" of the Constitution,

D E C R E T A:

Art. 1º For the purposes of organizing the United Nations Conference on Sustainable Development to be held in 2012 in the city of Rio de Janeiro, henceforth called the Rio + 20 Conference, stay created:

I-within the framework of the Ministry of Foreign Affairs:

a) the National Commission for the United Nations Conference on Sustainable Development, henceforth named National Commission; and

b) the National Committee of the United Nations Conference on Sustainable Development, henceforth called the National Organization Committee; and

II -within the framework of the Ministry of the Environment, the Extraordinary advisory for the United Nations Conference on Sustainable Development, henceforth called Extraordinary Assessments.

Art. 2º Compete for the National Commission to promote the interlocalization between the federal, state, municipal and civil society bodies and entities with the purpose of articulating the axes of Brazil's participation in the Rio + 20 Conference.

Art. 3º The National Commission will be co-chaired by the Ministers of State for Foreign and Environment and integrated, still:

I-by the holder of each organ indicated below:

a) Civil House of the Presidency of the Republic;

b) Ministry of Justice;

c) Ministry of Defence;

d) Ministry of the Farm;

e) Ministry of Agriculture, Livestock and Supply;

f) Ministry of Education;

g) Ministry of Culture;

h) Ministry of Labour and Employment;

i) Ministry of Social Development and Combat to the Famine;

j) Ministry of Health;

k) Ministry of Development, Industry and Foreign Trade;

l) Ministry of Mines and Energy;

m) Ministry of Planning, Budget and Management;

n) Ministry of Science and Technology;

the) Ministry of Tourism;

p) Ministry of National Integration;

q) Ministry of Agrarian Development;

r) Ministry of Cities;

s) Secretariat-General of the Presidency of the Republic;

t) Office of Institutional Security of the Presidency of the Republic;

u) Secretary of Institutional Relations of the Presidency of the Republic;

v) Secretary of Social Communication of the Presidency of the Republic;

w) Secretary of Strategic Affairs of the Presidency of the Republic;

x) Ministry of Fisheries and Aquaculture; and

y) Registry of Ports of the Presidency of the Republic;

II-by a representative of the state environment bodies and a representative of the municipal environmental bodies;

III-by two representatives of the scholarly community;

IV-by two representatives of the indigenous peoples;

V-by two representatives of the traditional peoples and communities;

VI-by two representatives of the business sectors;

VII-by two representatives of the workers;

VIII-by two representatives of the nongovernmental organizations; and

IX-by two representatives of the social movements.

§ 1º Will be invited to join the National Commission representatives of the National Congress, of the Judicial Power, the State of Rio de Janeiro and the Municipality of Rio de Janeiro, with respective alternates.

§ 2º The representatives predicted in the incisos II to IX of the caput and respective alternates will be indicated after transparent and inclusive process of choice realized by the representative entities of these social sectors, in the terms of joint act of the State Ministers of Foreign Affairs and the Environment.

§ 3º In the case of impediment, the co-chairs of the National Commission and the members indicated in the inciso I will be able to be represented by their immediate substitutes in the organ respective.

§ 4º The participation in the National Commission will be borne by the organ or entity of origin of each member.

§ 5º The designation of the representatives and alternates provided for in the incisors II to IX of the caput and in § 1st will be carried out by joint act of the State Ministers of Foreign Affairs and the Environment.

Art. 4º The National Commission will contest with a Secretary-Executive, integrated by:

I- representative of the Ministry of Foreign Affairs, who will chair it;

II-representative of the Ministry of Finance, which will coordinate economic topics;

III-representative of the Ministry of Social Development and Combat to the Famine, which will coordinate social themes; and

IV- representative of the Ministry of the Environment, which will coordinate the environmental topics.

§ 1º The representatives provided for in the incisors I to IV of the caput and its alternates will be indicated by the holders of the respective bodies and designated by the co-chairs of the National Commission.

§ 2º The Executive Secretariat will be able to invite to its meetings representatives of federal, state and municipal, private entities, civil society, as well as specialists.

Art. 5º Compete to the National Committee of Organization the planning and execution of the necessary measures to the realization of the Rio + 20 Conference, inclusive of the management of the resources and contracts affections to the official events held under the aegis of the Organization of the United Nations and the implementation of activities concerning the administration of material, works, transport, heritage, human resources, budget and financial resources, communication, protocol, security and conservation of real estate and furniture used.

Art. 6º The National Committee of Organization, the executive body, bound by the Foreign Ministry, will be integrated by its National Secretary, the Deputy National Secretary and, still, by representatives of the following bodies:

I-Ministry of Justice;

II-Ministry of Defense;

III-Ministry of Foreign Affairs;

IV-Ministry of the Finance;

V-Ministry of Social Development and Combat to the Famine;

VI-Ministry of Health;

VII-Ministry of Planning, Budget and Management;

VIII-Ministry of the Environment;

IX-Ministry of Tourism;

X-Secretariat-General of the Presidency of the Republic;

XI-Office of Institutional Security of the Presidency of the Republic;

XII-Advocacy-General of the Union;

XIII-Secretaria de Institutional Relations of the Presidency of the Republic;

XIV-Secretary of Social Communication of the Presidency of the Republic;

XV-Secretaria Ports of the Presidency of the Republic; and

XVI-Civil Aviation Registry of the Presidency of the Republic.

§ 1º The representatives will be nominated by the holders of the respective bodies and designated by act of the National Secretary.

§ 2º Will be invited to nominate a representative to integrate the National Committee of Organisation the Federal Public Prosecutor's Office, the State of Rio de Janeiro and the Municipality of Rio de Janeiro.

Art. 7º The National Committee of Organization, chaired by the National Secretary, with the support of a Deputy National Secretary, shall be composed of the following Directors:

I-Administration and Architecture; and

II-Ceremonial and Support for Authorities.

Art. 8º Compete to the National Secretary of the National Organization Committee:

I-coordinate and overseeing the participation of the federal, civil and military bodies and entities, in the planning and execution of the organizational and logistical measures indispensable to the realization of the Rio + 20 Conference;

II-articular the participation of state and municipal bodies and entities, civil and military, in the planning and implementation of the organizational and logistical measures indispensable to the realization of the Rio + 20 Conference;

III-acting as an interlocutor with the United Nations for the purposes of logistical organization of the Rio + 20 Conference and negotiation of the Sede Agreement;

IV-assist in the development of events activities related to the Rio + 20 Conference, inclusive of those promoted by private entities and civil society;

V-institute areas of work of agreement with the logistical needs of organizing the Rio + 20 Conference;

VI-naming the occupant occupants in committee of the organizational structure of the National Organization Committee;

VII-designate, among the servers of the Ministry of Foreign Affairs staff framework, and in agreement with the Undersecretariat General of Foreign Service of the Ministry of Foreign relations, personnel to exercise technical functions in the National Committee of Organization;

VIII-define the activities to be exerted by the servers of other organs and federal entities that act on the National Organization Committee; and

IX-edit acts available on the organization and the functioning of the National Organization Committee.

Art. 9º Compete for the National Secretary of the National Organization Committee to carry out the administrative and budgetary, financial and heritage management acts related to the holding of the Rio + 20 Conference, and may perform the duties of the ordering of expenses, firm contracts, convents, technical cooperation agreements and similar adjustments.

Paragraph single. The competencies foreseen in the caput will be able to be delegated.

Art. 10. They are remanded, until September 30, 2012, of the Management Bureau of the Ministry of Planning, Budget and Management to the Ministry of Foreign Affairs, nine posts in committee of the Group-Direction and Superiors-DAS, being a DAS 101.5, three DAS 101.4, three DAS 101.3 and two DAS 101.2.

Single paragraph. The remanded posts will be allocated to the activities of the National Organization Committee and will not integrate the structure of the Foreign Ministry, and must appear in the act of appointment its character of transitoriousness, upon remission to the caput.

§ 2º Fishing the deadline set in the caput, the remanded posts will be restituted to the Management Office of the Ministry of Planning, Budget and Management, being considered exonerated the holders in them invested.

Art. 11. The expenses pertaining to the acting of the National Organization Committee and the planning, organization and execution of the Rio + 20 Conference will run to the account of specific budget allocations in the Fiscal and Social Security Budgets of the Union.

Single paragraph. The expenses mentioned in the caput will be able to be supplemented by financial, material and human resources from states, from municipalities and from convennials and adjustments with federal public companies, federal mixed economy societies, private entities and not-for-profit organizations.

Art. 12. In coordination with the Controller-General of the Union and listened to the competent federal bodies, the National Secretary of the National Organization Committee shall determine the necessary measures for the broad transparency of federal actions in the realization of the Conference Rio + 20, in the form of the Decree No 5,482, of June 30, 2005.

Art. 13. To The Extraordinary Advice, direct assistance body to the Minister of State for the Environment, competes:

I-chairing the Preparatory Commission of the Ministry of the Environment for the Rio + 20 Conference, to be set up upon the act of the Minister of State for the Environment;

II-coordinate the elaboration of studies that subsidize the formation of the Brazilian positions in the major themes of the Rio + 20 Conference, with an emphasis on green economy and international governance for sustainable development;

III-coordinate the treatment of the environmental themes of the Rio + 20 Conference, in articulation with the remaining federal, state and municipal bodies, as well as with the diverse sectors of the civil society;

IV-support the activities of the National Commission and the National Committee of Organization;

V-promoting encounters with representatives from all sections of society civil and with specialties, aiming at harvesting subsidies for Brazilian participation in the Rio + 20 Conference;

VI-carrying out actions of social communication, dissemination and information to Brazilian society as to the environmental themes of the Rio + 20 Conference;

VII-represent the Ministry of the Environment at the preparatory character meetings that precede the Conference River + 20;

VIII-support the various initiatives of civil society, states and the municipalities related to the discussion of the environmental themes of the Rio + 20 Conference; and

IX- supporting the Minister of State for the Environment in his activities as a member of the United Nations Panel on Global Sustainability.

Art. 14. Are assignments of the Extraordinary Assessor:

I-plan, coordinate, guide, follow up and evaluate the implementation of the activities of the Extraordinary Advisory and exercise other assignments conferred upon them by the Minister of State for the Environment;

II-represent the Ministry of the Environment in the Executive Office of the National Commission;

III-represent the Ministry of the Environment at the national and international preparatory events for the Rio + 20 Conference; and

IV-represent the Ministry of the Environment in relations with intergovernmental, governmental, and nongovernmental involved with the preparation of the Rio + 20 Conference.

Art. 15. They are remanded, until September 30, 2012, of the Management Secretariat of the Ministry of Planning, Budget and Management for the Ministry of the Environment, to meet the activities of the Extraordinary Advisory, two posts in committee of the Group-Direction and Superiors Superiors-DAS, being a DAS 101.5 and a DAS 102.4.

§ 1º The remanded posts will be allocated to the activities of the Extraordinary advisory and will not integrate the structure of the Ministry of the Environment, owing to the act of appointment its character of transitoriousness, upon remission to the caput.

§ 2º Findo the deadline set in the caput, the remanded posts will be restituted to the Registry of Management of the Ministry of Planning, Budget and Management, being considered exonerated the holders in them invested.

Art. 16. At the end of the organizing works of the Rio + 20 Conference, the National Secretary of the National Organization Committee will present accountability to the Internal Control Bureau of the Foreign Ministry and publish official report of the event.

Art. 17. The National Commission, the National Committee of Organization and the Extraordinary Advisory Board become extinct on September 30, 2012.

Art. 18. This Decree comes into effect on the date of its publication.
