DECREE OF January 13, 2005

Declares of social interest, for the purposes of agrarian reform, the rural real estate it mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184, of the Constitution, and in the terms of the arts. 2º of the Supplemental Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of the Law no 8,629, of February 25, 1993, the following rural real estate:

I-"Santa Rosa", with area of four thousand, two hundred and fifty two hectares and sixty ares, situated in the Municipality of Coroatá, object of the Matriculation in the 4,678, fls. 50, Book 2-AB, of the Estate Registration Office of the Comarch of Coroatá, State of the Maranhão (Process INCRA/SR-12/nº 54230.000244 /99-30);

II-"Itaipu", known as "Fazenda Bom Jesus", with area of two thousand and forty hectares, situated in the Municipality of Rosario, object of the Registry in the R-1-949, fls. 157, Book 2-F, of the Carthorium of the 1st Oftice of the Comarch of Rosary, State of the Maranhão (Process INCRA/SR-12/nº 54230.004972 /2003-40);

III-"Fazendas Berro D' Water and others", with area of a thousand, seven hundred and seventy five hectares, thirteen airs and twenty-five centiars, situated in the Municipality of Coromandel, object of the Records in the R-1-11.354, fls. 46, Book 2-AO; R-9-7.622, fls. 120, Book 2-W; R-5-10.208, fls. 132, Book 2-AI; R-6-10.766, fls. 53, Book 2-AL; R-25-6.142, fls. 134, Book 2-T; R-32-4,870, fls. 57, Book 2-P; R-6-9.874, fls. 95, Book 2-AH; R-10-4.636, fls. 121, Book 2-O; R-7-4.548, fls. 33, Book 2-O and R-27-5.448, fls. 38, Book 2-R, of the Real Estate Registration Office of the Comarch of Coromandel, State of Minas Gerais (Case INCRA/SR-06/nº 54170.010362 /2002-56);

IV-"Farm Patience, Pilion and Grove", with area of four hundred and Sixty-one hectares, twenty-one airs and nine centiars, situated in the Municipality of Uberlândia, object of the Records in the R-1-31.160, Ficha 01, Book 2; R-1-31.163, Ficha 01, Book 2, of the Real Estate Registration Office of the Comarch of Uberlândia and R-2-26.244, Ficha 01, Book 2, of the Carthorium of the 2nd Oftice of the Comarch of Uberlândia, State of Minas Gerais (Case INCRA/SR-06/nº 54170.000464 /2004-25);

V-"Pioneer Farm", with area of two thousand, thirty and one hectares, ninety-nine ares and ninety-four centiars, situated in the Municipality of Pacajá, object of the Registry in the R-3-80, Ficha 80, Book 2, of the Real Estate Registration Office of the Comarch of Pacajá, State of Pará (Case INCRA/SR-01/nº 54107.000748 /2004-85);

VI-"Fazenda Bela Vista", with area of three hundred and sixty and three hectares, situated in the Municipality of Santo Amaro das Brotas, object of the Matriculation at 6,552, fls. 06, Book 3-M, of the Estate Registration Office of the Comarch of Maruim, State of Sergipe (Case INCRA/SR-23/nº 54370.000519 /2004-41);

VII-"Fazenda Capivara", with area of a thousand, one hundred and seventy five hectares and twenty ares, situated in the Municipality of Estance, object of the Registry in the R-1-129, fls. 129/2, Book 2, of the Estate Registry Office of the Comarch of Estance, State of Sergipe (Case INCRA/SR-23/nº 54370.000489 /2003-91);

VIII-"Fortress farm", with area of three hundred and twenty-three hectares, fifty-three airs and eighty-eight centiars, situated in the Municipalities of Good Hope of the South and Bocaina, object of the Matricles in the 9,332, fls. 103, Book 3-I; 6,480, fls. 168, Book 3-F; 9,337, fls. 105, Book 3-I; 8,650, fls. 186, Book 3-H; 9,336, fls. 105, Book 3-I; 11,952, fls. 149, Book 3-M; 11,668, fls. 57, Book 3-M, of the Estate Registration Office of the Comarch of Jaú; 5,868, fls. 25, Book 3-S and 6,418, fls. 48, Book 3-T, of the Estate Registration Office of the Comarch of Ribeirão Bonito, State of São Paulo (Case INCRA/SR-08/nº 54190.001227 /2004-43); and

IX-"Fazenda São Bento", with area of eight thousand, one hundred and forty hectares and thirty-seven ares, situated in Municipality of Fish, object of Matriculation No 2,517, fls. 191, Book 3-D, of the Real-estate Registration Office of the Comarch of Fish, State of the Tocantins (Case INCRA/SR-26/nº 54400.000454 /2004-39).

Art. 2º Excludes from the effects of this Decree the Seminers, the machines and agricultural implements, as well as the existing benfeons in the real estate referred to in art. 1st and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the dispropriations of rural real estate from which treats this Decree, in the form provided for in the Supplementary Act No. 76 of July 6, 1993, and to keep the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferentially in single gleba, so as to reconciling the settlement with the preservation of the environment.

Art. 4º This Decree comes into force on the date of its publication.
