PROVISIONAL MEASURE No 2.051-5, OF July 28, 2000.

Institutes the Gratification of Incentive to Docency and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the exercise of the office of President of the Republic, using the assignment that gives him the art. 62 of the Constitution, adopts the following Provisional Measure, with force of law:

Art. 1o Stay instituted, as of 1o of January 2000, the Gratification of Incentive to Docency, due to the occupants of the effective professorships of Professor from 1o and 2o Graus in the federal educational institutions related in Annex I.

§ 1o Gratification instituted in the caput of this article will have as a maximum limit eighty points per server, corresponding to each point to the value set out in Annex II, obeyed to the limit set in the art. 2o of the Law no 8,852, of February 4, 1994.

§ 2o The global monthly scoring limit will correspond, in each institution, the seventy and three times the number of teachers from 1o and 2the active Graus, and the score awarded to each teacher will observe regulation by it established, which will necessarily include the weekly hourly load in classroom, the number of students under their responsibility, the assessment qualitative of your classes and the participation in programs and projects of interest of the institution.

§ 3o The observance of the provisions of the art. 57 of the Act no 9,394, of December 20, 1996, is mandatory condition for the assignment of scoring to the teacher that it treats this Provisional Measure.

§ 4o The Executive Power will lay down the requirements basic to the regulation of which it treats § 2o.

§ 5o Federal educational institutions, listed in Annex I of this Interim Measlage, will give prior knowledge to the Ministry of Education of the Regulations referred to in § 2o, and shall publish them in the Official Journal of the Union, effective from thirty days of the said publication.

§ 6o The periodicity of the revision of the teachers ' score, pursuant to § 2o, may not be more than one year.

§ 7o For purposes of calculating Gratification in the months of holiday from the server or students, will be considered the average score achieved in the twelve months immediately prior to the competency of the effective payment.

Art. 2o The Gratification of which treats the article previous shall be paid jointly, in a non-cumulative manner, with the Activity Gratification of which it treats the Delegated Law no 13, of August 27, 1992.

Art. 3o Until the duration of the regulations of which treats the § 2o of the art. 1o, Gratification will be calculated based on scoring corresponding to sixty percent of the threshold set in § 1o of that article.

Single paragraph. Until it is possible the calculation provided for in the art. 1o, will note the provisions of the caput of this article for the payment of those installments.

Art. 4o The server that does not post scoring will only make jus to Gratification, calculated based on sixty percent of the maximum points limit fixed in the § 1o of the art. 1o, when you find:

I-ceded for exercise of a special nature office or DAS 6, 5 or 4, or equivalent post in the Federal Public Administration;

II-in exercise of Direction Cargo- CD or Gratified Function in the institution itself;

III-remoteness authorized by the institution for course of specialization, master's or doctoral degree in another institution.

Single paragraph. The teacher who finds himself in the situations foreseen in the inciso II will be able to opt for the perception of Gratification on the basis of his / her score effectively achieved, should it be posited.

Art. 5o For purposes of incorporation to the orderings of retirement or pension, the Gratification:

I-will only be due if realized at least two years of activity;

II-will be calculated by the arithmetic average of the last twenty four months prior to retirement.

Art. 6o Stay vetted, from the publication of this Provisional Measure, the redistribution of Teachers from 1o and 2o Graus with lower-to-graduate schooling for the institutions referred to in Annex I.

Art. 7o About the values set out in Annex II, will focus on general readjustment indices granted to civil federal public servants from the publication of this Interim Measure.

Art. 8o Stay readjusted in thirty percent, as of 1o of January 2000, the values set in reais in the Annex to Law no 9,678, of July 3, 1998.

Paragraph single. The Gratification instituted by the Law no 9,678, of 1998, is due, equally, to the occupants of effective positions of Professor of the Higher Ministry of the Federal Institutions of Military Higher Education.

Art. 9o Ficam convalidated the acts practiced on the basis of the Interim Measlant no 2.051-4, of June 29, 2000.

Art. 10. This Interim Measure takes effect on the date of its publication.
